3 OBJECTIVES: AT THE END OF THE SESSION EACH LEARNER WILL BE ABLE TO: 1. Without reference, as discussed in class the student will be able to administer breath tests using the breath analysis instrument (s) by following the instrument s messages and commands on the digital display. 2. Without reference, as discussed in class the student will be able to identify and differentiate between the various incorrect operational procedures, condition and instrument errors / diagnostic failure. 3. Without reference, as discussed in class the student will be able to demonstrate the appropriate action toward various incorrect operational procedures, condition and instrument errors / diagnostic failure. 3

5 : INTRO We are now going to go over each card that could possibly be produced by an operator while they are running test. You are responsible for not only identifying each card but knowing what actions to take to correct or report the condition. 5

6 Identical info: Name of agency, where the instrument is physically located Serial number, third line down far right side. Sub Name, this format is automatically generated as you type in the information. You do not put in commas. This field will hold up to 25 characters. Agency, Type the full name. (no OPD or RPD) An exception would be unique initials, such as KSP. 6

7 NTF LEC Go over the test, times and results of each. Point out the signature of the officer; the subject s name line, and the additional information and/or remarks. Point out the importance of documenting the observation time and not using abbreviations or just numbers that could be misunderstood. Differences in evidence: Date and time line, be sure to emphasize that the time used in the log book is the sub test time; the only time this line is used is if the sub test time is not on the card. With the 8000 the time at the top of the card is the time the operator pushed the start test button to begin inputting data (start a test, not bring it out of standby mode) ORI, the KY is automatically generated with the 5000EN; all the operator inputs are the numbers. However with the 8000 the operator has to manually input the KY prior to the ORI number. Drivers License No, It is important to include the two letter designation with the 5000EN, however the 8000 will prompt you for the state of issue after you enter the number. 7

8 Differences in evidence: (continued) Date of Birth, The 5000EN only requires the last two digits of the year; the 8000 requires the operator to input all four digits. Bottom of the card/slip, The 5000EN has a designated place for the subject s name if it is more than 15 characters; on the 8000 slip you will write it at the bottom where there is room. The 8000 slip has a designated place for the observation time. You will copy this from your notes. Any other information that does not fit in the appropriate field at the top the operator will fill in at the bottom of the 5000EN card in the Additional Information and/or Remarks. On the 8000 slip the operator will have to find a blank area and fill it in. 8

9 This card is operator-generated by pressing the start test button. The operator must write/print the subject s name at the bottom of the card if it is not printed at the top (This will depend on when the operator invalidated the card.) Log this card if it is DUI related. 9

10 NTF LEC The name Purge Fail was given to the identify this condition on the 8000, conditions are the same. This card will be printed if the instrument detects something in the surrounding air when it completes the Air Blank mode and it cannot reach a result of.000 at that time. This could be caused from smoke, cleaning products containing solvents, paint fumes, etc. which may be blocking or absorbing the infrared light; this will also occur if the subject is sitting too close to the instrument and the instrument is drawing in alcohol when it is purging. The operator should locate the source causing the condition and eliminate it before initiating another breath test. 10

11 NTF LEC The name Improper Sample was given to the identify this condition on the 8000, conditions are the same. The instrument can only accept a subject s breath sample during the Please Blow/R mode. If the subject attempts to provide a sample during any other time of the test mode sequence, the instrument will automatically cancel the test and print the card/slip shown here. 11

12 NTF LEC The name RFI Detect was given to the identify this condition on the 8000, conditions are the same. The instrument has detected high amounts of radio frequency interference. This can happen when a radio or cell phone is transmitting. The instrument will stop the test and print the card/slip shown. The operator should locate the source of the radio frequency interference and remove it from the operational environment of the instrument before initiating another test. 12

13 During the three minute Please Blow/R mode, the subject has elected not to continue with the breath test. The operator should push the R key and then the Enter key to obtain a printed Refusal card on the 5000EN to indicate a refusal of the breath test. On the 8000 the operator has only to press the R key. The instrument will print Refused on the 5000EN or REF on the 8000 beside Subject Test and will print the statement as shown below the results of the last Air Blank. 13

14 The subject had made no attempt to provide a breath sample into the instrument during the three-minute Please Blow/R mode. After three minutes, the instrument will complete the test mode sequence and print No Sample Given below the results of the last Air Blank. The operator can initiate another breath test or seek an alternate alcohol concentration test for the subject. NTF Note the difference at the Subject Test Results line of the sequence..000 vs. NSG. 14

15 The name Deficient with Alcohol was given to the identify this condition on the 8000, conditions are the same. During the Please Blow/R mode, the subject has three minutes to provide an adequate breath sample. If the subject fails to do this, the portion of breath provided will be analyzed by the instrument. The instrument will not be able to assess a specific alcohol concentration level due to the insufficient sample provided. 15

16 However, it will be able to indicate if alcohol is present. The instrument completes the mode sequence and prints Alcohol Present on the 5000EN where the subject test results would appear. It also prints Deficient Sample below the results of the last Air Blank. KRS 189A.005 (5) states that the operator shall request blood or urine, or both. The subsequent request (s) should take place at the site of the test (s). NTF Note the difference at the Subject Test Results line of the sequence, Alcohol Present vs. DEA. AFQ 16

17 During the Please Blow/R mode, the subject has three minutes to provide an adequate breath sample. If the subject provides an insufficient breath sample where a specific alcohol concentration level cannot be determined and the analysis fails to detect any alcohol molecules present, the impairment may not be due to alcohol but to drugs. The instrument completes the mode sequence and prints.000 beside the Subject Test on the 5000EN and DEF* on the It also prints Deficient Sample below the results of the last Air Blank. KRS 189A.005 (5) states that the operator shall request blood or urine, or both. The subsequent request (s) should take place at the site of the test (s). 17

18 Due to the high level of alcohol concentration in the subject s breath sample, the instrument is unable to calculate the highest possible breath alcohol concentration level. The instrument s range of detection was exceeded. The instrument will print Invalid Test Instrument Range Exceeded on the 5000EN card below the test information data. The 8000 will print RGE* next to subject test, and Range Exceeded below the testing sequence. The 8000 has a range of.000 to.600. Do not attempt to run a second breath test. Seek medical attention, then request blood and/or urine. 18

19 If the instrument detects residual mouth alcohol while the subject is providing a breath sample, it will stop the analysis. The slope parameter has been activated and has dropped by at least.006 BrAC in one of the 6/10ths of a second on the 5000EN while the subject is blowing into the breath tube. There are no numbers associated with the residual mouth alcohol given for the

20 The instrument will complete the mode sequence and print Invalid Sample.XXX on the evidence card next to Subject Test, below the printed test data. The following statement will also be printed: Mouth Alcohol Detected Observe subject for twenty minutes before performing another breath test on the subject. The operator may also choose to request an alternate chemical test. AFQ 20

21 While the subject is providing a breath sample, the instrument detected a significant amount of a substance that absorbs infrared energy in the same frequency range as alcohol, such as acetone, toluene, or methanol. It will stop the analysis, complete the mode sequence and print a card with INT beside Subject Test. Interferent Detected will be printed below the results of the last Air Blank. TIME: 1 Hour 21

22 The operator should first consider this a possible medical emergency and immediately run a second test. If the results are the same, seek medical attention for the subject. If the operator receives an alcohol reading on the second test follow normal procedures. AFQ 22

23 During the Cal Check mode the instrument is sampling the alcohol vapor from the attached simulator. If the simulator analysis is below the tolerance level of.075, the instrument will stop the test and print Invalid Test. Reference Check Out of Tolerance Fails Low Limit will be printed below the results of the last Air Blank, on the 5000EN. The 8000 will not identify Low limit. The operator will have to look at the calibration check to determine whether it was low or high. 23

24 The operator should immediately attempt to run a second test on the instrument. If the second test falls outside the tolerance range, the operator should seek another testing instrument or request the subject to submit to an alternate alcohol concentration test. Notify the supporting technician. If you have the name and phone number of the technician, you may call him directly unless it is late at night when he would normally be asleep. Otherwise, call the main number in Frankfort that is located in your Operator s Manual. Call as soon as possible and be specific about the instrument location and the problem. Do not mark the instrument as Out of Service unless told to do so by the technician. 24

27 The instrument s microprocessor was unable to obtain a stable voltage reference from the processor. The instrument stops the test and prints Invalid Test Unable to Obtain a Stable Reference below the test information data on the card. The operator should initiate another test on the instrument. If the condition continues, notify the technician. 27

28 When a subject is providing an adequate breath sample, you will hear a constant, steady tone. The words Please Blow/R will continually stay lit on the digital display. If Please Blow starts flashing on and off or flickers during the breath sample collection this indicates the subject is no longer meeting the parameters. The operator has three minutes during the Please Blow/R mode to gather the breath sample. 28

29 NTF The operator should follow the procedure sheet as follows: LEC NTF LEC Mouth Substances - Read the following statement: During the next 20 minutes you are not allowed to eat, drink, smoke or place anything in your mouth or nasal passages. Do you have anything in your mouth at this time? Explain why it is preferred to read the above statement before documenting the time. If the subject has something in his/her mouth you would have to start the observation time over. Begin Observation: Document the starting observation period on the bottom portion of the Intoxilyzer 5000EN evidence card or your notes if the operator is using the Take the starting time from the digital display. 29

30 Read the Implied Consent Warning provided on the procedure sheet or the warning card. When administering a breath test it is best to use the procedure sheet. Offer the attempt to contact an attorney by reading the following: You have at least 10 minutes, but not more than 15 minutes, to attempt to contact and communicate with an attorney. Do you wish to contact an attorney at this time? There is no expectation of privacy during this time. After the 20 minute observation period is complete, request the test by reading the following: Based upon the information which was previously read to you, I am now requesting you to submit to a test of your breath. Will you now submit to the test? This is the official request for the test and one of the 5 items that the officer must show for a refusal to be upheld in court. A refusal may happen either here or during the please blow mode. Attach the mouth piece. NTF Remind students that this must be done to purge the mouthpiece prior to the subject providing a sample. 30

31 Press the start test button 5000EN insert card 8000 this is not necessary Enter the appropriate data The operator may scan the subject s drivers license and the instrument operator s drivers license to input data. 2. Arresting officer data must be typed manually along with other necessary data. After the Review Data question is answered with N for No, the instrument will go into the administration of the testing sequence (ACABA). When the instrument goes into the Please Blow/R mode, you will ask the following: In the last 20 minutes have you brought anything up from your stomach into your mouth? NTF The operator should wait until the please blow mode to ask this question because if it is asked earlier you may plant the idea for the subject to attempt to bring something up from his stomach. 31

32 Since you have submitted to all requested tests, you now have the right to have a test or tests of your blood, performed at your own expense by a physician, registered nurse, phlebotomist, medical technician or medical technologist of your choosing within a reasonable time of your arrest. Do you want such a test? NTF LEC Explain to the student that it is important to wait until the test results have printed out prior to reading the above statement. If the operator reads this statement and the instrument detects a problem, i.e. RFI, during the last air blank the operator will have no breath test results, only the RFI card. The problem now comes because you already told the subject Since you submitted to all requested tests QTC AR LEC Can you now request any further tests? You may be able to. It would depend on your jurisdictional decisions, but your integrity may be in question if you do request another test. Remove the mouthpiece after the last air blank. Enter all DUI associated tests into the Breath Alcohol Testing Logbook. TIME: 2 Hours 32

33 EX#1 NTF Have each student to slowly run a practice test together. Impress upon the students to use the Admin Sheet. Give the students: Subject name Smith, David R. Operator s name Use theirs Students with 8000 s will scan their drivers license. Arresting Officer Use theirs Arresting Officers Agency Use theirs ORI Use theirs Citation On the board Report No (None) Have them press the space bar and Enter. 33
