1 June 8, 2010 Mayor Alan Brundage called the regular monthly council meeting for June 8, 2010, to order at 7:00 p.m. Council members present were Mayor Alan Brundage, Jessica Fitch, Joyce Reynolds, Ron Kenney, Bob Burns and Juanita Berry. Visitors present were Carol Pearce, Ron & Mary Jane Work, Val Wacker, Scott & Patricia, Maya, Kara Jones, Justin Stringer, Mondella Craig, Mary Beth Bookless, Wayne Vineyard, Julie Dolley, Melodee Gaskill, Dale & Marcia Weishaar, Ryan Quinn, Larry & Nancy Haskins, Judge Don Riggs, Pool Manager Hanna Hemberger, Police Chief Rebecca Mendoza, Reserve Officer Kevin Phillips and City Clerk Janet Etheridge. Ron Work requested to go early in the meeting to Open Forum since several of the individual present this evening are on call with Fire and EMS. Brundage stated they would go through the minutes and bills and then to Open Forum. Berry had two corrections for the May 25 th minutes; 3 rd page, 2 nd paragraph, 4 th line down delete get before request, and 5 th paragraph, 5 th line down change house to houses. Reynolds moved to approve the regular May 25 th 2010 minutes with corrections, Fitch seconded, motion carried 5-0. Reynolds asked if we have received the fence for the tank yet, Clerk stated that it has been ordered but not picked up yet. Fitch asked about spraying for the mosquito s, Clerk stated they have sprayed one time, Brundage stated that he approved the spraying ahead of time since the mosquito s were so bad, it was with the same company at the same price. Fitch moved to approve the bills in the amount of $45,713.71, Burns seconded, motion carried 5-0. Brundage called for Michelle Yipe, Yipe was not present at the meeting. Brundage called for Ron & Mary Work, Mary Beth Bookless, Scott and Patricia Jones, Mondella Craig, Thor Martin, Marcia Weishaar, Carol Pearce, Brundage asked if there was a spokesperson, Ron Work stated that everyone would address the Council. Work asked procedural questions of Brundage concerning time limits. Mendoza stated that Hanna Hemberger was present and was also working at the ball game that evening; Hemberger requested to present her report. Council commented about a few issues; Hemberger talked to the Council about the pool party for the summer reading program, Gaskill covered the details about the pool party and the requirements for attending the party. Reynolds moved to approve the pool party for the summer reading program, Fitch seconded, motion carried 5-0. Ron Work resumed addressing the Council about Ordinance 494 concerning dogs. Work passed out copies of letter from Argonia Clinic concerning their health and this issue. Brundage stated that the city does the best they can and appreciated that comments, Mary Jane Work addressed the Council about the dog ordinance. Brundage thank Work for her comments. Mary Beth Bookless address the council about dogs, she requested that the council adopt the county ordinances or to change the ordinance implemented in February to grandfather in those who have multiple dogs before Ordinance 494 was passed. Scott Jones addressed the council about dogs; Thor Martin was unable to come. Marcia Weishaar addressed the Council about dogs. Carol Pearce stated that we need to anything to keep these people from leaving town. Brundage asked for Councils comments, Berry moved to table the matter and take it under consideration, motion died for lack of second. Discussion was held; Mendoza stated that until the matter was settled no action would be taken on the tickets that have been issued. Brundage stated that the Council could not reach a resolution on this issue this evening, and that no action would be taken on this until it is resolved. by:
2 by: June 8, 2010 Larry and Nancy Haskins talked to the Council about people floating down the river. Haskins stated that the Chikaskia River is a non-navigable river which means that you can t raft, canoe or float down the river without specific permission from the land owner. Council requested Clerk to put something in the paper about this issue. Judge Don Riggs stated everything was okay. Beccie Mendoza stated the she spoke with Jimmy Reed; he has brand hand held radios from a 2001 grant, Mendoza stated that she needed the Councils permission to sign paper in order to receive the 2 radios for free. The repeater is in the car now and working. Mendoza stated the Bob Randall got with Clerk on the security system; Council was presented Option 1 at a cost of $1,375.00, Option 2 at a cost of $2, plus shipping and handling. Discussion was held, Kenney moved to purchase Option 2 of the security system, Fitch seconded, motion carried 5-0. Clerk will talk with CPA as to how to split out cost of system. Mendoza stated that ordinance violation letters were sent out for junk vehicles. Fitch moved to go into executive session for 5 minutes with an invitation for Mendoza to stay to talk about non-elected personnel, Berry seconded, motion carried 5-0. Council entered into executive session at 8:55 p.m. Council came out of executive session at 9:00 p.m. with Brundage stating no binding action had been taken. Brundage stated he received a phone call from Ralph Buresh requesting that the City call him when the grass gets to tall since they live out of town, Brundage stated he committed that would call them. Council did not agree that city employees should call Buresh when their grass needs mowed; Brundage said that he would call the Buresh s. Brundage asked about getting stop signs for the new edition on High street and Red Raider road, Mendoza will check with the State and the County on this. Discussion was held about the strategic planning process; Brundage hoped to get some committees together to address certain problems. Kenney talked to the Council about the Harper Rural Water District and the possibility of a new contract with them. Clerk stated that HRWD did find the leak in the system underneath a creek. Clerk stated that they averaged the bill for April on the HRWD. Kenney stated that KMGA has hired another general manager. Berry asked Vineyard if they have had any more dumping at the Recycle building, Vineyard said no. Clerk read thank you card from Mary Anne Goddard. Clerk stated that Richelle Greene was unable to attend the Rural Trauma Class as scheduled and checked into getting a refund and was denied. Clerk asked if Council wanted Greene to pay back fee for missing Class, Council stated no. Clerk requested to get family pool passes for the City Employees as a perk for working at the City. Discussion was held about the issue, Fitch moved to allow city employees family passes to the pool, Burns seconded, motion carried 5-0. Clerk stated that she talked with the Mayor and he authorized the cost of spraying for mosquito s, Council stated that we need to plan on doing this every year unless there is a large rate hike. Council said that we need to let him know where the boundaries are so that the whole town is getting sprayed and the water holes also. Discussion was held about strategic planning and the public notice for the meetings. The School will allow us to use the school library to hold these meetings, Clerk stated that the July 12 th meeting will need to be rescheduled so the school board can participate, they can attend the August 2 nd and October 4 th meetings. Clerk will get with Seth Bate to see about rescheduling the meeting in July. Clerk will create flyer for these meetings and post them around town. Clerk stated she talked with the City Attorney about the property on 120 S. Main and filling in low areas, discussion was held; Council wants to get bids on cost for filling property in. Clerk stated that SCEDC is requesting our support for next year in the amount of $1,
3 June 8, 2010 Fitch moved to pay the $1, to support Sumner County Economic Development Commission for the 2011 year, Berry seconded, motion carried 5-0. Clerk stated that she received an estimate from R.C. McNerlin for a custom made tarp for the Lions Club shelter at a cost of $ Vineyard stated that McNerlin has already received donations from campers for this tarp. Reynolds moved to get the awning for the Lions Club shelter, Fitch seconded, motion carried 5-0. Brundage asked the Council when they would be able to get together to solve the dog ordinance, discussion was held and a special meeting was set for Tuesday June 15 th at 7:00 p.m. Reynolds moved to adjourn at 10:25 p.m., Burns seconded, motion carried 5-0. by:
4 Minutes from Special Council Meeting June 15, 2010; at 7:00 p.m. The special council meeting was called to order at 7:00 p.m. by Mayor Alan Brundage. Council members present were Jessica Fitch, Joyce Reynolds, Ron Kenney, Bob Burns and Juanita Berry. Visitors present were Mondella Craig, Thelma Oldridge, Dennis Cooper, Mary Beth Bookless, Carol Pearce, Ron & Mary Jane Work, Dale & Marcia Weishaar, John Gough, Justin & LaDonna Stringer, Scott & Patricia Jones, Julie Dolley, Linda & Jasper Haskin Danelle Meyers, Sonny & Anita Larcade and City Clerk Janet Etheridge. This special meeting was called for discussion of changing the dog ordinance. Brundage stated that we have several individuals that would like to address the Council; Brundage asked that comments be restricted to 5 minutes or less. Bookless asked a question about if anything has been decided on this, Kenney stated that they have copies of other dog ordinances from surrounding communities that they have reviewed but no binding action had been taken. Fitch stated that they have also contacted the attorney to make sure that what we were doing was correct. Several individuals addressed that Council concerning the dog ordinance, Scott Jones talked about having a soft cap with a total limit and a fee schedule which would deter those that may not take care of dogs. Mary Beth Bookless suggested posting a synopsis of the dog ordinance in the window of the city building where people could see it. Brundage commented about the ordinances we have, and stated we may be able to put them on the internet at some point. Dale Weishaar and Julie Dolley both expressed concern about people moving out of town over a restrictive ordinance. Dale and Marcia Weishaar express concern about the leash laws and that they are too restrictive. Danelle Meyers suggested that you inform people of the dog ordinance when they move into town. Council discussed all of the comments made during the Public Comment and each member s thoughts about what they felt needed to be changed. Fitch stated that according to the attorney we can not grandfather all of the dogs in. Discussion was held about the dog issue, Bookless stated that there is a volunteer base that would be willing to help out with driving the dogs to the humane society. Clerk talked through an example utilizing Oxfords ordinance and paying for extra dogs. John Gough stated that if we call it a kennel fee would there be any danger that someone who pays the fee would fall under any kind of state regulations for operating a kennel, Gough though it would be wise to call it something else. Clerk stated that the only time the state gets involved it is usually with hobby breeders. Reynolds moved to allow after two (2) dogs not to exceed four (4) dogs there will be a $25.00 fee per year for each additional dog above two (2) dogs, Burns requested for Clerk to re-read motion, Burns seconded, motion carried 5-0. 5 June 22, 2010 Mayor Alan Brundage called the regular monthly council meeting for June 22, 2010, to order at 7:00 p.m. Council members present were Mayor Alan Brundage, Jessica Fitch, Joyce Reynolds, Ron Kenney, Bob Burns and Juanita Berry. Visitors present were Val Wacker, Zack Kirk, Maintenance Supervisor Kevin McCurley and City Clerk Janet Etheridge. Fitch had a few corrections for the June 8 th minutes; 1 st page, 7 th paragraph, 3 rd line change that to their, same paragraph, 4 th line change thank to thanked, 2 nd page 3 rd paragraph 1 st line change the to that, add new after brand same paragraph 3 rd line change the to that, same page, 4 th paragraph, 2 nd line change to to too, same line delete committed and move that before he. Fitch moved to approve the regular June 8 th 2010 minutes with corrections and the June 15 th 2010 Special Meeting minutes, Kenney seconded, motion carried 5-0. Brundage asked for Steve Thompson, he was not at the meeting. Clerk told the Council that Thompson has now paid his bill in full. Brundage asked Clerk if she had any information that Rose Mary Saunders from Ranson Financial wanted to share with us, Clerk stated that the KDHE is working on the draft loan agreement and should have it soon; Clerk did not receive the form concerning the KIAC for Brundage to sign. Clerk asked Council about who wanted to go to the KIAC, Fitch, Reynolds, Burns, Berry and Brundage all stated they would go, Clerk will drive. Brundage asked about Marylin Ray s home, discussion was held and Council would like a weed notice to be sent. Fitch stated she would like for the job description of the lifeguard to be changed to add that they would be on-call during the two weeks of swim lessons. Clerk passed out copies of Chapter 3 from Fair Labor Standards Act for being on call. Kenney asked if Clerk could check into finding steel dog tags. McCurley stated they replaced the pump on Well 5 last month and it also had some electrical problems, McCurley stated the bill was up to $5,100 and the Layne Christensen Company are not done yet. While the problems at Well 5 were going on Well 6 was having overload problems due to water leak at HRWD. Clerk read thank you card from Harper County concerning the recent search and rescue, Clerk gave card to Fitch to post at EMS barn. Clerk went over new Ordinance 500 for dogs, Clerk stated that Judge Riggs and Chief Mendoza have approved of the ordinance as City Attorney requested. Berry moved to pass Ordinance 500, Reynolds seconded, motion carried 5-0. Clerk presented Council with Ordinance 501 to take over the property at 213 N. High to demolish the house. Berry moved to pass Ordinance 501, Fitch seconded, motion carried 5-0. Clerk stated she received a Resolution from Janis Hellard requesting support from the city to designating the Chisholm Trail a nationally designated trail. Fitch moved to accept Resolution , Reynolds seconded, motion carried 5-0. Clerk went over proposal to raise wages for city employees. Discussion was held on the issue, Fitch moved to give Janet Etheridge, Richelle Greene, Kevin McCurley Wayne Vineyard a 50 cent raise and Judge Riggs $25.00 paycheck, no seconded was made; Brundage asked for an executive session for 5 minutes and for Clerk to stay. Fitch moved to go into executive session for 5 minutes to discuss non-elected personnel requesting Clerk to stay, Burns seconded, motion carried 5-0. Council entered into executive session at 7:36 p.m., Council came out of executive session at 7:41 with Brundage stating that no binding action had been taken. Clerk stated that they needed to move the July 12 th meeting for Strategic Planning because the school board could not come, it was agreed to change the date to July 15 th. Clerk informed Council that she would be going to small claims court for service id 336. Berry asked where we were at with the empty lot on main street, Brundage stated that we were taking bids on filling it in.
