Citation: CM819QKRB7 Photos Taken: YES Video General Yes/ No: Video Evidence Yes/ No: Interview Video: NO NO NO SUMMARY: On 6/ 1/ 2018 I was assisting in conducting Alcohol Compliance Checks along with checks, there were two locations Janesville Mobilizing for Change. With my found in violation, Five Points Liquor Store and the Vineyard on Mt. Zion Avenue. Two citations were issued and the Vineyard had to be shut down as no licensed employee was on the premise. ALCOHOL COMPLIANCE CHECK OPERATION: Officers from the Janesville Police Department Street Crimes Unit along with volunteers from Janesville Mobilizing for Change partnered to conduct compliance checks in the Janesville area liquor stores. Checks were completed at 23 liquor stores in Janesville. I drove volunteers, ' is 19- years old and S is 19- years old. andlimranirm. Aft Officer Fuhrmann drove volunteers and b while did separate compliance checks. IIMIIMMIDis 19- years of age and is 20- years of age. MID and MEM, were both instructed to go into liquor stores and attempt to purchase alcohol. If asked for an ID they were instructed to provide their state issued identification card. They were also instructed to tell the clerk their were asked how old they were. They were instructed real age in the event they not to lie to the clerk or make up any story about their age. FIVE POINTS LIQUOR STORE: On 6/ 1/ 2018 at approximately 7: 03PM, I dropped - and off in the parking lot of Five Points Liquor Store. They were instructed go inside and attempt to purchase alcohol from the liquor store. Several minutes later, - and IMMO came out of the liquor store with a six pack of beer and they were able to purchase the alcohol. STATEMENT OF After and came out of the liquor store, they turned over a six pack of Coors Light beer in cans. They also turned over a receipt for the transaction and the change. The the sale. went to the check out counter where_ provided his clerk looked at the ID card and continued STATEMENT OF ANGELA HERRERA: I went into the gas station and observed the female clerk, who was the only one working. I knew the clerk through prior police contacts to be Angela Herrera. Angela recognized me and asked what was going on. I explained to Angela that she had just sold alcohol to an underage individual. Angela told me she was sure that the male was 21 as she even checked the ID. She was adamant that the male was born in 1999 and knew her son, in that same year was born, to be 21. She then realized that her math was off and that the male was indeed under the age of 21. She apologized for the miscalculation and agreed that it was her error. I explained to Herrera that she would be receiving a citation for selling alcohol to an underage person. I got all of Angela Herrera' s current information and it was turned over to Officer Hageman. Officer Hageman issued the citation to Angela Herrera. We were having printer issues at the time so the citation was to be mailed to Angela Herrera. The citation issued was number CM819QKRB7. It had a non- mandatory court date of 7/ 3/ 2018 at 08: OOAM with a bond of $ The violation was sell or procure alcohol to underage person with city ordinance THE VINEYARD: On 6/ 1/ 2018 at around 7: 30PM I dropped4nom and off in a parking lot for The Vineyard on Mt. Zion Street in the City of Janesville. A few minutes later, the two came out with a six pack of Leinenkugel' s Summer Shandy beer. STATEMENT OF low AND ft After dall/bandal came out of The Vineyard they turned over a six pack of Leinenkugel' s Summer Shandy beer to me. They also turned over a receipt for the transaction as well as the change k had selected the beer from the shelf and brought it to the front counter. There was only one adult male working at the counter. The male working at the counter never asked for identification and took the money and completed the sale for the beer. STATEMENT OF MICHAEL D. KUTZ: After getting the six pack of beer and receipt with the change, I went back into the store and made contact with the male at the counter. The male identified himself as Michael D. Kutz. I explained to Kutz that a violation had occurred where he told to an underage male. Kutz' s response was " I knew it. " He apologized for the violation and told me that he had a feeling the male was underage. The store was so busy at the time that he cut a corner which he now regrets. In over 20 years of working part- time at the liquor store he has never had a single violation. He agrees that selling to minors is wrong and told me he understands he will be receiving a citation and he deserves it for his actions. apologetic and expressed remorse for his actions. I explained to Kutz was very Kutz that he would be receiving a citation under the violation of selling of procure alcohol to underage persons. Kutz gave me all of his information and was unable to provide a liquor license for the store. He told me he has never had one and there was nobody else there working that did have one. CITATION: Kutz was issued citation CM819QKRB9. That had a non- mandatory court date of 7/ 3/ 2018 at 08: OOAM with a bond of $ The violation was for selling or procure alcohol to underage person under city ordinance Kutz advised

Because no one on the premise was licensed to be selling alcohol, Officer Hageman stood by while arrangements were made to get a licensed person to the store. We were unable to find a licensed person to respond so this store had to be shut down with all the customers escorted out until someone with a license was on site. FOLLOW- UP: At this time, no further follow- up is needed and this can be closed. End of report. Follow- up: NO KML
