12 General Terms and Conditions Horses in this catalog are entered under the following terms and conditions: The Consignor agrees that all animals shall be at the place of sale in proper time, delivered free of expense to our sale grounds and subject to our directions for sale by auction. The animals consigned to the Saddle Brook Stables Spring Sale are entirely at the risk of the Consignor until sold or paid for fully. The Consignor is the responsible party and Saddle Brook Stables acts only as the agent. The Consignor guarantees the title of the property to the buyer and hereby represents that there are no claims against, no lien upon, nor ownership, in whole or part, of any animal entered by him that can in any way interfere with its rightful sale and delivery or that can hereafter deprive the purchaser of full, complete and peaceful ownership, and that all defects, tricks, unsoundness, or faults of any nature known to the Consignor will be stated. Full commission will be charged on animals and equipment sold through or by reason of a sale held and conducted by Saddle Brook Stables. A fee of $80.00 will be charged on each animal catalogued. However, 8%commission will be charged on each animal sold. Your entry fee will be deducted as part of your commission when an animal sells for over $1, and will take care of your commission if the animal sells for less than $1, An additional $40.00 will be charged to the Seller for the transfer fee on any horses sold that are registered with the TWHBEA. All entries are also subject to a $10.00 Veterinarian Fee. Consignors will have the privilege of no sale if they do not wish to sale, for the last bid to the animal. However, let it be known before leaving the sale ring. Immediately after the animal is sold, it will be the sole risk, expense and responsibility of the buyers. Saddle Brook Stables acts as the agent only. Buyers and spectators are cautioned to take care of themselves while horses are being sold or shown in the sale ring or on the grounds. We urge all in attendance to keep clear of the sale ring, and upon failure to do so, if there is an injury resultant there from, Saddle Brook Stables disclaims any liability. Ages, height, markings, and other matters of that character are approximated by the Consignor and are not guaranteed unless expressly announced. We endeavor to verify records and have them authentically stated, but bidders should examine for themselves, as the catalog statements may be in error; and only such parts of them as the Auctioneer shall specifically designate are warranted. The Consignor is the responsible party for all these representations, which we in no way guarantee, but, will have the Auctioneer call your attention to any corrections that should be made, which will take precedence over the printed matter in the catalog. Buyers are therefore cautioned to pay attention to the Auctioneer s announcements. All settlements will be made on the day of the sale before the horses are removed from Saddle Brook Stables if the buyer is on-site. Cash and checks will be accepted for on-site buyers. Transactions processed through our on-line bidding service are subject to the terms and conditions set forth in the Saddle Brook Stables On-Line Sales Terms and Conditions. All TWHBEA registration papers will be mailed to the TWHBEA for transfer of ownership and the Association will forward them on to the Buyer. Consignor will receive payment by mail within a reasonable amount of time after all checks have cleared and the funds have been fully collected. All horses entered in the sale will be examined by a licensed veterinarian for soundness. Buyers are cautioned to listen to the veterinarian s comments and carefully examine the condition and health of the horse as horses are sold as is and all purchases are final.
