1 TERMS AND CONDITIONS OF LEISURE AQUATIC PARK DIVERTILAND Section 1 Generalities. 1.1 The hereby General Conditions (hereinafter referred to as the "Conditions of Access") reflect the conditions in which the Operator, as identified hereinafter, allows the access to the perimeter of aquatic amusement park "Divertiland" (hereinafter referred to as the "DIVERTILAND") on the basis of the Tickets (hereinafter referred to as individually the "Pass Card") to leisure service package purchased both on its web site of the Operator identified below, as well as at the Sales Office organised within the DIVERTILAND s perimeter. 1.2 These Conditions of Access are integral part of the Terms and Conditions for supplying the Tickets to the leisure services within "DIVERTILAND" aquatic fun park ("Supply Conditions") SEASON 2013 accesible at the address: The Park is organized and operated by: Park Service Expert DTL SRL, J23/1454/2011, CUI RO (hereinafter referred to as the "Operator") at its working point in Chiajna commune, Chiajna village, Ilfov County, 1 Divertismentului street, contact@divertiland.ro, telefon: Any reference to the perimeter of the DIVERTILAND excludes its parking and access roads to the DIVERTILAND and parking. 1.5 All DIVERTILAND visitors and / or users and their guests are required to comply with these Conditions of Access. Also, they will comply with the Highway Code inside DIVERTILAND parking as well as with traffic signs meanings. Section 2 Access to the Park. Operator s Rights 2.1 Possession of a Passing-Card acquired and issued under the Supply Conditions available at the following address: www. Divertiland/Supply_Conditions entitles you, up to the limited available places, within the working hours of DIVERTILAND, to access without any additional payment the following facilities available within DIVERTILAND perimeter: parking, swimming pools, sand special areas, vestiars, toillets and showers. 2.2 Your subscription for the Season 2013 is nominal and shall not be transferable. Your subscription carried out in the form of a plastic card, printed with holder s data to which a series of elements unique identification shall be added, do not take place and may not be solely used to enter the aquatic amusement park Divertiland. Access to DIVERTILAND can be achieved only on the basis of a plastic special bracelet for access (hereinafter referred to as the Bracelet") which may be obtained on the Selling Point placed within DIVERTILAND premises where the holder shall be provided with valid Pass-Card to raise it up. The Bracelet shall be issued only after checking the data for the identification of the owner of Pass-Card presented with those of the applicant.

2 2.3 For card lockers and VIP gazebos, visitors will pay at the cash desk, DIVERTILAND tariff announced by electronic display in the DIVERTILAND perimeter on the day accessing the DIVERTILAND. 2.4 The program for the operation of the DIVERTILAND is every day from 10 to 20. Access to swimming pools is allowed between 10 and 20, and access to water slides between 11 and Temporary or final leaving of the DIVERTILAND perimeter (area which excludes parking), shall mean anullment of the Bracelet without any compensation from the Operator. 2.6 All rules enclosed by these conditions shall be governed strictly in your benefit. If they seem too restrictive, or simply you don't agree with them, please do not enter DIVERTILAND perimeter. 2.7 Once you have entered the DIVERTILAND perimeter through the areas specially designed for this purpose, You willingly comply and accept irrevocably and unconditionally of all rules below that you hereby have read and acknowledged carefully. Any further claims with respect to the Conditions of Access hereto will be disregarded. 2.8 By undertaking these Conditions of Access, You hereby understand and accept that the Operator reserves its right: a) to unilaterally modify the program of DIVERTILAND operation or these Conditions of Access or close DIVERTILAND in the event of adverse weather conditions and/or in any situations that may endanger visitors, by giving a prior in this respect by any means (at or on displays within the DIVERTILAND). b) no longer allows visitors access, if there are no places available in the Park. c) to select visitors and discard from the DIVERTILAND s premises anyone who infringes any rules of these Conditions of Access. d) to limit the free access to DIVERTILAND in case of some special events; e) to take photos and film for promotional purposes; f) to waive during 2013 Season to any DIVERTILAND visitor / user, without explanations, with his/her compensation limited to amound paid for the Pass-Card. g) not to sell minors alcohol and/or cigarettes, anywhere within DIVERTILAND premises, with observance of legal provisions on this respect; h) to refuse selling alcoholic beverages to drunk DIVERTILAND users. 2.9 For more comfortable, enjoyable and secure experience within the DIVERTILAND perimeter, any holder of a valid Pass-Card, by entering into DIVERTILAND s perimeter undertake unequivocally the observance of the special norms mentioned in the sections hereinafter. The Operator shall not be liable in any manner for damage of any nature caused by failure / improper compliance by DIVERTILAND s visitors / users to perform any of the obligations undertaken below: Section 3 Special Rules of Access

3 3.1 Access to DIVERTILAND is allowed only within displayed operating hours and only on the basis of the Bracelet available at the Selling Point on the basis of the Passing-Card especially released for this purpose. 3.2 It is forbiden entering DIVERTILAND with Bracelet and/or Passing Cards belonging to someone else and/or lent to someone else. 3.3 It is forbiden entering the DIVERTILAND perimeter behind another person or having permission granted to someone else to enter using another own Bracelet. Access is strictly individually, as well as the responsibility for infringements of these rules. 3.4 Acces within DIVERTILAND perimeter is denied with food or any type of drink, refrigerating boxes, balls, mattresses, inflatable items and/or weapons of any kind. 3.5 It is forbidden access of persons under influence of alcohol and intoxicated, under influence of drugs and/or other prohibited and/or hallucinogenic substances. 3.6 It is forbidden access to green space anywhere within the DIVERTILAND perimeter, as well as in the areas expressly delimitatated as not accessible to DIVERTILAND visitators/users by significant markings. 3.7 Acces of children under 16 years of age is restricted, being possible only if accompanied by an adult and supervised throughout their stay in the DIVERTILAND including in its parking. Responsibility for observance by the children of these Conditions of Access, for the actions and integrity of children being exclusive of each parent, the Operator does not assume any obligation and responsibility in this respect. The term "parent" includes any person who uses DIVERTILAND with a child whose supervision is fully responsible, notwithstanding to the degree of kinship or affinity. 3.8 It is forbidden the access within DIVERTILAND with things for sale, with samples, advertising material, or to recruit or to interview people. 3.9 It is forbidden DIVERTILAND visitors/users to walk around in bare feet within its perimeter It is forbidden within the DIVERTILAND s perimeter its visitors to access any of its entertainment equipment without prior reading of the instructions posted on appropriately marked wooden panels, and without having a shower, first ATTENTION, accessing water slides and pools must be carried out without previously to be consumed food and drink in excess, otherwise there is the risk of heart attack. Section 4 Special Rules of Behavior. 4.1 It is forbidden to carry out any activity or inappropriate behavior which may result in personal injury or discomfort to other visitors/users of DIVERTILAND. Otherwise, the supervision and guards personnel of the Park may require leaving DIVERTILAND premises, without returning the value of the Daily Pass-Card or paying any damages. Nudism is forbidden. 4.2 It is strictly forbidden to destroy and/or damage any equipment, facilities or DIVERTILAND decoration within the DIVERTILAND premises; It is strictly forbidden even touching objects in decoration. 4.3 Anywhere within DIVERTILAND perimeter it is forbidden photography, filming or recording, without prior approval of the Operator.

4 4.4 It is forbidden entry DIVERTILAND perimeter and its parking with animals of any kind, including pets. 4.5 DO NOT LET personal belongings left unattended anywhere in DIVERTILAND perimeter, including in its parking, as the Operator assumes no responsibility for personal items unattended, forgotten or stolen. 4.6 It is strictly forbidden to introduce / use / abandonment in DIVERTILAND perimeter (on the beaches, in the pools, on water slides, or anywhere within) of any sharp, frail object which can cause injury. 4.7 In DIVERTILAND, acces or use of rollers or bikes is denied. 4.8 It is forbidden to wear jewelry, watches, glasses and other metal accessories or brittle when using the water slides. 4.9 Smoking is allowed only in places specially designated and marked areas. Inside restaurants and buildings smoking is strictly prohibited It is mandatory keeping cleaning; disposal of waste outside places specially designated places is prohibited Inflatable equipment must be used only in specially designed pools and water slides, being forbidden using/storing them in any other area It is forbidden to use the pool or slide or any facilities of the DIVERTILAND with shoes and / or inadequate clothing It is forbidden to use the pool by DIVERTILAND visitors/users who can not swim at all It is mandatory the observance of signposts and signs posted everywhere in the DIVERTILAND (including parking), as well as the guidance provided by the lifeguards and staff supervision. Moreover, it is compulsory keeping adequate distance from one another, especially when using the water slides where any departure being made exclusively under the signal of surveillance personnel (lifeguards) Jumping, diving or pushing anywhere in DIVERTILAND facilities are prohibited It is prohibited leaving parked vehicles in DIVERTILAND, after operating hours, or in other than the designated parking spaces. It it forbidden to park cars with keys in the ignition, engine running, open windows, lights on. It is mandatory for all vehicles but in the Divertiland car park to be locked It is forbidden the use of beach umbrellas in windy conditions It shall be prohibited to use pools and all of water facilities in DIVERTILAND in the event of adverse weather conditions or for any unforeseen circumstances which may endager its visitors/users It is forbidden withinin DIVERTILAND perimeter that its visitors/users to enter dressed in swimming pools and/or with food/drink.

5 4.20 It is forbidden to use pools and any other facility in DIVERTILAND having skin or contagious diseases. Whoever is entering DIVERTILAND declares to be in good health condition, without any contagious or skin deseases It is forbidden to any of the visitors to sell, advertise materials, sample, recruit or interview people inside DIVERTILAND, without the Operator s permission It is forbidden to purchase, sell, consume, possess drugs or any substance prohibited by law inside DIVERTILAND It is prohibited to act in violence, to steal personal belongings and / or to breach the law in any of it s forms. 5. Hygiene Special Requirements: 5.1 It is forbidden within DIVERTILAND perimeter the access of visitors/users with precarious medical condition, infectious or transferable diseases. 5.2 It is mandatory to use the showers before entering the pools or water slides. 5.3 It is mandatory to use only toilets, being forbidden to discharge any human fluids beyond. 5.4 It is mandatory to use only toilets for bodyly functions. Access to lockers / toilets / showers / restaurants is allowed only to persons wearing adequate foot wear. Section 6 Risks of accident 6.1 General risks of accident a. Do not use entertainment facilities and ecquipment of DIVERTILAND itself before reading and acknowledging the rules of use for each one. Rules / instructions for use are found mentioned on wood panels marked by the DIVERTILAND mascots or in other designated signage. Please note that the purpose of any limitation is exclusively intended for the security of users, in accordance of the Manufacturer instructions for operation, installation and use. b. ATTENTION within DIVERTILAND perimeter, swimming pool and entertainment equipment areas are wet surfaces causing slipping, therefore pay maximum attention to wet tile/surfaces, you can slip and fall with serious injuries and irretrievable consequences. c. Do not touch electrical wires or electrical panels. d. Do not talk on the phone or while using slides and pools;. e. Do not stay in range of entertainment equipment used by another person. 6.2 Risks of injury from showers a. Use proper footwear in the shower. Risk of slipping b. Observe space access to showers. c. Do not use in shower inebriated, in discomfort or intoxicated.

6 BE AWARE in order to limit the risk of injury in the pools and water slides and other unpleasant situations that can cause serious and irretrievable consequences, DIVERTILAND Visitors / Users are obliged to comply with all the special rules enclosed by these Terms of Access, which are presumed to have been read, understood and accepted when entering DIVERTILAND premises and / or use of any entertainment equipment of DIVERTILAND.
