2 RULES AND REGULATIONS FOR PRE CONFORMATION-FUNCTIONAL COMPETITIONS FOREWORD Since PRE breeder associations were founded, one of the main objectives has been to consider horse breeding as a livestock activity that seeks to obtain high quality horses, to take advantage of their true productive potential, and adapt their development to market conditions, both on the national and international scene. Being that the promotion and preservation of the PRE as a breed, as well as its expansion and prestige are Association objectives and the very reason for its existence, it is evident that a meticulous review of the rules and regulations that govern conformation competitions are of utmost importance. These rules and regulations represent an impressive showcase where these horses can be admired and further the repercussions they have at all levels (economic, social, promotional ). Thus, this has been the motivation behind the creation of these current Rules and Regulations to govern conformation-functional competitions, under a strict legal framework that seeks consensus, justice and transparency. One of the key elements emerging from these rules and regulations is their dynamic nature which is a reflection of what takes place within the sector. Consequently, the constant work on behalf of breeders and owners to improve the breed translates in this text being open to the changes or advances taking place within the sector. These rules and Regulation cannot be a chiseled in stone when they are part of a changing reality; the previous version has been enriched to produce this version, which includes a series of innovative ideas. Innovation arises from the needs and practical demands of the competitions. On the one hand, the requirement for breeders to participate in qualifying competitions prior to qualifying for the final of the Spanish National Championships has been eliminated. On the other hand, the categories of judges and competitions have been simplified, expanding the scope of decision making and responsibilities of the Organizing Committees. Another improvement in the current rules and regulations refers to the responsibilities of the judges. This, together with the simplification and clarification of the applicable rules, seeks to have more objective and standardized judging criteria. The search for justice, transparency and fairness in judging, as well as the smooth running and organization of competitions has led to special emphasis being placed on this text, especially in terms of the aforementioned aspects. 2 of 58

3 CHAPTER I GENERAL PROVISIONS Article 1. The aim of these Rules and Regulations is to establish the procedures to be followed when holding Conformational-Functional Competitions for PRE Stallions and Mares, to determine the form and structure within the various organizations holding said events and the responsibilities of all those involved. The Competition Follow-up Commission shall review these rules and regulations annually and incorporate any and all changes into this legal text as agreed to by the Board of Directors. Article 2. A Conformational-Functional Competition is defined as a competition open to all stud farms and PRE horses registered in the PRE Stud Book and that fulfill the requirements established in its Specific Rules and Regulations (BOE (Official State Gazette of Spain) nº 127, dated the 28 th of May, 2012) and are listed on the Official Conformational-Functional Competition Calendar, and that fulfill the precepts laid out in these current Rules and Regulations. Article 3. These current Rules and Regulations must be applied at all Conformational- Functional Competitions for PRE Horses listed on the Official Calendar, approved and published annually by ANCCE. Article 4. Only the results of the Conformational-Functional Competitions that appear on the Official Calendar and that have been judged according to these present Rules and Regulations shall be valid for the Spanish National Championship for PRE Stallions and Mares. Article 5. No program or specific rule or regulation, general or individual condition stated by an Organizing Committee may contravene the mandates laid out in these Rules and Regulations, with the exception of those aspects that may be laid out in the specific Rules and Regulations for the Spanish National Championship Final. Chapter II. ALLEGATIONS AND APPEALS OF THESE ARTICLES Article 6. Follow-up commission This commission was created to ensure the strict observance of and compliance with these rules and regulations, as well as to solve any conflicts that might derive from their interpretation and application. Allegations may be presented before the said Commission at the ANCCE registry desk. Initially, all allegations shall be resolved by the Conformation Competition Follow-up Commission, and later by the ANCCE Executive Committee, in both cases by a majority of votes. The Conformation Competition Follow-up Commission shall be made up of three breeders, one of whom shall be the President, another, designated by the president, shall act as secretary. This Commission may request as many technical reports as deemed necessary for its correct performance. All members of the said Commission shall be appointed by ANCCE. 3 of 58

4 Chapter III. CONFORMATIONAL-FUNCTIONAL COMPETITIONS AND THEIR APPROVAL: REQUIREMENTS Article 7. Requesting an Official Competition 1. To organize a Conformational-Functional Competition, the request must be presented before the ANCCE registry desk before the 1 st of December of each year, so that the calendar for the following year can be prepared. To request a competition, APPENDIX I included in these Rules and Regulations must be completed in full. 2. All Conformational-Functional Competitions that are a part of the Spanish National Championships may not begin any later than the 10 th of November of each year. 3. Any requests presented by people or organizations that are not the owner of the facility where the competition is to be held must include an authorization granting them the use of the said facility with the request. Article 8. At all times, the objectives pursued by the competition organizing committees shall be: 1. To contribute to the promotion, preservation, expansion and prestige of PRE horse breeding both in Spain and abroad. 2. To provide breeders with the possibility of a better selection of horses. 3. To encourage the acquisition of breeding stock with the aim of promoting the excellence of the PRE. 4. To promote PRE horse sales. Article 9. Anyone participating in a competition, whether a breeder, rider, presenter, groom, judge or organizational staff must, while within the limits of the venue where the competition is held, show respect at all times. Article 10. Competition Classifications Conformational-Functional Competitions included in the ANCCE Spanish National Championships shall be classified based on the following categories: 1. International Competitions: This includes all those competitions held within Spain that are specified annually by the Follow-up and Control Committee, as well as all those taking place outside of Spain. 2. National Competitions: All those competitions held within Spain and that fulfill all the requirements of these current Rules and Regulations and that are not included in the International Competition category. This classification shall be reviewed annually by the ANCCE Executive Committee upon request from the Conformation Competition Follow-up and Control Commission. Article 11. The organization or individual seeking to organize a Conformational- Functional Competition must have facilities available in accordance with the competition to be held, and must guarantee the necessary health/sanitation requirements as demanded by the corresponding public authority. 4 of 58

5 Minimum requirements, conditions and facilities that competitions must fulfill depend on their category and are as follows: INTERNATIONAL COMPETITIONS: a) Organization: The organization must have at least: a.1) One Commissioner a.2) One Chief Steward a.3) One, two or three judges b) Infrastructure: b.1) One 60 x 20m ( x feet) competition arena b.2) One warm-up arena measuring at least 40 X 20m ( x feet). b.3) Appropriate, covered accommodation that is safe and suitable for horses to guarantee their safety and welfare at all times. All stabling for males and females must be sufficiently separated to ensure the tranquility of the horses and to avoid possible accidents b.4) Sufficient showers, segregated for males and females b.5) Public Address system b.6) Video recording and photographs of the sections during the competition b.7) Technical Secretariat to handle the competition c) Services: c.1) An Ambulance (medical services) c.2) Liability insurance c.3) Security and surveillance for the correct and smooth running of the competition c.4) A competition catalogue c.5) Bedding for boxes and pens c.6) Veterinarian c.7) Farrier d) Regulations: d.1) Fulfillment of these Rules and Regulations NATIONAL COMPETITIONS: a) Organization: The organization must have at least: a.1) One Commissioner a.2) One Chief Steward a.3) One, two or three Judges b) Infrastructure: b.1) One arena measuring at least 40 X 20m ( x feet) b.2) Warm-up area b.3) Appropriate, covered accommodation that is safe and suitable for horses to guarantee their safety and welfare at all times. All stabling for males and females must be sufficiently separated to ensure the tranquility of the horses and to avoid possible accidents. b.4) A sufficient number of showers for all horses b.5) Public Address system 5 of 58

6 b.6) Photographs of all competition sections b.7) Competition Secretariat to handle the competition c) Services: c.1) An Ambulance (medical services) c.2) Liability insurance c.3) Security and surveillance for the correct and smooth running of the competition c.4) A competition catalogue c.5) Bedding for boxes and pens c.6) Veterinarian c.7) Farrier d) Regulations: d.1) Fulfillment of these Rules and Regulations Independently of the competition category, the organizers must comply with all aspects of these Rules and Regulations with regards to holding this type of competition. ANCCE shall not be held responsible for non-compliance with any of these obligations on behalf of the organizing committee. CHAPTER IV. OPERATIONAL AND INTERNAL STRUCTURE ORGANIZATION: COMPOSITION AND DUTIES Article 12. The Organizing Committee: 1. - Definition: The Organizing Committee (hereinafter OC) is responsible for the management, handling and administration of a given Conformational-Functional Competition. of: 2. Structure: Its numbers may vary depending on the size, but in general, shall consist a) A President. This person shall be the maximum authority and is responsible for the competition. He/she shall formalize and execute the decisions made by the Committee with regards to matters under consideration. In the case of voting, he/she shall have the casting vote in the event of a tie, in matters within the competency scope of the aforementioned OC. b) A Competition Commissioner (also known as Technical Director). This person, at all times, shall seek compliance with these current Rules and Regulations, in addition to ensuring that the facilities meet all the necessary requirements for the correct undertaking of the Conformational-Functional Competition. Likewise, this person shall be responsible for providing the Judges with the necessary documentation to fulfill their role as Judges, as well as providing the participants with the final results of each Section and give these to 6 of 58

7 the President of the OC; the Chief Stewards and other OC personnel shall be responsible before this person. b.1) Responsibilities of the Commissioner: 1. Verify the conditions/situation of the event prior to its commencement and throughout the conformation competition that all aspects comply with the characteristics required for each category. 2. Issue a report that states the characteristics of the facilities and equipment, and a description of the running of the competition, with special emphasis on details of any possible irregularities that may be worthy of warning or disciplinary action. This report must be sent to the Follow-up Commission for Conformation Competitions within a period not exceeding five (5) days following the conclusion of the competition. 3. Verify the correct site and location of the presentation arena. 4. Verify that the Public Address system in the arena is working properly. 5. Guarantee the correct identification of all horses to be judged. 6. Establish, respect and demand compliance with the start times for all the sections. If, due to competition proceedings changes must be incorporated, he/she shall be responsible for informing all parties involved in the competition of the said changes as well as notifying the general public, and ensuring the greatest possible distribution of this information, using the best means available. 7. Make sure that presenters, grooms and farm managers comply with the indications from the judges in terms of placement, presentation of stops and in movements, as well as any other aspects the judge is responsible for. 8. Draft and send ANCCE all competition records, within the established time framework and manner. 9. Propose the necessary assistants to perform all the duties of the competition. 10. Immediately inform the ANCCE Competition Department about the suspension of the competition, as would be the case and the circumstances leading to this suspension, as well as sending a detailed, written report to the said Competition Department. The performance of Competition Commissioner may be inspected by the person appointed by the Follow-up Commission for Conformation Competitions. c) Chief Steward. This person shall be responsible for verifying the identity, the numbers and names of all horses, ordering their entry to and departure from the arena and maintaining communication with Stud Farm managers so that the competition runs smoothly. This duty is mandatory; therefore, in those competitions which, due to their size, do not have a Chief Steward, these tasks shall be performed by the Commissioner or Technical Director, depending on the competition category. d) Members-at-large. These could be as many as the Organizing Committee deems appropriate, one of whom shall always be the Competition Veterinarian. 7 of 58

8 Article 13. Responsibilities of the Organizing Committee: 1. Design the competition program with at least the following information: - Date and location where the competition is to take place, as well as the reception and departure dates for horses - Entry deadlines - Entry fee, as would be the case - Health and administrative permits/certificates as required by the authorities - Names of the judges judging the competition - Awards and trophies - Members of the OC The Initial Program must be published on the ANCCE Web-site, at least twenty (20) days prior to the commencement of the competition and be made available to all participating breeders from the competition secretariat, during the competition. 2. Verify the ownership of all horses registered with the PRE-ANCCE Stud Book; should there be any doubt, notify the Competition Department so that they may consult with the Stud Book, whose verdict shall be binding and final. There must be a register of these verifications, which shall be sent to ANCCE together with all requested documentation. 3. Verify any conflicts of interests between the judges appointed by the Organization and the contesting breeders and horses, ensuring that these do not reach the maximum limit of conflicting interests established in art. 42 of these Rules and Regulations as well as the compliance on behalf of the judges to fulfill their obligations, as established in art. 34 of these Rules and Regulations 4. Suspend the competition due to Force Majeure (unforeseeable circumstances) beyond the control of the OC, in which case the causes must be stated in a written report sent to ANCCE, who may claim (liability) for the damages suffered. If the suspension has taken place prior to the commencement of the competition, the OC is responsible for notifying breeders, Judges, and any other individual or organization participating in the event, although ANCCE is committed to publishing the suspension on its web-site for maximum distribution. 5. Appoint the Admission Jury and Appeals Jury. 6. Verify and be aware of any disciplinary actions that may have been applied to breeders and/or horses with regards to their participation or not in the competition. All interventions on behalf of the OC in any of its bodies, as well as in the organization and throughout the course of the competition, may be inspected by the personnel designated by the Competition Follow-up and Control Commission, as is required. Article 14. Admission Jury 1. - Composition These must be at least: The Commissioner A member of the OC The Veterinarian 8 of 58

9 Moreover, these shall be aided by as many assistants as are necessary to correctly perform their duties. Their decisions may be appealed before the Appeals Jury. The Admission Jury shall begin operating when the first entry for the competition is received. 2. Duties The Admission Jury are responsible for the admission (entry) of the horses to the competition, and therefore in charge of their reception, during which time they shall carefully examine the points required in Article 26 of the present Rules and Regulations as well as those laid out below: a) Health. Admission Jury, following a veterinary exam, may reject those horses showing a physical defect, whether congenital or accidental in nature, or those suspicions of disease. A horse s entry to the event is allowed only when the injury took place during transportation and it may only enter the competition arena following an examination by the competition veterinarian, who must authorize its participation. b) Documentation. Verify that all in-coming horses have the corresponding Health and Transport Papers. c) Identification. At the competition entry gate, all horses shall be identified by reading the microchip and verifying the description that appears on the Registration Certificate, Passport or accompanying document. d) Entries. Verify that the horses are correctly entered. e) Stabling horses. Coordinate the allocation of horses in the stables and pens. Article 15. Once the Admission Jury has confirmed that a horse is included in the entry presented by the breeder within the entry period and that it complies with all requirements for its participation in the competition, the Jury shall authorize its admission to competition facilities, with said hors being considered officially entered. In the event of an officially entered horse fails to participate in the Competition, it shall be considered as not presented. If the said horse is registered for the Award for the Best Breeder or Champion Owner, the corresponding points shall be Not presented, as indicated in APPENDIX IX, and taken into consideration when determining the average of the points obtained by the stud farm. Article 16. When a horse is registered for entry in a section that does not correspond to that horse, and should there be any type of manipulation in terms of documentation or attempted equine identity theft, the said horse shall be eliminated from the competition together with all the horses presented by that stud farm, and all awards that may have been earned shall be renounced, without forsaking the application of disciplinary actions as established by these Rules and Regulations. Those awards that have been renounced for this reason shall be awarded, whenever possible, to the horse/s placed in the next position. Should this be impossible, the award shall be considered null and void. Article 17. The Appeals Jury 9 of 58

10 The members of the competition Appeals Jury may not present horses at the said competition. 1. Jury composition. The Appeals Jury shall include the President of the OC or a person designated by the President and at least two members elected by the said President. These may not be breeders, riders or handlers participating in the competition, and the mandates laid out in Article 12 must be complied with to be included as a member of the C.O. One of the members shall act as the secretary. 2. Duties. The Appeals Jury must solve any and all incidences that arise during the Conformational-Functional Competition, except those conflicts regarding the judging of horses, in which case the maximum authority shall be held by the Judges of the competition. 1. Being the maximum authority at the competition, the Appeals Jury must solve any and all incidences that arise with regards to the application of these present Rules and Regulations. 2. Solve, in terms of appeals, any claims presented by breeders participating in the competition. To be taken into consideration, all claims must be formulated in writing within a maximum of one (1) hour following the event behind the claim; having surpassed this deadline, no claim shall be taken into consideration. 3. Make the decisions of the Appeals Jury known within a maximum period of twenty-four (24) hours, following the presentation of a claim. These decisions shall be public and all decisions are final within the realm of the competition. 4. Any possible incidents taking place during the competition MUST be reported to the Follow-up Commission. Article 18. Veterinarian team The OC must have a veterinary team on hand daily within the competition area while judging is taking place, from the start of the competition to the finish of the last section, as well as during the reception and departure of the horses. The team shall include at least one (1) veterinarian, aided by a farrier and sufficient equipment to effectively perform their duties. It is the duty of the competition veterinarian to treat any horse that becomes ill while at the competition facilities, having been summonsed previously by the owner, but keeping in mind that the expenses of medications shall not be the responsibility of the Organization (but rather the breeder/owner of the said horse) and the same holds true for costs related to shoeing. It is also the obligation and responsibility of the chief competition veterinarian to: - Confirm and thus guarantee that the verification of the identity of the horses is carried out correctly. - Attend, at the request of the Judges, through the Chief Steward and at any specific time, to issue a report about a horse that is in the arena, which shall not be binding for the final decision of the judges. - Safeguard, throughout the Competition, from the reception to the departure of horses, the all the requirements are meet for the well-being of the horses. 10 of 58

11 Should there be any type of failure to comply with the current norms in this areas, corrective measures shall be taken immediately and the competition Commissioner shall be informed immediately, who in turn, shall report to the OC, which may or may not confirm said measures, as would be the case, or shall proceed or shall take other necessary measures. - Rule, ex officio and as required by the breeder, the Chief Steward or the Judges, about the suitability of a horse to be able to enter the arena. Should the ruling be negative, a veterinary certificate must be issued, which shall be given to the breeder as justification why the horse has not appeared in the arena. Article 19. Competition Secretariat 1. An individual person or legally constituted organization who, in the opinion of the Competition Organizing Committee, fulfill the necessary conditions to handle the data and results generated by the competition, may act as Competition Secretariat. 2. The duties of the Competition Secretariat are administrative and informative: a) Handle the entries. b) Draft the list with the names of the horses in each section. Issue the scoring records for the cobras and for the individual horses, both for conformation and functionality as this appears in the appendix. In such case that a breeder enters a horse in a section other than what is established by the Rules and Regulations, this incident shall be reported immediately to the Competition Commissioner, so that the breeder is informed, together with the measures established in Article 16. c) Display in a visible location with public access, the lists of all the sections and of the breeders to be considered for the awards for the Best Breeder and Champion Owner, once the reception of the horses has finalized. In these latter cases, the horses that have been entered by the breeder to count towards these awards must appear. d) Draft and publish a list with the results, with the comparison of the judges at the end of the judging of each section, for breeders and the general public. This shall include the results of the judges in the selection of the Special Awards. All of these results shall appear on-line, at the web-site: e) Receive the corresponding score sheets, duly signed and completed from the Judges. The said sheets appear in Appendices III, IV, V, VI, VII and VIII, as relevant. f) Process the judges scores to obtain the total average for each judge and for all the judges. These scores must be reflected on the judges score sheets. Article 20. Responsibilities of the Organizing Committee The OC, in addition to complying with the rules and regulations, shall be responsible for the following: - Written notification to all Judges, indicating their appointment to the competition and the ANCCE Competition Department, at least twenty (20) days prior to the commencement of the competition. - Ensuring that the competition commissioner fulfills his/her duties. - Appoint the necessary assistants for the smooth running of the competition. 11 of 58

12 - Provide the secretariat with a suitable office and appropriate technical equipment for the Secretary to operate. - Send ANCCE the Competition results, minutes, reports, appeals and suggestions, duly completed in the correct manner and within the established timeline. - Aid the work of the Judges. Non-fulfillment of the aforementioned duties and responsibilities shall motivate disciplinary action/s, the degree of which shall depend on the severity of said non-fulfillment. CHAPTER V ENTRIES AND CANCELLATIONS. Article 21- Breeders may only enter horses they own. For identification purposes, only the breeder code shall be taken into consideration, with all horses competing under said breeder code, whether or not they were bred on said Stud Farm. Any horse belonging to a breeder and participating in his/her name at a competition included in the Spanish National Championships, and which has subsequently been sold to another owner, may return to the ownership of the vendor, but may not take part in the competitions making up the Spanish National Conformation-Functional Championships for a period of twelve (12) months. Any horse taking part in a competition may not change ownership between the time of its entry and the conclusion of the said competition. Should the ownership change after the horse has been entered, the horse shall be considered as not entered and may not take part in the competition. Article 22. A stud farm may enter into competition as many horses as it so desires; should the stud farm compete for the Best Breeder or Champion Owner award/s, it must clearly indicate this on the entry form, specifying which horses are to be considered for these awards. A stud farm that competes for the award for Best Breeder may not compete for the Champion Owner Award, and vice versa. Article 23. The entry of horses shall be carried out by means of the document found in Appendix II, which includes at least the following information: - Stud Farm name and breeder code - Name of the representative and contact and/or emergency telephone number - Name, code, sex (male/female/gelding), date of birth of the horse - Section number where the horse is to participate - Whether or not the horse is to be taken into consideration for the Best Breeder or Champion Owner Awards. (may appear as PMG/PME on form) - If a mare is to participate in her section, indicate this in the corresponding box. Should this same horse participate in the cobras, indicate this in the corresponding cobra box. Should she take part in cobras only, do not mark the box for the section. 12 of 58

13 Article 24. If an OC suspends a competition for reasons other than force majeure participants already present at the venue or in transit, must be compensated for the expenses incurred, notwithstanding other possible disciplinary actions. Article 25. Those breeders who have formalized the entry of their horses at a competition do not have the right to claim any fees paid once the deadline for entries has been reached. CHAPTER VI. HORSES, BREEDERS, GROOMS/PRESENTERS AND RIDERS Article 26. All horses presented at a Conformational-Functional Competition, in addition to being in perfect physical condition, must comply with the following: a) Health and welfare requirements as established by the Organizing Committee and the corresponding health/sanitation/animal welfare authorities. b) Necessary travel and transportation documents. c) Passport or photocopy of the registration certificate. Only for horses in sections 1 and 2 is the presentation of the registration certificate permitted. d) All horses presented in Sections 7 and upwards must be approved as certified breeding stock in keeping with the current legislation. Although OCs may overlook this requirement in Sections 7 and 8, it is unavoidable in the Spanish National Championship Final. e) Horses participating in Section 15 need not confirm its aptitude as breeding stock; however, the horse must not show any disqualifying defects in its conformation. The Competition Jury shall determine the absence or not of such defects, and disqualify any horse with a defect. f) Cobras in sections 13 and 14 shall exclusively be made up of mares eligible for sections 7 to 11, that is to say, aged 4 years and over. Requirements for mares taking part in the cobra section are exactly the same as those required for participation in an individual section. g) In sections 13 and 14, when the make-up of a cobra must be changed once the entries have closed, and always prior to the reception deadline, only one of the mares in a cobra may be substituted in the case of section 13, and two in the case of section 14. If there has been no change, should one of the components of the cobra suffer an injury during the competition, this horse may be substituted by another mare entered in one of the adult mare sections and that has been on the grounds from the reception and beginning of the event competition. As previously established for all cases, all horses must belong to the same stud farm at the time of entry. Horses participating in section 15 must have no disqualifying defects in their conformation. h) No horse presented at a competition shall have serious physical defects, whether congenital or acquired, apart from the surgical removal of a testicle due to a pathological process. 13 of 58

14 Article 27. All breeders who present their horses at a competition are committed to respecting and complying with the mandates laid out in these Rules and Regulations, and to contribute to the brilliance and dignity of these competitions, presenting their horses in the best possible conditions. Article 28. Breeders may not approach any of the Judges during the judging, and should they do so outside the competition arena, contact must be done with respect and consideration and always in the presence of the Competition Commissioner. Article 29. Breeders shall be responsible for: a) Horses having a suitable level of training and handling. b) The actions/behavior of the personnel in their employ, as well as that of their families. c) Presenting the horse, with its number, in the corresponding Section. d) Ensuring that all their horses remain within the competition facilities until their departure is authorized in writing by the OC. e) Having sufficient personnel for the appropriate care and handling of all their horses, as well as for their correct participation and presentation. f) Complying with all the decisions made by the judges, as well as those taken by the Appeals Jury. g) Showing respect and consideration for organization staff, other breeders, their personnel and the general public attending the competition. h) Ensuring that they, their employees and their family members know and comply with these present Rules and Regulations. Any questions that may arise about the mechanics of the competition, which have nothing to do with its organization, must be directed to the competition commissioner. Article 30. Failure, on behalf of a breeder, to comply with the Rules and Regulations in this Chapter may lead to the elimination of the both the breeder and the horses presented by said breeder from the competition, should the OC so decide. This being independent of any other disciplinary action that could be taken, in accordance with the disciplinary procedures laid out in these Rules and Regulations. Article 31. Handlers and riders The following aspects must be borne in mind by both handlers and riders when presenting horses in the arena: A. General Aspects 1. Be at least 16 years old, or should this not be the case, the OC must be informed of this fact and provide express authorization from the parents or legal guardian, who are responsible for any injuries that may occur and thus making the OC free of any liability. 2. At all times attend to and comply with the instructions given by the Competition Commissioner or the Chief Steward. 14 of 58

15 3. Carry out the stipulated routes when presenting in hand, without wasting time or exceeding the established limits. 4. Show good behavior at all times, both in and outside the arena. Respect and show consideration for the judges, all those linked to the organization, other breeders and their personnel, as well as the general public. 5. Keep horses both in and outside the arena under control at all times to avoid risks both for the people in that area as well as other horses. Therefore, horses must always be attended and never presented loose. 6. Identify, with the corresponding order number, all participating horses. 7. Comply with all decisions made by the Judge, as well as the Appeals Jury. 8. The following behavior is strictly forbidden; violations could lead to elimination: 8.1. Abuse horses participating in the competition, not only in the competition arena, but also in the warm-up arena and the entire showground The use of whips, lashes or sticks is permitted, provided they do not exceed one meter eighty (1.80 meters) in length, including the lash, except for the Cobra Sections, in which longer whips are permitted, but with the lash tied up Force an ill, exhausted or lame horse to move The use of any type of make-up that could hide or highlight aspects of the horse being presented is not allowed, nor is changing the natural color of the skin, hair or hooves. The use of colorless hoof-grease is allowed Entering and leaving the arena without the permission of the Chief Steward When a horse fails to behave correctly in the arena or should an abnormality be seen, speak to the Chief Steward, who shall inform the Judge, who shall or shall not authorize, as would be the case, the withdrawal Doing anything that would lead to the distraction of another horse being presented at that specific moment, such as moving a horse close to the arena or within the arena while waiting to be judged Speaking to the Judge in or outside of the arena, unless in the presence of the Competition Commissioner. 9. The following shall be a reason for a warning, without elimination The use of martingales, breast plates, rubber rings and any other type of artificial aid (whether plastic or material tied to the whip, or any other material that could be used in the presentation of the horses, including side, lateral, sliding or balancing reins, nose ties, etc.), any type of boot or bandage and any type of blinker (blinder), including ear covers and any others. Likewise the use of any decoration on the horse, such as ribbons, knots, flowers, etc. shall be a cause for elimination. Only in the Functionality test is the normal braiding of the mane and tail allowed. If, having given a warning, the use of such materials continues, this will be a reason for immediate elimination. 15 of 58

16 B. Specific aspects: 1. Handlers: 1.1. Horses shall be presented in presentation bridles or those with lined Spanish nosebands only; any other device that modifies the natural presentation of the horse or that causes damage or pain is absolutely forbidden. Only in the case of mares in sections 7 and above, may a headcollar be used, provided that this is made of leather and is of sufficient quality to guarantee the correct handling of the horse in the arena, both while waiting and at the moment of the in-hand presentation in the arena. On the contrary, should this not occur, the presenter shall be indicated to replace the horse or the horse shall be invited to leave the arena, thus being eliminated. A handler may be eliminated from a competition, should he/she alter the normal operation of a section The country short suit or Dressage suit shall be worn for all Dressage competitions. A typical regional suit may also be worn provided that this is authorized by the OC and it must be suitable for the presentation. No logos, commercial symbols or those of the Stud Farm are permitted that could distinguish one entry from another. No one may enter the arena unless they comply with this Competition Rule, even if they are only running circles to present the horse or holding its lead rein. 2. Riders: 2.1. Horses must be ridden with a Spanish, English or Vaquera saddle; no other variant being permitted. Logos are permitted on the saddle cloth, but with a maximum of 20 cm in height by 20 cm in width No aids or complements other than those authorized in these Rules and Regulations shall be permitted Clothing must match the type of saddle, with one of the following being possible: - Short country suit and other regional suits suitable for riding - Clothing suitable for Dressage Competitions - Hunting attire 2.4. Whips are authorized only in the Sections for 4-year olds. Article 32. Failure on behalf of breeders, grooms/presenters or riders to comply with the Rules and Regulations in chapter VI as well as any incorrect or inconsiderate behavior or abuse of the horse could lead to their elimination by the OC even though they may have already been judged. This decision may be appealed before the Appeals Jury. Likewise, this OC could also take action if the behavior for which the said horse has been eliminated is sufficiently serious. Not only may the said elimination be confirmed but it may also be extensive to any other horses owned by the same stud farm. These horses shall forfeit any award/s that they may have won up to that time. Those awards that have been relinquished for this reason shall be awarded to 16 of 58

17 the horse/s placed in the next position whenever this is possible. Should this not be possible, the award shall remain null and void. ANCCE must be duly informed of any possible incidents that could have taken place; this shall lead to disciplinary actions being taken in accordance with these Rules and Regulations. CHAPTER VII. THE JUDGES: RIGHTS AND OBLIGATIONS. Article 33. ANCCE is responsible for the training, qualification and certification of Judges. Judges may only judge PRE competitions that are qualifiers for the Spanish National Championships for PRE Stallions and Mares and those authorized by ANCCE. Article 34. Rights and Obligations The following are rights of the judges: a) Be respected for their decisions within the arena b) Be respected for their independence while judging c) Be provided with correct room and board d) Receive payment for their work up the conclusion of the competition The following are obligations of the judges: a) Not judge competitions that are not a part of the ANCCE Spanish National Championships. This shall be considered severe misconduct. b) Maintain their independence while judging. c) Judge according to the breed prototype standard and the current Rules and Regulations for Conformation Competitions. Objective and flagrant failure to comply with this obligation could lead to disciplinary actions, as laid out in the Disciplinary Procedure, or their banning as a judge. d) Declare all and any conflict of interests that might arise, and the reasons, whether of a general or unexpected in nature. This declaration must be made before the 1 st of January and must be up-dated as soon as any changes occur. e) Issue a report about the requirements of the competition and its proceedings, as well as any possible incidents that may arise during the event. Said report must be sent to the ANCCE Competition Department within seven (7) days. f) Attend and participate in the ANCCE courses for assessment and standardization of criteria. g) Judges may not be involved as equine brokers, as a general practice. h) Respect the resolutions affecting them and their actions as decreed by the ANCCE Conformation Competition Follow-up Committee. Article 35. Annually, prior to the commencement of the first competition of the season, ANCCE, at the proposal of the Follow-up Commission for Conformation Competitions, shall approve the judges to judge the competitions of the various categories. This category shall be maintained throughout the season unless disciplinary actions have been taken against a given judge, thus leading changes or the temporary or permanent disqualification said judge. 17 of 58

18 Article 36. Categories for judges At the start of each year, the Conformation Competition Follow-up Committee shall place the judges into one of the following categories: INTERNATIONAL Category Judges: may only judge those competitions that have been assigned the category as international, in accordance with the mandates of these current Rules and Regulations. NATIONAL Category Judges: may only judge those competitions that have been assigned the category as national, in accordance with that laid out in the mandates of these current Rules and Regulations. In the case of the INTERNATIONAL judges, a list of judges and replacements shall be published for each year. Article 37. The OC shall choose and inform the interested parties in writing and sufficiently in advance of the foreseen starting date, the designation as Judge and the names of the other Judges in the panel, always respecting the category of the competition and of the judges. The designated judges must reply in writing, within no more than five (5) calendar days following notification, stating their acceptance or not as judge. Article 38. Failure to attend a Competition to which he or she is committed shall be considered severe misconduct. Only in the event of Force Majeure or an unexpected generalized conflict of interests, and having notified the OC in advance, may a Judge withdraw from attending a competition. Likewise, changes in the competition timetable for reasons that are attributable to and not justified due to the conduct of the designated judge shall be considered severe misconduct. Any judge who rejects his/her designation by an OC, unless this rejection is due to an incompatibility, is not allowed to judge any other competition on the same dates that said judge rejected his/her designation. Article 39. Judges must complete the score sheet from the various Appendices as indicated. To this end, judges may count on the help of the auxiliary staff who shall write what the judge indicates on the score sheets. Should a judge have to leave during a section, for justified reasons, and be unable to return, all the scores by this judge for the whole section will be eliminated. CHAPTER VIII. CONFLICTING INTERESTS OF JUDGES Article 40. The OC, having received the entries and information regarding any possible conflict of interests on behalf of the Judges, must proceed to ratify or modify the Judges who are to judge the said competition. Conflict of interests shall be the only reason for which the OC can revoke the appointment of a Judge, once the said judge has confirmed his/her acceptance within the established deadline and in the established form. Failure to adhere to this mandate shall be considered severe misconduct. 18 of 58

19 There is a maximum limit for the number of conflict of interests permitted per Judges, which has been set at two (2) sections and/or three (3) horses in total, except for any exceptions as laid out in Appendix 1, which regulates the Spanish National Championship Final. Article 41. Any judge, when participating as a breeder, groom/presenter or rider, and is judged by another Judge, may not evaluate horses that have any relationship to the said judge, whether he/she is as breeder, groom/presenter or rider, during that season. Any horses judged in breach of this rule shall be disqualified and the Judges involved shall be guilty of severe misconduct. Article 42. No Judge may judge a Section where a participating horse is involved in any type of conflict of interest, as listed in the cases below: a) A horse that has been sold, transferred, employed in its various uses or bought by a Judge, either as owner or broker. This also applies in the event that said horse has been bred by the judge in question, whether or not it carries his/her brand. b) A horse, whether or not it carries the Judge s brand, is owned totally or in part by a Judge, a member of his/her family extendable to second-degree relatives (grandparents, grandchildren, aunts/uncles, niece/nephew, in-laws) or an associate of the said Judge. c) A horse that is owned by a stud farm where the Judge is employed or provides or has provided services during the current or previous season. d) A horse whose breeder, owner, presenter or rider supplies or has supplied services to the judge during the current and/or the previous season. e) A horse of a participant with whom the Judge has had a commercial or professional relationship during this and/or the previous season. f) When the Judge has visited the facilities or properties of a breeder, accepting his/her hospitality, during the three months prior to the celebration of said competition. g) When there is a family relationship extendible to second-degree relatives between said judge and the presenter, rider or owner. h) Once the Judge had judged a horse, said judge is not allowed to have any professional relationship with the owner of said horse during the same season. Article 43. Should a conflict of interests arise between a judge and a horse, breeder, presenter or rider, and there is a substitute judge, the judge with a conflict of interest shall withdraw from the arena and the substitute Judge shall take his/her place, judging the entire section, including the functionality test, where relevant. If there is more than one judge and there is no substitute judge, the entire section, including the Functionality test, where relevant, shall be judged without the presence of the judge affected by the conflict of interests. Should a conflict of interests arise in a competition that is being judged by a single Judge, and there is no substitute judge, the horse involved in the conflict of interests must be withdrawn from the competition and shall be treated as if it were not entered, with the entry fee being returned. 19 of 58

20 All the above is also applicable for any of the Special Awards, should the horse incurring in the conflict of interests qualify for any of these awards. The limits in this article shall be the same as expressed in Article 40 of these Rules and Regulations. CHAPTER IX. THE PANEL OF JUDGES Article 44. The Panel of Judges for a Conformation-Functional Competition shall be made up of one, two or three judges, depending on the criteria of the OC. As would be the circumstances, two Panels of Judges may be appointed, composed of the same number of judges, each one with the possibility of having one, two or three judges. Article 45. If there is more than one judge, the order of the Judges shall established by a draw before the start of the competition. Article 46. Should there be two panels of Judges judging different sections, the panel to judge each section shall be chosen by a draw. This draw could be undertaken using two different formats: 1. At the start of the competition, establishing two fixed panels for the entire competition. In this case, the judges shall alternate the sections for males and females. 2. At the start of each section, in which case the judge or judges that are not selected to judge the first section drawn shall judge the other section that is programmed at the same time. In both cases, the OC could establish whether or not the functionality test for the sections in which this test is run shall be judged by the same panel that judge the conformation, or if, on the contrary, this is judged by the panel that does not judge the conformation. By the same token, they could decide that the functionality tests for all the sections shall be judged by all of the judges. Should there be at least one mare from Sections 7, 9 and 11, who has requested to perform the functionality test, she will be judged together with the other horses from her same age range. The complete Panel of Judges must judge the Special Awards. Article 47. Within the judging arena, the judges have maximum authority with regards to the judging and placings, following the mandates established in these Rules and Regulations, and their decisions are not open to appeal. Article 48. The decisions made by the judges that do not affect the placing of the horses, can be appealed, in writing, before the Appeals Jury. 20 of 58

21 The deadline for such an appeal must be made within one (1) hour from the publication of the results or from the moment when the event to be appealed occurred. After this deadline, requests presented shall not be considered. Only the breeders who are participating in the competition may present an appeal. Article 49. The Panel of Judges shall suit their judging to the breed profile defined by the current legislation, following the mandates established in these Rules and Regulations. Article 50. The Judge(s) shall avoid the following behavior: 1. They must not touch the horses presented. 2. They may not receive or give any indication concerning the horses, their origins or results in previous competitions, or their owners, nor may they comment among themselves about the good or bad points of a horse to avoid influencing the thoughts of another Judge. 3. They must not visit the facilities or properties of a breeder before or during the current competition season, nor may they accept their hospitality. 4. Likewise, they may not attend meetings, dinners, meals, etc., together with the breeders whose horses they shall be judging, within the thirty (30) days leading up to the conclusion of the competition, nor while it is taking place. 5. They may also not present, ride, drive or hold any horse entered in the competition; likewise, judges may not assume any duties as organizer or commentator, nor any other duties related to the competition. 6. They may not talk among themselves about the horses to be judged throughout the entire competition, neither prior to judging nor during the presentation rounds, and not during the judging. Once they have completed the scoring for each section, they may comment on the horses from said section, except about those seeking the Special Awards. Article 51. If the OC agrees, this having been applied for, the Panel of Judges may, once the judging has concluded, make their decision public, explaining the pros and the cons of the participating horses. Article 52. To avoid accidents to third parties, the Judges may eliminate from the arena any horse that clearly shows to be unmanageable. The Chief Steward must organize the ordered departure of said horse, which shall be eliminated even if it has already been judged. As a horse that has been eliminated, it shall be awarded the points that correspond to a horse eliminated for the tally when it comes to determining the average points obtained by that stud farm for the Award for the Best Breeder or Champion Owner. Article 53. All members of the Panel of Judges must, in the area assigned to the competition secretariat, sign duplicate copies of the corresponding records with the results and scores of the horses from each Section and the Special Awards. One copy of said Records, also signed by the Commissioner of the Competition, must be sent to ANCCE within a period not exceeding five (5) days following the conclusion of the competition. The other copy shall remain in the OC files. 21 of 58

22 This has no implication on the fact that the competition results, using a computerized format, must be sent on-line to ANCCE Competition Department within a period not to exceed forty-eight (48) hours following the conclusion of the competition. Article 54. At all competitions, except the Final of the Spanish National Championships, the Panel of Judges may not judge more than eighty (80) horses in a single day. Article 55. The fees to be paid to the judges shall be agreed between the Judges and each O.C. and these shall be paid at the end of the competition. CHAPTER X JUDGING Article 56. The Judges shall, at all times, use the official forms and score sheets for all scores. While judging, the Judges may only carry the official score sheets, although they may also add a blank sheet of paper for notes to carry out their work with ease. These notes, which must be for their own exclusive use, may not be shared with any other Judge. Article 57. Horses must always be examined for their breed fidelity, conformation and movement, at walk, trot and, where relevant, canter. In addition, those horses presented in the corresponding sections, shall perform the functionality test. Article 58. Judging records 1. Once the Judge has turned the score sheet over to the table, no modifications may be made for any reason, unless it has not been signed or a score has been omitted, in which case the judge may only add this, without altering any other aspects of the said score sheet. 2. A marker, ballpoint or fountain pen must always be used when completing score sheets; never a pencil or erasable pen. Should a mistake have been made, this must be rectified, with the corresponding rectification confirmed by the Judge s own signature. 3. The owner of the horse, or his/her personnel, provided that he/she is properly identified, may request a copy of the score sheet. The organization shall establish and publish the moment when these score sheets may be requested, to avoid interrupting the normal running of the competition. All judges score records must be mailed to ANCCE within a period not exceeding five (5) days following the conclusion of the competition. These score records must include both those for the sections and those for the Special Awards and any possible tie-breakers that may have taken place. Article 59. Judging shall be carried out using score sheets by anatomical areas, in which case, the average of the scores granted on each Judge's record shall decide the score for each horse and the position in the rankings for the Section. 22 of 58

25 Article 62. Each section of the score sheet that corresponds to a different region or movement is followed by 11 boxes under the following caption: - With regards to movement: Not performed (np) corresponds to 0 points - With regards to movement and body areas: Appalling (a) corresponds to 1 points Very bad (vb) corresponds to 2 points Bad (b) corresponds to 3 points Deficient (d) corresponds to 4 points Sufficient (S) corresponds to 5 points Acceptable (A) corresponds to 6 points Good (G) corresponds to 7 points Very Good (VG) corresponds to 8 points Excellent (E) corresponds to 9 points Perfect (P) corresponds to 10 points The judge must mark, with a cross, the box that best describes what he/she considers the region of the horse being judged and the movement in hand and the functionality of the horse. Each box automatically indicates a score indicated in the above paragraph, score that the competition secretary shall later apply with the corresponding coefficient which shall be tallied for the final score, except in sections 8, 10, 12 and 15, in which case, the final score shall be obtained after adding 75% of the conformation score (Appendix VI) to 25% of the functionality score (Appendix IX). Article 63. Once the Judge has marked a box, should he/she wish to alter the score, he/she must shade in the whole square, sign alongside and put the cross in another box. Article 64. The functionality test This is mandatory for all horses participating in Sections 8, 10, 12, and 15. The number of horses taking part shall depend on the number of horses in the section: - Sections of up to 15 horses, the top 10 shall participate. - Sections of between 16 and 30 horses, the top 12 shall participate. - Sections of more than 30 horses, the top 15 shall participate. The Organizing Committee may deem functionality voluntary for mares participating in sections 7, 9 and 11. In this case, it shall not count towards the final score and shall only be taken into account for the placing in the functionality section for the horses corresponding to their age group and for the Special Award for the Competition Functionality Champion. The same criteria shall be applied to mares participating in the functionality section as to stallions. Article 65. Any placed horse that fails to perform the functionality test, if the reason is justified, shall retain a score of 75% of the score obtained in the conformation section, occupying the place corresponding to said points in its section. Should it have been entered for 25 of 58

26 the award for the Best Breeder or Champion Owner, the points corresponding to this position shall be added, in accordance with the table in Appendix X. If the non-appearance is not justified, the horse shall be eliminated; the corresponding points shall be tallied, and the breeder/owner shall be guilty of severe misconduct, as laid out in Article 15 of Appendix I. A horse that has not performed the Functionality test may not seek the awards for Competition Champion and Reserve Champion of the competition. Article 66. Should a horse be disqualified during the functionality test, that horse shall be tallied as having not performed it, even if the horse has received a score in one of its paces. It shall retain 75% of the conformation score, applied as laid out in the previous article. Article 67. In this test, the judges shall only evaluate the horse s natural paces, which are walk, trot and canter, scoring for regularity, impulsion and straightness both on a straight line as well as in a circle, the balance shown, but taking into consideration all the breed characteristics of the horse s movement. There shall be no penalty for mistakes made by the rider or for the exactness of the figures. With this in mind Appendix XI shall be used. Article 68. The score obtained in the said test shall, for stallions, account for 25% of the total score. The score obtained by mares in the functionality test shall not count towards their final score. Article 69. Each rider may select the type of presentation, but always in keeping with the attire that corresponds to the type of saddle chosen. The types of saddle and attire are laid out in Article 31 - B section 2.3. Article 70. Sections All horses entering a Conformational-Functional Competition shall be organized by Sections according to ages as confirmed by their passports, which shall be calculated by natural years as of the 1 st of January of the year the horse was born and distributed as follows: - Section 1, Yearling Fillies - Section 2, Yearling Colts Note: sections 1 and 2 may only be held in National Competitions, these two sections shall not be run at International competitions. - Section 3, 2-year-old Fillies - Section 4, 2-year-old Colts - Section 5, 3-year-old Fillies - Section 6, 3-year-old Colts - Section 7, 4-year-old Mares - Section 8, 4-year-old Stallions - Section 9, 5- and 6-year-old Mares - Section 10, 5- and 6-year-old Stallions - Section 11, Mares, 7 years and over - Section 12, Stallions, 7 years and over - Section 13, 3-mare Cobras 26 of 58

27 - Section 14, 5-mare Cobras - Section 15, Geldings of any age, which have no disqualifying conformation defects. Article 71. Sections 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 and 13 are mandatory in competitions of any category. Sections 14 and 15 may be held, but these shall not count towards any of the Special Awards. The horses from sections 1 and 2 may only participate in National competitions. CHAPTER XI. PROCEDURES Article 72. Entrance of horses into the arena At the time stated in the schedule for the start of each section, previously conveyed by the Competition Secretary, the Arena Steward shall call the handlers to enter with their horses. Upon entering at walk, and once inside, horses shall abstain from trotting or cantering, or warming-up, as this should have already been performed in the warm-up arena. Once all the horses have entered the arena, the Arena Steward shall place them, by number, along one of the sides of the arena. If any horse is found to be missing, an announcement shall be made on the public address system, requesting the presence of the said horse. If it does not appear after five (5) minutes, another warning shall be made over the public address system. Alter a further three (3) minutes, the Arena Steward shall close the arena, from which time no horse may enter, even if the judging has not yet started. Article 73. Once the arena has been closed, the first round/s shall begin. All horses, in number order shall make from 1 to 3 rounds at walk, the number depending on the criteria of the judges. Once this has taken place, the following could happen: - The horses will be placed along one of the sides of the arena, following the indications of the Arena Steward, for the best running of the competition. - When the O.C. has a warm-up arena available adjoining the competition arena, the horses may leave the arena in an ordered manner to subsequently, once called by the Arena Steward, enter in number order. The horse following the one in the arena must be prepared for entry. Under no circumstances may horses return to their stable to wait to be called to return to the arena. The behavior of the horses and their handlers shall be the same as if they were in the competition arena, that is to say, in accordance with the mandates laid out in Article 31 (no smoking, talking on the phone, admonishing the horse, etc.) - The Arena Steward must have absolute control of what takes place in this warmup arena. Those horses that, on being called to the arena, do not appear immediately, will be eliminated. 27 of 58

28 Article 74. Horses shall subsequently go out in walk, one by one, from the end closest to where they are standing. They shall go down the center line and having reached the end, perform four (4) circuits at canter in the sections where this task is to be performed (mares, stallions and geldings), and at trot, continue to the other end of the arena, also along the center line. There, the horse shall make a half-circle, to return at trot and halt in the center. Those horses that need not perform canter (colts and fillies aged 1 to 3 years, and cobras), after their circuit at walk, shall perform the extended trot to the other end (of the arena) and return to the center. Handlers shall avoid obstruct the presentation of their horses, with unnecessary circles either at the ends or throughout the route during the presentation of the various paces. If they do so, they could receive a warning for such behavior, including disqualification, should this behavior be repeated. Should the OC deem it necessary, and to maintain the timetable, limit the time for the presentation of the horses in the arena, to a maximum of 1 minute, 45 seconds. During this time, the handlers shall be able to freely (not at liberty) perform their movements in walk, trot and canter. One (1) minute and fifteen (15) seconds having passed of them performing their presentation, that is to say, thirty (30) seconds before the presentation time comes to an end, they shall be advised over the loud-speaker, to conclude within their allotted time, having to move to the center of the arena to be judged. Should they fail to do so, they could be eliminated. When the OC decides to use this time limitation, the judges shall also be affected, as they shall have a maximum of two (2) minutes and thirty (30) seconds to judge the horse. They shall also be advised, by the Arena Steward, when two (2) minutes have passed from the start of the judging. Any horse, including the cobras, that escapes the control of the handler shall, on the first occasion receive a warning and on the second shall be automatically disqualified. Article 75. Once halted in the center of the arena, the judges proceed to judge, using the appropriate score sheet. The Arena Steward shall ensure that all the judges have finished their judging and, should they have done so, indicate the handler that he/she may leave the center of the arena. The horse shall then be placed in the last place in the line. Article 76. While a horse is being judged in the arena, whether in movement or at halt, the other handlers must ensure that their horses remain quiet and must abstain from moving them, even if they are at one end of the arena, to avoid distracting or exciting the horse being judged. Article 77. No previous results of any horse may be announced while they are being judged. Nevertheless, as many details as are available or are desired, may be given after the scores for each horse have been published. Article 78. When the last horse has been judged, the Secretary shall work out the ranking for the whole section. Said ranking may not be altered, except in the case of a mistake by the Secretary. The Arena Steward shall read out the top 10, in reverse order of their place; these horses shall then go to the center of the arena to receive the corresponding awards. 28 of 58

29 Article 79. Should any horse be subsequently disqualified, the remainder shall all go up a place in the final ranking of the section, with a new list being prepared and published. Article 80. Ties In the event of a tie only the first five places shall go forward to a tie-break, other horses that are tied shall be considered as ex aequo. When there is more than one Judge, the horse that has been awarded the best scores from the greatest number of judges shall be chosen. Should the tie continue, the tied horses will move to the center of the arena and the judging shall be performed based upon comparison. Each Judge shall note on a sheet of paper the number of the horse they consider the best and give the said sheet of paper to the Arena Steward, who shall then count the votes. The winning horse shall be the horse receiving the highest number of votes from the judges. Should the tie persist, a deciding vote shall be cast. If there is only one Judge, he/she shall observe the tied horses where they are or by consulting the score sheets or his/her personal notes, as would be necessary. Should there be a tie in one of the sections for the Best Movement award, and there are more than two judges, the horse that the larger number of judges has given the best score will be chosen. Should the tie persist, they must perform, in number order, the same route they performed in the section. Each Judge shall note down on a sheet of paper the number of the horse they consider to be best and then turn the sheet over to the Arena Steward, who shall then count the votes. The winning horse shall be the horse that receives the greater number of votes from the judges. Should the tie persist, a deciding vote shall be cast. Should there be a single judge, he/she shall break the tie to determine the Best Movements in the Section by placing the horses involved in the tie according to their number, performing the same itinerary, or if the judge so decides this to be unnecessary, may consult the judging sheet or his/her notes, as considered necessary. Should the tie be for the Best Functionality Award for that section, the winner shall be the horse with the highest score on the score sheet by regions, including movements in hand. If, after this the tie persists, the tie shall remain. Article 81. Deciding Vote With regards to possible ties, a Deciding Vote by the Judges has been established. Ties shall be resolved as explained below: 1) For competitions with 2 Judges: each Judge has the deciding vote in the following sections: - Judge 1: sections, 1, 4, 5, 8, 9, 12 and 13 - Judge 2: sections, 2, 3, 6, 7, 10, 11, 14 and 15 2) For competitions with 3 Judges: each Judge has the deciding vote in the following sections: - Judge 1: sections, 1, 6, 7, 12 and 13 - Judge 2: sections, 2, 5, 8, 11 and 14 - Judge 3: sections, 3, 4, 9, 10 and 15 For Special Awards, the deciding vote shall be cast as laid out below: 29 of 58

Awards for Sections In each section, at least the following Awards shall be granted: -1 st Champion of the Section, gold medal and /or trophy. -2 nd Reserve Champion of the Section, silver medal and/or trophy. -3 rd Third place in the Section, bronze medal and/or trophy. - Award for the best movement in-hand (B.M.) - Award for Functionality where relevant (B.F.) Each Competition OC has the authority to award rosettes and/or certificates, along with the awards. The OC may grant as many Awards and Honorary Mentions as deemed appropriate. If in any of the sections being judged, none of the horses presented has, in the opinion of the Judges, sufficient quality to rank it in the top places, these places could be declared null and void, thus ranking the horses in the remaining places. The award for Best Movement in the sections 1, 2, 3, 4, 5 and 6 shall go to the horse that has the highest score resulting from adding the scores for walk and trot. In the case of sections 7, 8, 9, 10, 11, 12 and 15, the winner shall be the horse that has the highest score resulting from tallying the scores for walk, trot and canter. This award shall be considered null and void should the best score not exceed 16 points There is a Functionality Award for sections 7-8, 9-10, and This is granted to the mare or stallion that obtains the highest score in the functionality test, from among the finalists in the sections of the same age group. Should there be a tie, it shall be awarded to the horse that earned the best score for anatomical areas, including the movement in-hand. Should the tie persist, the tie shall remain. 31 of 58

32 Likewise, an award has also been established for the best functionality for those horses in section 15, this being the horse that obtains the best score in the functionality test. In the case of a tie, follow the instructions in the above section. Article 83. Special Awards At all competitions of any category, the following Special Awards must be offered: - Best Breeder - Reserve Breeder - Champion Owner - Stallion Champion and Reserve - Mare Champion and Reserve - Colt Champion and Reserve - Filly Champion and Reserve - Functionality Champion and Reserve - Adult Movement Champion - Youngstock Movement Champion 1. BEST BREEDER AWARD Any breeder seeking the Best Breeder Award must fulfill the following requirements: 1. All the horses presented at the competition, whether entered or not for this award, must have a microchip with his/her breeder code. 2. Horses that come from a family inheritance, donation or transfer may be included for this award, always provided that the original stud farm has been divided and the owner has ceased to be a breeder, this being an exception to the stipulation in the point above. 3. When a breeder or stud farm uses more than one brand or form of identification, they must demonstrate that both belong to the same owner or that they come from direct inheritances. 4. The horses are all owned by the said breeder. 5. Present horses at least in at least six (6) sections, of which it is obligatory to present at least one brood mare in any of sections 7, 9 or 11, one stallion in any of sections 8, 10 and 12 and one cobra in Section Present horses at least in three (3) other sections. These could include those for stallions or mares in which one horse may have already been presented. In those competitions where yearlings (sections 1 and 2) participate, these may not be tallied for the Champion Stud Farm Award. Horses in Section 15 shall also not be taken into account for this award. The Best Breeder Award shall be granted to the stud farm that earns the highest average resulting from the sum of the points obtained by each on the horses entered for this award divided among the horses presented. The points obtained by each horse depends on their ranking and the section in which they are participating, according to the table laid out in Appendix X, to which the following additional points must be added, which are awarded for achieving a Special Award: 32 of 58

33 - Stallion/Mare Champion: 3 points - Stallion/Mare Reserve Champion: 2 points - Filly/Colt Champion: 2 points - Functionality Champion: 2 points - Adult Movement Champion: 2 points - Youngstock Movement Champion: 1 point - Filly/Colt Reserve Champion: 1 point - Functionality Reserve Champion: 1 point In the division, any horse achieving a Special Award shall continue to be considered a single horse. Those horses that, having been registered and entered for this Award, and that were not presented at the competition in their Section, whatever the reason may be or were disqualified, shall be awarded the corresponding points according to the table in Appendix X. Section 13 shall be calculated in the same manner as the Sections for individual horses. Thus, the score established in Appendix X shall be added to the total for the stud farm and one single unit shall be added to the number of horses presented by said stud farm. Horses in section 14 shall not count towards the calculation for the Best Breeder Award, although they shall be taken into account under the first criteria when resolving a tie. In the event of a tie, this shall be resolved in favor of that Stud Farm which has: 1. Presented a 5-mare Cobra 2. If there is more than one Stud Farm in this situation, the one that earned the highest score in this Section 3. The stud farm which earned the highest score in the Section for 3-mare Cobras 4. Presented the highest number of animals for the Best Breeder Award 5. Presented a mare in the functionality test 6. Presented stallions in the highest number of Sections 7. Presented mares in the highest number of Sections 2. RESERVE BEST BREEDER This will be that breeder, from among those aspiring to this award, who has obtained the second best score. 3. CHAMPION OWNER AWARD All those who fulfill the requirements laid out in these Rules and Regulations and present horses belonging to them in the same Sections established for the Best Breeder Award, even though all or some of the horses may not carry their own brand, nor are micro chipped with the breeder code of the exhibitor, may seek the Champion Owner Award. The average shall be calculated in the same manner as described for the Best Breeder Award. In the event of a tie, the same criteria shall be applied as explained for the previous award. 4. STALLION AND RESERVE CHAMPION AWARDS FOR THE COMPETITION The Stallion and Reserve Champion for the Competition shall be chosen from among those placed 1 st and 2 nd in Sections 8, 10 and 12, and as follows: 33 of 58

34 - This championship shall be judged by all the Judges, who shall judge the horses at halt. Only when there are two panels of judges shall the horses perform the same movements that correspond to their Section. - The first placed from each of the indicated Sections shall be placed in the center of the arena. Those placed second shall remain at one of the ends of the arena. - The Judges shall then compare the three horses that placed first in their respective sections. - Each Judge shall award three points to the horse they consider the best, two to the one that they consider second best and one to the third. - The Arena Steward shall tally the points awarded by each of the Judges. The winner and therefore the Champion of the Competition shall be the horse with the highest number of points. - Subsequently, the Champion shall retire to the end of the arena, and his place shall be occupied by the horse that came second in their section. The election of the Reserve Champion of the Competition shall then take place using the same system as in the election of the Champion. - In the event of a tie, the Judges act in the same way, only scoring the two tied horses, giving two points to the horse considered the best and one point to the second. - If the tie persists, it shall be broken by the casting vote. 5. MARE AND RESERVE CHAMPION AWARDS OF THE COMPETITION The Mare and Reserve Champion of the Competition shall be chosen from among those placed 1 st and 2 nd in Sections 7, 9 and 11 using the same procedures established for the stallions. 6. COLT AND RESERVE CHAMPION AWARDS OF THE COMPETITION This Award has been established for horses in Sections 4 and 6, to determine the Colt Champion and Reserve. The procedure for this award is identical to the one used for the Stallion Champion and Reserve. 7. FILLY AND RESERVE CHAMPION AWARDS OF THE COMPETITION This Award has been established for the horses in Sections 3 and 5, to determine the Filly Champion and Reserve. The procedure for this award is identical to the one used for the Stallion Champion and Reserve. 8. FUNCTIONALITY AND RESERVE CHAMPION AWARD The procedure for the election of these awards shall be different, depending on the number of panels of Judges: 1. A single Panel of Judges: Whenever there is only one group of Judges, the Award for the Functionality Champion shall automatically be awarded to the horse with the highest score, out of all the participants in the sections for stallions and mares, according to their age group (8-7, 9-10 and 11-12), that have been judged. Likewise, the Reserve Award shall go to the horse that obtains the second best score. 34 of 58

35 In the event of a tie, the winning horse shall be the horse that has obtained the highest score for anatomical areas, including movement in-hand. Should the tie persist, the winner shall be the horse with the best score for in-hand movements and as a third option, a vote among the Judges. Should the tie persist, the casting vote shall be used. 2. Two panels of Judges: If, due to the characteristics of the competition, more than one group of Judges is necessary, even if the Functionality test has been judged by all of the judges, those horses placing first and second in sections, 8, 10 and 12 and of the mare sections that have performed this test, these horses shall dispute the title against one another in a final judged by all the Judges, complying with the Rules and Regulations established for each Section. The horse that achieves the highest average score from among the Judges shall be Functionality Champion with the Reserve being the horse that earns the second highest score. To determine the starting order, a draw will take place, involving those horses participating in the Final, bearing in mind those riders that are riding more than one horse. In the event of a tie, the horse that obtained the highest score on the score sheet for anatomical areas, including movement in-hand shall be the winner. Should the tie continue, the winner shall be the horse with the best score for in-hand movements and as a third option, a vote among the Judges. Should the tie persist, the casting vote shall be used. As in the previous cases, the Judges shall make no comments about the horses being judged. 9. ADULT AND YOUNGSTOCK CHAMPIONS OF MOVEMENT Two awards have been established in which different paces are judged depending on the age of the horse, one for the Youngstock, in which walk and trot are performed, and one for Adults, in which walk, trot and canter are performed. For both Awards, the horses must complete the same route taken when their section was judged twice. a) Youngstock Movement Champion: This shall be disputed by those horses that were the Movement Champion in each one of sections 3, 4, 5 and 6. These Champions shall compete against each other to choose the Youngstock Movement Champion by comparison, using the direct voting system. Each Judge shall vote for the horse that, in his/her opinion, has best performed the paces. The horse with the most votes shall be the winner. In the case of a tie, the said horses shall perform another route, the same as the previous one, and the Judges shall, once again, vote between the tied horses. Should the tie persist, the casting vote shall be used. b) Adult Movement Champion: This shall be disputed by those horses that were the Movement Champion in each one of sections 7, 8, 9, 10, 11 and 12. These Champions shall compete against each other for the award for Youngstock Movement Champion by comparison, using the direct voting system. Each Judge shall vote for the horse that, in their opinion, has best performed the paces. The horse with the most votes shall be the winner. In the case of a tie, the said horses 35 of 58

36 shall perform another route, the same as the previous one, and the Judges shall, once again, vote between the tied horses. Should the tie persist, the casting vote shall be used. Article 84. All horses qualifying for a Special Award must attend all judgings. Should a qualified horse fail to participate in the judging of any of the Special Awards, whatever the reason, it shall be disqualified, thus losing all its rights; moreover, in the case that nonattendance is not justified, such actions shall be considered severe misconduct. If said horse had been placed first in its section, the horse placed second shall take its place and be judged with the others in first place. If said horse placed second in its section, or in the section s Movements, no substitution shall be permitted. Article 85. Awards Ceremony The OC shall publish the time and location of the Awards Ceremony in the Competition program. Those horses that have won an award must to attend this ceremony. In the event of any winning horse fails to appear to receive an Awards, the owner shall lose the said Award/s and there shall be no winner. The penalty is applicable to all awards for horses presented by that owner, and shall be considered serious misconduct and shall lead to losing any acquired rights. A person may miss the award ceremony only if he/she has written authorization from the competition veterinarian. CHAPTER XIII. APPEALS AGAINST DECISIONS MADE BY THE ORGANIZING COMMITTEE Article 86. All decisions adopted by the OC may be appealed before the Appeals Jury, within one (1) hour. CHAPTER XIV. ANTI-DOPING TESTING Article 87. The administration/use of substances that could mask the physical condition of any horse is strictly forbidden. In the event that the competition veterinarian so authorizes, permission can be requested for exemption to use certain substances; the corresponding veterinarian report must be provided. In the event of a horse undergoing a specific treatment, the OC must be presented with a complete list of the medications being prescribed and administered to the horse. 36 of 58

37 PROVISION TO REVOKE: The approval of these Rules and Regulations supersedes any other rule or regulation that affects the undertaking of the Conformational and Functional Competitions published prior to the application of these current Rules and Regulations. These Rules and Regulations applicable upon approval by the ANCCE Board of Directors, independently of whether or not they have been endorsed by the General Assembly and compliance with them is obligatory at all the PRE Conformation-Functional Competitions throughout the whole of 2014, both in Spain and abroad. 37 of 58

38 APPENDIX I Misconduct and Disciplinary Action at Conformation Competitions CHAPTER I. DISCIPLINARY PROCEDURE Article 1. Competency 1. For these Rules and Regulations, the ANCCE Conformation Competitions Followup Commission is the competent body to launch, proceed and solve all disciplinary procedures. 2. The General Director shall be responsible for carrying out preliminary proceedings. 3. The commission shall adopt all agreements for the imposition of disciplinary action by simple majority. Article 2. The agreements to impose disciplinary action may be appealed before the ANCCE Executive Committee within a period of seven (7) working days following notification; this action shall conclude the disciplinary process. The ANCCE Executive Committee shall adopt all agreements for the imposition of disciplinary action by simple majority. For this to be valid, at least two-thirds of the members of the said committee must be present, with the President having the casting vote. Article 3. Initiation format 1. Disciplinary actions shall always be launched ex-officio, upon agreement of the ANCCE Follow-up Commission for Conformation Competitions, either on their own initiative, based upon reasoned request by the Organizing Committees, by the Appeals Jury for the Competition, from ANCCE itself, or due to motivated complaint. 2. The Commission Secretary, in a written or oral report, shall indict and provide the facts requiring disciplinary action. The Competition Commission, in view of these facts, shall oversee the actions taken, or shall order the initiation of the corresponding disciplinary actions. 3. The formulation of a petition does not automatically mean that the competent body shall begin disciplinary procedures, although it must inform the body that has formulated the request and the reasoning, as would be the case, should the initiation of disciplinary procedures not be required. When an accusation has been made, the plaintiff must be informed whether or not disciplinary procedures have been launched, when the report is accompanied by the corresponding request for disciplinary action. Article 4. Initiation 1. The initiation of disciplinary procedures shall be formalized with the following minimum content: a) The identification of the presumed responsible person or persons. 38 of 58

39 b) The facts, clearly explained that motivate the initiation of disciplinary procedures, the possible evaluation and the corresponding disciplinary actions, without prejudice to the final results. c) Judge and, where relevant, secretary of the procedure, specifying the system by which they are challenged. d) Competent body for the resolution of the procedure and the rule or regulation that attributes the said competence, indicating the possibility that the person presumed responsible may voluntarily recognize his/her responsibility. e) Provisional measures that have been agreed upon with the competent body to begin the disciplinary procedure, without this having any effect on any proceedings that may be adopted during the said procedure. f) Indication of the right to formulate allegations, a hearing during the procedure and the established time span for such processes. 2. The person responsible for pre-trial proceedings, including all necessary actions that may be taken, shall be informed of the agreement to launch disciplinary proceedings, and shall notify the plaintiff, as would be the case, and all interested parties, including the defendant. The notification shall inform all interested parties that should they not present allegations about the content of the procedure within ten (10) working days, the proceedings may be considered a resolution when it contains a precise pronouncement about the attributed responsibility, to the effects foreseen in articles 9 and 10 of the present appendix. Article 5. Provisional measures 1. At any time, the competent body may adopt, by means of a justified agreement, the resolution of this matter with the provisional measures necessary to ensure the effectiveness of the resolution that may arise, the good outcome of the procedure, avoid prolonging the effects of the offense and the demands of general interests. 2. The provisional measures must be suited to the intensity, proportion and needs of the objectives sought to guarantee each specific case. Article 6. Actions and allegations 1. The interested parties shall have ten (10) days to provide as many allegations, documents or information deemed suitable and, as would be the case, propose specific proof the foreseen resources. In the notification indicating the commencement of procedures, the parties and all interested parties shall be informed of the established calendar. 2. Having proceeded with the notification as referred to in the previous point; the judge for the procedure shall carry out, ex officio, all the necessary procedures to examine the facts, collecting the data and relevant information to determine, where relevant, the existence of responsibilities liable for disciplinary action. 3. If, as a consequence of the procedure, there is a modification of the initial determination of the facts, their possible description, the disciplinary actions that may 39 of 58

40 be taken or the responsibilities liable for disciplinary action, the defendant shall be notified of the resolution proposal. Article 7. Proposed Resolution 1. Once the analysis, as would be the case, has concluded, the judge of the procedure shall formulate a proposed resolution in which the facts shall be clearly laid out, specifying those facts considered proven and their precise legal name, determining the offense, as would be the case, as well as the responsible person or persons, specifying the disciplinary action proposed and the provisional measures adopted, as would be the case, by the competent body, to start the procedure or by the judge for the case; or he/she shall propose the declaration that no offense or misconduct has been committed. 2. The judge of the procedure must provide the proposed resolution within a period not exceeding one (1) month, as of the initiation of the procedure. The judge may, for justified reasons related to the use of evidence, request an extension of this time period from the Follow-up Commission. Article 8. Hearing 1. The interested parties shall be notified of the proposed resolution, giving them five (5) days to formulate allegations and to present the documents and information they deem necessary before the judge handling the procedure. 2. The proposed resolution shall be studied immediately by the competent body to resolve the procedure, along with all relevant documents, allegations and information. Article 9. Resolution 1. Prior to dictating a resolution, the competent body may decide, by means of justified agreement, to carry out complementary actions that are essential to resolve the procedure. The interested parties shall be notified of the agreement to carry out additional actions, granting seven (7) days to formulate the pertinent allegations. The complementary actions shall take place within a period not exceeding fifteen (15) days. The time span to resolve the procedure shall be suspended until the termination of the additional actions. The reports that immediately precede the final determination of the procedure shall not have the consideration of additional actions. 2. The competent body shall dictate a resolution that is justified and shall decide on all the questions suggested by the interested parties and all others derived from the procedure. The resolution shall be formalized by any means authorized by the competent body. The resolution shall be adopted within ten (10) days, from the reception of the proposed resolution and the documents, allegations and information used in the procedure, except for those aspects laid out in points 1 and 3 of this article. 3. In the resolution, facts that differ from those determined in the investigation phase of the procedure shall not be accepted, except for those that are, as would be the case, the type laid out in point 1 of this article, in accordance with the Report requested in this regard, independent of their different legal value. 41 competent body considers that the offense is more serious than what has been determined in the proposed resolution, the defendant shall be notified, so that he/she can supply as many allegations as deemed necessary, granting fifteen (15) days to this end. 4. The resolution could be brought before the ANCCE Executive Committee within a period of seven (7) days following the notification. This organ will dictate the resolution within a maximum period of 15 days. Article 10. Effects of the resolution 1. The resolutions that put an end to the disciplinary procedure shall be carried out immediately. 2. The resolutions that do not terminate the disciplinary procedure shall not be executed as long as a resolution has not been reached by the ordinary appeal, in which case, an appeal has been presented or the time span to present an appeal has lapsed without this having been issued. 3. When the plaintiff has been disciplined or refutes the resolution adopted, the ordinary appeal resolutions and the official review procedures that, where relevant, intervene or substantiate, shall not translate into the imposition of more serious disciplinary actions upon the plaintiff. Faced with the presentation of an appeal and while this is being substantiated, the committee could adopt precautionary measures. 4. In such case as indicated in the previous section, the resolutions could adopt the specific preventive actions to guarantee their effectiveness as long as they are not executive procedures. 5. The aforementioned actions may consist the maintenance of the provisional measures, which, as would be the case, have been adopted, the competent body may adopt, at any time, by means of justified agreement, any provisional measures necessary to ensure the effectiveness of the resolution that could be taken, the good resolution of the procedure, to avoid maintaining the effects of the offense and the requirements of the general interests. 6. When it is thus required due to urgent and pressing reasons, the competent body for launching the procedure or the judge may adopt the provisional measures deemed necessary. 7. The provisional measures may consist of the temporary suspension of activities and the deposit of bond, as well as the withdrawal of products or temporary suspension of services for reasons of health, hygiene or safety, and in the others laid out in the corresponding specific regulations. 8. The provisional measures must be specifically laid out and be suited to the intensity, proportionality and necessities of the objectives they seek to guarantee in each specific case. In any event, the preventive actions shall be subject to the limitations that the following article establishes for provisional measures. Article 11. The Secretary of the Committee must keep a register of the disciplinary measures imposed, for reason, among others, of the possible appreciation of circumstances modifying the 41 of 58

42 responsibility and of the calculation of the proposed time periods of both the violation and complying with the sanctions. Article Minor misconduct prescribe one (1) month, serious violations, six (6) months and very serious violations, two (2) years, as of the next day following the date when the misconduct was committed. 2. The prescribed time periods shall be interrupted by the initiation of the disciplinary procedure, but if this remains paralyzed for one (1) month for reasons that are not caused by the person or body subject to said procedure, the corresponding time period shall restart, being once again interrupted when the proceedings begin once again. CHAPTER II. MISCONDUCT AND DISCIPLINARY PROCEDURES Article 13. Minor Misconduct In all cases, the following shall be considered minor misconduct: a) Behaving in an inappropriate and notorious manner at the Conformational, Competitive or Championship Competitions of any kind, which alters the normal progress of the competition. b) The observations formulated by the Judges, technicians and other official members of the competition, Directors and other competition authorities while carrying out their duties, in such a way that they may be understood as being slightly impolite. c) Being slightly impolite with the audience, Judges, members of the Organizing Committee, breeders, riders and groom/handler. d) The adoption of a passive attitude in complying with orders and instructions received from Judges and members of the Organizing Committee when performing their duties. e) Negligence in the preservation and care of the grounds for amounts less than 600, grounds, facilities and other material resources, when this does not constitute a serious misconduct. f) Non-compliance on behalf of the Organizing Committee with their economic/financial obligations for amounts less than 600. The abuse of a horse provided that this does not constitute cruelty to animals or serious or severe misconduct. g) The non-presentation for judging in any Section within the competition, when this does not constitute serious misconduct. h) Being inconsiderate to any groom/handler or rider while in the arena. i) Using the scores of another Judge in the arena. j) Making apparent gestures or speaking between themselves, with regards to the animals presented for judging. 42 of 58

43 k) Non-compliance on behalf of the Organizing Committee with their formal obligations defined in the Rules and Regulations and administrations when this does not constitute serious misconduct. l) All those aspects not contained herein and that are manifestly against the Rules and Regulations for Conformational-Functional Competitions Article 14. Serious Misconduct In all cases, the following shall be considered serious misconduct: a) Any behavior, attitude or expression that is aggressive or unsporting used while confronting the Judges or members of the Organizing Committee, or other breeders, grooms/handlers, riders or the general public, when this is not considered severe misconduct, even though it is considered to be aggravated due to being under the effects of controlled substances and or recreational drugs. b) Judges, grooms/handlers and riders being present at the competition while under the effects of controlled substances and recreational drugs, when this is not considered to be a severe misconduct. c) Notorious and public actions that affect dignity or decency when they are especially serious, as well as libel, insults and slander towards Judges and official members, when this is not considered to be a severe misconduct. d) Actions of cruelty or abuse to a horse, when this is not considered to be a severe misconduct. e) Failure on behalf of the Organizing Committee to comply with any financial obligation of an amount great than 600 and less than 3,000. f) Negligence in the preservation and care of the, grounds, facilities and other material resources, which could cause damage to people or animals, for an amount great than 600 and less than 3,000. g) The discovery of any conflict of interests on behalf of the judges, breeders, riders or grooms/presenters, as referred to in the Rules and Regulations for Conformational-Functional Competitions for Purebred Spanish Stallions and Mares after the judging has been carried out. h) Not arriving to judge a competition or any Section within the competition, causing a major problem in the smooth running of said competition. i) A judge touching or moving a horse in the arena. j) Repeating three (3) examples of minor misconduct. k) Clear and flagrant non-compliance of the obligation to judge according to the breed profile and these present Rules and Regulations for Conformation Competitions, when there is at least serious negligence, on behalf of the Judge. l) Non-compliance on behalf of the Organizing Committee with their formal obligations as defined in the Rules and Regulations and administrations that negatively affect the normal running or processing following the Competition. m) All those aspects that are not contained herein and that are manifestly against the Rules and Regulations for Conformational-Functional Competitions Article 15. Severe misconduct In all cases, the following shall be considered severe misconduct: 43 of 58

44 a) Abuses of authority. b) Noncompliance with any disciplinary action imposed. Violations shall be punished with disciplinary action. The same listing shall be applied when the noncompliance is related to precautionary measures. c) Actions carried out with the aim of predetermining, by means of cash, intimidation or simple agreements, the results of a test or competition. d) Any behavior, attitude or expression that is aggressive or unsporting used while confronting the Judges or members of the Organizing Committee, or other breeders, grooms/handlers, riders or the general public, this being aggravated due to being under the effects of controlled substances and recreational drugs. e) Public declarations that incite violence. f) Judges, grooms/handlers and riders being present at the competition while under the effects of controlled substances and recreational drugs. g) For the breeders, the use of unauthorized drugs on horses. h) The improper participation, non-appearance or unjustified withdrawal from a competition test. i) Presenting a horse in a section different to where it belongs. j) Notorious and publics actions that affect dignity or decency when they are especially serious, as well as libel, insults and slander directed towards Judges and official members, or by these towards breeders. k) Serious actions of cruelty or abuse to a horse. l) Influencing or trying to influence the judgment of another judge who is a part of the same Panel of Judges m) Non-compliance with regards to conflicting interests by the grooms/handlers, riders, breeders or judges, which is listed for each of these herein, and behaving in the ways described in Article 53, points 3 and 4 of these present Rules and Regulations. n) The failure of the Organizing Committee to meet its financial obligation of an amount surpassing 3,000. ñ) Repeating three (3) examples of serious of misconduct. o) Not completing the judging records in all their sections p) Entering livestock while being a member of the Appeals Jury. q) Non-compliance on behalf of the Organizing Committee with their formal obligations defined in the Rules and Regulations and administrations that negatively affect the normal running or processing following the Competition. r) All those aspects that are not contained in these Rules and Regulations and are manifestly against Conformational-Functional Competition Rules and that are considered severe. Article 16. Disciplinary action for minor misconduct shall be a written reprimand, and could go as far as expulsion from the competition. Article 17. The following disciplinary actions shall be taken in the event of serious misconduct: 44 of 58

45 a) Temporary prohibition of up to one (1) year to attend and/or participate in competitions. This prohibition could be extended, for the same time period, to the horse or horses owned by said stud farm that are entered in the Competition in which the misconduct took place, including when these no longer belong to said stud farm. b) Loss of the scores of the entered horses, if it is a competition, with regards to the Book of Merits. c) Prohibition to act as a Judge for a term of up to one (1) year. d) Prohibition to participate in the organization of competitions for a period of three (3) years. e) In the case of the misconduct as laid out in Article 19-j, immediate loss of category, being able to be reinstated by carrying out the courses or complying with the training measures that are established. Article 18. The following disciplinary actions shall be taken in the event of severe misconduct: a) Temporary prohibition to attend and/or participate in competitions for a period exceeding one (1) year, which could lead to permanent disqualification or prohibition to participate in Conformational-Functional Competitions, following a hearing on the subject. The prohibition could be extended, during the period of the disciplinary action, except when this is definitive, to the horse or horses owned by said stud farm that are entered in the Competition where the misconduct took place, including when these no longer belong to said stud farm. b) Loss of the scores of the entered horses, if it is a competition, with regards to the Book of Merits. c) Prohibition to act as a Judge for a term exceeding one (1) year, which could lead to permanent disqualification or prohibition to participate in Conformational- Functional Competitions, following a hearing on the subject. d) Prohibition to participate in the organization of competitions for a period of three (3) years or more. In any event, for serious and severe misconduct, once the proceedings have commenced, the possible offender may be suspended from carrying out his/her duties or from presenting horses owned by the said person. The disciplinary actions restricting the rights to participate in competitions affect both the breeder who is guilty of misconduct and the horses owned by said breeder that have participated in the competition where the misconduct leading to the disciplinary action took place. Article 19. Termination of disciplinary measures a) Upon compliance with the disciplinary measure. b) With the removal of the disciplinary measure. This can be done by the body imposing the said measure, should the attitude and behavior of the individual being disciplined so justify. Thus, the repair to the damage caused or such intent shall be favorable elements for the removal of the disciplinary action. 45 of 58
