1 Western Whips and Wheels 2018 Arena Driving Trials Series, Sponsored by Driving Essentials, Inc. Arena Driving Trials are a fun way to keep us motivated through the wet winters of the Pacific Northwest. The monthly trials include dressage, cones and hazards, all adjusted to fit in a covered arena. The events are very casual and drivers may wear comfortable warm clothes. Your horse may have a shaggy winter coat and, yes, your carriage may be a bit muddy. This takes the pressure off and simply gives drivers a chance to practice and have fun. Last year we had many first time competitors who used the Arena Driving Trials as a way to learn about Combined Driving Events in a friendly and low pressure atmosphere. These ADTs are not ADS sanctioned events but are run under ADS rules. All the ADT s will begin at 10 am and run until the last competitor has finished and ribbons have been awarded. Driving Essentials Inc. has again provided some very generous prizes for our series. You must be a WWW member to qualify for the awards. Judges: The Arena Driving Trials are not ADS sanctioned; however, many ADS rules will be followed. Each ADT will be judged by a knowledgeable horse person who rides and/or drives at a high level of competence. Each judge is a trainer, competitor and/or registered judge in ridden or driven dressage. We are departing from the ADS rules in the selection of our judges to control expenses and due to the limited number of registered judges in our region. We will not restrict participation of competitors who train with, or have purchased horses from, the judge. Our goal is to encourage broad participation and to have fun practicing our sport. We will welcome our judges as competitors at the ADTs that they are not judging. Other Officials: There will not be a technical delegate or a veterinarian at the ADTs. A non-profit Oregon Corporation Please initial paragraph 4 and sign last page EQUINE ACTIVITY LIABILITY RELEASE, WAIVER OF RIGHT TO SUE AND ASSUMPTION OF ALL RISKS Pursuant to Oregon Law ORS to this Equine Activity Release, Waiver of Right to Sue, and Assumption of All Risks (hereinafter referred to as this Agreement ) is hereby given by the undersigned to Western Whips and Wheels, Inc. equine activity sponsor, and/or equine activity professional (in each case the sponsor ) and/or to the sponsor as agent for the benefit of each owner of land upon which an equine activity is conducted. Western Whips and Wheels, Inc. hereinafter referred to as sponsor, and as persons who lease and provide facilities for equine activities, to each agent, volunteer, heir, personal representative, successor and assign for the sponsor (whom shall also be included within the word sponsor as their relationships may determine) as provides as follows: In consideration for the opportunities provided by the sponsor and each land owner to the undersigned (including any minor on whose behalf the undersigned signs this Agreement) and for the enjoyment of equine activities as a participant or navigator or spectator or auditor, signs the Agreement and agrees as follows: 1. This Agreement is pursuant to Oregon Law ORS to as it may now provide or if amended. This Agreement shall be construed as to provide to the sponsor the fullest protection of this Release, Waiver of Right to Sue, and Assumption of All Risks that is afforded by ORS to , by other applicable statutes, and by general law. 2. The participant or navigator or spectator or auditor hereby acknowledges that he/she has full and complete notice and understanding of ORS to and all the risks inherent in equine activities which may cause, contribute to, or result in the death or personal injury of the participant and/or spectator, or damage to the participant s and/or spectator s property. (Hereinafter referred to as risks ) These risks include, but are not limited to: a. The propensity of equines to behave in ways that may result in injury, harm, or death to persons on, driving, or around them. b. The unpredictability of an equine s reaction to such things as sounds, sudden movement, unfamiliar objects, persons, or other animals. c. Certain hazards such as surface and subsurface conditions. d. Collisions with objects or other animals. e. The potential of a participant or navigator or spectator or auditor acting in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the equine or not acting within the participant s ability. f. The propensity for an equine to behave in dangerous ways or to trip and/or fall, or run away in an out of control manner. g. The inability of anyone whomsoever to predict or foresee an equine s reaction to excitement, weather conditions, sound, movement, objects both familiar and unfamiliar, vehicles, persons outside or people in an arena, or standing at gates, judges tables, outside wildlife of any species, and the effects of such reactions.

4 h. The hazards of surface or subsurface conditions, including but not limited to objects or conditions on, under, or protruding from the surface both latent and patent. i. The hazards which include but are not limited to are rocks, hills, fences, trees, tree stumps, tree branches, logs, bridges, ditches, bodies of water, debris, and obstacles for any equine activity connected therewith which may foreseeably or unforeseeably be present. j. The danger and risk of tack and/or harness breaking for whatever reason, or for no apparent reason. k. The dangers and risk of becoming entangled in tack and/or harness or saddle, vehicles/carts/carriages used in an equine activity. l. The risk of falling from or otherwise becoming unstable on an equine or in a vehicle/cart/carriage used in an equine activity for any reason whatsoever or for no identifiable reason. m. The danger and risk of being struck by an equine, or injured by an equine, including but not limited to a bite and/or a kick. This shall include equines that are ridden, driven, tied, or controlled via a lead rope/halter by a person/handler. n. Any negligent act or omission by the sponsor or any landowner which causes or results in the death of personal injury of the participant or damage to the participant s property. o. All other dangers and risks associated with equine riding, and/or driving an equine in a vehicle/cart/carriage, or handling of equines and related activities. 3. The participant or navigator or spectator or auditor hereby RELEASES and WAIVES all rights which may have or hereafter have against the sponsor and each land owner for any injury, loss, damage, or death which in anyway results from the intrinsic dangers of equine activities and/or associated with the Risks enumerated in Paragraph 2, subsections A through O above. He/she does hereby WAIVE his/her right to sue or bring any action against the sponsor in connection herewith. He/she agrees to INDEMNIFY and DEFEND the sponsor from and to HOLD the sponsor HARMLESS against any such suit or action including reimbursement of legal fees associated with the defense of any claim, and he/she hereby expressly ASSUMES ALL RISKS AND DANGERS of injury, loss, damage or death which are associated with the Risks enumerated in Paragraph 2, subsections A through O above, including an act or omission that constitutes negligence for the safety of the participant or navigator or spectator or auditor by the sponsor, or any other person. 4. The participant or navigator or spectator or auditor hereby authorizes and consents to any emergency medical care which may at the time appear reasonably appropriate under the circumstances as a result of injury or sickness caused by or incurred in the course of an equine activity. The Agreement shall remain valid and in full force effective from and after the date opposite the signature of the participant or navigator or spectator or auditor until expressly revoked by the participant or navigator or spectator or auditor in a written notice personally delivered to the sponsor. 6. If this Agreement is executed by the undersigned for and on behalf of a minor participant or spectator or auditor named below, the undersigned hereby warrants and represents that he/she is in fact the legal parent or guardian of such minor, with the full rights of custody and control and that this Agreement is given on behalf of and is intended to be binding upon said minor, his/her heirs, personal representatives, successors, and assigns. The undersigned further agrees that this Agreement shall also be fully binding on the undersigned as if it were entered into solely on his/her behalf.

5 7. This Agreement shall be binding upon heirs, personal representatives, successors, and assigns of the participant or navigator, or spectator or auditor and the undersigned. 8. I acknowledge the activity sponsor/professional has made a reasonable and prudent effort to determine my ability as a participant to safely manage the particular equine. I HAVE FULLY READ AND FULLY UNDERSTAND THE FOREGOING EQUINE LIABILITY RELEASE, WAIVER OF RIGHT TO SUE, AND ASSUMPTION OF ALL RISKS. I HAVE CONSULTED AND RELIED UPON MY OWN ADVISOR FOR ALL QUESTIONS IN CONNECTION THEREWITH, AND I HAVE NOT RELIED UPON THE SPONSOR/PROFESSIONAL OR ANY LANDOWNER OR EQUINE ACTIVITY SPONSOR FOR ANY ADVICE OR EXPLANATION IN CONNECTION THEREWITH.
