2 Page 2 TENDER SCOTT SCBA AIR PACKS AND ACCESSORIES T SCOPE OF WORK: T E N D E R Tender # T SCOTT SCBA AIR PACKS AND ACCESSORIES SAINT JOHN FIRE DEPARTMENT The City of Saint John Fire Department is soliciting quotations for the purchase and delivery of Scott Health and Safety Self Container Breathing Air Packs and accessories as per the following specifications, terms and conditions. SPECIFICATIONS: Air Packs Manufacturer: Scott Health & Safety (Tyco). Model: Air-Pak 75 SCBA Part Number AP AP75 SCBA, 4.5 /w Dual EBSS, Pak Tracker, No Case Quantity 14 each To include original Scott Health & Safety warranty cards. Accessories Accessories for: Air-Pak 75 SCBA Cylinders Part Number PSI, 60 Minute Carbon Cylinder Quantity 6 TERMS AND CONDITIONS 1. INQUIRIES: All inquiries regarding this Tender shall be submitted in writing, at least five business days prior to the specified submission date, only to the attention of: Holly A. The source of the question will not be identified in the response. Verbal information shall not be binding upon the City. Inquiries after the above deadline will not receive a response.

3 Page 3 TENDER SCOTT SCBA AIR PACKS AND ACCESSORIES T 2. PAYMENT: Payment shall be based on Net 45 Days from date of invoice or receipt of goods, whichever is later. Invoices are to be sent to: City of Saint John, Accounts Payable Department, P.O. Box 1971, Saint John, N.B., E2L 4L1. 3. EXPLANATION TO BIDDERS: No verbal agreement or conversation with any officer, agent or employee of the owner either before or after execution of the contract, shall effect or modify any of the terms or obligations contained in any of the documents comprising the said contract. 4. TENDERS: Tenders received by FAX WILL NOT be accepted. 5. SUBSTITUTES: Substitute products will not be accepted for this tender. The City of Saint John will give consideration to vendors who are authorized Scott Health & Safety distributors. Bids from resellers or non-authorized distributors will not be considered. Refurbished air packs or air packs with refurbished part will not be considered. The product must be new. 6. BID Please bid your net price on each of the above commodities or services, F.O.B. Saint John, NB, prepaid. 7. TAXES The bid price shall be HST excluded. 8. TIME LIMIT: Bids received after the time and date as shown on the request for quotation shall not be considered, and will be returned unopened to the bidder. 9. ACCEPTANCE The City does not bind itself to accepting the lowest or any tender submitted, but reserves the right to accept any bid deemed to be in its best interest. The bidder is advised that the City of Saint John reserves the right not to award this tender or to amend its total quantity purchased. 10. ADVISORY/ADDENDUM Periodically, the City of Saint John is required to issue notification of changes or corrections to a bid document. Normally these notifications will have direct bearing on the cost of a project and will influence the way Tenderers bid. Therefore, it is important that the city have assurances that Tenderers have received the notification(s).

4 Page 4 TENDER SCOTT SCBA AIR PACKS AND ACCESSORIES T In the case of an advisory notice, these are faxed to the Tenderers and are accompanied by a cover sheet. Tenderers are instructed to sign the cover sheet and return it either by fax or in person, to the Purchasing Agent, prior to the tender closing. Addendums are either faxed, mailed or hand delivered. Each addendum contains a notification which requires Tenderers to sign and include the addendum with their tender bid. Failure to comply with the instructions on an advisory or addendum will result in rejection of the tender, regardless whether the changes noted in the advisory or addendum are included in the tender or not TENDERS: Tenders received by fax WILL NOT be accepted. Tenders must be submitted on the enclosed Form of Tender (appendix B); tenders not submitted on said form will be rejected. 12. WARRANTY: Bidders quoting on the specified items must include complete details of warranty and post sales service for items offered. 13. FOB: The quoted price must include delivery to the Fire Station 1, situated at 45 Leinster Street, Saint John, N.B. Prices are to be bid in Canadian dollars and must include all freight, duty and excise taxes. 14. CLARIFICATION OF BIDS: The City of Saint John reserves the right it is sole discretion to clarify any bid after close of bidding without becoming obligated to clarify any other bid.
