1 The purpose of these Rules is to ensure equality for all participants and equal opportunities to win prizes after meeting the requirements set out in the Rules. On behalf of the organiser, the prize game is carried out by MPG d.o.o., which is also the personal data processor (registered office: Nova Ves 17, Zagreb, PIN (OIB): , 01/ ), hereinafter referred to as the Administrator of the prize game. Based on the Act on the Organisation of Games of Chance and Prize Games (Official Gazette nos. 87/09, 35/13, 158/13, 41/14 and 143/14) and the Ordinance on the Organisation of Prize Games (Official Gazette no. 8/10), the organiser, Zagrebačka banka d.d., Zagreb, Trg bana J. Jelačića 10, PIN (OIB) , sluzbenik. 01/ (hereinafter: the Bank/Organiser) hereby establishes the following: PRIZE GAME RULES Win a Samsung Galaxy S9 with m-zaba! (hereinafter: the Rules) Article 1 PARTICIPANTS AND NAME OF THE PRIZE GAME The Bank is organising a prize game entitled Win a Samsung Galaxy S9 with m-zaba! (hereinafter: the Prize Game) for natural persons users of the Bank s m-zaba mobile banking (hereinafter: Participants). Article 2 PURPOSE OF ORGANISING THE PRIZE GAME The purpose of organising the Prize Game is to promote the Bank s m-zaba mobile banking for natural persons referred to in Article 1 of these Rules and to reward the Participants. Employees of Zagrebačka banka directly involved in the Prize Game organisation, drawing of winners and other persons with access to data related to the Prize Game may not participate in the Prize Game. Article 3 DURATION OF THE PRIZE GAME The Prize Game shall be held from 20 July 2018 from 00:00 to 19 January 2019 at 23:59. All transactions made with m-zaba in the Republic of Croatia and/or abroad shall be included in the Prize Game. Article 4 CONDITIONS OF PARTICIPATION IN THE PRIZE GAME The right to participate in the Prize Game and the right to win a prize are exercised by the Participants referred to in Article 1 of these Rules, with legal capacity no later than on the last day of the Prize Game, and who are not in an unauthorized overdraft per any account opened with the Bank on their behalf and who have no outstanding debts to the Bank. Furthermore, in order to participate in the Prize Game and be entitled to win a prize, Participants shall do the following during the Prize Game: - register to participate in the Prize Game on the website with all necessary data (name, surname, PIN (OIB), telephone or mobile phone number and address), e.g. Zeljka 1

2 Babic, , , - use the m-zaba app* at least once a month, which they arranged and activated during the Prize Game or which they had previously arranged *the expression use the m-zaba app at least once a month implies, but is not limited to: checking account balance and transactions, purchasing e-vouchers, paying bills using the m-foto pay service or any other way, contactless payments in stores in Croatia or abroad where contactless payments using m-wallet or digital card are enabled. Participants automatically accept current official rules by registering to participate in the Prize Game. During the Prize Game, every use of any m-zaba functionality represents a new opportunity to win. The website was created by Zagrebačka banka d.d., Zagreb, Trg bana J. Jelačića 10, PIN (OIB): Functional specifications of the website are attached to these Rules. Article 5 PRIZE POOL The following prizes shall be awarded as part of the Win a Samsung Galaxy S9 with m-zaba! : 6 x Samsung Galaxy S9 The price of one Samsung Galaxy S9 smartphone is HRK 7, (VAT included). The total value of the prize pool is: HRK 43, (VAT included). The prize values are based on the market price on the day of preparation of the Rules, i.e. on the date of submission of the request for approval to the Ministry of Finance. The Bank disclaims the possibility of prize value changes that might be due to changes in market prices and shall not be liable for such changes in any case. Article 6 PARTICIPATION IN THE PRIZE GAME The right to participate in the Prize Game draw shall be given to Participants who are users of m-zaba mobile banking of Zagrebačka banka referred to in Article 1 of these Rules whose transactions were registered during the Prize Game duration, who have registered to participate in the Prize Game at and who meet the requirements of the Prize Game Rules. The right to participate in the Prize Game and the right to win a prize shall be exercised in accordance with Article 4 of these Rules. Monthly prize draws shall include all transactions of the Participants who confirmed their participation in the Prize Game by registering at for the previous month. In the event that a person, in the month of the draw, makes a transaction and confirms their participation in the Prize Game in that month, their transactions from that month shall be included in the monthly draw. If a person makes a transaction in a round month defined in Article 7 and confirms participation in the Prize Game in the following month, their transactions shall not be included in that monthly draw, but subsequent transactions shall be included in the prize draw of the current month. During the Prize Game, every new transaction represents a new opportunity to win. 2

3 Article 7 PRIZE DRAW All valid transactions of registered Participants that are received by the Organiser on the date no later than 19 January 2019 at 23:59 shall participate in the monthly draws. In the Prize Game, every Participant who is a user of m-zaba mobile banking, if complying with the requirements of these Rules, may win a monthly prize for which he or she is drawn. The Prize Game consists of six rounds/monthly draws. Entry periods for monthly draws shall last from: First round from 20 Jul 2018 from 00:00 to 19 Aug 2018 by 23:59. Second round from 20 Aug 2018 from 00:00 to 19 Sep 2018 by 23:59. Third round from 20 Sep 2018 from 00:00 to 19 Oct 2018 by 23:59. Fourth round from 20 Oct 2018 from 00:00 to 19 Nov 2018 by 23:59. Fifth round from 20 Nov 2018 from 00:00 to 19 Dec 2018 by 23:59. Sixth round from 20 Dec 2018 from 00:00 to 19 Jan 2019 by 23:59. The monthly winner draws shall be held at the Administrator s registered office (MPG d.o.o., Nova Ves 17, Zagreb) and shall be carried out according to the below schedule based on the random selection of winners by a computer system under the control of a three-member draw committee for each round, more specifically: First round 29 Aug 2018 at 12:00, Second round 28 Sept 2018 at 12:00, Third round 29 Oct 2018 at 12:00, Fourth round 29 Nov 2018 at 12:00, Fifth round 4 Jan 2019 at 12:00, Sixth round 29 Jan 2019 at 12:00. The prize pool exceeding HRK 5,000.00, which after the end of the Prize Game (after the expiry of the prize collection period) is not awarded, shall be sold through a public tender, and the proceeds of the sale shall be paid to the state budget within 90 days from the prize collection deadline. During the Prize Game, a winner can win only one prize. Article 8 PUBLISHING WINNERS AND PRIZE COLLECTION The names of monthly prize winners shall be published after drawing each round on the Bank s website at and Winners shall be announced within 5 days from drawing each round The Bank ensures all published prizes from the prize pool and guarantees their delivery to the winners. Prize winners may not claim payment of a cash equivalent of the won prize or seek a different prize or larger quantities of the prize than those indicated in these Rules. In the event of force majeure, winners may give a power of attorney to a third person to collect the prize on behalf and for the account of the winner, whose power of attorney shall contain a certified signature of the winner. The winner shall be notified about the winnings by the Organiser orally and in writing within 8 days from drawing in order to arrange the details regarding the prize collection and to collect all required data to award 3

4 the prize. The winner shall cooperate with the Organiser and the Administrator in order to award prizes and administer all required documentation. Prize collection shall take place in the Bank s branches selected by the winners. The prize winners are required to collect the prize within thirty days from the day of publication of the draw results on the websites referred to in paragraph 2 of this Article. If a winner fails to collect the prize during this period, the Bank shall inform them to collect the prize again with a new period of eight days. If the winner still fails to collect the prize within that additional period, the winner shall lose the right to the prize, and any further obligations of the Bank towards the winner shall be terminated. When collecting the prize at the agreed Bank s branch, the winners shall receive all the instructions on prize collection and are required, either personally or through a proxy, to sign a Prize Collection Certificate and a Waiver of Liability, thereby terminating any further obligations of the Organiser toward the winners. Article 9 INFORMING PARTICIPANTS ON THE RULES OF THE PRIZE GAME AND THEIR OBLIGATIONS Winners of prizes in the Prize Game, by submitting their registration to participate, consent to the publication of their personal data (name, surname and city) for the public announcement of the Prize Game winners. Further to Article 7 of these Rules, once the committee draws the prize winners, the winners shall be informed about winning the prize in this Prize Game by the Bank as the Prize Game Organiser, using the telephone or mobile phone numbers provided to the Bank. Article 10 OBLIGATIONS TOWARDS THE CROATIAN RED CROSS The Bank undertakes to immediately pay 5% of the established prize pool value to the Croatian Red Cross. The winners do not have to pay any taxes related to prizes. Article 11 IN CASE OF CANCELLATION OF THE PRIZE GAME The Bank shall cancel the Prize Game if, during the period of the Prize Game circumstances arise which the Bank could not foresee at the time of the decision to hold the Prize Game, and it could not influence those circumstances, which have or may have a negative impact on the Bank s business. In the event of circumstances from the preceding sentence, the Bank shall notify the Participants about the termination of the Prize Game at and Article 12 DATA PROCESSING By registering for the Prize Game, Participants agree that the Bank, as the data controller, may process data for the purpose of organising the Prize Game. The Bank shall process data according to the rules on the protection of personal data. 4

5 The data controller and the data processor shall keep the Prize Game Participants personal data for 120 days after the end of the Prize Game, after which the said data shall be destroyed, except winners personal data, which shall be stored during the product warranty period, which shall also be awarded to the winner as a prize, for the purposes of compliance with the warranty period for the benefit of the prize recipient. Submitting data for this Prize Game is voluntary. If the Participant believes that the data are processed contrary to the protection of their privacy, or contrary to the rules on personal data protection, they may file a complaint with the supervisory body for the protection of personal data and contact the Organiser for explanation. Every Participant has the right to request from the data controller to provide access to personal data and to correct or delete their data, to restrict their processing as well as to file a complaint against processing, in addition to the right to data portability. Participants have the right to withdraw their consent at any time, without that affecting the lawfulness of the processing which was based on the consent before its withdrawal. The personal data controller shall not disclose or consign data to third parties, except to the data processor and other companies for the purpose of the Prize Game organisation, and to the Ministry of Finance in accordance with Article 16 of the Ordinance on the Organisation of Prize Games. Winners of the Prize Game agree that the Organiser and the Administrator may user their name and address (stating only the city) in articles and reports regarding the collection of prizes for the purpose of public announcement of the prize draw results with no compensation. Information on personal data processing is available on the website: Article 13 IN CASE OF DISPUTE Disputes between the Bank and the Participants shall be resolved by a competent court in Zagreb having subject matter jurisdiction. Article 14 OTHER PROVISIONS These Rules have legal effect after obtaining the consent of the Ministry of Finance of the Republic of Croatia and after their publication on the official website of the Bank and are valid until the end of the Prize Game.
