2 Thank you for being a part of our 2016 Celebration Super Sale & Yearling Festival *****ABSOLUTELY NO PEN HOOKING***** This will strictly be enforced ALL HORSES ENTERING THE GROUNDS THAT ARE NOT ENTERED IN THE SALE WILL BE REQUIRED TO PAY $140 IN ORDER TO EXIT THE GROUNDS PVF Livestock Auction Rules: PVF Livestock Auction will be conducted in strict conformity with the Act as amended. All horses brought on the grounds will be closely inspected by a person qualified to detect and diagnose a horse which is sore, and management will prohibit the sale, offering for sale, or auction of any horse which is sore. 6 MONTHS NEGATIVE COGGINS TEST REQUIRED PVF Livestock Auction reserves the right to substitute a horse for one in the catalog if we are notified that the horse will not be at the sale. That number may be given to a new horse and it will sell with that number in order. Consignors All horses that are cataloged and entered in the sale are REQUIRED TO PAY $140 regardless whether they show up or not. Once horses enter the sale grounds, they will not be allowed out the gate without a paid stamp. The animals consigned to PVF Livestock Auction are entirely at the risk of the consignor until sold and fully paid for. At that time, they are the responsibility of the new owner. PVF Livestock Auction is only responsible for the sale of the animal the day of the sale. In any case that purchaser fails to pay for or pick up animal sold to him or her, PVF Livestock Auction is then authorized to accept the same amount from another person or they may, if in their judgment it be in the best interest for all concerned, put the animal up for sale a second time. But in the case the animal does not bring the same amount, the consignor agrees to receive it back as unsold without attaching any liability to PVF Livestock Auction unless the said Consignor is present and agrees to take the last bid on the animal when run through the sale a second time, and this condition includes in its obligation the stoppage of payment of checks or drafts or any action of that nature. Transfer Fees Buyers will be responsible to pay transfer fees for animals bought to TWHBEA in the amount of $ PVF Livestock Auction will transfer all animals sold during its sale and payment for transfers will go direct to TWHBEA. This is to protect the buyers and sellers at our sale.

3 Fee $140 Consignment Fee 1-2 horses $130 Consignment Fee 3-7 horses $120 Consignment Fee 8 or more horses Commission 8% of the Final Bid Price Bids The highest bidder will be the buyer, and if any dispute shall arise between two or more bidders, the animal in dispute shall immediately be put up again for advance bids. If there is no advance, then the animal shall go to the person from whom the Auctioneer recognized the last bid. PVF Livestock Auction is authorized by the consignor for each animal to decline any bid made by parties who have defaulted on former purchases or by any persons, in their judgment, that are not responsible. PVF Livestock Auction is governed by and will abide by all laws of the State of Tennessee and the United States of America. All finding of the Sale Veterinarian and DQP shall be final. Sellers will be paid for their completed sales within 15 days of the auction provided all paperwork is completed. Sales proceeds will be held in Paying with an INSUFFICIENT FUNDS check, the size of the purchases is a felony. Anyone writing an uncollectable check for any reason including but not limited to stop payment, insufficient funds, closed account, etc. will be turned over to the courts for collection and prosecution which may include jail time. Liability Buyers and spectators are cautioned to take care of themselves while horses are being sold or shown in the sale ring as well as on the grounds. We urge all in attendance to keep clear of the sale ring. If there is an accident, PVF Livestock Auction disclaims any liability. Under Tennessee Law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Tennessee Code Annotated, title 44, chapter 20.
