7 I. Background 1. The (Loan 2969-VIE) was implemented in the provinces of Quang Tri and Tay Ninh. The objective of the project is to promote the transformation of the transportation corridors in the Greater Mekong Subregion into a comprehensive economic corridor by improving urban infrastructure and institutional capacity building within the selected corridors. The project is implemented in three urban corridors: Dong Ha city, Lao Bao town, Khe Sanh town (in Huong Hoa district) Quang Tri province and Moc Bai city in Tay Ninh province. 2. In Quang Tri province, the project is implemented in Dong Ha city and Huong Hoa district (Lao Bao and Khe Sanh towns), which are on East-West Economic Corridor (EWEC). Currently, there are 07 updated Resettlement Plans/Resettlement Ethnic Minorities Development Plans(uRPs/uREMDPs), including: (i) urp for Thanh Nien and 2 to Dong Luong, Dong Le; (ii) urp for Ba Trieu and Hoang Dieu s; (iii) urp for Truong Chinh ; (iv) uremdpforthe along Se Pon River, Duy Tan-Cao Viet-Tan Kim (To Huu), Cluster-4 (Doan Khue and Truong Cong Kinh); (v) uremdpfor Hung Vuong and flooded s; (vi) uremdp for the solid waste collection and treatment in Huong Hoa district (Lao Bao dumping site) and (vii) urp for Dong Ha river embankment. 05 urps/uremdpsreceived non-objection letters from the ADB, and the urpsfor Dong Ha river embankment and Huong Hoa district solid waste collection and treatment are in the approving process. In addition, the urp for Le Thanh Tong is in the establishing process. There is land fund for the construction of the recycling facilities in Dong Ha city, therefore it is not necessary to set up a Resettlement Plan for this component. 4. The compensation, support and site clearanceis being implemented in all construction components of Quang Tri subproject. Dong Ha river embankment and the solid waste collection and treatment in Huong Hoa district have completed the DMS and are waiting for the urp approvalto carry out the next steps of compensation. Le Thanh Tong is the latest component but is implementing the DMS. II. Objectives, tasks and methods of monitoring 5. The independent monitoring for this report was conducted in September and ended on 28/9/

8 6. The composition of the independent monitoring team consists of 4 people, including 01 resettlement specialist and 03 support staff Objectives and tasks 7. All independent monitoring activities for site clearance aim at achieving the objectives set out in the updated Resettlement Plan of the Project, where the most importance is to ensure the entitlements and benefits of the project affected households and theirlivelihood rehabilitation. 8. Specific objectives and tasks include: Monitor the implementation, management and keeping of records and documents at the offices; Monitor the compliance of the implementation of compensation, support and resettlement for the affected households/organizations with the Project s updated Policy Framework and urps; and Review and propose measures to resolve issues that arise during the site clearance of the affected organizations/households. Update the resettlement progress of the Project, including the dissemination of information and community consultation, DMS, resettlement planning, payment of compensation, support, provision of resettlement land and the implementation status for displaced households as well as the income rehabilitation programs etc.; Review of the compliance of the compensation and support with the approved Project s urp and the Project s Policy Framework; Assessment of the affected people s participation in the resettlement as well as their satisfaction on the resettlement, in particular, and the project, in general; Comparison of differences in number of affected households, compensation values between the urp and actual implementation; Identification of shortcomings in the implementation of resettlement, causes and recommendations for resolution; Suggestion of solutions in need to improve the efficiency. 9. In this independent monitoring stage, of the implementation of the Resettlement Plan focuses on the following: Update the urp implementation progress in all components of GMS Quang Tri subproject; Monitor the components that have paid compensation, including: Dong Ha city: (i) Thanh Nien ; (ii) 2 to Dong Le, Dong Luong; (iii) Ba Trieu ; (iv) Hoang Dieu ; (v) Truong Chinh ; Huong Hoa district: (i) the along Se Pon River; (ii) Block 4 (Doan Khue and Truong Cong Dinh); (iii) To Huu ; and (iv) Flooded s Methods 10. The qualitative, quantitative and field observation methods were selected for monitoring and evaluation. Specifically, the monitoring team carried out the following tasks: Working at the PMU and the LFDC offices: 7

9 Review documents at the offices such as the DMS records by the LFDC of Dong Ha city and the LFDC of Quang Tri province and the LFDC of Huong Hoa district; Compare benefits of APs with the benefits proposed in the approved urps; Review the pricing and the calculation ofcompensation and support values of each type of affected asset which form the total values of compensation and support for the affected people to determine the accuracy of the compensation plans. Review if the compensation and support pricingwas based on the replacement costs of the sub-project; Interview and discuss with key staff of the PPMU and the LFDCs, including: Leaders and specialists of GMS Quang Tri PPMU s site clearance team; Site clearance officers of Quang Tri LFDC and Dong Ha LFDC. In these discussions, the Consultant monitored the following issues: (i) the general progress of the project, including the compensation implementation; (ii) advantages and disadvantages in the implementation process; (ii) shortcomings in the urp implementation; (iv) Complaints, inquiries and settlement status etc. Field monitoring: Interview and discuss with local authorities, communal cadastral officials and village/hamlet/village officials to discuss (i) the project implementation process (information disclosure, DMS results, compensation payment, site clearance status); (ii) community s consensus with the project; (iii) shortcomings; Questionnaire survey was conducted with 100% of severely affected households and 20% of the total affected households. Accordingly, the survey was conducted with 436 affected households, of which 233 are severely affected (affected houses and lost from 10% of productive land) and 203 are lightly affected. Of the surveyed households, 18 are poor (4.12%), 12 are ethnic minority (2.75%) and 26 are vulnerable (5.96%). The monitoring was carried out at all compensation and supportpayment by the PPMU and the LFDCs The progress 11. Monitoring results 3.1. Desk study 12. The monitoring team worked with theppmu and the LFDCs of Quang Tri and Dong Ha and the LFDC of Huong Hoa district.there, the team accessed to compensation documents and legal documents related to compensation and site clearancefor Quang Tri subproject. The monitoring results show that the offices have kept full project documents likedecisions on promulgation of compensation unit prices and approval of compensation plans, minutes of DMS, resettlement, compensation and support plans, minutes of compensation payment signed by the affected individuals/organizations. 13. The minutes of DMS were prepared according to the project form, clearly showing the quantity of affected asset. The compensation planswere clear and transparent, whichclearly show the quantity, unit prices and value of assets. The monitoringteam randomly checked 20% of the compensation plans and found that all were checked withouterrors. 14. The compensation dossiers are archived scientifically and convenient for reference Information dissemination and community consultation 15. The dissemination of information and community consultation are carried out by GMS Quang Tri PPMU in collaboration with the officers of the communes/wards and maintained throughout the project implementation. 16. During the RP update period, along with the implementation of the DMS, a socioeconomic survey was conducted by the Independent Monitoring Consultant for all Quang Tri subproject components. This survey was conducted with 100% of severely affected households and vulnerable households according to the definition by the Donor. The dissemination of information and public consultation in the implementation phase was paid with special attention, especially the consultations before the DMS and the public listing of DMS results as well as compensation plans. During this phase, at least 2 consultations were conducted for each subproject component. In addition, after the publicly listing of DMS results and compensation plans, the PPMU and the LFDCs regularly hold meetings, dissemination and explanation of the DMS results or resettlement, compensation and support plans. 17. The contents of information to be transmitted include: General information about the project such as Project Owner, Donor, total investment, project components, compensation 10

12 prices, data on damages of affected households, benefits of compensation and support, implementation plan likedms time, compensation payment time, construction time. The differences between the ADB Policy and the Vietnamese Law as well as the policies applied to Quang Tri subproject were mentioned in the consultations. 18. The forms of information include: information through the media, information through loudspeaker systems, community consultationsby the PPMU and the consultancy units, participating in the IOL and SES surveys and public listing etc. 19. The survey results on the project dissemination show that basically AHs received theproject information and know well about the damage data, the unit prices applied by the subproject and the benefits and entittlements of compensation, support they are entitled to. The following survey table will reflect this. The detailed measurement survey (DMS) and the compensation planningfor GMS Project of Quang Tri province were conducted by Quang Tri LFDC, Dong Ha LFDC and Huong Hoa LFDC. 22. In order to carry out the DMS, DMS team of the LFDCs was established, including: PPMU representatives, LFDC members, representatives of affected villages/hamlets and representatives of the People's Inspectors. The DMS wasimplemented publicly and transparently. Before carrying out the DMS, through the local authorities, the PPMU and the LFDCs informed the DMS plan to the affected households in orderthat they could take time to join the DMS team, thus limiting confusion, errors or questions about DMS results. 23. As mentioned above, the DMSfor all works has been basically completed, except Le Thanh Tong, which is in the process of implementation. Accordingly, there are 2,061 households/organizations (hereinafter referred to as households) affected by the subproject, in which the construction works in Dong Ha city affect 1,086 households and the construction works in Huong Hoa district affect 975 households. Compensation plan is not approved. 24. The number of households in reality compared to the RP differs by 28 households. The cause of the difference is mainly due to the fact that the subproject does not invest in Cao Thang (in the coponent of flooded s). Other routes do not substantially differ. 25. In terms of the DMS implementation, among 436 interviewed households (98.85%) 431had household heads or household members directly involved in the DMS process. In terms of the DMS results, 429 households (98.39%) said that the DMS was sufficient compared to the actual assets, only 7 households (1.61%) said that the DMS was incorrect or missing withwrong type, size etc. 26. In terms of publicity, 433 households (99.31%) said that the DMS was open and transparent with the participation of many stakeholders, including representatives from residential areas and affected households. They also said that the DMS plan was announced in advance therefore they could take time to join, only 0.69% (03 households) said thatthey did not known before the DMS plan, therefore they could not participate. After the DMS finished, the DMS minutes were approved and signedby the stakeholders, including the household represetatives. The details are in Table 3. 14 Approval of compensation plan and payment Approval of compensation plan 27. Among 14 construction components in Quang Tri province,apart from the construction of the recycling facilitywhich is not engaged in land acquisition, 13 componentsmust carry out resettlement. At present, the subproject has approved the compensation, support and resettlement plans for10 works: (i) Thanh Nien ; (ii) 2 to Dong Luong - Dong Le; (iii) Truong Chinh ; (iv) Ba Trieu ; (v) Hoang Dieu ; (vi) Hung Vuong ; (vii) Flooding s; (viii) Cluster-4 (Doan Khue and Truong Cong Kinh, (ix) the along Sepon River, and (x) Duy Tan-Cao Viet-Tan Kim (To Huu ). Other works: (i) the solid waste collection and treatment system in Huong Hoa district, (ii) Le Thanh Tong, and (iii) Song Hieu river embankment has not been approved due to waiting for the RP approval or under the DMS implementation process. 28. However, for the subproject components that completedthe DMS, due to the progress requirement, the PPMU and the LFDCs did not develop and approve the compensation plansfor the whole routesbut section by section. Accordingly, out of the 2,061 affected households joined in the DMS (excluding Le Thanh Tong which has not implemented the DMS), now 1,587 compensation plans were approved (77%), of which Huong Hoa district approved for 931/975 affected households (95.48%) and Dong Ha city approved 656/1086 affected households (60.4%). 29. At present, in Huong Hoa district, only the compensation plan for thesolid waste collection and treatment system has not been approved, other works have been approved. However, in Dong Ha city, apart from the compensation plans ofhieu River Embankment and Le Thanh Tong have not been approved, other works have been approved. The details of the implementation of the compensation plans are presented in Table The compensation and support plans are developed pursuant to the policies specified in the urps and in line with the project policy framework. The unit pricesapplicable to calculate the compensation and support are based on the replacement costs established by the Consultancy Unit and approved by Quang Tri Provincial People's Committee. 31. The consultations with the communal leaders as well as the AHs on the compensation,support unit prices of residential land, agricultural land, buildings and crops show that most of them have the same opinion that the unit prices of the subproject is reasonable and acceptable. For this assessment, from 86% to 94% of the households whose residential land, agricultural land and crops are affected accept the compensation prices, onlythe rating for the prices of houses and buildings is lower ( 70.4%). The number of households evaluating the prices as equal to market ratesis low at 1% to 4%; for all types of assets, below 10% of the households said that they are slightly lower than market prices;from 2.16% to 17.6% said that the compensation prices are too low and unacceptable, of which the highest is relating to the unit prices of works and structures (17.6%), while other assets isbelow 10%. 18 32. At present it is too early to compare the number of households and the compensation value between the approved urps with the actual implementation of the whole Project. The comment above is because there are only 5/13 components which basically completed the resettlement plan (in Huong Hoa district), 08 components are still in the implementation stage, in which some components are preparing compensation plans and even some components are implementing the DMS (Le Thanh Tong ). 33. However, it is preliminary comparison that the components was basically completed in Huong Hoa district without major change. Accordingly, the number of affected households was only changed in 2 components: Cluster-4 (reduces 3 households) due to the adjustment of the design to reduce damage to people and the flooded s reduce 28 HHs because the Project does not invest in Cao Thang (Lao Bao town). In terms of value, for all 4 components in Huong Hoa district, the compensation reduced. The main reason is narrowing the scope of land acquisition. However, the exact comparison was made only for 2 works, Cluster-4 and To Huu, which completed the compensation, support and site clearance and rewarded for timely site clearance. In addition, for Hung Vuong and flooded s, although the compensation plans for the whole routes completed, the reward for timely site clearance have not been approved, therefore the compensation data for these routes is not final. 34. For Dong Ha city, among 07 components of works, no-one completes the compensation and site clearance on the whole. According to the preliminary statistics of these routes, the compensation plans for 430 households have not approved, not including Le Thanh Tong route which has no data on the number of affected households as the DMS is not completed. The comparison in Dong Ha city will be resumed in the next monitoring report. The details of households, compensation value between urp and actual implementation is shown in Table The payment of compensation, support 35. The total approved amount of compensation, support and resettlement of 10 routes is VND 223,976, 922,000 (This amount does not include 2% of operation cost for LFDCs). The compensation and support funding for the routes in Huong Hoa district is VND68,394,387,000 and Dong Ha city is VND155,582, Up to now, the compensation has been paid to 1,533 households (96.59%) with the amount of VND 204,000,544,000 (91.08%), of which for the s of Huong Hoa district the compensation includes 895 households (96.13%) with the amount of VND 59,976,208,000,for Dong Ha city the compensation includes 638 households (97.26%) with the amount of VND 144,024,336,000 (92.57%) The households that have not received money and reasons 37. Up to now, out of the total number of households whose compensation plans were approved, there are 54 households (3.40%) with the amount of VND 19,976,378,000 (8.91%) have not been paid, in which Huong Hoa has 36 households (3.87%) with the compensation amount of 8,418,179,000 (12.30%) and Dong Ha has 18 households (2.74%) with the amount of VND 11,558,199,000 (7.43%). 38. There are groups of causes leading to households not receiving compensation: (i) Low compensation prices (29 households); (ii) Waiting for resettlement land plots/disagreement with resettlement plots (2 households); (iii) Proposing for allocation of resettlement land (5 households); (iv) Proposing for rechecking affected asset (4 households); (v) Disagreement with the land classification in compensation plans/proposing 15

19 for land compensation (4 households); and (vi) 10 households were absent at the compensation payment, therefore they have not received their compensation money. 39. The details of the number of households, compensation and support amounts that were approved and paid andthe number affected people who have not received compensation money are shown in Table 5. The list of households who have not received compensation is presented in Appendix Resettlement 40. Up to now, the Subproject identified150 affected households, in which 37 fully affected households have no land for rebuilding housesand have tomove to Resettlement Site, 113 other households have sufficient remaining land, therefore they resettle on site and built and repaired houses on their remaining land. The above figures are calculated for the cases whose compensation planswere approved. 41. For the households whose houses are affected, in addition to compensation, support pursuant to thesubproject s unit prices and policy, if they do not have sufficient land to rebuild houses, they will be relocated to Resettlement Sites. As Quang Tri GMS sub-project has a small number of relocated households and people are dispersing, Quang Tri province has been planning and constructing Resettlement Sites for relocation and resettlement of affected households when implementing projects in the province,therefore, Quang Tri GMS sub-project does not design new Resettlement Sites but uses existing Resettlement Sites in Quang Tri province, Dong Ha city and Huong Hoa district. 43. The displaced households selected Resettlement Sites according to their aspirations and the list prepared by Quang Tri GMS PPMU and Huong Hoa District for the subproject. Accordingly, 06 resettled households affected by Hoang Dieu will enter the Northern Resettlement Site of Hieu River. At present, they have selected resettlement plots and the City LFDC is finalizing the dossiersfor submission to the People's Committee of Dong Ha city for approving the resettlement plan. 44. For Ba Trieu, 03 affected householdswill move into the Resettlement Site of Block 2 of Khoa Bao and Thanh Co s. At present, Quang Tri GMS PPMU and the Provincial People's Committees are compiling dossiers and procedures for the households that select resettlement plots. 45. The relocated households (4 households) affected by Thanh Nien and 2 to Dong Le - Dong Luong will be allocated in Resettlement Sites: 3 households in Block 5 of Dong Le ward (the households affected by 2 to Dong Le - Dong Luong) and 01 household (affected by Thanh Nien ) to the SouthernResettlement Site of Dong Ha city. The process of division of resettlement plots is still ongoing.the households have not moved to the Resettlement Site. 46. In Huong Hoa district, the concentrated resettlement households affected by the construction in Lao Bao town include:the along Sepon River, the flooded s,are arranged intheresettlement Site of Cao VietCluster. At present, the subproject has completed resettlement land for them. They received and moved to resettlement land and handed over their acquired land to the Project for construction. 47. The concentrated resettlement households affected by construction in Khe Sanh town include Cluster-4 (Doan Khue and Truong Cong Kinh), Hung Vuong are relocated at Hung Vuong Resettlement Site. At present, the subproject is carrying out necessary procedures to prepare resettlement land for the households. 48. It can be said that the pace of allocation of resettlement land for the affected households is slow, which isone of the causes to the subproject delay.however, the Project does not have to provide additional rental assistance to households who have not been allocated resettlement land because they have neither received resettlement land nor handed over site for the Project. 17

21 49. Currently, most households that resettle on their remaining land cleared the site, built/repaired houses and stabilized their lives. For these households, their lives are not affected much because they do not have to move. The monitoring team went to the site and took pictures of the new houses or built-up works of these households (Appendix 5.5).All 113 households that have to build and repair houses do not have to rent houses during construction because they can take advantage of the rest of their houses which are not demolished or live with relatives Livelihood, Gender and Ethnic Minorities Program 50. The Income Rehabilitation Program of the subproject has been integrated through the compensation, support and resettlement of the subproject such as support for living stabilization of the severely affected households (lost from 10% of productive land or income), support for job change and looking for new jobs for households whose agricultural land is acquired, support for business affected households, special support for vulnerable groups (7,000,000 VND/household). The support for the households whose business is affected has been paid, too. Accordingly, the affected households would be provided with one time allowance in cash as follows: (i) For affected households that have business registration, the support is 70% of excise tax; (ii) For households that don t have business registration, the support is 70% of the minimum excise tax (693,000 VND/household). 51. A separate Income Rehabilitation Programhas been developed for Quang Tri GMS Subproject. Accordingly, the support activities have been implemented: - Training on improving knowledge and skills related to the following contents: Business planning and small business start-up; Use of compensation money to make profits; - Support to practice breeding models: goats, chickens, pigs: Training on transfer of goat, chicken and pig breeding techniques; Allocation of goats, chickens and pigs to affected households; - For the s of Sepon River, To Huu, Cluster-4, 54 households received breeding chickens. Each household received 23 chickens of 21-days-old which were vaccinated and quarantined according to the regulations, 01 feeding trough and 01 water trough. 22 households received piglets. The level of support for the breeding model is 1,500,000 VND/household; - For 43 households living in Ka Tup hamlet, each household received 2 breeding goats, with an average weight of 8-12kg/head, the average support level is 4,000,000 VND/household. 52. Participants in the Income Rehabilitation Program are severely affected households (affected houses or houses lossing from 10% of productive land), vulnerable households and affected business households. 53. According to the DMS as well as the survey results for the development of the income rehabilitation program for the whole project (excluding Le Thanh Tong which is being in DMS implementation, therefore the data is not updated), there are 712 households participating in the income rehabilitation program, in which Dong Ha has 489 households and Huong Hoa has 223 households. Classified by subjects, there are 183 households whose houses are affected, 210 households which lossing from 10% production land or income source, 223 vulnerable households, and 96 households whose business is affected. 54. Currently, the income rehabilitation program has been implemented for 9 components: (i) Thanh Nien ; (ii) 2 to Dong Le, Dong Luong; (i) Ba Trieu 18

22 No. ; (iv) Hoang Dieu ; (v) the along Sepon River; (vi) To Huu ; (vii) Block 4 ; (viii) Hung Vuong ; and (ix) flooded s. The number of households participating in the IRP of these 9 components includes 551 households. However, in practice, there are only 484 households because some households may belong to different groups of participants in the IRP. For example, a household may suffer from both lossing houses and lossing from 10% productive land and/or subject to vulnerable groups and/or subject to affected business. 55. According to the present data update, 133 households have affected houses, 96 households loss from 10% of their land, 181 households are vulnerable households and 74 affected business households, which have participated in the Income Rehabilitation Program of the Project. The detailed data are presented in Table 7. The seed distribution has been completed in Huong Hoa district (except the solid waste collection and treatment component). For Dong Ha city the seed distribution have been completed for four s of Thanh Nien, 2 to Dong Le - Dong Luong, Hoang Dieu and Ba Trieu. Other works includinghieu River Embankment, Truong Chinh, Le Thanh Tong have not yet implemented. 57. The number of households involved in the Income Rehabilitation Programincludes 484, of which Huong Hoa district has 201 households and Dong Ha city has 283 households. The number of breeding animals which have been allocated is 12,300, of which the number of chickens is 121,922 (419 households); the number of pigs is 22 (22 households) and the number of goats is 86 (43 households). Monitoring the compensation plan, we can affirm that the income restoration program as well as the community consultation and the policies set out in the urp/uremdp for vulnerable groups were fully implemented by GMS Quang Tri PMU. 60. At present, it is too early to evaluate the effectiveness of the Income Rehabilitation Program because the livestock provisionhave been implemented for about one month. However, during the monitoring, we preliminarily assessed the program through questionnaires to the households. Learning whyit is ineffective, we know that among 37 households, 21 households (56.8%) whose animals were dead from disease, 12 households (32.4%) said due to poor quality of seeds and 4 households (10.8%) said that the animals are not good at climate The general assessment of the implementation of compensation 62. It can be said that up to now the implementation of the Resettlement Plan of the, Quang Tri subproject has achieved above 2/3 of the workload. However, the activities related to this work are still 20

24 No ongoing, therefore the understanding of AHs' assessment on compensation, support and resettlement plays a very important role. The results of this assessment will help the project implementers to have a holistic view and draw experiences in the implementation process. 63. During the September 2017 monitoring period, the Independent Monitoring Consultant sought to the assessment of people's perceptions of all aspects of the project from disclosure of information, DMS, income rehabilitation, compensation, to the issues related to the implementation process, complaints and grievance redress as well as the satisfaction of the AHs. The details are intable 8 below. 64. The overall satisfaction of compensation is rated good, when respondents said that they are pleased, 12.16% said that they accepted, and only 3.9% said that they are unpleased. 65. Assessing according to the criteria, we learn that the information dissemination and community consultation of the subproject was highly appreciated, when 51.15% are totally pleased, 7.8% are pleased, 41.06% are acceptable, no one are unpleased or very unpleased about this. Next to the DMS, 39.45% of the households are very pleased, 14.45% are pleased, 44.72% are acceptable, and only 1.38% is unpleased. 66. The affected people s assessment is not high in relation to complaints and grievance redress, compensation costs (in particular compensation for buildings and residential land) and support for income rehabilitation. Accordingly,regarding complaints and grievance redress, among 17 households that complained, 11 households (64.71%) are unpleased, 03 households (17.65%) are very unpleased, and 03 are acceptable. At a lower level, 16.54% of the households are unpleased about the unit prices of structural compensation, while the very unpleased figure is 3.94% and the acceptable figure is 40.16%. Similarly, for the supports and Income Rehabilitation Program, 13.29% of the households are unpleased, 38.73% are acceptable, however, the satisfaction of the people remains high (47.98%). The households that are unpleased due to deadanimals or because their animals do not grow. The details are referred to Table 10. Quang Tri PMU, Dong Ha DRC, Huong Hoa DRC, and CPCs where the subproject runs through were very concerned with the expectation and questions of people related to the subproject implementation. So any complaint or question of AHs could be conveyed to authorized agencies in the following procedures: 68. AP might address a complaint/grievance related to the compensation, land acquisition to the CPC in writing or verbally; and within 15 days upon the receipt of such the complaint/ grievance, CPC would hold a informal meeting between the AP and the chairman of the CPC to hear to problem; 69. If the CPC could not address the AP s concerns to his/her satisfaction, such the complaint/grievance could be raised to the DPC. Within 30 working days from the receipt of the complaint/grievance, the DPC would give the decision; 70. If the DPC could not address the AP s concerns to his/her satisfaction, such the complaint/grievance could be raised to the PPC. Within 30 working days from the receipt of the complaint/grievance, the PPC, together with PRC and PIU would give the decision. 71. If AP still did not satisfy with the PPC s decision, they could submit the case to the Provincial People s Court. This is the final source to deal with the compliant/grievance. 22

26 72. In fact, during the land acquisition and compensation process, most of complaints of AHs were solved up by DRC and CPCs at the commune level, so none of them had to log to higher level. 73. There are 31 complaints from AHs to the Compensation and Site Clerance Committee. At present, 30 cases have been resolved and all agreed with the Project s solutions except one case that has just sued the complaint and is in the settlement process. IV. Conclusions and Recommendations 4.1. Conclusions 74. The implementation of compensation, support and site clearance of Quang Tri GMS subproject is being implemented simultaneously in all construction components. Due to the demand for progress to avoid the rainy season, the PPMU and the LFDCs participated in the compensation, which have been divided into phases in each components of works. At present, the compensation workloadhas been completed about 80%.The Income Rehabilitation Program has been implemented.the construction of some components have been allowed. 75. The DMShas beencompleted for 12 construction components throughout Quang Tri sub-project, except Le Thanh Tong, which is implementing the DMS. Accordingly, the total of 2,061 affected households wereparticipated in the DMS, of which thecompensation plans of 1,587 households were approved. At present, the compensation has been paid to 1,533 out of 1,587 affected households whosecompensation plans were approved, while the rest of 54 affected households have not received compensation. 76. The activities of the Income Rehabilitation Program have been implemented. Accordingly, 484 households have joined in the Project sincome Rehabilitation Program. Apart from the training and capacity building, the households participating in the program wereprovided with breeding livestock, including: Chickens, Pigs and Goats. However, the preliminary assessment of the Income Rehabilitation Program shows that the program has not been as effective as expected as breeding animals died many and in some households their breeding animals died all, especially chicken. 77. The compensation, support and resettlement complies with the urps/uremdpswhich were approved by the ADB and Quang Tri PPC. 78. The compensation and support unit prices were made on the basis of replacement costs. Please see Appendix 5.2 for more details. 79. The implementation of the subproject receives the high consensus of the majority of people as well as the affected people. Through the monitoring, we found that over 80% of the affected households are pleased with the project implementation. 80. However, the implementation of the subproject remainscertain shortcomings, leading to complaints or dissatisfaction of affected people, for example, the compensation prices of land (especially at the cross-sections), the compensation prices for structures and buildings, the settlement of complaints by the APs, especially the time to respond to complaints, and the effectiveness of the Income Rehabilitation Program. 81. The progress of approving the compensation plans for the rest of sections remains slow, leading to pressing concerns among the people. 23

27 82. The delay in the land allocation documentation makes some households can not hand over land to the subproject Recommendations 83. Quang Tri GMS-PMU should coordinate with the LFDCs and the People's Committee of Dong Ha city to accelerate the preparation and approval of compensation plans for remaining routes to pay compensation to AHs. 84. Quang Tri GMS-PMU should cooperate with Dong Ha People's Committee, Huong Hoa People's Committee and the People's Committees of the communes/wards/towns to resolve 54 cases of households that have not received compensation money. 85. The LFDCs need to quickly process the land allocation dossiers and submit them to Dong Ha CPC to decide allocation of resettlement land to the households that have to move to the resettlement sites to stabilize their lives and livelihoods. 86. The LFDC of Huong Hoa district needs to quickly synthesize and approve the reward site clearance policy for the households that received compensation in the areas of Cluster-4 and flooded s as the routes basically completed the implementation of the urp (except some households that have not received compensation money as mentioned above). 87. To improve the efficiency of the Income Rehabilitation Program, we believe that apart from improving the quality of breeding stock, the most importance is improving the technical breeding level of the households like the periodic vaccination and standard breeding facilities. 24
