3 INTRODUCTION This prospectus avails information on the hunting available in Tuli Safari Area. The area falls under the management of the Parks and Wildlife Management Authority (PWMA).The hunting camps are sold through a public auction to local and foreign buyers. TULI SAFARI AREA Hunting in Tuli can be conducted from Packenham Camp, North Camp or South Camp. The three hunting camps are located on the western bank of the Shashe River hence access is strictly by 4x4 vehicles as hunters have to cross the Shashe River from the Tuli administration offices. Clients are expected to provide their own outfitting services. The offices are open from 0700hours to 1700hours and all hunters are required to report to the office during these prescribed hours on entering and leaving the hunting area. Failure to report is an offence. 1
4 Tuli can be contacted on the mobile phones and addresses below: Mr Innocent Mupedze or Mr Simeon Mudimba or GENERAL INFORMATION The Parks and Wildlife Act Chapter 20:14 has rules and regulations on the protection of Zimbabwe's natural resources. In addition, the hunting permit also has details on the terms and conditions to be followed while conducting the hunts. This Hunting Permit can be obtained from the Parks and Wildlife Management Authority Head Office, National Botanical Gardens, Corner Borrowdale Road and Sandringham Drive, Alexandra Park, Harare, from Monday to Friday from 0800hrs to 1300hrs and 1400hrs to 1630hrs. NB: Permits should be collected and signed for, and will only be issued upon production of a Desired Liaison Auctioneersinvoice, receipt, and acceptable identification. GENERAL ADVICE Desired Liaison Auctioneershave taken all due care to ensure that all information printed, advised, and/or announced about the hunting camps' description is correct and accurate as no responsibility for any inaccurate description will be accepted. Purchasers are therefore urged to follow all the legal requirements of operation and to familiarize themselves with the hunting permit as well as the Parks and Wildlife General Regulations. THE HUNTING CAMPS CONDITIONS OF SALE 1. All hunting bags will be sold in United States dollars (US$). 2. The highest accepted bidder will be declared the purchaser subject to the reserve price. 2
5 3. A RESERVE PRICE HAS BEEN SET FOR EACH HUNT AND LOT AND NO BID BELOW THIS FIGURE WILL BE ACCEPTABLE UNLESS RATIFIED BY A PARKS AND WILDLIFE MANAGEMENT AUTHORITY REPRESENTATIVE. 4. A registration fee of $20 per bidder is payable to Parks and Wildlife Management Authority through the Auctioneers. 5. A cash participation deposit of five thousand United States dollars (US$5,000) (which is refundable if all sale conditions are met) is required in order to obtain a buyer's number. NB: No buyer will be allowed to participate at the auction without paying this deposit. 6. Please note that, the participation deposit will be forfeited if any of the camps bid for has not been fully paid for. The participation deposit therefore counts against the last bag bid for. 7. The remaining balance is to be paid within 7 (seven) working days from the date of the sale. If payment is not received within this period, the hunting camps will be withdrawn and re-offered for sale to other buyers. PLEASE NOTE THAT THE DEPOSITS PAID WILL BE FORFEITED FOR THE DEFAULTERS. 8. In the case of the highest bidder defaulting payment, the Auctioneer has the right to re-offer the under-bidder or any other bidder (whose offer is acceptable), using unbiased discretion. If the Auctioneer acts transparently and in good faith, then any aggrieved party shall take no litigation. 9. All purchases are subject to 15% VAT payable over and above the bid price. An administration fee of 0.09% payable to the Auctioneer will also be levied over and above the purchase price. This is payable at the conclusion of the sale. 10. NO REFUNDS will be given for the camps for whatever reason. 11. If for any reason legal proceedings arise regarding the sale, Desired Liaison Auctioneers shall deal with them in his capacity as the Auctioneer. 3
6 12. Should any disputes arise between bidders during the auction, either involving hunting camps or bags, the hunting camps or bags shall be put up again and re-auctioned. However the Auctioneer may use his discretion to declare a purchaser. If the dispute concerns some other issues pertaining to the auction, the Auctioneer shall arbitrate in an unbiased manner to resolve the dispute. In this regard, the decision of the Auctioneer shall be final. 13. The Auctioneer reserves the right to refuse a bid or withdraw any camp, bag or lot in line with the conditions of sale and the hunting permit. 14. All intending purchasers accept that they are aware of, and understand the requirements of the Parks and Wildlife Management Authority to hunt in the areas being offered for sale. It is essential that buyers are familiar with the Parks regulations on their HUNTING PERMITS. 15. Sale of Extra animals: These shall be sold as separate and independent lots in Tuli Safari Area after the sale of the respective camps. For eligibility to bid for these lot animals, a hunter must have purchased at least one hunting camp. These animals must be hunted within the stipulated period of the purchased hunting camp. 16. RESALE OF PURCHASED CAMPS: Provided a hunt has not been cancelled by the Director General for any failure to comply with the terms and conditions of the sale or the hunting permit terms and conditions, or the provisions of the Act or any regulations made, the purchaser may be permitted to resell a hunt he has purchased in accordance with the circumstances set out in Paragraph 11 of the Hunting Permit. Should the Director General authorize the resale of any hunt, the purchaser may only recover, from the subsequent purchaser (as approved by the Director General), at most the price paid by the bidder. Desired Liaison Auctioneers can only assist with the resale after the Director General's permission has been obtained. The new camp owner will have to pay 10% of the selling price to the Director-General. 17. Combining hunts will be allowed, however prior arrangements should be made with the hunting office and the Officer in Charge at Tuli. 4
7 WEAPONS PROHIBITION AND RESTRICTIONS FOR HUNTING Parks and Wildlife (General) Regulations, 1990 Third Schedule (Section 53) In accordance with the provision of sub-section (2) of these regulations: No person shall use for hunting purposes: - (a) Any rifle or shotgun capable of firing more than one cartridge as a result of one pressure on the trigger; or (b)any weapon with a barrel length of less than 500mm; or (c)pistol or revolver or a bow and arrow. PART A Buffalo Elephant Hippopotamus Any person who hunts any animal specified in Part A of the Third Schedule shall use a weapon having a rifled barrel and propelling a projectile of not less than nine comma two millimeters in diameter with not less than five comma three kilojoules of energy at the muzzle. PART B Eland Giraffe Lion Any person who hunts any animal specified in Part B of the Third Schedule shall use a weapon having a rifled barrel and propelling a projectile of not less than seven millimetres in diameter with not less than four comma three kilojoules of energy at the muzzle. 5
8 PART C Crocodile Kudu Leopard Sable Waterbuck Wildebeest Zebra Spotted hyena Any person who hunts any animal specified in Part C of the Third Schedule should use a weapon having a rifled barrel and propelling a projectile of not less than seven millimeters in diameter with not less than three kilojoules of energy at the muzzle. PART D Bushbuck Bush pig Impala Reedbuck Warthog Any person who hunts any animal specified in Part D of the Third Schedule should use a weapon having a rifled barrel and propelling a projectile of not less than five comma six millimeters in diameter with not less than eight hundred and fifty joules of energy at the muzzle. Any person who hunts any animal except a bird or any animal which is specified in the Third Schedule excluding Parts A, B, C, D shall use: A weapon having a rifled barrel and propelling a projectile not less than five comma six millimeters in diameter with not less than eight hundred and fifty joules of energy at the muzzle, or A smooth bore weapon with an internal barrel-diameter of not less than fifteen millimeters and propelling shot of an average diameter of not less than five millimeters. 6
9 Any person who hunts any bird shall use a weapon having: - A rifled barrel and propelling a projectile with not less than one hundred and fifty joules of energy at the muzzle; or A smooth-bore weapon with an internal barrel diameter of not less than ten millimeters. FIREARMS Hunters and their agents are advised to abide by Zimbabwean Laws regarding the importation and transportation of fire arms. Hunters should also not leave their fire arms unattended at all times. UNSOLD-CAMPS Unsold hunting camps at the auction will be retained by the Director General ZPWMA, and can be sold through the Auctioneer with the authority of and at the sole discretion of the Director General. AGENTS ONLY BONA FIDE ZIMBABWEAN RESIDENTS MAY ACT AS AGENTS Any prospective bidder who nominates AN AGENT to represent his interests does so ENTIRELY AT HIS OWN RISK. It is a condition of sale that any bidder represented by an agent accepts the terms and conditions of sale outlined in the prospectus. CO-HUNTERS INFORMATION A successful bidder shall furnish Parks with the name of his co-hunter at the time of obtaining his permit to hunt and the names of both hunters shall appear on the permit. HUNTER DETAILS FOR TRAS 2 PROCESSING. The full details of the hunter including name, address, passport number and nationality shall be furnished to the officer in charge at Tuli Office for commencement of processing of the TRAS 2 for export of the trophies. 7
10 PURCHASE AND PARTICIPATION RESTRICTIONS ONLY TWO HUNTERS are allowed to participate in each hunt. Hunters are allowed to purchase more than one hunt but not exceeding 8 hunts in Tuli. The Director-General has the right to: - Cancel, withdraw and/or sell any hunt from the Prospectus prior to the Auction. Change the quotas or amend any errors that may occur or appear in the Prospectus. No action pertaining to this, legal or otherwise may be brought against the Parks and Wildlife Management Authority, any representative of the Authority or the Auctioneer for any loss incurred. UNSHOT ANIMALS No refunds will be made for any unshot animal and the animal may not be shot outside the stipulated period of the relevant hunt. WOUNDED ANIMALS All wounded animals count against the bag and must be entered on the permit. The hunter must follow any animal wounded while it remains in the area allocated to the hunt, but may not hunt such animal outside the area prescribed. However the hunter should within 24hours advice the Appropriate Authority of the area in which the wounded animal would have taken refuge into of the presence of the wounded animal. WOUNDING OF DANGEROUS GAME The wounding of elephant, buffalo, lion, leopard or hippopotamus must be reported to an Officer of the Authority within 24 hours. SPECIALLY PROTECTED GAME If any Specially Protected animal is killed or injured, except in terms of a permit, a report must be made to either the Authority or the Police. 8
11 SPECIES AND SEX OF ANIMALS The ONUS is on the hunter to determine the species or sex of any animal he intends to shoot. Shooting of the wrong species or wrong sex of animal attracts a fine and the payment of the compensation value of the said animal. The trophy may not be taken by the client. HUNTING OF DANGEROUS ANIMALS If Hunters are inexperienced in the hunting of dangerous animals, they are urged to seek the assistance of Licensed Professional Hunters as the Director General will not be held responsible for any accidents that may occur during the hunts. HUNTING RESTRICTIONS While hunting the following are prohibited: Shooting within a distance of 400 meters from the main road; Shooting from a motor vehicle; Shooting within 1 (one) kilometre of a recognized waterhole; Shooting females with dependent young at foot. If you do so inadvertently, inform an Officer of the Authority as early as possible; Shooting at night, i.e. half an hour after sunset to half an hour before sunrise. TRANSPORTATION OF TROPHIES AND HIDES The hunting permit issued by an Officer of the Authority may be used as proof to show that the hides, skins and trophies were obtained legally. The Veterinary Department will issue a Veterinary Export Certificate upon receipt of an export permit from the Parks and Wildlife Management Authority confirming the legality of the trophies to be exported. Processing of Import and Export documentation into the country of destination is the hunter's responsibility. Please make certain that all trophies to be exported comply with all CITES Import/Export Regulations. Refer to Control of Goods (Import/Export) Wildlife Regulations S.I. 76 of
12 OCCUPATION OF CAMPS, VISITORS AND ENTRY PERMITS The hunters, their hunting party and camp assistants may occupy their camps 24 hours before hunting commences after reporting to the Officer-in-Charge at Tuli Camp. They must vacate the camp clean to the satisfaction of the Officer-in-Charge within 24 hours after their hunt. In each camp the hunting party should comprise of a maximum of two (2) hunters who may be accompanied by up to a maximum of eighteen (18) other persons whether visitors or camp assistants. The first eight (8) persons inclusive of the hunters are free. Any excess persons are levied US$ per person for the duration of their stay. Thus the hunting party may not exceed a maximum of twenty (20) persons on aggregate for the period of the hunt. The entry fees are to be paid at Tuli Camp prior to entry into the hunting area. LOCAL RULES AND CONDITIONS Any local rules and conditions applicable to these areas will be handed to you on arrival and will form additional terms and conditions of your hunting permit. INDEMNITY FORM All persons must ensure that the indemnity form available at the entry point is completed in full, as the entry permit into the hunting area can only be issued when the indemnity form has been submitted duly completed and signed. OFFICIAL INSPECTIONS Parks Officials will periodically conduct inspections to confirm if hunters are abiding by the Parks rules and regulation. Any hunter caught on the wrong side of the law will have his camp cancelled by the Director General and no monies will be refunded. NON-HUNTING TOURIST AREAS There are small non-hunting areas within Tuli Safari Area (three botanical reserves, the area around Fort Tuli and the Pioneer Cemetery). These are setaside for non-hunting tourists only and should be respected as such. OBSERVANCE OF BOUNDARIES The onus to ensure that boundaries are not crossed rests on the hunter, although there will be Parks Guides to accompany each and every hunt. Please note that the international boundary with Botswana is clearly marked and hunters are not allowed to go beyond the stipulated hunting area. 10
13 Roads or rivers define boundaries between hunting and non-hunting areas and hunting should be undertaken within the prescribed areas. GUIDES The Hunting Guides provided by the Authority have knowledge of the area and are employed for this purpose only. THEY ARE NOT EXPERIENCED HUNTERSand should not be relied upon as such. The Guides ARE ALSO NOT to be used as camp attendants, personal workers or gun-bearers. SANITARY CONDITIONS IN HUNTING CAMPS All hunters are legally obliged to burn or bury rubbish. Each camp has a disposal area so all unwanted hides, horns etc should be disposed therein. Basic facilities such as pit latrines are provided and hunters are also required to remove all non-biodegradable waste matter out of the Parks Estate in order to maintain the camp area in a natural state. MALARIA PRECAUTIONS Hunters and those accompanying them are advised to take an anti-malarial prophylactic before, during and after their visit. They are also advised to include mosquito nets and a snake bite outfit in their camping equipment as WATER It is advisable to BOIL all drinking water. VELD FIRES NEVER LEAVE A FIRE UNATTENDED. Precaution is essential to prevent uncontrolled veld fires. Severe penalties will be inflicted for causing veld fires. PROTECTION OF VEGETATION It is an offence to damage the vegetation in the hunting area. LABOR It is the hunter's responsibility to make arrangements to bring labour to assist them in the field. DOMESTIC ANIMALS They are not permitted into the hunting areas. 11
