1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of May 19, 2018 DATE: May 10, 2018 SUBJECT: Award of Contract No RFP to Bennett Group, Inc. for Construction Management at Risk services for the replacement of the Powhatan Springs Skate Park and associated amenities C. M. RECOMMENDATION: 1. Approve the Award of Contract No RFP between the Arlington County Board and Bennett Group, Inc. to provide Construction Management at Risk (CMAR) services for the replacement of the Powhatan Springs Skate Park at 6020 Wilson Boulevard in the amount of $1,733,957.67, plus a County-held contingency amount of $136, for a total authorization of $1,870, Authorize the Purchasing Agent to execute the Contract, subject to legal review and approval as to form, by the County Attorney. ISSUES: Award of a capital construction contract of $250, or more requires County Board authorization. There are no outstanding issues as of the date of this report. SUMMARY: This is a request for approval of award of Contract No RFP to replace the existing Powhatan Springs Skate Park. The project is being renovated through the Fiscal Year 2017 Parks Maintenance Capital program and includes design and construction of the skate park, site furnishings, signage and ADA parking. BACKGROUND: The existing Powhatan Springs Skate Park opened to the public Labor Day 2004 and is approaching 14 years old. The facility is Arlington County s only skate park and has served thousands of skateboarders, inline skaters and BMX bicyclists since it first opened. Significant portions of the concrete in the skate park are failing, causing potentially hazardous conditions for users. At the same time, the evolution of the sport of skateboarding has advanced, as have skate parks themselves to serve the sport. County Manager: ##### County Attorney: ***** 33. Staff: Robert E. 2 To design a new skate park facility, the County engaged the design firm of RRMM Lukmire Architects, P.C. to plan and design the new facility. The County also engaged the services of GeoConcepts Engineering, Inc. to undertake a geotechnical report that included an evaluation of the subsurface conditions, soils design and load-bearing capacity and storm water recommendations. A location map and the final concept design are attached to this Board report. To deliver this project in the shortest, most expeditious timeframe and meet the specialized requirements of this facility, a Construction Manager at Risk (CMAR) process has been used. The CMAR process is a design and construction methodology relatively new to the County that can better control the project delivery by allowing builder input on costs, schedule, value and quality. The process brings together experienced construction professionals who can construct the skate park using the specialized construction methods needed for a very exacting sport. DISCUSSION: Three CMAR construction firms and five skate park specialty subcontractors were prequalified by the County under Request for Qualifications No RFQ. These prequalified firms were invited to submit proposals for the CMAR services to replace the Powhatan Springs Skate Park. On February 15, 2018, the County s Office of the Purchasing Agent received three proposals in response to Request for Proposals No RFP from the following firms: Bennett Group, Inc. FHP Tectonics, Corp. Meridian Construction Company, Inc. The evaluation and selection process conducted by the County established that Bennett Group, Inc. provides the best value to the County in provision of the services. The following costs have been negotiated with Bennett Group, Inc. for the project: Cost of Work $ 1,495, Construction Management Fee $ 78, General Conditions Fee $ 160, Total Cost $ 1,733, The CMAR costs are in line with industry norms and the contractor has identified numerous value engineering options that the County is considering in addition to any potential value enhancements realized in constructability reviews. The final Guaranteed Maximum Price (GMP) will be negotiated with the contractor following value engineering and constructability reviews. It is therefore recommended that the contract be awarded to Bennett Group, Inc. PUBLIC ENGAGEMENT: Public engagement for replacement of the skate park took place over the last three years and prior to the recent development of the County s Six Step Public Engagement Guide for Capital Projects. Consultants and County staff engaged with the skater community, adjacent neighbors, civic associations, commissions and the broader community to develop the design for the skate park replacement. This was accomplished through public meetings, an open house and on-line outreach. County staff also worked closely with the support - 2 -
3 group for the sport, Skaters for Arlington Skateparks. A member of this organization was a member of the Selection Advisory Committee and participated in the review of the proposals and the selection of the CMAR construction firm. There is wide community support for the skate park design. A letter of support from Skaters for Arlington Skateparks is attached to this Board report. FISCAL IMPACT: The overall project budget for the Powhatan Springs Skate Park project is $2,210,060 and includes design, stormwater management, construction and project management. Funding for the CMAR contract is available from account PSSP.R16.PC17 and was approved by Arlington County voters in the November 2016 referenda

We understand that the County is poised to enter into a contract for renovation of the skatepark. We are writing to express our continued support for renovation, and to urge the County to proceed with the work as expeditiously as possible. The concrete surface of the skatepark continues to degrade and we are once again working with DPR s Tom Mitchler to identify needed repairs. These are stopgap measures, and we look forward to a new concrete surface that will endure regional weather patterns for years to come. You have shared the 60-percent designs for the renovated park with us, and we have in turn shared them widely with others in our community. The feedback we ve received is uniformly positive. Skateboarders and other users are excited about the design and believe it represents the best possible use of the space. We predict that the park, when built, will be highly attractive to skateboarders and other users, many of whom will travel from across the nation to visit it. We appreciate the County s efforts to involve park users in plans for the renovation. The County s design was improved after it gathered input from users and park neighbors at two public meetings and through online solicitation. Review of contractor qualifications and proposals was no doubt improved by the County s decision to include a skateboarder on its review committee. Please continue to draw on us as a resource as the County enters the demolition and construction phases of the project.
