2 2018 USA Softball of Colorado Umpire Agreement This forms an agreement, between OFFICIAL NAMED BELOW (hereinafter called OFFICIAL) and USA Softball of Colorado. (USASC) I, the undersigned umpire, acknowledge, agree, understand and certify that: 1.) I have voluntarily, and of my own free will, elected to participate as an umpire registered with the USA local association designated herein. 2.) My registration as an USA umpire does not create any kind of employer/employee relationship. My participation as an USA umpire is solely as an independent contractor. 3) I will abide by and enforce the provisions of the USA Code and USA playing rules. INDEPENDENT CONTRACTORS Officials are not employees of USASC, a non-profit corporation. All officials are independent contractors using USASC as a procurement and assignment office. Official agrees to pay all association fees, attend clinic(s) pass the umpire exam prior to obtaining assignments. BACKGROUND CHECKS I have not been convicted or pled guilty to any felony or misdemeanor charge from any court relating to sexual offenses and offenses against minors. I represent and warrant that I will notify the local USA association of any convictions or guilty pleas related to any such charges against me, and I recognize that any future convictions or guilty pleas related to any such charges against me may result in termination of my status as an USA umpire and I further recognize that any false statements, misrepresentations or omissions concerning this information, present or in the future, will be grounds for immediate termination. I understand that USA does not tolerate abuse of any kind in its program and I agree to report to USA any allegations or suspicions of abuse of which I may become aware of. If I plan to work any youth games, I will turn in a background check consent form to give USA permission to run a background check. ASSIGNMENTS Officials accepting assignments agree to the following: Assignments for all games will be offered on the basis of ability to officiate as determined by availability, examination results, clinic attendance, cooperation and ratings. All assignments will be made by the UIC or their designee whether written or oral. After each tournament a umpire s evaluation may be conducted. Official hereby waives any and all rights and claims against USASC for the manner in which assignments are made. No right to work is expressed or implied by the acceptance of this agreement. The first pitch must be at the scheduled game time. An umpire who arrives at the field more than 5 minutes after the scheduled start time of a game will be paid 75% of the full game fee regardless of the number of innings played. COMPENSATION Officials shall be compensated for all services rendered pursuant to such assignments at the rate per game reflected in the official fee schedule. Official agrees to abide by all rules, regulations, laws, policies and ordinances set forth and made known to Official whether verbally or written. No withholding taxes or contributions for social security, unemployment, disability insurance, or other employee benefits or contributions shall be deducted from Official s compensation. Official is responsible for paying all applicable taxes, fees and contributions. They may be eligible for certain limited excess medical coverage expenses for injuries sustained during participation as an USA umpire. Umpires will not be paid for canceled games. USA Softball of Colorado has two levels of umpires, they are Registered (R) and Certified (C) Below is the criteria. The game fees are listed below:

3 Registered Umpire (R), current USA registration, and in good standing with USA Softball of Colorado. a) Attend one local or national clinic b) Pass background check c) Score higher than 80% on the national umpire exam d) Promote and support USA softball in positive light Certified Umpire (C): Meet all the requirements of a registered umpire and any criteria set forth by the UIC. Certifications are made on an annual basis. If an umpire does not meet the certified requirements they will be automatically moved down to the lower level. In order to be considered for national selection you must obtain the certified level. a) All requirements of a Registered Umpires b) Score higher than 90% on the national umpire exam c) Attend two local or one national and one local clinic (For umpires who have over 5 years of USA Softball registration you will only be requried to attend one national or one local clinic) d) Work 25 games in a single season, can be a combination of both plate and base e) Promote and support USA softball in a positive light f) Game day evaluations must average rating at Very Good (46-54) or Excellent (55-60) *Evaluation rating at the level of Goof (36-45) will be deliberated upon by UIC staff for certification g) Participate in the direct deposit program** 2018 Official Game Fee Schedule One Man Two Man Three Man UIC Tournament R C R C C S A W *Assignor Scholarship Organizational/Invitational Junior Olympic Classic State Champions (R) Registered (C) Certified S - Site *cancellation fee RAIN-OUTS and OTHER UNCONTROLABLE EVENTS: Umpires will retain the full game fee for any game that starts but must be stopped due to weather, light failure, sundown, or sprinklers, or any other circumstances that prevent further play. If any of the above conditions forces a game cancellation prior to the scheduled start of a game, but after umpires have arrived at the complex, umpires shall be compensated one-half the normal game fee. If the first scheduled game of the day is canceled and umpires have arrived at the complex they will receive a full game show fee. If subsequent games can't be played and the UIC is notified no game fee will be paid. If the first scheduled game is a forfeit and umpires have arrived at the complex, umpires shall be compensated the full game fee. If subsequent games can't be played and the UIC is notified no game fee will be paid. The Assignor will receive the full game fee. UNIFORMS AND EQUIPMENT Official agrees to appear for each and every assignment accepted under the terms of this agreement in the prescribed uniform. Official hereby agrees that as an independent contractor he/she shall acquire, repair and maintain at his or her cost such equipment as Official needs for performance of officiating services. These items shall include, but are not limited to, the official uniform as prescribed by USASC. The official uniform shall be prescribed by the rule book or the official s manual of that sport. In case of any discrepancy or disagreement as to the proper uniform, the decision of the UIC shall be final. Official also understands that a system is in place to impose fines for uniform violations in order to maintain the high standards of the association. GAMEON Sports is our official supplier of uniforms.

4 SERVICE The services rendered under this agreement by the official shall be in conformity with the operating procedures mutually agreed upon by the Official and USASC. At the request of a tournament director, the tournament UIC, will remove from service, as soon as a qualified replacement is available any Official, who in the tournaments director s opinion, is not qualified to perform the work assigned. Official agrees that he or she will not receive compensation if replaced due to non-compliance of code, rules, ability, this contract, ordinances and/or policies. CONTRACT This agreement shall commence on the date specified above and shall continue in effect until December 31, This agreement must be signed and registered with USASC prior to any assignment being offered. ENTIRE AGREEMENT I voluntarily accept and solely assume all risk of damages, injury, including death, incurred or suffered by me while participating as an umpire or play by teams or other participants and I therefore release, discharge and agree not to sue USA and/or the USA local association designated herein, their owners, officers, agents, servants, associations or employees for any claim, damage cost or cause of action I have or may have in the future as a result of injuries or damages sustained or incurred by me from whatever cause while I am participating as an USA registered umpire, including by not limited to negligence, breach of contract, or other wrongful conduct or omissions by the parties hereby released. This agreement supersedes all previous agreements oral or written between USASC and Official, and represents the whole and entire agreement between the parties. No other agreement or representations oral or written have been made by USA Softball of Colorado. This agreement cannot be altered, modified or amended, except in writing, and approved by the Colorado State Commissioner. This agreement shall be covered by all the laws of the state of Colorado. I agree USA Softball of Colorado may retain my background consent form on file for future use.
