The original purpose of the policy was to facilitate communication and cooperation between East Frederick Little League and the neighboring residents. The policy includes conditions relating to lighting, field maintenance, the public address system, etc. Specifically, the 2007 policy stipulates that the field's public address system can be used only for opening day ceremonies and all star games, and does not give any consideration for its use at regular season games or special games such as the "Challenger" game. SCOPE: The proposed resolution will effect the following changes: (I) Allow East Frederick Little League the use of the public address system for all games, including opening day, regular season games, all star games, and special games such as the Challenger game; (2) Require the public address system to be tumed off when the lights go on, but no later than 8 p.m. for all games, except for the Challenger game, at-which the public address system must be tumed offby 8:30 p.m. This will allow the participants of the Challenger game to play under the lights, as that game starts about 15 minutes later than regular games; (3) Prohibit the PA system from being used before 9 a.m.; and (4) Change the community liaison from the Community Outreach Assistant to the Community Ouh'each Specialist (or other individual designated by the Mayor). All other conditions will remain the same. 3 THE CITY OF FREDERICK MAYOR AND BOARD OF ALDERMEN RESOLUTION NO: A RESOLUTION concerning The Max Kehne Park Little League Baseball Field Standards Policy WHEREAS, The City of Frederick ("Cityn) encourages the responsible use of its baseball fields by little league baseball teams; and WHEREAS, East Frederick Little League is a regular user of the baseball fields in Max Kehne Park; and WHEREAS, the Mayor and Board of Aldermen have the authority to adopt policies to regulate the operation of City parks, recreation areas, and facilities; and WHEREAS, on March 23, 2004, the Mayor and Board of Aldermen approved Resolution No , which adopted the Max Kehne Little League Baseball Field Standards Policy; and WHEREAS, on July 19, 2007, the Mayor and Board of Aldermen approved Resolution No , which amended the Policy in accordance with a request by East Frederick Little League relating to the start tinle of games and the use of the public address system; and WHEREAS, East Frederick Little League has once again requested that the Policy (as previously amended) be revised in certain respects, which request again relates to the use of the public address system; and WHEREAS, on June 11, 2013, the City's Parks and Recreation Commission voted to recommend to the Mayor and Board of Aldermen that the Policy (as previously amended) be revised in accordance with the request of East Frederick Little League. NOW THEREFORE BE IT RESOLVED by the Mayor and Board of Aldermen of The City of Frederick that the Max Kehne Park Little League Baseball Field Standards Policy, attached hereto as Exhibit A and incorporated herein by this reference, is hereby adopted; and BE IT FURTHER RESOLVED that Resolution No is hereby repealed, and that the Max Kehne Park Little League Baseball Field Standards Policy adopted thereby is of no further force or effect. The public address system must be tullled off when the lights go on, but no later than 8 p.m. for all games except for Challenger games, at which the public address system must be turned offby 8:30 p.m. 5. The public address system may not be used before 9 a.m. 6. The public address system volume shall be in compliance with City and State noise regulations at all times. 7. The public address system shall only be operated by an adult. 8. Public address system speakers shall be directed down toward the stands, not out toward the residential neighborhood. 9. No scheduled evening game shall begin later than 6:30 p.m. (except for Challenger games, which begin at approximately 7:15 p.m.), and no inning of any game shall begin after 9 p.m.

All field users shall instruct parents, coaches, and other spectators to park in the Seventh Street parking lot, not on nearby residential streets. Announcements will be made prior to each game that parents, coaches, and spectators are to park in the Seventh Street parking lot, not on nearby residential streets. 12. The City's Community Outreach Specialist (or other individual designated by the Mayor) shall be the community liaison between field users and neighbors. 13. No personnel except for City employees may perform any work or any type of field improvements on the Max Kelme Little League field after 9:45 p.m. any night or before 9 a.m. on Saturdays and Sundays. 14. Compliance with the foregoing conditions will be monitored by the City. Failure to comply with such conditions may result in the loss of field usage privileges.

6 A RESOLUTION CONCERNING THE CITY OF FREDERICK MAYOR AND BOARD OF ALDERMEN RESOLUTION NO: The Max Kehne Park Little League Baseball Field Standards Policy WHEREAS, The City of Frederick encourages the responsible use of its baseball fields by little league baseball teams; and WHEREAS, East Frederick Little League is a regular user of the baseball fields in Max Kehne Park; and WHEREAS, the mayor and board of aldermen have the authority to adopt policies to regulate the operation of city parks, recreation areas, and facilities; and WHEREAS, on March 23, 2004, the mayor and board of aldermen approved Resolution No. 04-5, which adopted the Max Kehne Park Little League Baseball Field Standards Policy ("the Policy"); and WHEREAS, East Frederick Little League has requested that the Policy be amended to allow games to statt no later than 6:30 p.m., instead of 5:45 p.m. and to allow for the use of the public address system during Opening Day Ceremonies and All Star games upon approval by the Parks and Recreation Department; and WHEREAS, on March 21, 2007, the City's recreation and parks commission voted 8-1 to recommend to the mayor and board of aldermen that the policy be changed to allow games to start no later than 6:30 p.m. NOW THEREFORE, BE IT RESOLVED that the mayor and board of aldermen hereby adopt the attached Max Kehne Park Little League Baseball Field Standards Policy. NOW THEREFORE, BE IT FURTHER RESOLVED that Resolution No is hereby rescinded, and that the Policy adopted thereby is of no further effect. 7 Amended Policy Adopted by Resolution 07-19, July 2007 Replaces Policy Adopted by Resolution 04-5, March 2004 Max Kehne Park Little League Baseball Field Standards Policy The Mayor and Board of Aldermen have enacted this policy to ensure responsible field usage for all users of the little league baseball field at Max Kehue Park and to protect the quality of life for the neighboring community. The stipulations listed below apply to all users of the little league field. Failure to comply with this Policy may cause the forfeiture of usage privileges. 1. 8 MINUTES: JUNE,a) 10'3 PAR\(S ~ RfCP-EAT'ON COMMISSIoN R. Myers stated he has met with the owner/development and staff is happy with what has been presented. Motion by R. Fox to recommend to the Planning Commission to recommend approval ofthe proposed Keller Properties parkland dedication; 2ndM. Long ALL in favor. ~ 3. Review and discussion of a request to change the Max Kehne Park Little League Baseball Field Standards Policy for East Frederick Little League, City Resolution Michelle Bowman of the Frederick Police Department Community Outreach. Proposed changes to the existing agreement by number are: 3. The public address system may be used for Opening Day ceremonies, All Star games, Challenger game and regular season games played Monday through Saturday. The PA system will not be used on Sunday's. 4. The public address system will be unned off when the lights go on, but NO later than 8:00 p.m. for all games and activities except for the Challenger game which the P A system must be turned off by 8:30 p.m. 5. Myers offered some history on how this agreement came to be. Back when East Frederick Little League (EFLL) proposed adding lights to the Max Kehne Park baseball field, there was a long drawn out process with the residents in coming up with an agreement. At the time, the City was meeting with all four (4) little leagues in the beginning of each year to work out ball field materials (lime, ulrface, etc.) and field day schedules. At the same time we would go over the special agreement with EFLL for many years. During the Holtzinger administration, it was detelmined to not have EFLL sign an agreement evely year but to make the agreement a Resolution which would not have to be signed annually. The residents who did not follow this change did not understand why the agreement was not be signed ammally; since then the Resolution is posted in a frame in the Press box, laminated copies are posted at the concession stand and EFLL has it posted on their website. Michelle Bowman has stepped up to help to make this agreement/resolution right for all involved. M. Bowman offered that they have spoken to a lot of residents and sent information out to both NAC 6 and 9. Only one person had issues with it and all others did not have issues. It makes sense to let EFLL use the PA system as allowed by the Resolution. Resident Sarah Heald expressed thanks to Michelle Bowman about the meeting tonight. She wanted to echo that the posted rules were the most absurd thing when they read them about the loud system was just to be used twice a year so she was really glad to have the opporttmity to change that. They like having the little league there. As long as the P A system is at a good level, she does not mind hearing it evely day of the week until the lights come one. Molion by J. Myers to recommend to the Mayor and Board of Aldermen to accept the proposed changes to the Max Kehne Park Little League Baseball Field Standards Policy (Resolution 07-9); 2 nd by J. Grove ALL ill favor. Mr. Joey Pritchard, EFLL President, asked that since the City Tournament is going on this week could they use the PA system this week. M. Bowman stated to go ahead and use the PA system for the All Star Games. 2

9 Mr. Mike Long, Commission member, stated he was out at the field on Saturday before the game talking to a few neighbors who were training their dog and some that were outside their houses asking how the little league has been treating them. All said they are glad the kids are playing sports instead of getting into trouble in the neighborhood. In going over to Atlantic, he obsetved kids running to the ball field because they were late. That is the way he remembered it, was glad to hear it has not changed and glad that there is a good relationship with the neighbors. It's tough because if one neighbor misunderstands what is going on and you have a league member that misunderstands what a neighbor is saying, then there is an issue. At that point, complaints go to the City and it becomes a "he said, she said" issue. It is a great thing when the neighbor's and the little league work together. R. Myers stated that Randy Knight's tenn on the Commission has been completed and he will not be returning. We thank him for his service over the years.
