1 2018 Potomac Station Community Association PRIVATE SWIMMING POOL RULES AND REGULATIONS The pool is for the use of Potomac Station Community Association members and guests only. The following rules are intended to provide a safe and enjoyable environment for Potomac Station Community residents and guests. Failure to abide by any rules or regulations stated herein can cause the removal of the pool patron(s). 1) Personal Responsibility. Potomac Station Community Association assumes no responsibility for any accident, injury or personal property loss concerning the use of the pool, and is held harmless from any action occurring within the pool area. Upon acceptance of the family by signing the Pool Registration Form, and guest pool passes, all persons use the pool at their own risk. Any homeowner account that is 60 days or more in arrears will not be eligible for admission to the pool until such time that the account is brought up to date. 2) Pool Management. All persons must obey the instructions of the lifeguards. The lifeguards are responsible for enforcement of pool rules and have the authority to deny residents use of the facility for infraction(s) of the rules. In cases of disagreement with the interpretation of the rules, the lifeguard s interpretation will prevail until the Pool Committee (PC) or Board of Directors (BOD) Pool Committee liaison can provide a resolution to all concerns/complaints regarding the interpretation/enforcement of the pool rules. The Pool Manager shall wear a Manager on Duty tag at all times while working in the pool area for easy identification. NOTE: Please consider the lifeguard, who typically is a young adult, is not hired to absorb the anger of any pool patron. They are there to ensure safety and the rules are followed. For any conflicts or concerns please see the Pool Manager. 3) Resident and Guest Pool Use. Each household is required to have an approved registration on file. Members age 7 and older entering the facility are required to have a current pool pass. Pool passes will be scanned each time a member is admitted to the pool facility. Passes are not transferable. Children ages 11 and under must be accompanied and supervised by a responsible person, age 16 or older while at the pool facility. Children ages are permitted to enter the facility unaccompanied. The resident may only bring one guest of the same age group (12-15) or older. Nannies, au pairs, and child care providers who provide child care in the residence of the homeowner will be authorized access to the pool facility via the pool registration process and may accompany younger residents to the pool facility in lieu of the parent(s). Their use of the pool facility shall be limited to fulfillment of their duties during their hours of employment as the resident s primary child care provider. The provider will be required to have a pool ID card. Visiting family members are welcome to escort younger residents as their chaperones in lieu of adult resident(s). The visiting family member(s) will be required to use a guest pass. The adult PSCA member who furnishes the guest pass to the visiting adult chaperone shall be held responsible for their guests.

2 Each household will receive 10 guest admissions on their account at the start of each pool season. Guest passes are electronically linked to each household s account. *No physical pass will be issued*. Residents are responsible for knowing the remaining number of guest passes they have available for use. To add additional guest passes, please visit the association office to purchase. Guest passes may be purchased in 10-use increments for $20. The office can accept exact change cash or checks made out to Potomac Station, for additional guest passes during normal business hours Monday thru Friday, 9:00 a.m. 5:00 p.m. Members must escort their guests at all times and are held responsible for their guest s actions. Please acquaint your guest(s) with the pool rules as posted. Guest passes expire at the end of each season. Please note the guards do not have guest passes for sale, so if you require additional guest passes please plan accordingly to purchase them from the Association office Monday through Friday from 9am to 5pm. If the pass is lost, a replacement can be purchased at the management office for $5. Maximum capacity for the pool facility (to include all areas inside the perimeter fence) is 275 persons. This includes swimmers and non-swimmers. Should the facility reach maximum capacity, the On Duty Manager will institute a one out for one in policy to maintain compliance with our occupancy certification to avoid shut downs by the Health Department. 4) Hours. The posted hours are the operating times of the swimming pool. NO ONE (including pool staff) will be allowed to use the pool outside of the posted hours (except those associated with swim team operations or as participants of an Association sanctioned pool function). Because of safety and liability considerations, trespassers/vandals will be prosecuted to the fullest extent of the law. The Board of Directors, if appropriate, will hold the person(s) or, if relevant, their guardians, financially liable for any loss suffered by the Association. 5) Health and Hygiene. The law requires swimmers to shower before entering the pool area and after using tanning solutions. Admission shall be refused to any person(s) having infections (i.e., inflamed eyes, colds, nasal or ear discharges, poison ivy, excessive sunburn, open sores, or any visible communicable condition). Exceptions may be made based on a physician s certification. Children with soiled undergarments shall be changed in the appropriate restroom facility. The pool deck and deck chairs shall not be utilized as changing stations. 6) Diving. NO DIVING in any portion of the pool. This will be cause for immediate expulsion from the pool. 7) Behavior. Lifeguards reserve the right to determine if any pool activity jeopardizes the safety of others and will at all times enforce safety regulations. Disruptive and dangerous behavior, to include running, wrestling and foul language, is not permitted. In cases of egregious offenses the On Duty Manager has the discretion to summarily suspend the offender s pool privileges and escort them from the pool facility. In such cases the On Duty Manager will write a report and provide it to the Community Manager. All safety violations will be documented in the On Duty Manager s log. Flagrant and repeat offenders will immediately have their pool privileges suspended until an appeal is ruled upon by 2

3 the Pool Committee and/or Board of Directors. In cases of disagreement with the interpretation of the rules, the lifeguard s interpretation will prevail until a member of the Association s Board of Directors or Pool Committee assigned to monitor pool operations is consulted. 8) Adult Supervision. The presence of paid life guard staff and other adults does not relieve the accompanying adult of their supervisory responsibility. Children 11 years and under must be accompanied by an adult or adolescent above the age of 16. A. Wading Pool. Wading pool use is for children six (6) years of age or younger. Adult supervision is required at all times in this area. Play equipment is permitted in the wading pool. We request that parents not utilize the wading pool as a secondary pool or an alternative activity during prescribed rest periods. B. Main Pool Crescent Shaped Sections. Any child wishing to swim in water above their shoulders must pass a swimming test by demonstrating reasonable swimming skills at the lifeguard s request. Any child who does not pass a test needs to be under the direct supervision of an adult no further than the side of the pool. C. Main Pool - Lanes Section. Children 11 years and under must be accompanied by and remain under the supervision of an adult while in this portion of the pool area. D. Main Pool - Lap Lane. Please be considerate and refrain from entering the lap lane when there is a swimmer present. E. Slide. Swimmers may be required to pass a swimming proficiency test before using the slide. Persons not passing the test will be restricted to water not over their shoulders. (Swimming test consists of ability to swim 25 yards in good form, ability to tread water for 30 seconds.) Only one person allowed on any part of the slide at any time. The next person must stand at the bottom of the stairs until the person before them exits the water. Roughhousing or horseplay on the slide is strictly forbidden. Do not use the slide as a diving platform. The slide is made for sliding not for diving. Slide in a seated, face and feet-first position. NO HEAD FIRST SLIDING!!! Do not stop in the slide tube. Handicapped persons should use caution and may require supervision. Young children should be supervised at all times. Only flotation devices that are sewn into bathing suits or affixed/fastened vests are authorized on the slide. Water Wings and Noodles do not fulfill this requirement. Those who have not passed a swimming test, may not use the pool unless a supervising adult is in the water stationed in front of the slide to assist the swimmer safely back to the pool deck. 9) Attire. Pool users must wear proper bathing attire. Cut-offs, dungarees, thongs, etc. are not be permitted. Children who are not toilet trained must wear disposable swim diapers, tight fitting rubber pants, and snug fitting bathing suits. Disposable diapers not designed for swimming are prohibited. All soiled swim diapers must be changed and disposed of in the designated changing areas and not on the pool deck. **NOTE: In the event of multiple closings due to the non-adherence of the proper attire rule for non-toilet trained children, the Association s Board of Directors via the Pool Committee reserves the right to restrict non-toilet trained children from using the main pool. 3

4 10) Rest Periods. A fifteen (15) minute rest break will be invoked each hour for children under sixteen (16) years of age. Exceptions made only for infants when accompanied by an adult.. 11) Pool furniture. Pool furniture and other pool facilities are for the benefit of all members and are to be shared equitably. Please be considerate of others. Furniture shall be kept clear of the marked area immediately in front of the emergency access gates at all times. All parts of pool furniture should be kept on the pool deck; no portion of pool furniture should be submerged in the pool. 12) Personal Equipment. Neither PSCA nor the contracted Pool Management Company is responsible for lost or stolen personal property. Please immediately notify the On Duty Manager if property is lost. Lost items will only be held for 24 hours. Should you wish to file a police report, the On Duty Manager will assist you in contacting the Town of Leesburg Police Department. A. Personal Floatation Devices and Water Wings. Non-swimmers utilizing any section of the main pool shall wear a personal flotation device or water wings and remain within arm s reach of an accompanying adult swimmer. B. Other Play Equipment. Soft sponge-like balls and noodles are permitted unless restricted by the On Duty Manager. All other inflatable items are restricted. C. Wheeled Recreational Equipment. Bicycles, scooters, skateboards and other wheeled recreational items are not permitted in pool area. A bike rack is provided outside the pool facility for your use. D. Radios. Radios are permitted, provided the volume is maintained at a level that will not be disruptive to others. The On Duty Manager has the discretion to require headphones. 13) Smoking. Smoking is prohibited anywhere within the fenced perimeter of the pool facility. You may smoke outside of the pool area and use the provided cigarette disposal caddies. FLOWER POTS ARE NOT CIGARETTE DISPOSAL CADDIES. 14)Pets. Pets are not permitted within the confines of the fenced perimeter of the pool facility. Certified service animals are exempt from this provision. 15) Pool Closures. The pool may be temporarily closed for the reasons stated below. If you want up-to-the minute status -- please call the pool facility at A. Weather conditions. 1. Thunder and/or lightning. Swimmers must exit the pool when the lifeguard sights lightning or hears thunder. Swimmers will remain out of the water for 45 minutes after the last lightning flash is sighted or the cessation of thunder. 2. High winds. Closure will last until the weather conditions permit the pool to be safely reopened under normal operating conditions. 3. The On-Duty Manager may extend closure periods at his/her discretion. B. Equipment Failure. Operational breakdowns may require a delay in opening the pool or temporary closing of the pool. 4

5 C. Community permitted/sanctioned events. The Association permits on a year by year agreement the community s swim team, the Sailfish, to conduct swim meets at the Association pool. Dates and times of these events will be posted by the Sailfish several locations no less than three days in advance of the event. Please be mindful of these days as the pool will be closed to Non-Sailfish patrons. 16) Unsanitary Mishaps. In case of an accident involving bodily fluids or discharge (blood, vomit, urine, or feces) please notify a lifeguard immediately. If it is determined that the mishap will affect the safety of other swimmers, the pool will be closed for a thorough cleaning of the affected area. If this accident was caused by improper attire or negligence, thus forcing the pool to close, the violator s pool usage rights may be suspended for a period of up to 3 days. Repeat offenders may have their pool privileges revoked for the remainder of the season. 17) Food Consumption. A. Snacks and Food Items. Food items shall be consumed in the designated eating area. Meals that are delivered to the pool facility shall be received, kept, and consumed in the designated eating area or taken to the parking lot. Food items are not be taken onto the pool deck. B. Drinks. Bottled water stored in unbreakable, resealable containers are permitted on the pool deck area. All other drinks are to be consumed in the designated eating area. C. Alcohol Consumption. Consumption of alcoholic beverages on pool grounds is prohibited at all times. Violators will be denied access to the pool area. Additionally, any person believed to be intoxicated will be denied access to the pool area. D. Trash. Members must pick up and deposit trash into receptacles before leaving the pool area. Recommendations or requests for changes may be directed to the PSCA Pool Committee via the Community Management Office. We look forward to another safe and enjoyable season.
