1 Small Vessel Compliance Program for Fishing Vessels not more than 15 Gross Tonnage (SVCP-F) Standing Committee on Fishing Vessel Safety Rimouski, February 8 th 2018

2 WHERE DOES THE SMALL VESSEL COMPLIANCE PROGRAM COME FROM? The SVCP was created in 2011 by Transport Canada. Purpose: Collaboration between the owners and Transport Canada to improve the safety of the marine industry. The Small Vessel Compliance Program is available to all commercial vessels (non-pleasure craft) that: measure between 0 and 15 gross tonnage carry between 0 and 12 passengers are not fishing vessels are not human-powered vessels.

3 SMALL FISHING VESSEL INSPECTION PROGRAM In Quebec region, a similar program was created in 2006 and is still active: Small Fishing Vessel Inspection Program or Self-Inspection Program.

4 SMALL FISHING VESSEL INSPECTION PROGRAM More than 350 fishing vessels from the Quebec region are registered in the Self-Inspection Program. 358 vessels registered in the Self-Inspection Program (Quebec Region) Gaspé IDM Rimouski 212 *** These vessels will be gradually transferred to PCPB-P over the next few years.

5 SMALL VESSEL COMPLIANCE PROGRAM FOR FISHING VESSELS NOT MORE THAN 15 GROSS TONNAGE (SVCP-F). With the new Fishing Vessel Safety Regulations, coming into force on July 2017, a new version of the SVCP was developed to include fishing vessels: Small Vessel Compliance Program for Fishing Vessel not more than 15 gross tonnage (SVCP-F)

6 WHICH VESSELS ARE ELIGIBLE FOR THE SVCP-F? SVCP-F applies to small fishing vessels of not more than 15 gross tonnage used for commercial fishing. Fishing vessels more than 15 gross tonnage will continue to be inspected for certification by Transport Canada. (Annual or 4 years).

7 IS ENROLMENT IN THE SVCP MANDATORY? Enrolment in the SVCP-F is optional. However, being compliant with the CSA 2001 and its regulation is mandatory. Duties of authorized representative under CSA, 2001: 106 (1) The authorized representative of a Canadian vessel shall (a) ensure that the vessel and its machinery and equipment meet the requirements of the regulations made under this Part;

8 THE REGULATION Several regulations and standards may apply to your vessel, crew or equipment, even if it is less than 15 gross tonnage.

9 WHAT HAPPENS IF I DO NOT COMPLY WITH THE CSA 2001? If you are not in compliance with the CSA 2001 and its regulations: you are operating your vessel illegally; you may be subject to an administrative monetary penalty, a fine or your vessel may be detained. The penalties vary depending on the regulation violated and range from $500 - $25,000, while the fines may go up to $1,000,000. Some are daily penalties that will accumulate until your vessel is compliant.

10 WHY SHOULD I PARTICIPATE IN THE SVCP-F? SVCP-F: helps simplify the process of regulatory compliance ; Consolidates the requirements of numerous regulations in one easy-to-use tool : A checklist Guidance notes Helps determine if your vessel meets the requirements of the regulations and allows you to make the necessary corrections as needed. May get you informed on the manner in which your boat has been built

11 WHY SHOULD I PARTICIPATE IN THE SVCP-F? SVCP-F allows to establish a risk profile for each vessel listed in the program. So Transport Canada is able to focus the inspection effort on the most at-risk vessels or not listed in the program.

12 YOUR OPINION IS IMPORTANT! Do you think that Transport Canada should increase its number of compliance inspections and thus be more present on fishing vessels of not more than 15 gross tonnage? YES NO

13 HOW DO I ENROLL A VESSEL IN THE SVCP-F : Option 1: (a) The vessel owner will complete the Detailed Compliance Report for Small Fishing Vessels; For each question, the guide provides a detailed explanation so that you can properly target the requirement for your vessel and make sure you meet it.

14 HOW DO I ENROLL A VESSEL IN THE SVCP-F : b) He will attach to the report the supporting documents specified; c) He will submit all the documentation to Transport Canada Marine Safety : via the new online enrolment system registration process for SVCP (Coming soon) or At a Transport Canada Office.

15 Option 2: HOW DO I ENROLL A VESSEL IN THE SVCP-F : a) Support by TCMSS (Preferred option) : While this is a tool to simplify the compliance process, the regulations remain complex and the exercice may be difficult. Therefore it is possible to ask to be accompagnied in the process by a TCSM inspector: An inspector will go on board your ship, with no fees, and will proceed to the verification. He will also complete the documentation with you. «Self-Inspection» Program: An inspector will contact you to plan the transfer to the SVCP-F. A short inspection of your vessel could be necessary.

16 ONCE I HAVE FILLED OUT MY SVCP-F COMPLIANCE PACKAGE? A Transport Canada inspector will analyze your application and will advise you, if necessary, of any changes required to meet all applicable requirements. If necessary, a list of items to be corrected will be sent to you. The items reported or that are missing must be corrected according to the deadline mentioned so that your application can be completed. Once your ship complies with the regulations, you will receive the orange decal to post at a well-seen place aboard your vessel and a letter of confirmation attesting that the vessel is in conformity with the regulations and your participation in the SVCP-F.

17 The blue decal is valid for five years. AFTER THAT It is your own responsibility to maintain your vessel and its safety equipment as required per regulation. To make sure that nothing will be overlooked, we will send you, before the beginning of the next season, a form and a user's guide made to ease your way through this process. Once filled, the form shall be send back to us. Self-Inspection Program: As before, Transport Canada will continue to send you the self-inspection form.
