This application is for a new mooring in Ngakuta Bay, associated to their Phillips Road property, to accommodate their 10M vessel. All the necessary forms are attached along with aerial maps, drawings, photos and supporting s from the neighbouring community and associated affected parties. We have notified Ngati Kuia, but do not expect any response. We have also notified Te Atiawa who intend to go through the application this week and provide their response. We trust they will offer their affected party approval and will forward this to council immediately it is received. As this application has some complexities, we request that it be directed to Peter Johnson for processing. Note: Some of the information requested below is required under Schedule 4 of the Resource Management Act 1991 incorporating changes as a result of the Resource Management Amendment Act If you do not complete/provide certain information in this form, your application may be returned to you as incomplete. Description of the Proposal 1(a) Introduction It is the applicant's responsibility to provide an accurate description of the proposal, including the mooring coordinates and the length and type of vessel to be moored. Such details are essential to the understanding of the environmental effects of the activity. The precise coordinates and water depth (at Mean Low Water Springs) of the mooring site are particularly important. Any vessel using a swing mooring will traverse a circle centred on the mooring block. The size of this 'swing circle' varies from mooring to mooring, depending on the water depth, tackle length and vessel length. Council will calculate the swing circle from the information provided on this form. 1(b) Mooring Details Name of bay or locality: NGAKUTA BAY For existing moorings, what is the mooring number and consent number? Assessment of Environmental Effects 2(a) Introduction Section 88 of the Resource Management Act 1991 requires each application for resource consent to include an assessment of the actual and potential effects of the activity on the environment. Such an assessment must include such detail as corresponds with the scale and significance of the effects that the activity may have on the environment. Those effects may be positive or adverse, temporary or permanent, and include past, present or future effects. The term "environment" has a wide definition under the Resource Management Act 1991, and includes ecosystems, people and communities, natural and physical resources, and amenity values. The applicant's assessment of environmental effects should enable the Council and any affected parties (such as neighbouring mooring or land owners) to understand what will or may happen to the environment when the proposed mooring is installed and used. For existing moorings, the effects to consider are those arising from the continued existence of the mooring and associated vessel. Please attach additional pages if they are necessary to complete your assessment of environmental effects of the proposed or existing mooring. 2(b) Positive Effects The mooring will be used: 0 In association with nearby property Lot 3 DP Other (please specify) In association with a commercial enterprise in the area. Not in association with any nearby property or commercial enterprise. As a temporary and short-term 'stopover' or holiday mooring while visiting the area. Please describe what positive effects the subject mooring of a vessel will have for the applicant and community: The ability to moor our vessel will enhance our boating experience as it will alleviate the stress involved with launching and retrieving our vessel from the tidal ramp in Ngakuta Bay. We regularly use the launching ramp and have found the ramp area is becoming busier with people and vessels from Ngakuta Bay and neighbouring bays, and also children playing around the ramp at peak times. 8 Having a mooring will also assist with the congestion occurring in the public car parking area, as we would no longer need to leave a vehicle and trailer parked, it would be returned to our private residence and stored. Having a mooring will significantly enhance our Marlborough Sounds experience. The ease of accessing our vessel will encourage the family to participate in local activities and events. Also having a professionally designed environmentally friendly mooring system will ensure that there is minimal disturbance to the seabed and surrounding area and provide peace of mind for the security of our vessel when moored. 2(c) Effects on Maritime Safety Will the mooring(s) and associated vessel(s): Be located within a main navigational route? Yes 0 No Following on from the above two questions, please describe how and from where you access your moored vessel and where you store any associated dinghy, vehicle and/or boat trailer: We will require the launching ramp to launch and retrieve our vessel, however we have our own boat storage shed (15M x 12M), wash down area and parking area at our property and any dinghy, vehicle and/or boat trailer will be stored there. Consultation with Affected Persons 3(a) Introduction Consultation with persons who may be affected by the mooring(s) can have a bearing on the outcome of the application. Consultation involves discussing the proposal with others who may be affected by it, considering their responses, and deciding what will be done (if anything) to account for their concerns. There is however no obligation under the Resource Management Act 1991 for the applicant to consult any person. For moorings - proposed or existing - the main persons who may be potentially affected are neighbouring mooring owners, nearby land owners and Te Tau Ihu (top of the South Island) iwi that have a statutory acknowledgement for the area. 3(b) Statutory Acknowledgements A statutory acknowledgment is legal recognition of the particular cultural, spiritual, historical and traditional association of an iwi with an identified statutory area. Statutory acknowledgements for each of the Te Tau Ihu iwi form part of their respective Treaty of Waitangi settlements with the Crown. The settlements were legislated in 2014 and were enacted on 1 August The eight iwi of Te Tau Ihu to which these statutory acknowledgements relate are: Ngati Apa ki te Ra To Ngati Rama Page 4

The boating club was formed in 1956 and represents the interests of the boating community in the bay. The club is an incorporated society and a registered charity; membership sits around 30 members. The clubs focal point is the boating interest of the community. It also acts as a liaison body working with council, the Harbour Master and the Police, consulting on Resource Consents, water use, signage, speed limits, the ski lane, and all other boating related infrastructure in the area. Ngakuta Bay Community Association, have been consulted. The Chairman/President has offered his personal thoughts - s attached. Please note that these are his comments as we have been advised that the application details have not been circulated by the committee to the residence and community. The May family have spoken too, and been contacted by, a selection of households in Ngakuta Bay. Attached are various s from these residence and members of the Community Association in full agreement of this application. These members do not hold the same view as the Chairman/President and wish to have their thoughts and opinions heard in support of this mooring application. Furthermore, these members have not been approached by the Community Association for their opinions and or comments. Page 5

Public notification consists of the placement of a notice of the application in the local newspaper and a copy of the application being sent to interested persons. Within 20 working days thereafter, any person can make a submission to the Council on the application, stating their support, opposition or neutrality to the application. If the effects of the proposal on the environment are assessed as being minor, public notification will likely be unnecessary. If this is the case the Council may still identify individual persons who will be affected by the application, and may ask that the applicant seeks the written approval to the proposal from those affected persons. If the applicant is unwilling or unable to obtain those written approvals the Council will serve notice of the application on those identified persons - called 'limited notification'. The notified persons will then have an opportunity to make a submission on the application. 4. Objectives and Policies 4(a) Introduction Section 88 and Schedule 4 of the Resource Management Act 1991 requires each application for resource consent to include an assessment of the relevant provisions of the applicable resource management documents. Such an assessment must be specified in sufficient detail to satisfy the purpose for which it is required. The following documents and specified provisions therein are not an exhaustive list, but are likely to be of most relevance to an application for an ordinary mooring - either an existing or proposed mooring. 4(b) New Zealand Coastal Policy Statement Policy 6(2)(a): Recognise potential contributions to the social, economic and cultural wellbeing of people and communities from use and development of the coastal marine area. In what ways would being able to moor a vessel in the proposed location contribute to the applicant's wellbeing? Knowing that we can safely moor our vessel on a suitably sized and designed environmentally friendly mooring system will relieve the pressures involved with using our vessel. We intend to leave our vessel on our mooring only when it is in use and we are staying in the bay. When not in use, the vessel will be securely stored at our private property. Accessing our vessel during these times will promote the exploration of the Marlborough Sounds and area. It will also relieve the stresses involved with using the boat ramp. Being tidal the ramp has limited launching and retrieval times. During busy public holidays, children swim and play around the area including the new floating jetty built and installed by the boat club. At these times bringing a boat into the ramp can be difficult and stressful. The relief by having our own safe anchorage would benefit us hugely; it would promote relaxation and wellbeing within our family, allowing us the true Marlborough Sounds experience. Page 6

12 Policy 6(2)(b) Recognise the need to maintain and enhance the public open space and recreation qualities and values of the coastal marine area. It will be used to process the application and, together with other official information, assist in the management of the region's natural and physical resources. Access to information held by the Marlborough District Council is administered in accordance with the Local Government Official Information and Meetings Act 1987 and Privacy Act This means that information within this application may be disclosed to other people who request it in accordance with the terms of these acts. 5(b) Application and Consent Costs The Council operates a user-pays policy for the processing of resource consent applications. This means the applicant (rather than ratepayers) will be charged for the actual and reasonable costs associated with the processing of the application. A copy of the policy and complete schedule of current fees are available on our website: An initial application processing fee of $ (including GST) must be paid at the time of lodging the application for resource consent. The application will not be accepted for processing until this fee has been paid. If payment is made into Council's bank account , please put the applicant name and either the property number or consent type as a reference. If you require a GST receipt for a bank payment, please tell us. The total fee for processing the application will depend on the complexity of the proposal, the significance of its effects and the notification and hearing process required to determine the application. A simple application which is not publicly notified will typically cost between $700 and Page 7

13 $900 to process, while a complex application requiring a public hearing is likely to cost upwards of $5,000. The processing fee must be paid regardless of the outcome of the application. The applicant is liable for all fees and charges relating to this application. Payment is due within thirty (30) days of the issue date of any subsequent invoice. Council will charge interest on overdue invoices at 15% per annum from the date of issue to the date of payment. In the event of non-payment the applicant will be liable for all legal and other costs of recovery. 5(c) Timeframes for Reaching a Decision Section 115 of the Resource Management Act 1991 sets out the time limits within which the Council must determine the application. If the application is not publicly notified a decision can be expected within 20 working days of a complete application being lodged. If the application is publicly notified a decision can be expected within 60 working days, unless a public hearing is required in which case a decision can be expected within 130 working days. The term 'working days' excludes weekends, public holidays and those periods where Council is awaiting further information or affected party approvals from the applicant. 5(d) Ongoing Responsibilities of the Applicant If the application is granted, the consent holder will be responsible for complying with the conditions of consent and the payment of any monitoring charges Council incurs in monitoring the exercise of the consent. 14 Appendix 1 Mooring Construction Guidelines These guidelines are not intended as a substitute for the need to address the particular seabed and weather conditions encountered at each individual mooring site. It is recommended that you consult a professional mooring provider and/or chartered professional engineer for site specific advice tailored for the vessel/s to be moored. Be aware that risk cannot be completely eliminated in the mooring of a vessel. Council does not accept any responsibility for any loss or damage which may occur as a consequence of the use of these guidelines or otherwise. Length of the rope to be equal to the depth of water at mean high water springs, (see below) The total length of the mooring tackle should be equal to twice the water depth at Mean High Water Springs at the mooring site. Generally, mooring tackle consists of a combination of chain and rope totalling twice the water depth. 4. All shackles must be welded. 5. Swivels may be used at the mooring provider's discretion, but where these are used, the size of the swivel must be commensurate with that of the chain. 6. Anodes may be used at the mooring provider's discretion. 7. All mooring blocks must be designed by a Chartered Professional Engineer with expertise in mooring structures and be made to those specifications. 8. Similar metals are to be used throughout. 9. Moorings of different design and/or manufacture will be considered on a case by case basis. As a minimum, such moorings must be supported by appropriate Chartered Professional Engineer design drawings and certification. Mooring Inspection Requirements 1. Moorings must be recovered to the water surface for the purpose of inspection. 2. All tackle is to be replaced at 20% wear. 3. Moorings must be inspected at intervals not exceeding 2 years. 4. A completed mooring inspection report must be forwarded to the Manager Resource Consents, Marlborough District Council, not later than 30 days after the inspection. Page 9

15 1 ASSESSMENT OF EFFECTS ON ENVIRONMENT FOR Stewart Allan Stanley, Dale Robert May & Jacqueline Monique May as trustees of the D & J May Family Trust Positive Effects & Wellbeing The ability to moor our vessel in the bay will benefit our family greatly. The convenience of accessing our mooring will enhance our boating experience as it will alleviate the stresses involved with launching and retrieving our vessel from the tidal ramp in Ngakuta Bay making the delivery of both young and old family members safe and secure. A mooring will also encourage the exploration of the wider sounds and significantly enhance our boating experience. It will relieve the pressures involved with using the tidal ramp especially at peak times and promote relaxation and wellbeing for our family opening opportunities to participate in local activities and community events with ease. Knowing that our vessel is moored on an environmentally friendly designed mooring system (Marine Flex) will be visually pleasing within the bay and will offer peace of mind and security of our investment. We have the support of the wider residence and community, along with the Ngakuta Bay Boating Club members. Another mooring in the bay should not affect the safe mooring of vessels or the navigational routes within the bay. Effects on Navigational & Maritime Safety The proposed mooring will be positioned on New Zealand Transverse Mercator N E , in 10 metres at high tide and 8.4 metres at low tide. Tackle length will be 12 metres. The estimated swing circle radius will be 18.6M. Should strong winds or storm conditions occur the Marine Flex By Pass system will restrict the mooring elongation to 80%. Therefore for that "moment in time" only the tackle elongation may extend by a maximum of 1.5M. This elongation is only for the moment of the wind gust or storm condition and only if there is weight on the mooring i.e. a vessel. The tackle will return to the original resting length immediately the weather conditions subside. A scale drawing showing the estimated resting and elongated tackle lengths is attached along with a location plan showing the proposed site in relation to the neighbouring moorings and area. We have also included the 2012 chat from the Ngakuta Bay Community Association which was created and sent to council with a proposal to establish a mooring management zone in Ngakuta Bay. 16 2 The proposed mooring specification will be Class B, suitable for a vessel up to 12M in length. The applied lenrth will be 10M. The mooring construction will be an elastic tackle Marine Flex together with a 3 tonne concrete mooring block. The location does not hinder navigational routes or any structures in the bay and is situated within a general cluster of moorings. It does not impede navigation to or from any of the nearby jetties, launching ramps or similar. The swing circle also does not interfere or overlap with any of the existing moorings, and as mentioned above is within the zone preferred by the Community Association. All vessels operating within 200 metres of shore should be underway at less than 5 knots so navigational safety should not be compromised with the addition of this mooring. The application is associated to Property No , Lot 3 DP The mooring is to be used to moor our private vessel and will only accommodate one vessel at any time with the maximum vessel length not exceeding 10M. The mooring will be maintained biennial (and / or as maintenance is required) to ensure that the system remains fit for purpose. Effects on Recreational Value & Casual Anchoring This area of the sounds has an established residential development within the bay and many of these properties have swing moorings. An additional mooring should not affect the safe mooring of the community vessels or their navigational routes, and the presence of another buoy will not affect the recreational activities to any extent. Recreational activities are carried out within the bay. This application will not limit any of these activities as the position of the mooring has been well sited within a cluster of existing moorings. The shoreline is not popular for diving due to the muddy seabed and the lack of interesting marine life. Water sports, including swimming, sailing, kayaking, yachting and fishing are the main activities and the addition of this mooring will not hinder these activities. The general area is not generally recognised as a casual overnight anchorage. Should this be required there is available space. Effects on Marine Ecology N-Viro has undertaken a dive survey on the proposed site and immediate area, noting soft flat seabed, mud and limited shell. At the time of survey there were no fin fish evident. N-Viro found no marine life that may be displaced or disturbed by the application. The Grove Arm and Ngakuta Bay are identified as having areas of dense beds of "red algae" however the location of this mooring system is outside of this area. 17 3 The mooring will be a concrete block with an elastic mooring tackle (Marine Flex). The mooring block will cause slight disturbance to the seabed at the time of installation, this will settle quickly. The Marine Flex tackle will have no contact with the sea floor therefore there will be no destruction of the seabed and marine life surrounding the mooring. The expectation is for the block to become a mini reef creating opportunities for marine life to develop. The vessel to be moored does not have a sewage treatment system and / or holding tanks but as the owners have a residence in Ngakuta Bay, overnight visiting on this vessel will not occur. No waste will be discharged into the environment. Effects on Visual Amenities & Natural Character There are many registered moorings in the surrounding area. The proposed mooring has been situated with a cluster of moorings in the bay and will not compromise the existing character, amenities, or change any significant visual effect on the surrounding area. The mooring cluster has been part of the marine-scape for many years and the addition of another buoy will not affect this. The overall affect will be less than minor given the sensible location of the mooring within the mooring zone preferred by the community and residence. The mooring site is well positioned; there are no structures in the vicinity. The addition of this mooring will not change the visual effects and it will be consistent with the existing area complimenting the general view in keeping with the aesthetics of the bay. Effects on Utilities including Subaqueous Cables No undersea cables were located by N-Viro on the dive survey. No cables were located on the seafloor, or in the general area of the mooring site. Effects on Land Base Facilities As property owners the proposal will not affect the land based facilities within the bay. We will require the launching ramp to launch and retrieve our vessel, however we have our own boat storage shed, parking and wash down area at our property and any dinghy, vehicle and/or boat trailer will be stored there. We will not obstruct public land. Effects of the Activity of Installation N-Viro's specialised construction vessel Soundz Image will be used to install the mooring system. 18 4 Installation will be made using our Differential Global Positioning System using satellite technology which is accurate to within 0.5 metres on the earth's surface. Soundz Image works extensively in the sounds and is widely known and recognised by locals who are used to its presence. Other Effects on the Environment The seabed around the mooring location is soft mud (see photos). The mooring location is within a bay already acknowledged as being a safe anchorage and the proposed mooring will not affect the aesthetics in the bay. It has been clustered with the existing moorings to minimise the use of open water space, and is not intended to compromise the existing character or create significant visual effect on the surrounding area. It is not evident that any particular birdlife or fish species would be adversely affected by the proposal. The only minor affect on the seabed will be at installation and this will settle quickly. The mooring and vessel will enable the applicants to enjoy and explore the wider Marlborough Sounds, participating in community activities and local events. It will relieve the pressure of accessing a tidal launching ramp with limited retrieval times due to tides and increased activities during peak times. It will encourage healthy recreational activities and ease the stresses of modern life, promoting relaxation and wellbeing for the family Volunteered Conditions We volunteer the following conditions: 1. That our mooring be linked to our property in Phillips Road, Grove Arm, Ngakuta Bay. I know the topic ot moorings has been on going for many years now and as a community we are anxious to get a mooring plan formalised by the Marlborough District Council. Below are some thoughts from our President who has followed the debate more closely than I and reflects the opinion of the residents Re mooring proposal: 1. Position. The proposed position is directly in the path of the approach to the wharf which Is an area the MDC and users are keen to clear of Impediments 2. Mooring plan: The mooted mooring plan for the Bay will delineate areas where moorings are possible without undue encroachment on other bay usage. Applications should be delayed or on moratorium until that plan is installed, due to the excess of current moorings in the bay. 3. Present usage: Many moorings are unused for all but the peak holiday period and even then many remain vacant. The NBCA maintains a website, naakutabavcommunitv.weebly.com It would be possible to have a section devoted to moorings available for use for periods of time (similar to bookabach) which should allow for periodic users to satisfy their needs without a huge clutter of rarely used moorings clogging the bay. As a community association we do not desire to see the May application go to an environmental hearing such as did the TomUnson mooring application. In the recent newsletter, you invite comments on your Chairman's thoughts, which you say reflect the opinion of most residents. I use the same paragraph numbering. 1. The proposed position of the mooring appears to be (just) within the boundary of the preferred mooring zone submitted by the Association to Council in their management plan. The position was determined by Council as being suitable. It is further from the approach fairway to the jetty than several other moorings (207, 1098, 1102 and 1099). 2. If you refer to the notes of the meeting between Norm Wilson, myself and Pere Hawes of Council on 22nd(?) December 2015, it is clear that Council has not yet even formulated a policy on mooring management. When it does, the first area to be implemented will be Waikawa Bay. It will be years before a mooring management plan is implemented in Ngakuta Bay. A moratorium on new moorings is just not a practical proposition. 3. It is quite reasonable that residents should have buoys for the periods that they are in the bay using their boats. I would rather see a bay full of empty mooring buoys than boats. As a property owner 1 was very fortunate to have a mooring come with our property thus letting us enjoy boating in the bay without being challenged by launch and retrieval at low tide in a shallow bay. I believe if you own property in the bay you should have the right to access your own mooring in the bay. Maybe our energy should be put into the many moorings that clearly have not been serviced in many years thus making them low in the water and a boating hazard. Other issues making the bay crowded are people with multiple moorings that they do not use.
