3 The purpose of this Injury and Illness Prevention Program is to provide staff with a safe and healthy workplace by identifying responsibilities to be followed by management, staff and the employer. Staff have a right to a safe workplace and their employer has a duty to ensure that every manager and manager/supervisor is aware of KWE s safe work practices and that each staff member is following them. KWE is adopting this Injury and Illness Prevention Program to meet or exceed the requirements of the Code of Federal Regulations, Title 29, Section It applies to all full and part-time staff, temporary and seasonal staff and volunteers working for KWE. 7 Evaluating hazards is an essential part of hazard control. It is important to identify all equipment and practices during the course of all job classifications and their duties. Examples of the tools used for identifying and evaluating work place hazards include the Job Safety Analysis Forms. 10 Communication is an important part of the safety program. KWE believes the best way to maintain the safety "mind set" is through the following five means: A safety bulletin board for written communication, relevant safety topics, and posted temporary hazards. Safety posters and signs will be posted in areas of concern to help remind staff of certain hazards and to protect themselves. Any signs, labels, or posters are provided at no cost by calling Du-All Safety at (510) General safety meetings will be scheduled as needed to review changes in the program and receive staff member input. 11 Records will be kept by the Safety Coordinator, and will include the records: Periodic inspections identifying unsafe work practices and conditions including: The name of the person(s) conducting the investigation. The unsafe condition or work practice(s) identified. The action taken to correct the unsafe condition or practice. Copies to the appropriate persons and files. ii. Documented safety and health training including: Staff member name. Training dates. Type(s) of training. Name(s) of trainer(s). iii. 12 The Log 300 is kept at Human Resources. Human Resources will log all staff member injuries & illnesses within 6 days of the event. Human Resources will provide each KWE site with the Log 300 summaries to post from February 1 to April 30 of each year. ALL FATALITIES AND WHEN FIVE OR MORE PEOPLE ARE SENT TO THE HOSPITAL, MUST BE REPORTED TO OSHA IMMEDIATELY BUT NO LONGER THAN 8 HOURS AFTER THE EVENT. 13 Communication is an important part of the safety program. KWE believes the best way to maintain the safety "mind set" is through the following five means: A safety hotline for staff to call and anonymously report unsafe conditions that may cause injury to staff or Temp. staff working for KWE on or off site. The KWE safety hotline phone number is at Du-All Safety: (510) No name need be provided when calling. All reports will be posted on the safety bulletin board and will include a documented reply as to the investigation findings and any corrective action(s). 14 An Emergency Action Plan (EAP) is a written document required by OSHA. The purpose of an EAP is to establish a plan that instructs employees who work or frequent KWE facilities about appropriate actions to take before, during and after an emergency to reduce risk of injury and property damage. The two most important goals of any emergency plan are to protect lives and property. With this written plan, safety inspections, and annual training exercises, it is our intent to reduce the risk of injury and death and damage to the building and its contents. Knowledge of this plan, coupled with on-going safe work practices and housekeeping habits, will provide all occupants with a reasonable degree of safety.

15 The emergency planning and response procedures outlined in this plan apply to all KWE operations and activities conducted by its employees, contactors, subcontractors and visitors who work or visit. This Emergency Action Plan (EAP) is intended to address various hazards that may arise during normal working conditions, such as: Personal injury or illness Fire Chemical release Earthquake Bomb threat Power outage Flooding Aggressive persons/workplace Violence.

16 West Fertilizer Co. Explosion -- West, Texas After failing to disclose unsafe stores of ammonium nitrate, among other safety violations, a plant owned by West Fertilizer Co exploded killing 14 people and injuring 160. Most victims were fire fighters and rescue workers.

28 Hazard classification (determination) are self-classification processes manufactures and importers must classify each chemical, determine appropriate hazard class and category based on evaluation of full range of available data/evidence No testing is required OSHA adopted one study rule for findings of hazards. Appendix A defines health and physical hazards Appendix B includes additional parameters to evaluate health hazard data Appendix F pertains to carcinogens A floor of chemicals to be considered hazardous is provided by reference to several existing lists of chemicals Added supplemental class: Hazards not otherwise classified and included coverage of combustible dust.

Use of third party hazard rating systems such as the NFPA diamonds and HMIS is still a valid approach in the workplace
