Work Done Toward Completion of Appropriation: Cornerstone Reservoir #4 was completed in October, 2007 at a cost of approximately $4.3 million. During the diligence period, the golf course on which water from the subject rights is to be used was also completed at a cost of approximately $14.2 million. Reservoir #4 stores water in priority under the subject water right, as well as effluent from the Cornerstone wastewater treatment plant and water provided under a contract with the Tri-County Water Conservancy District. All water stored in Reservoir #4 has been used to irrigate the golf course. Significant amounts of time and money were spent on engineering and planning for future construction of Reservoir #1 to further reduce reliance on potable water for golf course irrigation, but construction on the Reservoir has not yet begun. The economic recession of 2008 severely affected the pace of development of the project and there were not financial resources available to develop that structure. Lot sales slowed to a halt in The original developer of the Cornerstone project sold it in 2011 and since that time, the current owner has not been in a position to fund the completion of the Reservoir. The Applicant, the Cornerstone Metropolitan District No. 1, provides water to the golf course and the balance of the Cornerstone development. It has the right and obligation to operate Reservoir #4 and to exercise the subject water rights to preserve the Cornerstone development. 5. Claim to Make Absolute. A. Cornerstone Reservoir #4. During the diligence period, water was stored in priority in Cornerstone Reservoir #4 and was put to beneficial use. Specifically, during the 2009 water year, acre-feet of water from the Cottonwood Creek drainage was stored in priority in Reservoir #4. During the 2010 water year, acre feet of water was stored in priority in Reservoir #4. The Applicant claims to make absolute the full acre-feet per year of storage decreed to Cornerstone Reservoir #4, with the entire 220 acre feet per year conditional water right decreed to Cornerstone Reservoir #1 to be continued in full force and effect. 6. Applicant will fill the Gun Range Pond Nos. 1-7 at the beginning of irrigation season each spring with irrigation tailwater from the Filmore Ditch that diverts at the Mike Bear Tailwater Ditch, First Enlargement and irrigation tailwater that is tributary to the ponds, as well as with local runoff. This tailwater historically accrued to Deep Creek. The Gun Range Pond Nos. 1-7 and the Mike Bear Tailwater Ditch, First Enlargement will typically go out-of-priority in early July of each year, and will remain out-of-priority through mid- September due to calls from senior irrigation rights located downstream on the North Fork of the Gunnison River. The call period could further be extended by a call from the Redlands Power Canal located on the Gunnison River mainstem near Grand Junction. Applicant has therefore conservatively estimated an annual call period that runs from June 15 through October 31. Applicant will augment out-of-priority evaporation depletions from the Gun Range Pond Nos. 1-7 with releases of water stored in priority in the Pearl Pond, by exchange, as follows: At times when the senior Filmore Ditch water rights are operating in priority or under the exchange agreement between the United States Bureau of Reclamation, the North Fork Water Conservancy District, and the Ragged Mountain Water Users Association (see the decree in Case No. 05CW236,

10 Division 4 Water Court), Applicant will fill and top off the Gun Range Ponds with irrigation tailwater from the Filmore Ditch that diverts at the Mike Bear Tailwater Ditch, First Enlargement and irrigation tailwater that is tributary to the ponds, as well as with local runoff. This water will be used to fill, freshen, and replace evaporative losses from the ponds. Applicant will replace all out-of-priority evaporation depletions from the Gun Range Ponds with releases from Pearl Pond according to the schedule of releases shown on Tables 3 and 4 which are on file with the court. At times when the senior Filmore Ditch water rights and all other ditches on Deep Creek senior to the Filmore Ditch, Bear Ranch Second Enlargement are out-of-priority or are not operating under the exchange agreement between the United States Bureau of Reclamation, the North Fork Water Conservancy District, and the Ragged Mountain Water Users Association, and at times occurring outside of the irrigation season, Applicant will top off the ponds with water diverted under the Filmore Ditch, Bear Ranch Second Enlargement. This water will be used to freshen and replace evaporative losses from the ponds. Applicant will avoid injury to the senior Filmore Ditch water rights by refraining from diverting the junior enlargement right when the senior rights are operating. Applicant will replace all out-ofpriority evaporation depletions with releases from Pearl Pond according to the schedule of releases shown on Tables 3 and 4 which are on file with the court. The monthly evaporation depletions for the Gun Range Pond Nos. 1-7 are summarized in Table 1 (on file with the court), and calculated at acre-feet per year. The monthly dry year augmentation releases out of Pearl Pond for the Gun Range Pond Nos. 1-7 are shown on Tables 3 and 4 (on file with the court). At times when the Gun Range Pond Nos. 1-7 are out-of-priority, Applicant will curtail all out of priority irrigation and municipal uses out of the ponds and those uses will be limited to water previously stored in priority. Crystal Meadows Pond No. 1 and Crystal Meadows Wells. The Division 4 Water Court decreed the Crystal Meadows Pond No. 1 in Case No. 93CW08 for fish culture, stockwater, and fire protection purposes. The 93CW08 decree includes a plan for augmentation that replaces out-of-priority depletions occurring at the Crystal Meadows Pond No. 1, the Crystal Meadows Wells, and other water rights with releases from the Mary Kay Pond No. 2 storage water right. The plan for augmentation applied for in this case replaces the 93CW08 plan for the following uses: augmentation of evaporation for the Crystal Meadows Pond No. 1 and augmentation of domestic and fire protection uses (not irrigation) from the Crystal Meadows Wells. Applicant estimates an annual call period running from June 15 through October 31. Applicant will augment depletions from Crystal Meadows Pond No. 1 and the Crystal Meadows Wells with water released from Pearl Pond according to the schedule of releases shown on attached Tables 3 and 4 (on file with the court). The monthly evaporation depletions for the pond are summarized in Table 2 (on file with the court), and are calculated at acre-feet per year. The plan for augmentation applied for in this Application will serve as a supplemental plan for augmentation for the Bear Ranch Ponds. It provides for the full replacement of out-of-priority evaporation depletions from the ponds with releases of water stored in priority in Pearl Pond, by exchange. This will enable Applicant to alternatively release required augmentation water out of Pearl Pond and/or the Williams

11 Creek Lake Reservoir Augmentation Enlargement at its discretion, with prior consultation and coordination with the water commissioner. The monthly dry year augmentation releases out of Pearl Pond for the Bear Ranch Ponds are shown on Table 4 (on file with the court), and are identical to the schedule of releases out of the Williams Creek Lake Reservoir Augmentation Enlargement for the ponds in Table 6 of the 09CW78 decree. Town Well Nos The Division 4 Water Court decreed the Town Well Nos. 1-3 in Case No. 10CW117 for domestic use in 10 EQRs, stockwater, fire protection, and irrigation. The 10CW117 decree includes a plan for augmentation that replaces out-ofpriority depletions occurring at the wells with releases from the Williams Creek Lake Reservoir, Second Augmentation Enlargement storage water right. The plan for augmentation applied for in this Application will serve as a supplemental plan for augmentation for the wells. It provides for the full replacement of out-of-priority domestic, stock, and irrigation consumptive use depletions from the wells with releases of water stored in priority in Pearl Pond, by exchange. This will enable Applicant to alternatively release augmentation water out of Pearl Pond and/or the Williams Creek Lake Reservoir, Second Augmentation Enlargement at its discretion, with prior consultation and coordination with the water commissioner. When the Gun Range Pond Nos. 1-7 and the Bear Ranch Ponds are filling under the Filmore Ditch, Bear Ranch Second Enlargement, the exchange will operate from the confluence of Anthracite Creek and the North Fork of the Gunnison River up to point of diversion for the Filmore Ditch. The exchange rate below the point where return flows from the ponds accrue to Deep Creek will be the peak monthly evaporation depletion rate. The exchange rate above the point where return flows from the ponds accrue to Deep Creek up to the Filmore Ditch headgate will be the Filmore Ditch, Bear Ranch Enlargement and Filmore Ditch, Bear Ranch Second Enlargement diversion rate.
