2 The Council of the City of Westminster, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers confelted by sections 6 and 124 of and Pmi IV of Schedule 9 to the Road Traffic Regulation Act 1984(a) as amended, and of all other powers thereunto enabling, hereby make the following Order: Citation and commencement 1. This Order may be cited as The City of Westminster (Free Parking s) (Dip,lomatic Missions) (Consolidation No.1) Order 2013 and shall come into force on 12" August Interpretation 2. (1) In this Order, except where the context othelwise requires, the following expressions have the meanings hereby respectively assigned to them:- "civil enforcement officer" has the same meaning as in section 76 of the Traffic Management Act 2004(b), being a person authorised by or on behalf of the Council to supervise any parking place; "Council" means the Council of the City of Westminster; "driver", in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place; "electronic communications network" has the same meaning as in the Communications Act 2003(c); "enactment" means any enactment, whether public general or local, and includes any order, byelaw, mle, regulation, scheme or other instmment having effect by virtue of an enactment; "one way street" means a highway in which the d11ving of vehicles otherwise than in one direction is prohibited; "parking place" means any area on a street designated as a parking place by this Order; "penalty charge" and "penalty charge notice" have the same meanings as in The Civil Enforcement Parking Contraventions (England) General Regulations 2007( d); "Schedule" means a Schedule to this Order; "street" includes part of a street; (2) Any reference in this Order to any enactment shall be constmed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by viliue of any subsequent enactment. (3) Any reference in this Order to a numbered Aliicle or Schedule shall, unless the context otherwise requires, be constmed as a reference to the Article or Schedule bearing that number in this Order. 3 Revocation 3. Without prejudice to the validity of anything done or to any liability incun'ed in respect of any act or omission before the coming into force of the Order, The City of Westminster (Free Parking s) (Diplomatic Missions) Order 2003(a) and the Orders that have amended that Order and set out in Schedule 2 to this Order are hereby revoked. Designation of parlung place 4. Each area on a highway comprising the length of carriageway of a street specified in column 2 of Schedule 1 and, unless otherwise so specified, bounded on one side ofthat length by the edge of the caitiageway and having a width throughout of 2 metres is designated as a parking place. Vehicles for which parldng places are designated 5. Each parking place may be used, subject to the provision of this Order, for the leaving of vehicles used by the Head and members of the staff of diplomatic missions. Contravention in parking places and amount of penalty charge 6. If a vehicle is left in a pal'king place referred to in a Schedule to this Order during the pennitted hours without complying with the requirements of this Order, a contravention shall be deemed to have occurred and a penalty charge shall be payable. A penalty charge notice showing the infolmation required by The Civil Enforcement of Parking Contraventions (England) General Regulations 2007 may then be issued in accordance with the regulations of2007. Manner of standing in a parking place 7. The driver of a vehicle waiting in a parking place in accordance with the foregoing provisions of this Order shall cause it so to stand: (a) in the case of a parking place in relation to which special provisions as to the manner of standing of a vehicle in that place are specified in column 2 of Schedule 1 as to be in accordance wi th those provisions; (b) in the case of any other parking place :- (i) (ii) if the parking place is not in a one-way street, that the left or nearside of the vehicle is adjacent to the left hand edge of the carriageway; and that the distance between the edge of the caniageway and the nearest wheel of the vehicle is not more than 300 millimetres. (c) that every part ofthe vehicle is within the limits of a parking place. (a) WCC /3

4 Power to suspend use of a parldng place 8. (I) The Commissioner of Police of the Metropolis or any police officer above the rank of Superintendent may suspend the use of a parking place or any part thereof for a peliod not exceeding twenty eight days whenever they consider such suspension necessary for maintaining the seculity of premises in the vicinity of the parking place. (2) At the expiration of the period of twenty eight days mentioned in paragraph (I) of this Article, the suspension of the parking place or any part thereof shall be reviewed by the person who suspended its use and any continuation of the suspension that they consider necessary shall be notified to the Council and shall not exceed a further period of twenty eight days without similar review. (3) Any person duly authorised by the Councilor the Commissioner of Police of the Metropolis may suspend the use of a parking place, or any part thereof, whenever they consider such suspension reasonably necessary: (a) (b) (c) for the purpose offacilitating the movement of traffic or promoting its safety; for the purpose of any building operation, demolition, excavation adjacent to the parking place, the maintenance, improvement or reconstruction of the highway or the cleansing of gullies in or adjacent to the parking place, the laying, erection, alteration or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any electronic communications network or the placing, maintenance or removal of any traffic sign; or on any occasion on which it is likely by reason of some special attraction that any street will be thronged or obstmcted. (4) A police constable in unifonn may suspend for not longer than twenty four hours the use of a parking place, or any part thereof, whenever they consider such suspension reasonably necessary for the purpose of facilitating the movement of traffic or promoting its safety. (5) On the suspension of the use of a parking place or any part thereof in accordance with the provisions of this Atticle, the person authorising or causing such suspension shall place or cause to be placed in or adjacent to that parking place or that palt thereof, as the case may be, traffic signs indicating that waiting by vehicles is prohibited. (6) No person shall cause or pelmit a vehicle to wait in a parking place or any part thereof at any time duling which there is displayed in or adjacent to that parking place or that part thereof, as the case may be, a traffic sign placed in pursuance of paragraph (5) of this Article: Provided that nothing in this paragraph shall appl y:- (i) in respect of any vehicle being used for fire brigade, ambulance or police purposes or any vehicle which is waiting for any reason specified in Alticle 9(1)(a) or (c); or 126/4

5 (ii) to anything done with the permission of the person suspending the use of the parking place or part thereof in pursuance of paragraph (1), or as the case maybe, paragraph (3) of this Alticle, a police constable in unifonn or a civil enforcement officer in unifolid. Restriction on waiting by a vehicle in a parking place 9. (1) Notwithstanding the foregoing provisions of this Order, any vehicle may wait during the pennitted hours in any patt of a parking place if the use of that part has not been suspended and if:- (a) (b) (c) (d) the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond their control or to such waiting being necessary to avoid an accident; the vehicle is being used for fire brigade or police purpose or, not being a passenger vehicle, is being used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such powers or in the performance of such duties for the vehicle to wait in the place in which it is waiting; the vehicle is waiting for only so long as may be necessary to enable it to be used in connection with the removal of any obstluction to traffic; or the vehicle not being a passenger vehicle is waiting only for so long as may be reasonably necessary to enable it to be used for any purpose specified in Alticle 8(3)(b) of this Order; (2) Except as provided by this Order, the diiver or person in charge of a vehicle shall not cause or pelidit a vehicle to wait in a pat'king place. Removal of a vehicle from a pal'ldng place 10. (1) Where a civil enforcement officer in uniform is of the opinion that any of the provisions contained in this Order have been contravened or not complied with in respect of a vehicle left in a parking place, they may remove, or cause to be removed, the vehicle from the parking place and, where it is so removed, shall provide safe storage of the vehicle. (2) Where a vehicle has been removed from a parking place in accordance with the provisions of paragraph (1) of this Article a fee shall be payable to the Council in respect of the removal of the vehicle. A daily charge connnencing at midnight after the day of removal of the vehicle shall be payable in respect of the storage of the vehicle. Movement of a vehicle in a parldng place in an emergency 11. A police constable in uniform or a civil enforcement officer may move or cause to be moved, in case of emergency, to any place they think fit any vehicle left in a parking place. 126/5

6 Placing of traffic signs 12. The Council shall: (a) (b) place and maintain traffic signs indicating the limits of each parking place refelted to in Schedule 1 and that each parking place may only be used for the leaving of the vehicles specified in Article 4; and carry out such other work as is reasonably required for the purposes of the satisfactory operation ofthe parking places designated by this Order.
