1 No.4] Merchant Ships (Registration) 1 BELIZE: STATUTORY INSTRUMENT No.4 of 2013 ORDER made by the Minister responsible for International Merchant Marine Registry of Belize in exercise of the powers conferred upon him by section 12(3) of the Merchant Ships (Registration) Act (No. 22 of 2010), and all other powers thereunto him enabling. (Gazetted S'h January, 2013.) 1. This Order may be cited as the Short title. MERCHANT SHIPS (REGISTRATION) (AMENDMENT OF FIRST SCHEDULE) ORDER, The First Schedule to the Merchant Ships (Registration) Act, 2010, is hereby repealed and replaced by the Schedule to this Order captioned "First Schedule". 3. This Order shall come into force on the 1st day of January Repeal and replacement of First Schedule. No. 22 of First Schedule. Commencement. 11 No. 4] Merchant Ships (Registration) 11 (p) Re-issuance of Certificates due to change of owner, name change or other $ amendments 13.2 INCENTIVES (YACHTS ONLY) Special discounts apply for multiple applications by Groups/Yacht Clubs/other associations and ship builders. Also, a 15% discount on Annual Taxes is granted to yachts which comply with ISO or equivalent. 14. PENALTY FOR LATE PAYMENT OR FILING 14.1 A penalty fee of US$ is payable due to the non-submission of documents required for the permanent registration of a vessel 14.2 If a fee or tax is not paid on the due date, penalties are charged on all outstanding payments as follows: 15. INCENTlVES l 0% if outstanding for a period in excess of 30 days but not exceeding 90 days; - an additional 10% if outstanding for a period in excess of 90 days but not exceeding 180 days; - an additional I 0% if outstanding for a period in excess of 180 days For New Buildings: Under 7500Gt a discount of 25% on the registration fee, and the annual service tax for the first year applied at the point of initial registration. A 20% on the annual tonnage tax and service tax on the second year and a 10% discount on the annual tonnage tax on the third year. Over 750 I Gt and under 25,000gt a discount of 35% on the registration fee, and the annual service tax for the first year applied at the point of initial registration. A 25% discount on the annual tonnage tax and service tax on the second year and a 20% discount on the annual tonnage tax and service tax on the third year.

12 12 Merchant Ships (Registration) [No. 4 Over 25,00 1 Gt and over, a discount of 50% on the registration fee, and the annual service tax fo r the fi rst year applied at the point of initial registration. A 35% on the annual tonnage tax and service tax on the second year and a 20% discount on the annual tonnage tax and service tax on the third year For Vessels I 5 years and under: Over 7,50 1 Gt and under 25,000Gt a discount of 25% on the registration fee, and the annual service tax for the first year applied at the point of initial registration. A 15% discount on the annual tonnage tax and service tax on the second year. Over 25,00 I Gt and under 50,000gt, a discount of 35% on the registrati on fee, and the annual service tax fo r the fi rst year applied at the point of initial registration. A 20% discount on th e annual tonnage tax and service tax o n the second year. Over 50,00 I Gt a 50% discount on the registration fee and annual service tax for the first year applied at the point of initial registration. A 30% discount on the annual tonnage tax and service tax on the second year Economic Group (Loyalty Incentives) The registration of 3 to 10 vessels by a ship owner, ship management company or group, regardless of tonnage may be entitled to a discount of 25% in the registration fee, annual service tax for the first year applied at the point of initial registration. For fl eets comprising of more than I 0 vessels being registered by a ship owner, ship management company or group, regardless of tonnage may be entitled to a discount of 50% on the registration fee, annual service tax for the first year applied at the point of initial registration.

13 No.4] Merchant Ships (Registration) For Vessels with good record on PSC detentions Regardless of their tonnage or age, a vessel which is trading not laid up which is not the subject of any Port State Control detention for a continuous period of 12 months will be entitled to a 25% rebate on the Annual Tonnage tax due for the subsequent period of 12 months. After 24 months or more of no Port State Control detentions, the rebate will increase to 35% of the normal annual tax due. All rebates will cease in the event that a vessel is detained by PSC with effect from the date of such occun ence. This discount will not apply if the vessel is granted other discounts indicated in this regulation An incentive program for the registration of ships applicable only to Deputy Registrars /Designated offices appointed bv IMMARBE: For the registration of a vessel of I 00 I to S,OOOgt: $250 For the registration of a vessel of 5,001 to 1 OOOOgt: $3 50 For the registration of a vessel of I 000 I to 25,000gt: $450 For the registration of a vessel of25,00 1 gt & over: $500 Special Note: An additional US$100 will apply to the registration of a vessel of l 0 years or newer. For the registration of a new build vessel over I 5,000gt: $750 Exemptions: Pleasure crafts. non-propelled vessels and those Vessels registered under SpeciaL registry or on a short term basis do not qualify in this scheme Incentive scheme-annual taxes 0 For those Deputy Registrars who register more than 100,000 but less than 250,000 gross tons during a calendar year, regardless of the number of vessels registered, may qualify for an incentive of 5% of the annual taxes collected from their existing fleet of vessels. 0 For those Deputy Registrars who register more than 250,000 gross tons during a calendar year, regardless of the number of vessels registered, will quality for an incentive of 10% of the annual taxes collected from their existing fleet of vessels.

14 14 Merchant Ships (Registration) [No.4 Exemptions: Vessels registered under Special registry or on a short term basis do not qualify in this scheme. The Registrar of Merchant Ships or the Senior Deputy Registrar of Ships is empowered to adjust the percentages of the discounts depending on the competitiveness of the ship registry business with other open registers as deemed appropriate from time to time. 16. ADMINISTRATIVE CHARGES 16.1 IMMARBE. may impose a surcharge on the abovementioned Taxes and Fees in respect of the registration of a specialized or hybrid vessei involving the examination of complete technical or operational data or consideration. Also, in the event of vessel arrests or other legal disputes, IMMARBE may charge additional administration fees so as to reflect the management time and expenses incurred by them in respect of their involvement in such arrests or legal disputes.
