1 House Rules - General CHICHESTER YACHT CLUB MEMBERS RULES AND STANDARD INDEMNITY With effect from 17 October The following terms used in these Rules and Indemnity ( the Rules ) mean: CYC means Chichester Yacht Club and the Club means CYC; the Clubhouse includes all internal areas, balconies, terraces, gardens and car park; eating rooms means the Bar, Dining Room (including Conservatory), Quarterdeck and Sloop, plus any other internal area (e.g. Upper Deck) that may from time to time be assigned for eating purposes, outer garden means the grassed area north of the line of trees, and the Millennium Deck; 2. CYC is a members' club and therefore all members, visitors and guests on the premises or grounds or sailing or representing CYC elsewhere are expected to conduct themselves in the customary friendly manner with due consideration to the sensitivities of others, dress, tidiness and presentation of the club or other area or other venue they are using. 3. Members are expected to be appropriately dressed whilst in the Clubhouse. It is inappropriate to wear swimwear, wet sailing clothes, foul weather gear, wet/dry suits or to go shirtless in the eating rooms except for the Sloop. Shorts are acceptable. 4. Members are asked not to embarrass the staff by seeking to make private use of the Club Bar, Restaurant, storage, cooking, garden equipment, tools or other items. 5. It is not permitted to smoke anywhere inside the Clubhouse building or immediately outside the door from the Bar to the terrace. 6. The use of mobile phones or other electronic devices for the making or receiving of calls in the Bar, Dining Room, Conservatory and Quarterdeck or other areas set up for dining is not allowed. Calls should be made in other areas of the club such as the Sloop or thoroughfares. In other eating areas which are hired out as Meeting or Conference Rooms, such as the Quarterdeck and Upper Deck, mobiles, laptops and electronic media may be used at the discretion of the host. 7. No charity collections are to be made without the authority of the General Committee. 8. Members are asked to maintain the cleanliness of the Clubhouse and Dinghy Park, including the toilets, to a reasonable social and hygienic level. If any complaint about these areas is to be made, members are invited to inform a member of staff, so that quick steps can be taken to rectify the situation. 9. Members are not to leave litter, rubbish or soiled clothing on Club premises except in areas or receptacles designated for that purpose. 10. Members, guests or visitors using the Changing Rooms should keep them tidy and remove all their belongings when they leave. The Club reserves the right to dispose of any low value items after 7 days and higher value items after 28 days. 1

2 Visitors 11. The facilities of the Clubhouse are available to fully paid-up Club Members and their guests only with the following exceptions, limited to six times per year for those listed under (a), (b) and (c): (a) a non-member may visit the Clubhouse as a guest and must be signed in; (b) a member of a club affiliated to the Royal Yachting Association or another bona fide yacht or sailing club may, on production of their Club membership card, have full use of the Clubhouse and its facilities provided that on arrival they introduce themselves to a member of staff and enter their name and address in the Visitors Book; (c) a yachtsman arriving by sea and reporting to the Club staff shall be authorised to use the Clubhouse provided his/her name and address are entered in the Visitors Book and provided that his/her vessel is not normally berthed in Chichester Marina or Birdham Pool; (d) any individual who is a competitor or participant in any race or event sponsored or organised by or on behalf of the Club by virtue of a race or event entry fee, and any individual who is a member of the crew of any such competitor or participant shall be permitted to use the Clubhouse within a period of twenty-four hours before and after the race or event in which they are competing or participating. 12. Further to Rule 12, any Member over the age of 18 may introduce as his/her guest any individual provided that the Member so introducing enters the name and address of the guest in the Visitors Book and at no time leaves the Clubhouse while the guest is therein. For the purpose of this Rule, the families of individual Members and the relatives of Family Members over the age of 18, if not Members in their own right, are counted as guests. Members may bring any child in their guardianship (including temporary guardianship) aged under 18 into the Clubhouse provided they are signed into the Visitors Book. There is no limit to the number of times children can enter the Clubhouse under this Rule. The Club staff are instructed to check valid membership in case of doubt. From time to time the Club General Committee may authorise a complete membership check of all those in the building and grounds. Young Persons and Children 13. In all areas of the Club the safety and behaviour of young persons is the responsibility of their parents/guardians/sponsor. Should a parent/guardian/sponsor not be present at any time the Office should be informed, in writing, of the name of the person who is acting in loco parentis during their absence. The Club has a Child Protection Policy, a copy of which is available from the Office. A statement of this policy is located within the folder accompanying the Visitors Book. 14. In the case of misbehaviour, the staff are authorised to remind Members as above. Repeated serious misdemeanours by young persons will result in the family s membership of the Club being suspended. Disabled and Infirm Persons 15. Registered blind members, guests or visitors are most welcome to be accompanied by their guide dogs or helpers throughout the public areas of the Clubhouse. 2

3 16. Members who are disabled and infirm are most welcome to be escorted by their helpers or carers throughout the Clubhouse. 17. Should blind or disabled visitors require directions or help to the disabled toilets or in the lift it is recommended that they ask a member of Club staff for assistance. Dogs and Other Pets 18. Dogs and other pets are not allowed in the Kitchen or behind the Bar. 19. Dogs and other pets are not allowed in the eating rooms except for the Bar and Sloop. 20. Dogs and other pets must be kept on a lead or other suitable form of restraint throughout the Clubhouse, including the grounds, car park and dinghy park. 21. Owners should ensure that their dogs and pets do not foul or fight whilst in the Clubhouse, including the grounds, car park and dinghy park. If fouling does occur, the owner is to clear it up immediately. Emergencies and First Aid 22. In the event of an emergency, such as a fire, members should depart the building calmly and immediately through the nearest exit door and assemble as directed by the Staff, which will normally be in the outer car park. Do not run and do not re-enter the building to collect belongings. The staff will not have time to persuade members to exit and therefore they are asked to respond accordingly. 23. In the event of a fire DO NOT use the lift. An Evacuchair is provided for the wheelchairbound or infirm. 24. Any injury no matter how small should be reported to a member of staff and entered in the Accident Book held in the Office. Staff should then report it to the senior staff member. 25. A list of qualified First Aiders is posted in the Sloop, Bar and the Office. Eating and Drinking 26. The Club Bar and Restaurant will be open as advertised, including on the Club website. These times may from time to time be modified and members will be advised by the office. 27. Alcohol may only be consumed in the licensed areas which are the Bar, Bar Patio & Garden, Restaurant, Quarterdeck, Sloop, Sloop Patio, Upper Deck and Fly Bridge balcony. 28. Alcoholic drinks will not be served outside the advertised hours. All glasses are to be emptied and returned to the Bar and members should depart the licensed areas within 30 minutes after the advertised closing time. 29. The Bar Staff must refuse to sell or serve alcohol to anyone who is under 18 and any adult who they consider may be likely to supply the alcohol to a person aged under 18 (except as in Rule 30 below). If the Bar Staff have any doubt that a person is under the age of 18 they will ask for 3

4 acceptable photographic ID as proof of age. This will be a passport, photo driving licence or PASS accredited proof of age card. They must also refuse to serve alcohol to any adult they feel might resort to anti-social behaviour and/or is likely to bring injury on themselves or others or bring the Club into disrepute. 30. Young people over the age of 16 are allowed to sit at a table in the Restaurant at a proper meal and consume wine, beer or cider, with their parents or adult supervisors (with their parent/adult host permission), but no fortified wines or spirits. Light snacks such as crisps do not constitute a proper meal and young persons should not consume alcohol with them and in any case Bar staff may ask for ID in order to verify that those young people are over Bar snacks may be eaten in the eating rooms or outside. If Members wish to bring their own meals, they are asked to enjoy them in the Sloop, Sloop Patio, Dinghy Park or outer garden and to dispose of their rubbish responsibly afterwards. Notice Boards 32. The Club Notice Boards may only carry approved notices which are to be be submitted to the Office to be signed and dated before posting. The notice boards and For Sale board should be kept neat and tidy and not be allowed to become too congested. The General Committee or Office reserve the right to remove any notice from the Club Notice Boards. 33. Commercial or third party advertising will be considered inside the Clubhouse building at the discretion of the Office and commercial advertising only accepted on the basis that a genuine discount is being offered to Members. Any advertisement or poster must be signed and approved in the Office. 34. Items for sale should only be posted on the Sloop For Sale notice board and no others. Advertisements are to be signed in the Office. For Sale notices without Office signature, those posted for over three months or those that have become scruffy will be discarded. Car Park 35. The Club rents only the spaces on the hard standing immediately adjacent to the Clubhouse, of which two spaces are reserved for registered disabled who should display their badges. These spaces constitute the Club Car Park. 36. Parking in the outer car park and other areas of the marina is by courtesy of the marina owners and subject to their rules. Members should therefore park responsibly and with due regard to other users of these areas. 37. Members who are House Boat owners are requested to park in the outer car park (which is reserved for them by the marina owners). 38. Members, guests or visitors unloading dinghies should not bring them through or leave them in the Club Car Park and should unhitch the road trailers and store them tidily away from the Club Car Park area. 39. The yellow hatched areas adjacent to each side of the building must be left clear for emergency vehicle access. 4

5 Dinghy Section and Dinghy Park 40. All Dinghy Section members and all CYC members who have any vessel in the dinghy park are expected to assist in the Club Programme with Officer of the Day, Safety Boat or Tea Bar duties. 41. For reasons of safety: (a) All dinghy sailors and users of ALL vessels kept in the dinghy park or launched from CYC, including tenders, kayaks, canoes, skiffs, stand-up paddleboards, windsurfers & personal watercraft are to wear personal flotation devices at all times while afloat, except briefly while changing or adjusting clothing or personal equipment; (b) Safety boat drivers and crew are to wear personal floatation devices at all times while afloat, except briefly while changing or adjusting clothing or personal equipment. The kill cord must be used at all times. In this Rule, personal flotation device means a lifejacket or buoyancy aid appropriate to the wearer. Wet suits and dry suits are not personal flotation devices. Those participating in racing should note that Rule 40 applies at all times. 42. The Club permits only single-hulled (mono-hull) sailing dinghies under 16ft overall length to be stored on the Dinghy Park. 43. The appropriate Harbour Dues should be paid to the Harbour Master and displayed on the aft port rear side of the vessel. 44. The Dinghy Section Committee requires that a member with a berth in the Dinghy Park must sail for a minimum of 12 sailing day outings per sailing season (1 April to 31 October) to be considered for a berth in the Dinghy Park for the following season. Priority in the allocation of berths will be given to those with berths in the previous season who comply with this rule in full. 45. If a dinghy is locked or clamped such that it cannot be moved, a key or note of the combination should be given to the Office. 46. Dinghies and other craft in the dinghy park should not be left so as to block a gangway. 47. Where the mast or mast sections are longer than the boat they should be stepped, upright and rigged and not left in the lowered position or on the ground where they can represent a hazard to those walking in the Dinghy Park. 48. From time to time the General Committee can require that dinghies, individually or by rows, or all boats in the dinghy park be removed for the purpose of ground or other maintenance or annual reallocation of berths. 49. The Dinghy Park electric winch may only be used by those members or staff who have been trained by the Beach Master or his authorised representatives and whose names are contained in the Authorised User list held in the Office. Those Authorised Users will be issued, on a personal basis, with safety instructions which must be adhered to at all times. The winch must be kept locked when not in use and the key must be collected from and returned to the Office after use. It is the responsibility of the user to ensure that the winch is returned to the store and immobilised and that no unauthorised persons are allowed to use it while under his/her control. 5

6 CLUB STANDARD INDEMNITY A. Every member confirms that he or she considers that the terms of this standard indemnity are entirely fair and reasonable. This Indemnity takes precedence over any other Club rule where there might be a conflict. B. Every member acknowledges that the property of members, guests and visitors, if left anywhere on the Club's premises, is at the owner's risk. C. Every member acknowledges that, except in the case of death or personal injury caused by the Club's negligence, the club shall not be liable to any person for death or personal injury or for the loss of or damage to any vessel, equipment or other property arising out of any activities which the member may undertake or in which the member may be involved as a member of the Club whether organised by the Club or otherwise and indemnifies the Club against all and any costs, claims, demands and liabilities in respect of the same. D. Without prejudice to the generality of paragraph C of this standard indemnity every member: (a) warrants the suitability of his or her vessel for any race, cruise or activity in which he/she may participate and certifies that such vessel complies with the safety regulations locally in force; (b) understands that the safety of such vessel and her entire management shall be his or her sole responsibility, and that it is his or her responsibility to ensure that the vessel is fully found, thoroughly seaworthy and manned by a crew sufficient in number and experience who are physically fit to face bad weather; (c) undertakes to arrange adequate insurance cover to include cover against third party liability whilst racing or cruising of not less than 2 million; (d) warrants that he or she is satisfied as to the soundness of the hull, spars, rigging, sails, propulsion (main and auxiliary) and all gear and understands that it is his or her responsibility to ensure that all safety equipment is properly maintained, stored and in date and the crew know where it is kept and how it is to be used; (e) understands that neither the establishment of these conditions, their use by the race organisers nor any inspection of the vessel by and on behalf of the Club in any way limits his or her absolute responsibility. 6
