1 These Rules & Waiver for Bermuda Four Corners Challenge 2018 are to be read in conjunction with the document Bermuda Four Corners Challenge Event Info - vfinal and together they form the full detail of which participants should be aware when considering swimming in one or both of the Fair or Foul Four Milers

2 Bermuda Four Corners 2018 Event Details: 2018 Dates Day 1 start 9:00 am, Saturday 21-April-2018 from Somerset Long Bay NW route Day 2 start 9:00 am, Sunday 22-April-2018 from Well Bay, Cooper s Island SE route Route Maps Maps for all of the Fair or Foul Four Miler routes can be found in the document titled Bermuda Four Corners Challenge Event Info vfinal. If you don t have that document events@bows.bm and we will get you a copy. Registration If you intend to swim either (or both) routes, please to events@bows.bm on or before 1-April No Entry Fee is due until the In Person Registration at the start of each swim, and the notification is to help us understand numbers and prepare an order for T-Shirts / ladies tank tops. Entry Fee Age Limit Relay T-Shirts / Tank Tops Swim caps Swim Floats No cash is payable until the time of In Person Registration. In Person Registration will be done at the start location for the swim, and must be completed at least 30 minutes prior to the start of the swim. The Registration process includes completion and signing of the Registration form and waiver (see copy of waiver at the end of this document), and payment of the Entry Fee. There will be an In Person Registration for overseas swimmers on Friday 20- April-2018 at the Grotto Bay hotel time to be advised on Grotto Bay bulletin board. Each swimmer (or their guardian for swimmers under 21 years of age) are required to complete the Registration form and to sign the waiver. Payment in cash only at the start of each Fair or Foul Four Miler. Fees for 2018 are: One Fair or Foul Four Miler only - $50 Both Fair or Foul Four Milers - $75 (payable prior to the start of the Saturday swim) There will be no refunds if a swimmer subsequently elects not to participate in a route, or is unable to complete a route for which they have paid the Entry Fee. No age limit however, anyone under 21 years of age needs to have a guardian present at the start to sign the Registration and waiver and consent to the swimmer participating. This is an individual swim, no relays are considered as formal participants. You receive an event T-shirt or ladies tank top as part of your Entry Fee, please advise when Registering the size desired (S, M, L, XL), and whether you want a T-shirt or ladies tank top. T- shirt/tanks collection will be location/time to be determined. If you wish to receive additional T-shirts/tanks they can be purchased at a cost of $20 per shirt (again please advise by in advance if you wish for additional shirts, and sizes). For 2018 we are willing to work on an honour basis for shirt ordering no cash up front. Registration for at least one route must be completed before a shirt can be collected. The arrangements for shirts may need to be revisited for future years if we have a large mismatch between shirt requests and payments received. NOTE: If you do not pre-advise requesting a shirt there is a risk that shirts will be unavailable. A Four Corners latex swimcap will be provided upon Registration. Participants can elect to wear it or other caps (or no cap at all) for the swims. Additional caps may be purchased for $10 each. If you wish to use a safety float to increase visibility (such as can be found at you are permitted to do so. To the best of our knowledge they are not available in Bermuda, so anyone wishing to use one should obtain it well in advance of the event date. Strongman competitors - feel free to paint your log in a bright colour!

3 Safety / Boat Support Route Markers / Buoys Wetsuits / fins Cancellation / Postponement Check-in points Drink / Feed Stations While it is possible that boat support may be on hand, swimmers should assume that none will be present, and make their safety decision on whether to undertake the swim assuming that there will be no safety boats or other support on the route. Each swimmer (or their guardian for those under 21 years of age) is responsible for making their own judgment regarding the course safety, weather conditions and their health, fitness and ability to complete the swim. Each swimmer should assume that they are on their own should they experience difficulties of any kind during the event. The only markers or buoys will be on the shoreline at the finish of the route all routes are designed so that the natural shoreline forms the boundaries of the route. Each swimmer (or their guardian for those under 21 years of age) is responsible for making their own judgment regarding the course safety, weather conditions and their health, fitness and ability to complete the swim. Each swimmer should assume that they are on their own should they experience difficulties of any kind during the event. The sea surface temperature on the date of the swims should be approximately 22 c / 72 f. Wetsuits are allowed unless water temperature is warmer than 24 c / 75.2 f. If the update at 5:30 am on event date at indicates the water temperature is not warmer than 24 c / 75.2 f, then a wetsuit is permitted. Each swimmer is responsible for verifying if this website indicates a temperature which would allow a wetsuit. No fins, paddles, or other devices which aid buoyancy or speed are permitted. Safety devices as detailed in Swim Floats are permitted, but neither required, nor provided. The device should be attached by a rope/cord which results in the device not providing buoyancy assistance to the swimmer when in a normal swimming position in the water. The event will not be postponed or cancelled regardless of conditions. Each swimmer (or their guardian for those under 21 years of age) is responsible for making their own judgment regarding the course safety, weather conditions and their health, fitness and ability to complete the swim. Each swimmer should assume that they are on their own should they experience difficulties of any kind during the event. See section below titled What might I consider when determining whether or not I should swim in a Fair or Foul Four Miler? for a subset, but not exhaustive list, of the types of questions a swimmer (or their guardian) could reflect upon to evaluate whether to swim. There will be no check-in points along the route. If a swimmer does leave the water without finishing it would be preferable to advise the organizers that you are safe, so they don t have to report you as lost at sea in the final results. Bermuda Four Corners Challenge will provide a snack size zip lock bag which will contain a note with a contact number for a swimmer to get a ride if they leave the water without finishing. Swimmers may also want to keep some money with them for the swim in the zip lock bag this will help them in case they need to exit the water early and need to pay for transport to the finish or elsewhere. There will be no drink or feed stations along the route. If swimmer wishes to drink or eat along the route they are solely responsible for providing and coordinating it.

4 Awards Transportation of swimmers Transportation of Bags Hotel Partner Each swimmer completing a swim will receive a custom dog tag for that route. Each route will have a different medal. Once a swimmer has received all 4 medals the grouping of them demonstrates the swimmer has completed the Bermuda Four Corners Challenge. There will be awards for fastest combined time across both routes for the year. Awards for fastest Male and Female, both for local and overseas swimmers. Winners of awards in prior years are no longer eligible for awards in subsequent years. An awards/celebration dinner will be coordinated for the Sunday evening with full details to be confirmed. There will also be awards for the fastest male and female in the Strongman division. Results will be tracked for each swim and results, photos and drone footage will be posted to once the website goes live. Swimmers are responsible for getting to the start of each swim with sufficient time to complete all required Registration documentation please be at the start at least 30 minutes prior to scheduled start time due to the need to complete waivers and payment for participation. Swimmers are responsible for their own transport after each swim. If a number of swimmers are staying at Grotto Bay we can work to help coordinate transport on the day of the swims, cost of such transport to be determined. A vehicle will be available at the start of each swim to transport swimmers bags to the finish of the swim. Swimmers are requested to use moderately sized bags to ensure they don t take up too much space. Additionally it is suggested that swimmers use bags that can be easily distinguished to facilitate collection and minimize confusion at the finish. After each swim the intention is to meet at a location convenient to the finish for food and drinks, so it is suggested that swimmers bring some money for those items. The bags will be monitored to ensure they are safe from theft. You are welcome to stay anywhere you like, however the wonderful team at Grotto Bay Beach Resort ( local , toll free ) have very generously agreed to a Group Daily Rate for rooms - $195 for single/double occupancy, $228 for triple occupancy, $276 for quadruple occupancy (meals, taxes, and gratuities not included). Grotto Bay have blocked off some rooms, but the summer season starts ramping up in April, so we suggest booking early to avoid disappointment. If you try to book and Grotto indicate they have no more rooms, try ing us at events@bows.bm and we will try to get Grotto to add more rooms but since we don t control that we can t promise success. 5 What might I consider when determining whether or not I should swim in a Fair or Foul Four Miler?: Open water swimming of any kind carries with it a multitude of risks, and each swimmer should appreciate that an open water swim such as the Fair or Foul Four Miler is an extreme test of a person s physical and mental limits and carries with it the potential for death, serious injury and property loss. Given it is most likely that there will be no safety boats, markers, buoys or other assistance on the route, the Fair or Foul Four Miler should be considered as an unpatrolled route in open ocean with all the risks that entails. Each swimmer (or their guardian for those under 21 years of age) should make the decision whether they are willing to attempt the swim. The following is a list of questions a swimmer might choose to pose to themselves when evaluating whether to participate in the event this is not considered to be exhaustive, and swimmers should recognize that there are an innumerable number of risks associated with participating in any of the Fair or Foul Four Milers. QUESTION Am I healthy enough to do the swim? Do I have enough open water experience? Do I have enough ocean experience? Will the water be too cold? OBSERVATION There may be health factors that constrain your ability to complete the Fair or Foul Four Miler regardless of how good the weather conditions are. Some of the health conditions may not even be known to you. Having a health related episode, such as a heart attack, cramp, seizure or other affliction, in the ocean, with no safety boats around and potentially no access to the shoreline can result in death, serious injury or property loss. Open water swimming is not the same as pool swimming, and until you have experienced it, you may wish to be cautious with assumptions of how your body will respond to the unfamiliar environment. Swimmers who have open water experience with lake swims may find an ocean swim presents different and unfamiliar hazards such as marine life and the potential for swells, and the related risk of being pushed onto or under a reef. Some swimmers can be very internally focused and are less aware of their surroundings, and this can be an incremental risk factor in an ocean swim. Each swimmer reacts differently to the water temperature. The water should be approximately 22 c / 72 f, but each swimmer should verify the water temperature at the start. If the 5:30am update to indicates the water temperature is not above 24 c / 75.2 f, then a wetsuit is permitted. It s choppy inside the reefs, but will it be smooth enough if I get outside the reefline? I don t know the route is that a problem? Is there a risk from boat traffic? Each swimmer is responsible for verifying if this website indicates a temperature which would allow a wetsuit, and can make their own decision whether to use a wetsuit. Actual conditions along the route of a swim are hard to know until you are in the specific location. Even if it is less choppy outside the reefline there are other factors, such as stronger current, deeper water, more potential for marine life in the area, and you will be further from the shore if you do find it is more difficult than you anticipated. Knowledge of your surroundings is always preferable, so it would be wise to consider a lack of familiarity of the route, or surroundings such as reefs or currents as material risks. That said, the routes are specifically designed to use obvious landmarks for guidance and with point to point routes you generally keep the island on one side or the other of you, facilitating navigation. The routes are not in no go areas, and hence boat traffic is entitled to use the area, and may not be fully attentive to swimmers. Wearing a brightly coloured swim cap may increase visibility, but cannot be considered to be a guarantee that boat traffic will see the swimmers. Devices such as Swim Floats (detailed above) may also increase visibility.

6 Is there a risk from marine life? Others are swimming today, does that mean it s safe for me? I have a swim buddy, does that mean the swim will be safe? I will be wearing a wetsuit does that mean I m safer? I m comfortable with the risks, but if something goes wrong will my body be found? The ocean is home to many animals, such as Portuguese Man of War, Jelly Fish, Sharks, and Barracuda to name a few. The possibility of encounters with one or more of these, and potential consequences thereof, should be considered and evaluated as a risk factor. Another individual electing to swim simply means that in their estimation, and based on their skills and risk appetite, the reward is worth the risk. You should not worry about what others are doing, and instead base your decision solely on your own personal circumstances and evaluation of the risks. While having a buddy is generally a benefit, there are myriad scenarios where having a buddy will simply mean someone knows how you died or were injured rather than your buddy being able to save you. It s never certain what difficulties a swimmer may encounter on an ocean swim. A wetsuit may reduce the risk that a swimmer gets stung by a Portuguese Man-of-War, but there are possible negatives from wearing a wetsuit which may put the swimmer in a worse position than if they had no wetsuit on. There will most likely be no support boats, and hence it is possible that a swimmer in difficulty will not be noticed by anyone else. In an open ocean environment it is possible that a deceased participant will not be found. It should be assumed that no search for your body will be undertaken, and your body will be lost at sea if you die during the swim. I further acknowledge that each Fair or Foul Four Miler is a long distance ocean swim. I further acknowledge that there may be no safety boats, buoys or route markers for either or both of the Fair or Foul Four Milers. I further acknowledge that I understand it is entirely my obligation to assess the risks of participating in either or both of the Fair or Foul Four Milers, and I accept the risks and any and all consequences of participating in either or both of the Fair or Foul Four Milers. I certify that I am physically fit, have sufficiently trained for participation in this event and have not been advised otherwise by a qualified medical person. I further certify that I have fully read the Rules & Waiver document, and the Event Info document for the Bermuda Four Corners Challenge, and have fully considered and understand all of the information therein, and have been provided the opportunity to enquire about any questions I might have about the information in those documents and how it might apply to me. I hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assigns in respect of the Fair or Foul Four Milers for which I have registered, as follows: a) waive, release, discharge and agree not to sue from any and all liability for my death, disability, personal injury, property damage, property theft, or action of any kind, which may hereafter accrue to me as a result of my participation in either or both of the Fair or Foul Four Milers, the following entities: Bermuda Open Water Swimming Ltd, directors of Bermuda Open Water Swimming Ltd, event organizers, event sponsors, event workers and volunteers, and event locations, b) indemnify and hold harmless the persons or entities mentioned in this AWRL from any and all liabilities or claims made by other individuals or entities as a result of any of my actions during either or both of the Fair or Foul Four Milers.
