1 PARK TIMBERS SWIM & TENNIS CLUB RULES AND REGULATIONS FOREWORD The purpose of these house rules is to endeavor to establish and maintain a standard of service, deportment, and orderly use of facilities to the end that all members may fully enjoy the Park Timbers Swim & Tennis Club. MEMBERSHIP 1. Membership shall be limited as necessary. 2. Each application for membership in the Club shall be made in writing. 3. Membership shall not be denied on the basis of gender, race, religion, or sexual orientation. 4. The privileges of membership in the Park Timbers Swim & Tennis Club are extended to the member and the relative members of his or her household, including the member s spouse or significant other; the children of either living with them; step-children and foster children of either living with them; parents/grandparents living with them; and grandchildren living with them. 5. Membership in the Club is a privilege. Accordingly, any member may be suspended or expelled from the Club for good cause, including, but not limited to, conduct prejudicial to the Club, violation of Club rules, theft or intentional damage to or defacement of Club property, and/or failure to pay Club dues. 6. The Club reserves the right to adjust fees, dues, deposits and other charges as becomes necessary. 7. Each member of the Club will be assigned a Club number, which will be required each time they sign in. 8. Members shall not give out their access codes to anyone outside their household for any reason. Members who violate this rule may be fined, suspended, or expelled without refund. Sharing one s code after warning may result in a fine of up to the cost of a full membership for each non-member to whom the code is revealed, plus suspension or expulsion without refund. 9. If a member should sell his or her house and relocate during the term of the membership, the balance of the membership is transferrable (at the member s option) to the purchaser of the house at no charge. GENERAL RULES 1. Members will be allowed the use of the pool area, tennis courts, playground, BBQ pits, patio area and bathrooms in the Club House. Adult members will also be allowed to use the Fitness Center in the Clubhouse.

2 2. Conduct of a member detrimental to the good or welfare of the Club or the reputation of the Club may result in suspension or expulsion. 3. Members and/or guests, upon request, must show photo identification. 4. Members are responsible for any damage they cause to Club property and will be charged for same. 5. Members are responsible for the loss or damage to personal property, and all persons using the Club facilities do so at their own risk. 6. Children under eleven (11) years of age must be accompanied by an adult member of the family or babysitter at least fifteen (15) years of age, except for those planned Club functions specifically designated for younger ages. Children ages eleven (11) to fourteen (14) will not be allowed to be unaccompanied by an adult unless such children can pass the Club s swimming test. 7. Solicitation of subscriptions and sales will not be permitted on the Club premises except as approved by the Club. 8. Members or guests shall not reprimand or discipline any employee of the Club, but shall make all suggestions and complaints, preferably in writing, to the Club Committee. 9. No pets are allowed on Club property. 10. Nuisance and unsafe toys are prohibited on the Club premises. 11. Loitering in or about the parked automobiles on the premises will not be permitted. 12. No speeding of any motor vehicle will be permitted on the Club premises. 13. Club hours are from 5:00 a.m. until 10:00 p.m. Sunday-Thursday, and from 5:00 a.m. until 11:00 p.m. on Fridays, Saturdays, and on the eve of legal holidays. 14. The facilities of the Club may, from time to time, be used for singular functions of a community nature. 15. Members are to use good judgment with respect to wearing apparel. 16. Smoking on or in the Club premises is prohibited by anyone under the age of eighteen (18). 17. Only those coaches/instructors authorized by the Club may coach or instruct members in any activity on the Club premises for a fee. 18. Members will not tip for services at the Club. 19. Delinquent Charges. All charges not paid within thirty (30) days following due date will be subjected to a ten percent (10%) delinquent fee.

3 20. No firearms or weapons are allowed on the Club premises except for law enforcement officers and hired security. 21. No Club property may be removed from the premises, including but not limited to chairs, tables, ice chests, BBQ equipment, umbrellas, sports equipment, etc. without permission of the management. 22. Each member shall be furnished with a copy of the Rules and Regulations of the Club. GUEST RULES 1. The management shall set out fees for guests of members as well as the permitted frequency of guest utilization of the privileges of the Club s grounds and services. Management must approve an excess of six (6) guests per membership at one time. The standing rule is that no more than 6 guests may be allowed on any visit without having to book a party. Members who break this rule may be charged the full non-member cost of the unauthorized party. 2. All guests must be accompanied by the sponsoring member when using any of the Club s facilities. 3. Members shall be responsible for the conduct of their guests, including their financial obligations to the Club and charges for Club property destroyed or damaged by their guests. 4. Members who bring guests to the Club must register and pay the required $5.00 fee per person for the use of any Club facility when billed. Any member failing to pay when billed may be assessed a penalty fee of $10.00 per guest. No cash will be accepted at gate. 5. Each guest must be registered by the sponsoring member on the day such guest uses the Club facility, or attends any Club function. 6. There is no guest fee charged for the grandchildren and great-grandchildren of members who accompany the member to the club. However, the parents of those children and grandchildren are considered as guests (unless they reside in the household of the member) and must sign in as such. The parents of the grandchildren and great-grandchildren may not use the club facilities without the presence of the paid member. The purpose of this rule is to allow members to bring their grandchildren with them to the club, not to dispense with the need for grown children of members to purchase separate memberships, which is required for them to use the facilities as members. Members who give their access codes out to their adult children not residing with them for their separate use are subject to the fines, penalties, and forfeitures set forth above. 7. Plus One guests- contact Jackie at to pre-pay under our Plus One program. For $40/year, you can bring in one guest under age 18 or over age 60 each time you come to the club without being charged for the guest. The Plus One guest does not have to be the same guest on each visit. Plus One guests must not live in Park Timbers. (Regular guests may.) For $80/year, you can bring in two guests under the same arrangement. For $120/year, you can bring in three guests under the same arrangement. The limit of prepaid Plus guests is 3. You still pay $5 per guest for each guest over the number of prepaid Plus guests. The total number of guests is still limited to 6. When signing in Plus One, Plus Two, or Plus Three guests, please include the name and age of the guest whose fee has been prepaid.

4 POOL AND PATIO RULES 1. The pool hours are to be established by the Board of Directors and published to the general membership. The Club Facilities will not be available before 5:00 AM or after 10:00 PM (11:00 PM on Fridays, Saturdays, and Holiday eve s). The pool will be available with lifeguards from late May to mid-august during the hours of 12:00 PM 9:00 PM Sunday through Friday and 10:00AM -9:00 PM Saturday. On Mondays from 6:00 P.M. 9:00 P.M. the pool may be closed for private parties. 2. No one under eighteen (18) years of age may swim without a lifeguard on duty, unless accompanied by a parent or guardian. When no lifeguard is on duty, persons over eighteen (18) years of age swim at their own risk. 3. The lifeguard has the responsibility of maintaining discipline in the pool area. Consequently, the lifeguard is to call to the attention of the individual or individuals, any infraction of regulations or other behavior, which is detrimental to the welfare or safety of members and guests and the operation of pool facilities. Lifeguards have the authority to deny the use of the pool or patio facilities to members and guests for cause, pending action by the Club Committee. 4. The lifeguard may close the pool if he or she considers the weather, or other hazards, or unsafe conditions warrant it. 5. Admission to the pool may be refused to anyone wearing bandages or who has skin abrasions, a cold, a cough, inflamed eyes, or other infection. 6. The main gate must be closed and locked at all times. 7. The control of the use of pool toys, floats, balls, etc., will be at the discretion of the lifeguard and Club Committee. 8. No running. 9. No glass containers or balloons anywhere on grounds. 10. No diving in shallow end. No back dives from the side of the pool. 11. No jumping or diving from starting blocks (except with permission of swim team coach). 12. No jumping, diving, or sliding from objects on the side of the pool - e.g., tables, chairs, benches, slides. 13. No food, gum, or drinks in pool. 14. No water balloons are allowed on Club premises. 15. Lifeguard may impose time out or ejection for disorderly conduct or disobedience.

5 16. Showers are required before entering the pool after exercising or sunbathing. 17. Please close umbrellas after use. 18. Please sign in when the book is out. Report suspected trespassers to guard or manager. 19. No pets allowed on premises. 20. Please turn off lights when leaving if no lifeguard is on duty hour video surveillance in use. DIVING BOARD RULES 1. Weight limit 225 lbs. 2. Only one person is allowed on the board at a time. 3. Diving area is for divers only; exit immediately after dive. Do not rest on the walls or stairs when others are diving. 4. Divers shall wait until the diving well is completely clear (a) before stepping onto the board and (b) immediately before diving. 5. No jumping or diving onto anything in the water. 6. No tossing objects toward a diver in the process of diving. 7. Divers must step onto the board from the rear, not from the side, and not from under the rails. 8. No swinging or playing on or under the handrails. 9. No running on the board; no running onto the board from behind the board. 10. Divers must be bare-footed. No flippers or shoes. 11. Back dives are permitted only from a stationary position, and only if the diver rotates away from the diving board and toward the tennis courts. No inward back dives. 12. All diving shall be from the end of the diving board and straight forward, never to the side. 13. No cartwheels or handstands. 14. No sitting on or hanging from the board. Caution: The bottom of the diving well slopes up to the main pool. To avoid injury, do not dive too far. BABY POOL RULES

6 1. Lifeguard is not responsible for baby pool area. 2. Members are responsible for the safety of their children. 3. No unattended children in baby pool. 4. Only children under 6 years old are allowed. 5. No jumping or diving into the pool. 6. No food, gum, or drinks in pool. 7. Clean diapers or swimmies must be worn by toddlers who are not potty-trained. (Please immediately report accidents to the lifeguard or management, so the pool can be treated.) 8. Please remove toys from pool when finished. FITNESS CENTER RULES/INFO 1. Adults only in the clubhouse. (Infants & toddlers in playpens excepted). Additionally, children age 15 and over may use the equipment, but only under the direct supervision of an adult age 25 or older actually in the room with the minor. Access codes shall not be given to minor children. 2. Hours of operation: a. Sunday Thursday: 5:00 a.m. to 10:00 p.m. b. Friday Saturday: 5:00 a.m. to 11:00 p.m. c. As the Clubhouse is used as a polling facility, the clubhouse and Fitness Center shall be closed as directed by the deputy in charge of the particular election, typically twelve hours before the polls open until twelve hours after they close, but the closure is within the discretion of the official in charge of the election at the precinct. 3. Shirt and shoes required. Towels encouraged. 4. Please use hand sanitizer before each use. 5. Please wipe machine clean after each use. 6. Please obey weight restrictions: a. Treadmill 330 lbs. b. Ellipticals 330 lbs. c. Upright bike 260 lbs.

7 d. Recumbent bike 330 lbs. 7. All doors must always remain completely closed. All politeness aside, do not open the door for anyone whom you do not know to be a member. (You may be charged a guest fee if you do.) 8. You must be dry to be in the clubhouse. 9. WiFi Network: ParkTimbers Password:SwimTennis 10. Automated External Defibrillator (AED) is on porch. 11. No food, smoking, glass, pets, or alcoholic beverages allowed inside. 12. Use equipment at your own risk. Please be sure you are in proper condition and know how to operate the equipment. Facility is unsupervised. 13. Do not attempt to move any of the machines. 14. Do not use the monitors as handles, supports, or drink holders. 15. Over-exercising may result in serious injury or death. If you feel faint or if you experience pain while exercising, stop immediately and cool down. 16. Please turn off TV and lights when you leave. 17. Do not set the thermostat below 72 degrees or above 78 degrees. 18. After exercising, a shower is required before entering the pool hour video and electronic door monitoring in progress. 20. Enter the bathrooms from the pool area. 21. Report any problems or suggestions to parktimbersclub@bellsouth.net. ADDITIONAL TREADMILL SAFETY INSTRUCTIONS/INFO Weight limit 330 lbs. Attach the safety clip to your clothing. Avoid exiting treadmill while the tread belt is in motion. Never walk or jog backwards on the treadmill.. To avoid injury stand on the straddle covers before starting the treadmill. Wear shoes with rubber or high traction soles. No sandals or flip-flops. Do not use shoes with heels or spikes. Remove foreign objects from soles. Keep fingers, hair, clothing, shoelaces, and towels away from moving parts.

8 Use the side handrails whenever additional stability is required. In case of tripping, the side handrails should be grabbed and the user should place his/her feet on the straddle covers. The front handlebars should be used to grasp the heart rate sensors or to rest the hand on while operating the activity zone keys, but not for stability, emergency, or continuous use. Only one person at a time on the treadmill. See for the full owner s manual including complete safety recommendations for the PS900 Treadmill. ADDITIONAL ELLIPTICAL MACHINE and STATIONARY BIKE SAFETY INSTRUCTIONS/INFO Weight limits (lbs.): Elliptical-330 Upright bike-260 Recumbent bike-330 Hold the handlebars or the upper body arms when mounting, dismounting, or using the elliptical exerciser. The pulse sensor is not a medical device. Various factors may affect the accuracy of heart rate readings. The pulse sensor is intended only as an exercise aid in determining heart rate trends in general. When you stop exercising, allow the pedals to slowly come to a stop. Note: The elliptical exerciser does not have a free wheel; the pedals will continue to move until the flywheel stops. Wait until the machine slowly comes to a complete stop before attempting to dismount. Step off the higher pedal first, then step off the lower pedal. Only one person at a time on the ellipticals and bikes. NordicTrack machines are ifit compatible. See See for more information on the A.C.T. Pro Elliptical Trainer and stationary bikes. TENNIS RULES 1. When others are waiting, play is limited to one set or 30 minutes stroke time. 2. No food, gum or glass containers permitted on the courts. 3. Please turn off lights when finished. 4. Only proper tennis shoes may be worn on the courts. 6. No profanity. PARTIES From mid-may thru mid-august, non-private swim parties are available only to members and their guests, at a cost of $75/hr. for up to 25 guests and $110/hr. for up to 40 guests. Both members and nonmembers can rent the pool for a private party on Monday nights from 6-9. These 3-hour private, Monday night parties cost $1,000 for up to 100 people. ($500 for members). From mid-august thru mid-may, non-private parties are available almost every day to both members and non-members, but

9 members receive priority over non-members, and members also receive 50% off the regular price of $150/hr. for up to 25 guests and $220/hr. for up to 40 guests. An extra charge of $10/person will be assessed for each of the first ten persons who enter the party in excess of the agreed upon limit, and $20 per person above those first ten excess guests. We reserve the right to deny admission to any and all persons over the limit. Note that the Fitness Center is not included in the party and remains open to members even for private parties. Members may not circumvent the rules regarding the applicable fees and/or availability for nonmember parties by sponsoring a party for a nonmember in order that the nonmember can receive the member rate or in order to arrange for a nonmember party at times reserved for member parties. Members who sponsor parties must be physically present throughout the duration of the party. Members who violate the letter or spirit of this rule can be charged the difference between the cost of a member party and a nonmember party, plus an equal amount in penalties. Violating members also face possible suspension of privileges without refund. A. NON-PRIVATE PARTIES 1. Members who wish to bring more than 6 guests onto the premises shall contact the Club Committee to arrange for a party. Failure to do so will result in being charged for a party. The Club Committee shall designate and promulgate fees for parties, based on the following limitations: a. Non-private Parties for up to 25 people (to include the cost of one extra lifeguard). b. Non-private Parties for up to 40 people (to include the cost of two extra lifeguards). B. PRIVATE FUNCTIONS 1. Reservations for private functions should be made at least one (1) week in advance. 2. All charges for private functions must be paid in advance. 3. During the swim season, the pool may be rented for private, exclusive functions only on Mondays, after 6:00 p.m., or as determined by the Board of Directors, 4. Members may access the tennis courts and fitness center even during private parties. C. IMPROMPTU MULTI-MEMBER PARTIES In today s world of social media, group texting, and the like, it is possible and legal for multiple members or groups of members to arrange for large gatherings of members to show up at the club simultaneously. However, this can pose safety issues if insufficient lifeguards are on duty. It can also cause overcrowding if we happen to have a party on the books at the same time. Members are kindly asked to include our party coordinator, Jackie Teague, in any texts or s in which more than 3 separate members are contemplating such a rendezvous.
