3 EXECUTIVE SUMMARY This report has been prepared in accordance with Public Law 1997, c. 4 (N.J.S.A. 27:1A-5.15), which requires the New Jersey Department of Transportation (Department) to annually prepare and submit to the Governor and Legislature an inventory of property owned by the Department and held for transportation projects not under construction. The inventory is to include the location and size of a property, the date and cost of acquisition, the purpose for which the parcel of land was acquired and the reasons why the property has not been used for that purpose. The Department has endeavored to provide such information as could reasonably be discovered from the records available. The following terms are used to describe the status of such parcels owned by the Department: Retained means that the parcel is retained for a specific purpose, or for a future transportation need, but that it can be reviewed on a case-by-case basis to determine its availability for sale or lease. Under Review means a parcel to be determined if it can be declared as excess land and made available for sale or conveyance as surplus property. Available means the parcel has been declared as excess and deemed available for sale or conveyance as surplus property. Leased means a parcel under lease to a public or private entity. As of January 2012, the Department s inventory of properties consists of approximately 2,095 acres of land. Approximately 1,475 acres in the Department s inventory are retained and considered as being needed for present or future transportation needs. Approximately 313 acres are eligible for review to determine whether the parcel can be declared surplus property. Approximately 49 acres of property are declared excess and available for sale or other conveyance. The remaining approximately 258 acres are under lease. In 2011, the Department completed 18 sales of surplus property, consisting of 38 parcels and approximately 8.2 acres. Since 1956, the Department has sold excess lands not needed for transportation purposes as surplus property. Once a highway project has been completed, the Department determines what parcels are excess and initiates steps to dispose of them. Many parcels have been sold, but many more remain to be reviewed and determined if they can be disposed of as surplus property. Most of the parcels that make up the Department s inventory of land are small tracts that are often only of value to the adjoining property owner. While the Department does have some parcels of land that are large in size, many are landlocked; encumbered with restricted use, such as wetland, storm water retention or as a landscape parcel; or are viewed as parcels that may be needed for future transportation needs. Potential new environmental requirements and changing needs of the Department cause the number of acres considered excess and available for purchase as surplus property to change from time to time.

4 All parcels are deemed to be needed by the Department until declared as excess and available for sale as surplus. Property identified as surplus and not sold in a two-year period from when it was declared as excess and available for sale, reverts back to the pool of properties considered retained by the Department. These properties are then considered available for potential future use serving a transportation need such as wetland mitigation, roadway beautification, reforestation, park and ride locations, or other transportation needs. As with all parcels retained by the Department, they may be reevaluated for sale as surplus property when the Department receives an inquiry on a particular parcel. Sale of such parcels would again be dependent on a determination of its potential need by the Department for transportation purposes. There are times when the Department will exchange land that is owns, considered surplus land, with an adjoining owner, municipality or other government agency for land that the Department has determined could be used for a transportation-related need. Exchanges of this kind, often involve a consideration of only $1.00. Since excess parcel review is a continuing process, inventory is expected to change frequently. Additional properties identified as owned by the Department will be added to the Department s inventory. In addition, completion of transportation projects may result in property being deemed excess land. The Department maintains its own parcel identification system to identify property that it owns. Tax block and lot information is also included, where available. Note that some municipalities do not use that type of designation for State properties adjoining highways.
