Our program is dedicated to building well-rounded athletes through a safe, fun, and positive environment. 4 Memphis Cheer Discounts We offer a 50% discount on MONTHLY TUITION ONLY (not total monthly fees) for Memphis Cheer siblings. The first athlete s tuition is payable at 100% based on the child in the highest level; each Memphis Cheer sibling s tuition thereafter is payable at the discounted amount listed below: Tiny Exhibition - $45.46 Prep - $50.00 Mini Level 1 - $50.91 Youth & Up - $71.59 Memphis Cheer Scholarships Memphis Cheer offers a non-transferrable monthly scholarship for those willing to work at the events that we offer. The following are the requirements for receiving the scholarships: o Scholarship form must be on file before an event is worked. o Events offered are: Memphis Redbirds Memphis in May Events Liberty Bowl Snowden Grove FedEx Forum o All event donations received will be divided between the scholarship athletes and added to your account before the 1 st of each month. o Please note that the events can take a minimum of 6-8 weeks to be paid. o At events where tips are given, workers working that event will divide tip money evenly. Mandatory Fundraisers Each family will be responsible for 2 program-wide fundraisers: o 2 Gift Card fundraisers Proceeds will go toward the gym facility, equipment, updated software, etc. Wildcard, At Large and/or Paid Bids US Finals, Wildcard/At Large Bid Events Teams that receive a Wildcard or At Large Bid will be individually responsible for competition/commuter fee, travel and housing for the dates given once the bid is received. The parent will be responsible to book the athlete s commuter/competition package through Varsity by the due date, which is usually 30 days after the bid has been received. More information will be given at the time of the bid. Paid Bid Events Teams that receive a Paid Bid to Worlds or Summit will travel together. Paid Bids include hotel and registration/competition fees. Summit bids included the athlete s hopper pass. More information will be given at the time of the bid. 4

5 FINANCIAL COMMITMENT (Billing Authorization) I have read the Cheer Packet and I fully understand my financial commitment to Memphis Cheer outlined in this document. I understand that I am giving my credit card/debit card information and that the information will be used if I do not meet payment deadlines to Memphis Cheer. I understand that I am entering into this program of my own free will. I understand that my card will be set up on automatic payments to be drafted out of my account each month. There will be no refunds made to anyone who is asked to leave the program or that quits a team. Other refund request will be decided by ownership. You can cancel your contract on or before September 1, 2018 with no cancelation fee. Any cancelation after September 1, 2018 until November 1, 2018 will incur a $750 cancelation fee. All cancelations after November 1, 2018 will be responsible for the remaining monthly payments included in contract. Major credit cards will have a 2% credit card fee added. * It is your responsibility to inform the office of any changes to this card. Anyone who fails to submit an active auto draft option will be subject to an additional $50 per month fee. * Monthly fees are drafted out of your Memphis Cheer account on the 1 st of every month. Payment is expected on or before the 7 th. This credit card/debit card will be charged for any outstanding balance on the 8 th along with a $25 late fee. * I understand that this authorization will remain in effect until I cancel it in writing, and I agree to notify Memphis Cheer in writing of any changes in my account information or termination of this authorization at least 15 days prior to the next billing date. If the above noted periodic payment dates fall on a weekend or a holiday, I understand that the payment may be executed on the next business day. I understand that because this is an electronic transaction, these funds may be withdrawn from my account as soon as the above noted periodic transaction dates. In case of an ACH Transaction being rejected for Non-Sufficient Funds (NSF) I understand that Memphis Cheer may at its discretion attempt to process the charge again within 30 days, and agree to an additional $45 charge for an attempt returned NFS which will be initiated as a separate transaction from the authorized reoccurring payment. I acknowledge that the origination of ACH Transactions to my account must comply with the provisions of US Law. I agree not to dispute this reoccurring billing with my bank so long as the transactions correspond to the terms indicated in this contract and authorization form. Parent Signature: Date: 5

7 Please carefully read this entire form. This form must be completed in full, signed, and returned before your child may participate in any Activities (as defines below). Memphis Cheer Participant Agreement As parent or legal guardian of, a minor ( Minor ), and in consideration for Minor s participation in the cheerleading, dance and other activities and services, including, without limitation, travel to and from such activities, competitions, conferences, meetings, and other events that may require travel (collectively, the Activities ), conducted and provided by Memphis Cheer, LLC a Tennessee limited liability company; and their respective affiliated entities, owners, agents, officers, employees, representatives, and all other persons or entities acting in any capacity on their behalf (referred to as MC hereafter), I AGREE AS FOLLOWS: I. Liability Release. ON BEHALF OF MYSELF AND MY HEIRS, ASSIGNS, EXECUTORS, AND ADMINISTRATORS, I RELEASE AND FOREVER DISCHARGE MC FROM ALL CLAIMS, JUDGEMENTS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES (COLLECTIVELY, THE CLAIMS ) OF ANY NATURE ARISING OUT OF OR IN ANYWAY RELATED TO THE MINOR S PARTICIPATION IN THE ACTIVITES WHETHER OCCURING ON THE PREMISES OF THE MC LOCATION; I FURTHER AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MC FROM AND AGAINST ANY AND ALL SUCH CLAIMS, INCLUDING, WITHOUT LIMITATION, ATTORNEYS AND OTHER PROFESSIONALS FEES AND COSTS. I understand that this release and discharge of Claims includes, without limitation, any Claims based on the negligence, action, or inaction of MC and covers personal and bodily injury (including death) and property damage, whether suffered by Minor before, during, or after participation in any Activities, and includes all Claims arising from the publication of use of any photograph, videotape, or narrative in any media. I acknowledge that MC makes no representations or warranties, either express or implied, regarding the condition or suitability of MC s location or equipment for the Activities. The laws of the State of Tennessee shall govern this release and indemnity agreement. II. Medical Release. I acknowledge and agree that Minor s participation in the Activities subjects Minor to the possibility of physical illness or serious injury (including death). I further acknowledge and agree that Minor is assuming the risk of such physical illness or serious injury (including death) by participating in the Activities. In the event of such physical illness or injury, I authorize MC to obtain necessary medical treatment for Minor and I release, hold harmless, and forever discharge MC from any Claims arising from or related to any physical illness or serious injury (including death) and to the exercise of this authority. I further acknowledge and agree that I will be responsible for any and all medical and related costs and expenses incurred by and on behalf of Minor for any such physical illness or injury. III. Appearance Agreement. I understand that MC may from time to time produce promotional and other audio or visual materials and media relating to the Activities (the Promotional Material ). I understand that, as a participant in or spectator of such Activities, Minor may be included in video recordings, audio recordings, photographs, and images taken during Activities for use in Promotional Material. THEREFORE, I HEREBY ASSIGN, TRANSFER, AND GRANT TO MC, WITHOUT RESERVATION OR LIMITATION, THE ROYALTY-FREE, EXCLUSIVE RIGHT TO USE SUCH VIDEO RECORDINGS, AUDIO RECORDINGS, PHOTGRAPHS, AND IMAGES OF MINOR, AS WELL AS MINOR S NAME, LIKENESS, PERSONAL AND DEMOGRPAHIC INFORMATION, VOICE AND APPEARANCE AS PART OF ANY PROMOTIONAL MATERIAL. IN GRANTING THIS LICENSE, I HEREBY WAIVE ANY RIGHT TO INSPECT OR APPROVE ANY SUCH PROMOTIONAL MATERIAL PRIOR TO PUBLICATION. I FURTHER AGREE THAT, UPON THE REQUEST OF MC, I SHALL IMMEDIATELY REMOVE OR TAKE DOWN ANY PROMOTIONAL MATERIALS THAT MINOR OR I HAVE UPLOADED OR POSTED TO ANY WEBSITE OR SOCIAL MEDIA PLATFORM (INCLUDING, BUT NOT LIMITED TO, FACEBOOK, TWITTER, SNAPCHAT, INSTAGRAM AND YOUTUBE), OR IN ANY OTHER PUBLIC FORUM. IV. Confidentiality. I acknowledge and agree that MC develops and creates unique and valuable proprietary dance routines, cheerleading routines, training techniques, and other intellectual property that are unique and valuable to MC and that may be used to prepare for and participate in competitive events (collectively, the Intellectual Property ); I further acknowledge and agree that maintaining the confidential and proprietary nature of the Intellectual Property is of the utmost importance to MC and its competitive success. I understand that I may not video record, audio-record, photograph, or take other images of the Intellectual Property without permission solely for my, Minor s, or Minor s immediate family s personal, non-commercial use; PROVIDED ALWAYS, HOWEVER, THAT MINOR AND I SHALL NOT POST OR UPLOAD ANY SUCH RECORDINGS OR IMAGES TO ANY WEBSITE OR SOCIAL MEDIA PLATFORM (INCLUDING, BUT NOT LIMITED TO, FACEBOOK, TWITTER, SNAPCHAT, INSTAGRAM, AND YOUTUBE), OR IN ANY PUBLIC FORUM WITHOUT THE PRIOR WRITTEN CONSENT OF MC. V. Breach. I ACKNOWLEDGE AND AGREE THAT ANY BREACH OR THREATENED BREACH OF SECTION IV OF THIS AGREEMENT WILL CAUSE ME IRREPARABLE INJURY FOR WHICH NO ADEQUATE REMEDY AT LAW IS AVAILABLE AND I CONSENT TO THE ISSUANCE OF AN INJUNCTION PROHIBITING ANY CONDUCT VIOLATING THE TERMS OF SECTION IV. I ACKNOWLEDGE THAT ANY VIOLATION OF THIS AGREEMENT BY MINOR OR BY ME MAY RESULT IN MINOR BEING SUPSENDED FROM OR PERMANENTLY EXPELLED FROM PARTICIPATION IN SOME OR ALL ACTIVITIES AND MY SUSPENSION FROM ATTENDING AND SPECTATING SOME OR ALL ACTIVITIES. I ACKNOWLEDGE THAT IN ANY CASE WHERE MINOR IS SUSPENDED OR PERMANENTLY EXPELLED FROM PARTICIPATION IN SOME OR ALL ACTIVITES, I WILL NOT BE ENTITLED TO ANY REFUND OF ANY AMOUNTS PAID FOR PARTICIPATION IN ANY CURRENT OR FUTURE ACTIVITES. I have had sufficient time and opportunity to read this agreement. I have read this document in its entirety and understand it. 8 Memphis Cheer Program Policies and Procedures If you have any questions or concerns that need immediate attention please use the following chain of command: 1. Administrative Manager at front desk 2. Head Coach 3. All-Star Director 4. Owners Good sportsmanship, polite manners and a good disposition are mandatory at all practices and competitions. Crossover Policy; if you are asked to be a crossover athlete you will be responsible for the crossover fees in addition to your regular tuition. It is your responsibility to wear the appropriate practice wear to every practice when requested. Personal items such as cell phones, school bags, or gym bags must be taken into the gym and stored in the cubbies/shelf. NO items are to be left in the gym hallways and cell phones must be turned off when practice starts. The gym is not responsible for any lost or stolen items. No Food or Colored drinks allowed on floor. Only water bottles with tops allowed. No gum chewing allowed on floor. You must arrive at all practices, competitions, or any scheduled event on time. Punctuality is a MUST. During practice, your opinion does not count. All squad and routine decisions are left to the discretion of the coaches. Please feel free to talk to your coach about anything; remember to do it at the appropriate time. For example, approaching a coach in the middle of a practice would not be an appropriate time. Athletes need to be able to physically and mentally perform all aspects of competitive cheerleading. NO GOSSIP about any other teams (All Star or School team). NO GOSSIP about a child on your team or another team. NO GOSSIP about coaches and staff. It is much better to address a problem than to listen to idle gossip. No profanity or abusive language. Never post any negative comments on social media. Practices may be changed or added at any time during the season. Anyone threatening to quit or to pull their child from a team will be dismissed from the program immediately. Only cheerleaders and coaches are allowed on the cheer floors, seriously! No one is allowed to yell onto the floor or try to make contact through the parent viewing area window during practices or tumble classes. This is extremely distracting to all involved. All parents must remain upstairs in parent viewing room. Please do not stand in hallway downstairs. The coaches reserve the right to close practices at ANY time for ANY reason. It is the parent s responsibility to know what is going on with your team. Check your s and the website regularly. Stay connected on your team s Group Me. Withholding a child from a practice or a competition should never be used as a form of punishment. Athletes should be able to handle school work and All-Star practices, homework is not an acceptable excuse for missing practice. Parents, relatives, friends and cheerleaders are never allowed to speak with competition officials for any reason. Ever. Parents are never allowed to represent Memphis Cheer under any circumstances concerning accommodations, competitions, or any other situation. Ever. *Parents, relatives and athletes need to remember that everyone is representing Memphis Cheer and should always have positive and proper behavior. Always!! There will be no arguing or questioning of the coaching staff s decisions at competitions. If a problem arises between you and a teammate or another parent, the problem will be addressed with all parties involved at a meeting with your coach and the All-Star director. Anonymous s/letters/texts/tweets, etc. will be ignored. *A doctor s note is required for any missing practice due to a sickness or injury. Detailed information from your doctor is required showing any restrictions and the time of recovery recommended. *If your child misses numerous unexcused practices the following consequences will occur. After one unexcused missed practice, your cheer account will be charged $25. Each missed practice after that will be an additional $50 each. After 5 unexcused missed practices you will be removed from team. Memphis Cheer maintains the right to refuse services at any time. 9 Memphis Cheer Vacation Request & Approval Form This form must be filled out and turned into the gym. This form must be signed by the owner or a coach in the gym. If it is not signed, then the vacation form will not be valid. We need this form as soon as possible, but no later than 2 weeks before your scheduled vacation. 10 Important Information and dates: Group Evaluations: March p-8p March 24 10a-1p April p-8p April 28 10a-1p Starting March 12, 2018 private evaluations can be scheduled by calling Group Evaluation Fee will be $50. Private evaluations will be $75. These fees will be credited toward your registration fee when you sign the packet. Registration Fee is $300 for any new athlete or any athlete paying after April 30 th. Registration Fee is $200 for all returning athletes if paid prior to April 30 th. 10
