2 SUMNER PLANNING COMMISSION Thursday, January 4, :00 p.m. Sumner City Hall 1104 Maple Street CALL TO ORDER The meeting was called to order at 7:00p.m. by Chair Haines FLAG SALUTE Chair Haines led those in attendance in the flag salute. ROLL CALL Commissioners Present: Bush, Haines, Hamilton, McDermott, Mintz, Ridell, Robbert Commissioners Absent: None Staff Present: Director of Community Development Ryan Windish, Senior Planner Eric Mendenhall None before the Commission. PUBLIC COMMENT NEW BUSISNESS a. PUBLIC HEARING- Outdoor Seating Chair Haines opened the public hearing regarding Outdoor Seating at 7:02p.m. Senior Planner Eric Mendenhall explained the existing code limits dining options regarding outdoor seating and serving alcohol. said local businesses are very supportive of the changes. If adopted, all sidewalks would still need to remain A.D.A. compliant at all times of the year. Mr. Mendenhall also asked that the Commission include taverns, bars, and microbreweries to the changes. Staff recommends approval. Discussion ensued. Chair Haines brought up questions and concerns about parklettes, which are public areas temporarily used for seating. Director of Community Development Ryan Windish replied Staff could look further into parklettes, evaluate internally, and perhaps create a pilot program to evaluate possible concerns. Commissioner Robbert motioned to approve changes to Outdoor Seating. Commissioner Hamilton seconded the motion. All were in favor. MOTION PASSED UNAIMOUSLY. Chair Haines closed the public hearing at 7:24p.m. b. PUBLIC HEARING- Noticing Requirement Text Amendment Chair Haines opened the public hearing regarding Noticing requirement text amendment at 7:25 p.m. 2

3 Senior Planner Eric Mendenhall explained the current public noticing requirements, and stated the costs and difficulties Staff has seen. Staff recommends removing the newspaper noticing requirement, and adds an electronic method in its place. Mr. Mendenhall stated the changes would comply with the comprehensive plan as well as state regulations. Commissioner McDermott motioned to approve amending the Noticing Requirement text suggested by staff. Commissioner Robbert seconded the motion. All were in favor. MOTION PASSED UNAIMOUSLY. Chair Haines closed the public hearing at 7:31p.m. c. Chair and Vice-Chair Elections- Chair Haines opened up the meeting and asked the Commission to make nominations for Chair and Vice Chair positions. Commissioner Mintz nominated Ron Haines for Chair. Haines stated he would accept and serve. Commissioner Bush motioned Ron Haines as Chair of the Planning Commission. Commissioner McDermott seconded the motion. All were in favor. MOTION PASSED UNAIMOUSLY. Commissioner Ridell nominated Greg Mintz for Vice-Chair. Mintz stated he would accept and serve. Commissioner McDermott motioned Ron Haines as Chair of the Planning Commission. Commissioner Hamilton seconded the motion. All were in favor. MOTION PASSED UNAIMOUSLY. None before the Commission. CORRESPONDENCE COMMISSION COMMENTS Commissioner Bush asked about marijuana sales billboards, as she saw two and thought the Commission had made changes so they were not allowed. Staff member Windish stated there are about locations where they would be allowed, but Staff will check on the billboards mentioned to make sure they comply. Chair Haines announced the Memorial Service for Mayor Dave Enslow will be on Saturday, January 6 th at 11:00 AM at Calvary Community Church. STAFF COMMENTS Staff member Mendenhall noted a few upcoming meeting dates. He also mentioned that there will be an Open House on the Town Center Plan on February 15 th at 6:00 PM. 5 STAFF MEMO DATE: January 24, 2018 TO: Planning Commission FROM: Ann Siegenthaler, Associate Planner RE: Sign Code Amendments SMC Chapter PLN I. BACKGROUND The Sign Code (Chapter of the Zoning Code) establishes size limits for business signs in Sumner. The current size limits are appropriate for most developments; however, signs could be significantly larger due to gaps in the current code. Staff is concerned that very large buildings in commercial and industrial zones could have excessively sized wall signs and Electronic Reader Board signs. In addition, there are several areas of the Sign Code where missing definitions or confusing provisions create inconsistencies in how the Sign Code is applied. The proposed amendments will place additional limits on the size and number of signs in commercial and industrial zones. In addition, amendments will to clarify height and setbacks for freestanding signs, clarify definitions, and miscellaneous corrections. Staff discussed the proposed ordinance amendments with the Council Community Development Committee on December 12, II. SUMMARY and ANALYSIS OF PROPOSED AMENDMENTS Proposed amendments are for Commercial and Industrial zones only. The amendments and rationale for the changes are summarized below. 1) Place a cap on the size and number of Wall Signs in commercial and industrial zones. Make the formula for size calculations consistent across all commercial and industrial districts. Under current code, there is the possibility of very large wall signs that may be incompatible with the scale of the surrounding development. The size of a wall sign is based on the height and width of the wall, so a larger building results in a larger sign. For example, a large multi-story building could have a 600 s.f. sign that is 2 stories tall by 1 story wide. Also, for some signs, there is no clear limit on the number of signs allowed, which can lead to excessive number of signs on a building. The proposed code changes would limit size and number of signs. Another Page 1 of 5 5

6 proposed change is to make the formula for calculating the size of signs consistent across commercial and industrial zones. In some zones the formula uses 10% of the façade versus 5% in other zones. This leaves the possibility of very large wall signs for multi-story buildings. The proposed amendments would limit wall signs to 5% of the façade for all zones. Proposed changes are summarized below: Industrial zones: Wall signs = 5% of building façade (was 10%) capped at 300 s.f. Industrial w/only one street front: Add allowance for 1 more wall sign. Interchange Commercial: Wall signs = 5% of building façade (same) capped at 300 s.f. Interchange Commercial additional wall signs: The 4 additional wall signs currently allowed in IC would be allowed on lower stories only, and capped at 80 square feet each. Interchange commercial additional freestanding signs: Properties with more than one street frontage get an additional low monument sign. General Commercial: Wall signs = 5% of building façade (same) capped at 250 s.f. Other Commercial (e.g. CBD): Wall signs = 5% of façade (was 10%) capped at 150 s.f. Add minimum sign allowance: Allow at least 30 s.f. of wall signs, in case of very small or odd-shaped facades. Add another sign for corner buildings: Businesses limited to 2 wall signs, but allow 1 more on building corner. Additional small signs: Allow small signs at entrances from parking lots/alleys for all zones (missing from GC and IC). Allow small suspended signs. 2) Establish a maximum size for business names on a Building Identification Sign. A Building Identification sign (e.g. Evergreen Shopping Center) may also contain the names of individual tenants up to 70% of the sign area. The code does not address how the 70% is allocated, so the Building ID sign could become one large individual business sign, in excess of what is otherwise allowed. Proposed changes would maintain the intent of a Building Identification Sign, prevent excessive signage, and provide more equitable allowance for all the businesses on a site. Proposed change: Create definition of Building Identification Sign that allows any one business no more than 50% of the sign face. 3) Clarify definition of façade for calculating wall sign size. Wall sign size is based on the height and width of the façade on which the sign is placed. A clarification is needed to ensure that the entire building façade is not counted again and again for each tenant sign. The proposed change would prevent an entire façade being covered with signs, and allow each tenant to have a sign that is sized in relation to the size of their tenant space. Proposed change: Update the definition of building façade in Sign Code definitions to add: the façade defining the space occupied by the establishment. Staff Memo-SignCode Page 2 of 5 6

7 4) Change allowances for Window Signs, Projecting Signs, and Suspended Signs. A. Window signs. The current Sign Code allows permanent, large window signs, in addition to other signs. There are two concerns: a) Window signs could be overly large, especially on multi-story buildings; and b) This can result in windows being entirely covered. This can create a cluttered, distracting streetscape, and it conflicts with goals in Sumner s design guidelines for attractive building architecture and storefront windows. The proposed size limit would make window signs proportional to the window, and cap window signs at 40 s.f. A typical tenant in a multi-tenant retail strip would still be able to have window signs in the 6-10 s.f. range. Proposed changes: Limit size to 20% of the window where displayed (up from 10% in GC, IC and Industrial zones), capped at 40 s.f. each. Can have numerous window signs, but they count toward the overall sign allowance. Limit window signs to ground floor except for tenants on upper floor. B. Projecting signs and suspended signs. Current code allows projecting signs (project out from the wall plane) and suspended signs (hang under awning) in addition to freestanding signs and wall signs, but does not limit their size or number. These types of signs can add interest to the streetscape if not overly large. Proposed changes: Projecting signs must be counted in total sign allocation and size is limited to 8 s.f. Suspended signs will be allowed (up to 4 s.f.) at public entrances to buildings; businesses will be allowed a small suspended sign in addition to wall signs. 5) Correct a code error that inadvertently prohibits sandwich board signs in General Commercial. In commercial districts in Sumner, businesses are allowed to have sandwich board signs. This allowance is missing from the General Commercial District. The proposed code change would allow sandwich board signs along all commercial frontages, where they can be an attractive addition to the pedestrian streetscape, and would make the sign allowance more equitable. All downtown businesses should have similar sign allowances. The proposed change would: Add a provision to allow sandwich board signs in the General Commercial zone, subject to the existing performance standards in the Sign Code. 6) Codify a current height requirement for low monument signs; establish a minimum setback for freestanding signs. Current code does not specify a height limit for monument signs. Height is based on a code interpretation, which makes it difficult for sign companies to design the height of a monument sign. The proposed change would set a height consistent with typical monument signs seen in commercial zones in Sumner. Also, the Sign Code does not specify a minimum setback from the Staff Memo-SignCode Page 3 of 5 7

8 public street for freestanding signs. This is confusing for sign companies. The proposed code change would create a safe clearance from the sidewalk and street trees, and enhance the pedestrian streetscape, while allowing for visibility of signs. Proposed changes: Set a height a limit of 7 feet for a monument sign. Establish a minimum setback of 2 feet for monument signs and 5 feet for other freestanding signs. 7) Cap the size of Electronic Reader Board wall signs (GC and IC zones). Current code allows ERBS in the General Commercial zone and the Interchange Commercial zones only. Under the current code, there is the potential for very large ERBS. For example, a multi-story development downtown or in the IC zone could have an ERBS that is square feet. Limiting ERBS to 75% of the sign face AND placing a cap on the size will help minimize the visual impacts of ERBS, and help keep future ERBS a similar size to those existing. Smaller businesses (with smaller buildings) would not be unreasonably limited, and could still have ERBS within their wall signs. The proposed code change: General Commercial zone: ERBS no larger than 75% of sign face, capped at 125 s.f. Interchange Commercial: ERBS no larger than 75% of sign face, capped at 175 s.f. General Commercial west of White River: Allow freestanding ERBS (same) but cap at 125 s.f. ERBS must be counted in the overall sign allowance, not in addition. 8) Correct a code error that inadvertently prohibits electronic reader board signs. The recent ERBS code change inadvertently left in the prohibition for ERBS, only allowing them in the Interchange Commercial zone at SR-410. The proposed change would correct this prohibition to be consistent with the recent ordinance passed by City Council. Proposed change: Allow ERBS west of the White River in General Commercial zone consistent with Council s recent ordinance. 9) Allow flexibility for historically significant signs in the CBD. When an older, non-conforming sign undergoes substantial repair or alteration, the current Sign Code requires them to be brought up to current standards. It also requires other signs on the premises to be brought up to standards. This is a disincentive to repair historically significant signs. Proposed code language would allow historically significant signs to deviate from the standards, subject to review by the Design Commission. Also it would allow a projecting sign on Main Street, if it protects historic building architecture. Approval criteria are also proposed. 9 Add definition of historically significant sign (50 years or older, associated with business 50 years or older, quality design, etc.) Add criteria for granting a deviation (reflects building architecture, compatible with character of downtown, etc.) III. CONCLUSION One of the Sign Code s stated purposes is to maintain and enhance the aesthetic environment and the city s ability to attract sources of economic development and growth The proposed amendments will set reasonable limits on signs; reduce the visual impact of very large signs on building architecture, surrounding businesses and the streetscape; and at the same time will allow adequate signage and visibility for businesses, and will help ensure that the intent of the Sign Code is met. IV. NEXT STEPS The City Council CD Committee reviewed the proposed amendments on December 12, 2017 with do pass recommendation. SEPA environmental review has begun, and the 2-week public comment period has started. Additional public notice will occur prior to the Planning Commission public hearing, which is scheduled for February 1, V. 17 EXHIBIT A ORDINANCE NO. CITY OF SUMNER, WASHINGTON AN ORDINANCE ADOPTING AMENDMENTS TO THE CITY OF SUMNER ZONING CODE REGUATIONS AMENDING SECTIONS , , , , , , , , ; OF THE SUMNER MUNICIPAL CODE. WHEREAS, to address the potential impact of excessively large advertising signs in commercial and industrial zones; and WHEREAS, to create consistency and clarity in how the Sumner Sign Code is applied in commercial and industrial zones; and WHEREAS, the proposed amendments are consistent with the stated Purpose of the Sign Code; and WHEREAS, the proposed amendments are consistent with the City s Comprehensive Plan; and WHEREAS, the City s State Environmental Policy Act (SEPA) official issued a Determination of Nonsignificance on ; and WHEREAS, on notice was sent to the Washington State Department of Commerce requesting expedited review. On the City was granted expedited review and was informed that it had met the Growth Management Act notice requirements under RCW 36.70A.106; and WHEREAS, the Planning Commission held a public hearing on ; and WHEREAS, the City Council Community Development Committee reviewed the proposed amendment on and recommended it be added to Councils consent agenda with a do pass recommendation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SUMNER, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That section Definitions, of the Sumner Municipal Code is hereby amended to read as follows: Definitions. For the purposes of this chapter, certain words and phrases have the following meanings, unless the context otherwise indicates or a definition exists in chapter SMC: [ ] Page 1 of 21 17

18 Building sign means a sign attached to any part of a building, as contrasted with a freestanding sign. Printing on a canopy or awning is considered as a building sign. Building façade is the entire building front defining the space occupied by the business establishment and to which the sign is attached. Building identification sign means a sign containing the name and/or address of the premises, for the primary purpose of identifying the premises. A building identification sign does not include a sign where any one business establishment or tenant name or logo occupies more than 50 percent of the sign face. [ ] Facade. See definition in SMC [ ] Historically significant sign means a sign that meets any or all of the following: - The sign is more than 50 years old and is associated with a building or business that has been located in Sumner for more than 50 years; - The sign embodies the distinctive characteristics of a type, period, style or method of design or construction present in Sumner in the early 20 th century or earlier. Identification sign means a sign containing the name of the business establishment, occupant of the building, and/or address of the premises. [ ] Projecting sign means a sign which is attached to and projects from a structure or wall in such a manner that its leading edge extends more than 16 inches beyond the surface of such structure or wall. A marquee sign is not considered a projecting sign. Suspended sign means a sign that is suspended from the underside of a horizontal plane surface and is supported by such surface. Section 2. That section Prohibited signs, of the Sumner Municipal Code is hereby amended to read as follows: [ ] N. Electronic reader board signs, except in the interchange commercial zone south of SR- 410 as permitted under SMC and in the general commercial zone as permitted under SMC Section 3. That section Business park identification sign, of the Sumner Municipal Code is hereby amended to read as follows: Business park identification sign. A business park identification sign may be erected for business parks according to the following standards: Page 2 of 21 18

19 [ ] B. Maximum height of monument sign: five feet. All other freestanding signs shall not exceed a height of 15 feet. C. Area The area within five feet of the sign base must be landscaped. D. Monument style signs are preferred and shall be located at the entrance to the property, and shall meet a minimum setback of 2 feet from the public right-of-way. Freestanding signs supported by poles or pylons shall meet a minimum setback of 5 feet from the public right-of-way. Freestanding signs are limited to with a maximum of two signs per entrance, two entrances maximum. Section 4. That section Signs permitted in the central business district, of the Sumner Municipal Code is hereby amended to read as follows: B. Multiestablishment Multi-Establishment Buildings. A single building that contains more than one establishment may erect the following signs up to the maximum aggregate sign area: 1. Building Identification Sign. Sign(s) identifying the name and/or address of the building are allowed as follows. The names of individual establishments in the building may be placed on up to 70 percent of the sign area. a. Freestanding Sign. i. Freestanding signs are prohibited in the central business district along Main Street between Wood Avenue and the Burlington Northern Railroad right-of-way. ii. One wall sign or freestanding sign is allowed for each street frontage not to exceed a total of two signs on the premises. iii. The maximum sign area permitted for a freestanding sign is 150 square feet. No one face shall exceed 75 square feet. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 15 feet within 15 feet of any lot line abutting a public street right-of-way. For each additional one-foot setback beyond 15 feet the sign height may be increased by two feet to a maximum height of 35 feet. iv. Low, horizontal monument signs are preferred Freestanding signs supported by poles or pylons shall meet a minimum setback of 5 feet from the public right-ofway. Monument signs shall meet a minimum setback of 2 feet from the public right-of-way. b. Wall Signs. One wall sign or freestanding sign is allowed for each street frontage not to exceed a total of two signs on the premises. The maximum sign area permitted for a building identification wall sign is equal to 10 5 percent of the facade to which it is attached, or 150 square feet, whichever is less. c. Window Signs. Sign area shall not exceed 20 percent of the total window area of any facade. Window signs shall meet the standards in SMC (D). dc. Projecting Signs. One projecting sign is allowed per building in lieu of an allowed suspended sign; except that Projecting projecting signs are prohibited on Main Page 3 of 21 19

20 Street between Traffic Avenue and Wood Avenue and the north side of Main Street between Lewis Avenue and Valley Avenue. Projecting signs shall be erected in accordance with SMC The sign area permitted for a projecting wall sign shall not exceed 8 square feet. ed. Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. fe. Roof signs are prohibited. gf. Suspended Signs. One suspended sign is allowed at each public building entrance. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards set forth in SMC Individual Establishment Identification Signs. Each individual establishment in a multi-establishment building is allowed a minimum of 30 square feet of signage as set forth below. Aggregate sign area shall not apply to signs for individual establishments. a. Freestanding signs are prohibited. b. Wall Signs. A maximum of two wall signs are allowed; except that an establishment on a building corner is allowed one additional wall sign on the ground floor up to 10 square feet. The maximum sign area permitted is equal to 10 5 percent of the facade to which it is attached, or 150 square feet, whichever is less. c. Window Signs. Each individual establishment is allowed window sign(s) provided the combined area of window sign(s) and wall sign(s) does not exceed the wall sign allowance in Subsection (B)(2)(b). Uses that occupy the ground floor are allowed window signs on the ground floor only. Sign area shall not exceed 20 percent of the total window area of any facade the window in which the sign is displayed, or 40 square feet, whichever is less. Window signs shall meet the standards in SMC (D). d. Projecting Signs. One projecting sign is allowed per establishment in lieu of one suspended sign; except that Pprojecting signs are prohibited on Main Street between Traffic Avenue and Wood Avenue and the north side of Main Street between Lewis Avenue and Valley Avenue. The sign area permitted for a projecting wall sign shall not exceed 8 square feet. 4. Projecting Signs. Projecting signs are prohibited on Main Street between Traffic Avenue and Wood Avenue. and the north side of Main Street between Lewis Avenue and Valley Avenue; except that, on properties where installation of a wall sign would substantially detract from, damage or obliterate the significant architectural features of an existing building built prior to 1950, one projecting sign may be approved in lieu of one allowed wall sign; provided: a. The projecting sign receives design review approval pursuant to SMC (E); b. One projecting sign is allowed per establishment; Page 4 of 21 20

21 c. The sign area for such projecting sign shall not exceed 20 square feet; and d. Where allowed, Pprojecting signs shall meet the standards set forth in SMC e. Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. f. Roof signs are prohibited. g. Suspended Signs. One suspended sign is allowed for each establishment. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards set forth in SMC C. Single Establishment Buildings. 1. Freestanding Sign. a. Freestanding signs are prohibited in the central business district along Main Street between Wood Avenue and the Burlington Northern Railroad right-of-way. b. One freestanding sign is allowed per street frontage of the premises up to a maximum of two signs. The maximum sign area permitted is 150 square feet. No one face shall exceed 75 square feet. c. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 15 feet within 15 feet of any lot line abutting a public street right-of-way. For each additional one-foot setback beyond 15 feet the sign height may be increased by two feet to a maximum height of 35 feet. d. Low, monument signs are preferred. Freestanding signs supported by poles or pylons shall meet a minimum setback of 5 feet from the public right-of-way. Monument signs shall meet a minimum setback of 2 feet from the public right-ofway. 2. Wall Signs. A maximum of two wall signs are allowed on the premises, except that an establishment on a building corner is allowed one additional wall sign on the ground floor up to 10 square feet. Sign area shall not exceed 10 5 percent of the area of the building facade to which it is attached, or 150 square feet, whichever is less. A single establishment building is allowed a minimum of 30 square feet of total signage. 3. Window Signs. Window signs are allowed, provided the combined area of window sign(s) and wall sign(s) does not exceed the wall sign allowance in Subsection (C)(2). Window signs are allowed on the ground floor only. Sign area shall not exceed 20 percent of the total window area of any facade the window in which the sign is displayed, or 40 square feet, whichever is less. Window signs shall meet the standards in SMC (D). 4. Projecting Signs. Projecting signs are prohibited on Main Street between Traffic Avenue and Wood Avenue and the north side of Main Street between Lewis Avenue and Valley Avenue; except that, on properties where installation of a wall sign would substantially detract from, damage or obliterate the significant architectural features of an existing Page 5 of 21 21

22 building built prior to 1950, one projecting sign may be approved in lieu of one allowed wall sign; provided: a. The projecting sign receives design review approval pursuant to SMC (E); b. One projecting sign is allowed per establishment; c. The sign area for such projecting sign shall not exceed 20 square feet; and d. Where allowed, Pprojecting signs shall be erected in accordance with SMC Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. 6. Roof signs are prohibited. 7. Suspended Signs. One suspended sign is allowed. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC D. Other Signs Allowed. 1. Sandwich board/sidewalk signs are allowed subject to the provisions SMC Rear Entrance Signs. Any building with a rear entrance from a public or private parking lot or alley may have a sign at the rear entrance sign which shall be either a wall sign or a marquee, suspended, or awning sign. Said sign shall not exceed 10 5 percent of the facade to which it is attached, or 15 square feet, whichever is less. E. Historically Significant Signs. Alteration, restoration or replacement of a historically significant sign that deviates from the standards of this Chapter shall be subject to design review as provided for in chapter SMC, procedures for Land Use Permits, and shall require design review according to the procedures for Type III.b. decisions. Deviations may be approved based on the following criteria: 1. Deviations from the standards of this Chapter are deemed necessary to preserve the original size, material or location of a historically significant sign. 2. Proposed changes to a historically significant sign substantially conform to the original sign in terms of character, size, materials, workmanship and design. 3. Installation of a sign in strict conformance with this chapter would substantially detract from, damage or obliterate the significant architectural features of an existing building built prior to The proposed sign does not detract from the building s architectural design, and reflects the character of the building and/or the period architecture. 5. The design is compatible with the character of the surrounding area and the overall character of the city. 6. The proposed sign is professionally constructed using high-quality materials. 7. Brackets, guy wires, braces and similar hardware are visually minimized, or an integral part of the overall design. Exposed conduit, wiring, and junction boxes are be concealed to the extent possible from public view. Page 6 of 21 22

23 8. The deviation requested is the minimum necessary to achieve the design intent of this subsection, and will not be materially detrimental to adjacent properties or the streetscape. Section 5. That section Signs permitted in the neighborhood commercial district and mixed-use developments in the central business district, general commercial district and in the mixed-use development district, of the Sumner Municipal Code is hereby amended to read as follows: B. Multi-Establishment Buildings. A single building that contains more than one establishment may erect the following signs up to the maximum aggregate sign area: 1. Building Identification Sign. Sign(s) identifying the name and/or address of the building are allowed as follows. Said sign(s) may contain the names of individual establishments in the building on up to 70 percent of the sign area. a. Freestanding Signs. i. Freestanding signs are prohibited in the central business district along Main Street between Wood Avenue and the Burlington Northern Railroad right-of-way and in the mixed-use development district. ii. One wall sign or freestanding sign is allowed for each street frontage not to exceed a total of two signs. iii. The maximum sign area permitted for a freestanding sign is 150 square feet. No one face shall exceed 75 square feet. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 15 feet within 15 feet of any lot line abutting a public street right-of-way. For each additional one-foot setback beyond 15 feet the sign height may be increased by two feet to a maximum height of 35 feet. iv. Low, horizontal monument signs are preferred. Freestanding signs supported by poles or pylons shall meet a minimum setback of 5 feet from the public right-ofway. One wall sign or freestanding sign is allowed for each street frontage not to exceed a total of two signs. The maximum sign area permitted for a building identification wall sign is equal to 10-5 percent of the facade to which it is attached, or 150 square feet, whichever is less. c. Window Signs. Sign area shall not exceed 20 percent of the total window area of any facade. Window signs shall meet the standards in SMC (D). dc. Projecting Signs. One projecting sign is allowed per building in lieu of one allowed suspended sign; except that Projecting projecting signs are prohibited on Main Street between Traffic Avenue and Wood Avenue and the north side of Main Street between Lewis Avenue and Valley Avenue and in the mixed-use development district. Each individual establishment in a multi-establishment building is allowed a minimum of 30 square feet of signage as set forth below. Aggregate sign area shall not apply to signs for individual establishments. a. Freestanding signs are prohibited. b. Wall Signs. A maximum of two wall signs are allowed; except that an establishment on a building corner is allowed one additional wall sign on the ground floor, up to 10 square feet. The sign area permitted for a projecting wall sign shall not exceed 8 square feet. Projecting signs shall be erected in accordance with SMC Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. 6. Roof signs are prohibited. 7. Suspended Signs. One suspended sign is allowed. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC Digital Message Signs. Digital message signs in the neighborhood commercial zone shall be allowed only for schools, or regional community centers subject to the following standards: Page 9 of 21 25

26 a. The digital message sign shall be considered a freestanding sign as per subsection (C)(1)(b) of this section. b. The digital message sign shall not exceed a height of seven feet, and shall meet a minimum setback of 2 feet from the public right-of-way. c. The digital message sign shall not exceed 63 square feet in area. The electronic portion shall not exceed more than 60 percent of the total sign area. d. The digital message sign shall be a monument sign. D. Other Signs Allowed. 1. Neighborhood identification sign per SMC Sandwich board/sidewalk sign per SMC Rear Entrance Signs. Any building with a rear entrance from a public or private parking lot or alley may have a sign at the rear entrance sign which shall be either a wall sign or a marquee, suspended, or awning sign. On properties where a freestanding sign cannot be erected due to setback requirements or building placement, a projecting sign may be allowed in lieu of the permitted freestanding sign. Said projecting sign shall not exceed 30 square feet and 15 square feet per face (outside dimensions);. Signs shall meet the standards in SMC ii. One projecting sign is allowed per building in lieu of one allowed suspended sign, provided the area for a projecting wall sign shall not exceed 8 square feet; and iii.projecting signs are not allowed along East Main Street from Valley Avenue to 160th Avenue East. Where allowed, projecting signs shall meet the standards in SMC ed. Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. fe. Roof signs are prohibited. gf. Suspended Signs. One suspended sign is allowed at each public building entrance. Sign area shall not exceed percent of the total window area of any facade the window in which the sign is displayed, or 40 square feet, whichever is less. Window signs shall meet the standards in SMC (D). 4. Projecting Signs. i. On properties where a freestanding sign cannot be erected due to setback requirements or building placement, a projecting sign may be allowed in lieu of the permitted freestanding sign, provided the maximum sign area shall not exceed 30 square feet and 15 square feet per face; Page 12 of 21 28

29 ii. One projecting sign is allowed in lieu of one allowed suspended sign, provided the sign area permitted for a projecting wall sign shall not exceed 8 square feet; and iii. Said sign shall meet the requirements as set forth in SMC Projecting signs are not allowed along East Main Street from Valley Avenue to 160th Avenue East. Where allowed, projecting signs shall meet the standards in SMC Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. 6. Roof signs are prohibited. 7. Suspended Signs. One suspended sign is allowed. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC Electronic reader board signs (ERBS) are allowed west of the White River as follows: a. ERBS shall not display more than one message per eight seconds. b. Animation between messages shall not be allowed. c. ERBS are allowed on wall signs in lieu of a wall sign allowed in Subsection (C)(2). A wall ERBS shall not exceed 75 percent of the square footage of the wall sign face allowed under Subsection (C)(2), or 125 square feet, whichever is less. ERBS are allowed in lieu of a freestanding sign allowed in Subsection (C)(1). If ERBS are installed on freestanding signs they cannot exceed 75 percent of the allowed square footage of the sign face allowed in Subsection (C)(1), or 125 square feet, whichever is less. At least 25 percent of the sign must be fixed identification sign. d. Only one ERBS is allowed per site and parcel. e. The difference between the off and solid-message measurement using the ERBS measurement criteria shall not exceed 0.3 foot-candles over ambient lighting conditions when measured at the recommended distance, based on the ERBS size. The measurement distance shall be calculated by using the following formula: measurement distance = the square root of the (area of the sign square feet x 100). f. ERBS shall be programmed to automatically adjust illumination for all times of day and night based on ambient light conditions using photocell technology. D. Other Signs Allowed. 1. Sandwich board/sidewalk signs are allowed subject to the provisions SMC Rear Entrance Signs. Any building with a rear entrance from a public or private parking lot or alley may have a sign at the rear entrance which shall be a wall sign or a marquee, suspended, or awning sign. Said sign shall not exceed 5 percent of the facade to which it is attached, or 15 square feet, whichever is less. Section 7. That section Signs permitted in the interchange commercial district, of the Sumner Municipal Code is hereby amended to read as follows: Page 13 of 21 29

Sign(s) identifying the name and/or address of the building are allowed as follows. Said sign(s) may contain the names of individual establishments in the building for up to 70 percent of the sign area. a. Freestanding Signs. i. One freestanding sign or wall sign is allowed for each street frontage not to exceed a total of two signs. The maximum sign area permitted for a freestanding sign is 300 square feet. No one face shall exceed 150 square feet. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 45 feet. Freestanding signs supported by poles or pylons shall be set back a minimum of 5 feet from the public right-of-way. Monument signs shall meet a minimum setback of 2 feet from the public right-of-way. ii. One additional freestanding sign is allowed for properties with more than one street frontage, or for those properties located within 100 feet of a state route and access to the site does not front along the state route. The maximum sign area permitted is 50 square feet. No one face shall exceed 25 square feet. The additional freestanding sign shall not exceed a height of six6 feet and shall be set back a minimum of 2 feet from the public right-of-way. b. Wall Signs. One wall sign or freestanding sign is allowed for each street frontage not to exceed a total of two signs. The maximum sign area permitted for a building identification wall sign is equal to five percent of the facade to which it is attached, or 300 square feet, whichever is less. c. Window Signs. Sign area shall not exceed 10 percent of the total window area of any facade. Window signs shall meet the standards in SMC (D). dc. Projecting Signs. i. Any commercial building occupied by a single establishment may erect signs as follows up to the maximum aggregate sign area: 1. Freestanding Signs. a. One freestanding sign is allowed. The maximum sign area permitted is 300 square feet. No one face shall exceed 150 square feet. b. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 45 feet. Such maximum height shall be available regardless of sign setback. Freestanding signs supported by poles or pylons shall be set back a minimum of 5 feet from the public right-of-way. Monument signs shall meet a minimum setback of 2 feet from the public right-of-way. One additional freestanding sign is allowed for properties with more than one street frontage, or at the frontage road entrance for those properties located within 100 feet of a state route and access to the site does not front along the state route. The maximum sign area permitted is 50 square feet. No one face shall exceed 25 square feet. The additional freestanding sign shall not exceed a height of six6 feet and shall be set back a minimum of 2 feet from the public right-of-way. 2. Wall Signs. Sign area shall not exceed five percent of the area of the building facade to which it is attached, or 300 square feet, whichever is less. A single establishment building is allowed a minimum of 30 square feet of total wall signage. Said sign may be illuminated externally or internally. A maximum of two wall signs are allowed on the premises, except as follows: a. On buildings with total building facade area greater than 12,500 square feet and less than 25,000 square feet, : an An additional two wall signs are allowed, on the first two stories only, up to a maximum of 80 square feet each. b. On buildings with a total building facade area of 25,000 square feet or greater, : an An additional four wall signs are allowed, on the first two stories only, up to a maximum of 80 square feet each. 3. Window Signs. Window signs are allowed on the ground floor only, provided the combined area of window sign(s) and wall sign(s) does not exceed the wall sign allowance in Subsection (B)(2)(b). Sign area shall not exceed percent of the total window area of any facade the window in which the sign is displayed, or 40 square feet, whichever is less. Window signs shall meet the standards in SMC (D). 4. Projecting Signs. i. On properties where a freestanding sign cannot be erected due to setback requirements or building placement, a projecting sign may be allowed in lieu of the permitted freestanding sign. provided the maximum sign area shall not exceed 30 square feet and 15 square feet per face; ii. One projecting sign is allowed in lieu of one allowed suspended sign, provided that the maximum sign area permitted for a projecting wall sign shall not exceed 8 square feet; and iii. Where allowed, Said a projecting sign shall meet the standards in SMC Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. 6. Roof signs are prohibited. 7. Suspended Signs. One suspended sign is allowed. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC Electronic Reader Board Signs. Electronic reader board signs (ERBS) are allowed in the IC zone south of State Route 410 as follows: a. ERBS shall not display more than one message per eight seconds. b. Animation between messages shall be limited to one second. Page 16 of 21 32

33 c. No single electronic message is permitted to be repeated by flashing more than once every 16 seconds. d. ERBS may only be allowed as part of a wall sign, in lieu of one wall sign allowed in Subsection (C)(2). ERBS shall not exceed 75 percent of the square footage of the wall sign face allowed in Subsection (C)(2), or 175 square feet, whichever is less. Freestanding ERBS are not allowed. e. Only one ERBS is allowed per site and parcel. f. The difference between the off and solid-message measurement using the ERBS measurement criteria shall not exceed 0.3 footcandles. The measurement distance shall be calculated by using the following formula: measurement distance = the square root of the (area of sign square feet x 100). g. ERBS shall be programmed to automatically adjust illumination for all times of day and night. D. Other Signs Allowed. 1. Rear Entrance Signs. Any building with a rear entrance from a public or private parking lot or alley may have a sign at the rear entrance which shall be a wall sign or a marquee, suspended, or awning sign. Said sign shall not exceed 5 percent of the facade to which it is attached, or 15 square feet, whichever is less. Section 8. That section Signs permitted in the industrial districts, of the Sumner Municipal Code is hereby amended to read as follows: B. Single Establishment Buildings. Monument signs shall meet a minimum setback of 2 feet from the public right-ofway. 2. Wall Signs. One wall sign and one freestanding sign are allowed for each street frontage of the premises not to exceed a total of three signs. A maximum of two wall signs are allowed on the premises. The maximum sign area permitted is equal to 10-5 percent of the facade to which it is attached, or 300 square feet, whichever is less. Window signs shall meet the standards in SMC (D). 4. Projecting Signs. Projecting signs are permitted as follows: a. Sign(s) identifying the name and/or address of the building are allowed as follows. Said sign(s) may contain the names of individual establishments in the building on up to a maximum of 70 percent of the sign area. a. Freestanding Signs. i. One wall sign or freestanding sign is allowed for each street frontage of the premises not to exceed a total of two signs. ii. The maximum sign area permitted is 150 square feet. No one face shall exceed 75 square feet. iii. Monument signs shall not exceed a height of 7 feet. The All other freestanding signs shall not exceed a height of 15 feet within 15 feet of any lot line abutting a public street right-of-way. For each additional one-foot setback beyond 15 feet the sign height may be increased by two feet to a maximum height of 35 feet. iv. Low, monument signs are preferred. Projecting signs are permitted in lieu of freestanding signs allowed under Subsection (C)(1)(a), provided that the sign area permitted for a projecting sign shall not exceed 30 square feet and 15 square feet per face. Projecting signs shall be erected in accordance with SMC ed. Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. fe. Roof signs are prohibited. gf. Suspended Signs. One suspended sign is allowed at each public building entrance. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC Individual Establishment Identification Signs. Each individual establishment in a multi-establishment building is allowed a minimum of 30 square feet of signage as set forth below. Aggregate sign area shall not apply to signs for individual establishments. a. Freestanding signs are prohibited. b. Wall Signs. The maximum sign area permitted is equal to five percent of the facade to which it is attached, or 300 square feet, whichever is less. c. Window Signs. Each individual establishment is allowed window sign(s) on the ground floor only, provided the combined area of window sign(s) and wall sign(s) does not exceed the wall sign allowance in Subsection (B)(2)(b). Sign area shall not exceed 20 percent of the total window area of any facade the window in which the sign is displayed, or 40 square feet, whichever is less. Window signs shall meet the standards in SMC (D). d. Projecting Signs. One projecting sign is allowed per establishment in lieu of one allowed suspended sign, provided the maximum sign area permitted for a projecting wall sign shall not exceed 8 square feet. Projecting signs are permitted and shall meet the standards set forth in SMC e. Awning or Canopy Signs. Sign area shall be calculated as part of total allowed area for a wall sign. No canopy sign shall extend above the top of the canopy. f. Roof signs are prohibited. Page 19 of 21 35

36 g. Suspended Signs. One suspended sign is allowed for each establishment. Sign area shall not exceed 4 square feet. Suspended signs shall meet the standards in SMC Section 9. That section Nonconforming signs, of the Sumner Municipal Code is hereby amended to read as follows: A. The provisions of this chapter do not apply to signs legally in existence on the effective date of the ordinance codified in this chapter; provided, that: 1. The alteration, enlargement, installation or erection of signage shall not increase the degree of nonconformity. 2. If the value of structural alterations to a nonconforming sign equals or exceeds 25 percent of the value of the sign, as determined by the building official, the sign shall be made to conform with all provisions of this chapter. 3. Enlargement, installation or erection of conforming signage shall be accompanied by a reduction in the degree of nonconformity for other signage existing on the premises. This reduction in nonconformity can be accomplished by a reduction in size of existing signs (if nonconforming as to square footage), removal (if nonconforming as to number of signs), relocation (if nonconforming as to location), or a combination of reduction, removal and relocation. The total cost of reduction, removal or relocation of nonconforming signage shall equal, as nearly as is practical, 75 percent of the value of the new or enlarged conforming signage, or the cost necessary to bring all signage on the premises into conformance with this chapter, whichever is the lesser requirement. 4. The provisions of subsections (A)(2) and (3) of this section do not apply to: a. temporary Temporary signs or to illegal signs. b. Alteration or replacement of a historically significant sign, provided that such alterations or replacement are approved through design review pursuant to SMC (E). 5. Any nonconforming off-premises sign shall comply with subsection (B) of this section. [ ] Section 10. Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the Code Reviser are authorized to make the necessary corrections to this ordinance, including the correction of clerical errors; ordinance, section, or subsection numbering; or references to other local, state, or federal laws, codes, rules, or regulations. Section 11. Severability Construction. If a section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reason by any court of competent jurisdiction; such decision shall not affect the validity of the remaining portions of this ordinance. If the provisions of this ordinance are found to be inconsistent with other provisions of the Sumner Municipal Code, the provisions of this ordinance shall control. Section 12. Effective Date. This ordinance shall take effect five (5) days from and after its passage, approval and publication as provided by law. 38 MEMORANDUM DATE: January 25, 2018 TO: Planning Commission FROM: Ryan Windish, Community Development Director CC: Eric Mendenhall, Senior Planner RE: Zoning Code Amendments Temporary Uses Staff is researching Zoning Code Amendments that would allow for more options regarding the temporary uses. Temporary uses are usually allowed for limited periods of time such as special sales events, granted with special exceptions and modifications to the development regulations that apply to permanent uses, and at times allow uses that may not otherwise be allowed in a particular zone (e.g. carnivals). The amendments are intended to accomplish the following: 1. Allow for greater flexibility on the permit duration for temporary uses. The current code limits temporary uses to only 3 weeks. There are examples throughout the community where organizations (e.g. YMCA) or businesses (e.g. Old Cannery Furniture) have events that last longer than 3 weeks. 2. Allow for temporary uses that may be located on gravel or otherwise unimproved or minimally improved properties. There are properties in town located in the historic downtown, on corners, or elsewhere along Main Street that have great visibility and access but are vacant or underutilized. Staff is looking at options for allowing temporary businesses, structures, and sales in these locations. Currently we are discussing a preference for temporary uses that would provide a pedestrian friendly environment, promote community events, develop public gathering places and really active these spaces. Could these lots be used for certain temporary uses for up to 12 months or more if they bring a public benefit and pedestrian friendly use to the site? 3. Allow pilot uses or temporary uses that test a market demand? Staff has been approached by an RV dealer asking about a temporary use that would allow RV sales for up to 6 months at the 24 th Street interchange to test the market to see how much interest the site generated. This is a unique an intriguing idea, but the code currently would not allow for this type of use for that length of time. Staff is researching other city s and seeing who they address such requests. I m looking forward to hear your ideas on this topic and for an engaging discussion. 38
