8 CPAML Certification (continued) Content This advanced level course includes case studies and real examples of the challenges faced by the Senior AML Compliance Officer or AML Compliance Manager who is responsible for the entire AML compliance program at the institution. This certification focuses on the analysis and interpretative side of AML compliance that is necessary in a riskbased regulatory environment. 9 FATCA Workshop & Training Program Overview The Foreign Account Tax Compliance Act (FATCA) is an important development in U.S. efforts to improve tax compliance involving foreign financial assets and offshore accounts. FATCA requires foreign financial institutions (FFIs) to report to the U.S. Internal Revenue Service (IRS) information on financial accounts held by U.S. taxpayers, or held by foreign entities in which U.S. taxpayers hold a substantial ownership interest (generally 10% or more). In order to identify customers who are U.S. taxpayers, FFIs will be required to implement due diligence, identification, controls and reporting systems. Failure to comply with FATCA will be costly and may subject FFIs to a 30% withholding tax on U.S.-source payments, including dividends, interest and gross proceeds from the sale of assets which may generate U.S. dividends or Interest. 10 Correspondent Banking AML Certificate Overview The risks posed by correspondent banking are of concern to regulators, bankers, and brokerdealers in securities alike. Recently, U.S. financial institutions have faced severe penalties as a result of having weak BSA/AML compliance programs for their foreign correspondent banking accounts. The various sections of the USA PATRIOT Act and implementing regulations in the Bank Secrecy Act have been in final form for a number of years now. This course will discuss not so much the regulations but rather the practical applications of the regulatory requirements, with a particular emphasis on nested accounts. This course is designed for both U.S. financial institutions offering correspondent banking as well as for foreign financial institutions which have or are seeking a U.S. correspondent banking relationship. U.S. financial institutions will acquire practical knowledge to apply to their compliance program. The foreign financial institution will have a much better understanding and appreciation for understanding the correspondent relationship and be able to demonstrate to its U.S. correspondent bank its compliance program to respond to contract requirements.
