CQ Security at Malden Park After Hours Councillor Payne inquires whether this type of security measure will be utilized at other parks. Jan Wilson, Corporate Leader Parks, Recreation, Culture & Facilities appears before the Environment, Transportation & Public Safety Standing Committee regarding the administrative report CQ Security at Malden Park after Hours and indicates that this application was put in place to test the effectiveness, and limit the unauthorized night time entrance at the park. She adds, it is not the intent of Administration to use this type of measure at all parks, each case will be reviewed individually. Ms. Wilson indicates they are considering it for the Little River corridor near the east end yard as there has been inappropriate uses which has caused some damage. Pictures of the proposed memorial are provided for viewing. Mr. Gertsakis indicates that the configuration of the Memorial is yet to be determined although it is fully funded by the Windsor Professional Firefighters Association. Moved by: Councillor Francis Seconded by: Councillor Borrelli Decision Number: ETPS 608 THAT Council AUTHORIZE the Windsor Professional Fire Fighters Association IAFF Local 455, Windsor/Detroit Fire Fighters Memorial Committee, to designate a new site for the construction of the memorial at the northern border of the Civic Terrace adjacent to the river walk; and further, THAT AUTHORIZATION be given to the City Solicitor or designate to develop an Agreement between the Corporation of the City of Windsor and the Windsor/Detroit Fire Fighters Memorial Committee for the Windsor/Detroit Fire Fighters Memorial Committee project Local; and further, THAT the CAO and the City Clerk BE AUTHORIZED to sign the agreement, satisfactory in form to the City Solicitor, in financial content to the City Treasurer, and in technical content to the Corporate Leader of Parks, Recreation & Culture and Facilities. 10 Minutes Environment, Transportation & Public Safety Standing Committee Wednesday, May 16, 2018 Page 6 of Road Safety Report - CITY-WIDE Councillor Payne inquires about the overall road safety in Windsor and whether it is improving or declining. Dwayne Dawson, Executive Director Operations appears before the Environment, Transportation & Public Safety Standing Committee regarding the administrative report 2017 Road Safety Report and indicates that collisions have increased substantially, although that increase is attributed to numerous factors including the general economy, more people employed in the area on special projects and added trips. He adds that it is difficult to pinpoint the exact causes for the increase. Administration adds that there is an increase in following too closely as a cause of accidents. Drinking and driving occurrences have declined, although distracted driving incidents have also increased. Councillor Payne inquires as to whether any action will result from the data received. Administration indicates that improvements at high collision areas can be reviewed as a result of the data. 14 Town & Gown Committee March 20, 2018 Meeting Minutes 4. Business Items 4.1 Downtown Student Open House J. Boyd and J. Fairley provide the following comments relating to the Downtown Student Open House: The event will possibly be held in April 2018 at the St. Clair College - MediaPlex. Discussion to include what is student life like downtown. The televised discussion will be approximately one hour in length. City Administrative staff will be invited to attend, i.e. Police, Fire, By-law, Building J. Fairley indicates he will provide a draft script of discussion items to members of the Town & Gown Committee. Moved by Councillor Francis, seconded by L. Angelidis, That APPROVAL BE GIVEN to an expenditure in the upset amount of $500 for costs associated with hosting the Downtown Student Open House at the St. Clair College - MediaPlex on a date to be determined. Carried. 4.2 Riverwest Windsor J. Williams states the Riverwest Citizens Initiative would like to install approximately 50 Community Banners along the avenues of Riverside, University, and Wyandotte Street West. The banners will serve to identify and link the community providing cohesion between residents, students, businesses and visitors, and the greater community and riverfront. J. Williams advises the banners are to be installed on light standards owned by Enwin. He adds Enwin has requested a $200,000 bond for liability and he notes Riverwest does not have the funds to pay for the liability insurance. Councillor Francis asks if the banners can be donated to Enwin, or if the banners can be donated to the City and Enwin can install them. The Chair indicates the banners will be purchased through his Ward Funds. Moved by Councillor Francis, seconded by L. Angelidis, That the update relating to the Riverwest Citizens Initiative to install banners along Riverside, University and Wyandotte Street West BE RECEIVED. Carried. 15 Town & Gown Committee March 20, 2018 Meeting Minutes 4.3 Town and Gown 2018 Annual Membership Moved by Councillor Francis, seconded by J. Boyd, That APPROVAL BE GIVEN to an expenditure in the upset amount of $250 for the 2018 renewal of the Town and Gown Association of Ontario Membership. Carried. 4.4 Town and Gown 2018 Symposium The Chair asks if members of the Town and Gown Committee wish to attend the 2018 Town and Gown Symposium to be held May 7-9, 2018 in Hamilton. S. Morris, L. Angelidis and the Chair indicate their interest in attending the Symposium. Moved by Councillor Francis, seconded by J. Fairley, That APPROVAL BE GIVEN to an expenditure in the upset amount of $3,000 for three (3) members of the Town and Gown Committee to attend the Town and Gown 2018 Symposium to be held from May 7-9, 2018 in Hamilton, Ontario. Carried. 5. New Business Inspector J. Crowley advises a meeting of west end residents was held regarding safety issues identified by international students. It appears the students are fearful of walking on the street (being hit by a car), and getting off a bus. J. Fairley states 1,500 international students were enrolled at St. Clair College in January 2018, which has been taxing on the transit system. He adds the students mostly reside in the Sandwich area, near the WFCU Centre and in Forest Glade. He suggests an orientation booklet be provided to the students which provides information relating to etiquette, how to shop in a grocery store (and removal of carts from the store). L. Angelidis proposes students be informed regarding the use of smoke detectors. J. Lee states Fire and Rescue Services will launch a program in the Spring 2018 which will include Public Service Announcement messaging relating to smoke alarms, exiting a building and charges levied against owners of the housing unit. J. Williams suggests information relating to shoveling sidewalks and picking up litter also be included in the booklet for students. Page 3 of 4 Page 15 of 51

17 Kadour, Karen From: Pillon, Adam Sent: Monday, March 26, :07 AIVl To: Kacfour, Karen Subject: Banner Sign Permits Hi Karen, In order to obtain a banner sign permit, the proponent is required to first execute a banner-pole-use agreement with Enwin Utilities. A banner-pole-use agreement is an agreement between Enwin Utilities and the applicant for permission to use the poles and also the obligations. The agreement details the quantity, size, material and location of the banner signs. The Traffic Engineering Department is currently preparing a banner sign policy, however the policy has not been approved as of yet. The policy will require additional deposits for each banner sign. Once the banner-pole-use agreement is executed the proponent is required to obtain a Public Works permit. The permit fee is $ plus a $ indemnity deposit. The following information is required to obtain a permit: 1. Public Works permit application 2. Provide a copy of the executed banner-pole-use agreement with Enwin Utilities. Which includes Location of the banners. The size of your banners 4. Time frame that the banners will be in place. 5. Certificate of Insurance 6. Information on the Contractor who will be installing and removing the banners. 7. Ensure that the banners are positioned on the pole so as not to interfere with any streetlights or traffic signage. 8. DiMaio, seconded by Councillor Bortolin, That the minutes of the Windsor Bicycling Committee of its meeting held February 8, 2018 BE ADOPTED as presented. Carried. 4. Business Items 4.1 Active Transportation Master Plan Walk Wheel Windsor The Chair reports she and K. Dohring attended the Active Transportation Master Plan Community Stakeholders meeting held at the WFCU Centre. She encourages members to participate in the survey at WalkWheelWindsor.ca. Lori Newton, Bike Windsor Essex states the document entitled Community Input for the 2018 City of Windsor Active Transportation Plan Bike Windsor Essex has been prepared to provide community input for the 2018 Active Transportation Plan. The recommendations and data were generated through consultations with the cycling community in Windsor and Essex County. She adds this report has been provided to Urban Systems, Consultant for the Plan, Mayor Dilkens, City Councillors and Mayor Duggan, City of Detroit. Moved by Councillor Bortolin, seconded by K. Dohring, That the document entitled Community Input for the 2018 City of Windsor Active Transportation Plan provided by Bike Windsor Essex BE RECEIVED. Carried. 4.2 Bike Safety Enforcement Week Constable Dale Roorda states the numbers were weak during the 2017 Bike Safety Enforcement week, but adds Windsor Police Services enforce what they can. It is noted June is Bike Month. Constable Roorda and K. Morse volunteer to assist with facilitating public service announcements to be advertised during Bike Safety week that may include share the road and the one metre rule. Councillor Bortolin suggests the public service ads be shown on Facebook as it is less costly and can be shared with other groups. The Chair indicates she will investigate the Face Book options including prices and will report back. Page 2 of 5 Page 20 of 51

21 Windsor Bicycling Committee April 24, 2018 Meeting Minutes Moved by Councillor Bortolin, seconded by R. DiMaio, That APPROVAL BE GIVEN to an expenditure in the upset amount of $400 for the placement of Public Service Announcements relating to bike safety on Facebook for the month of June Carried. 4,3 Transportation Planning Update J. Eugeni advises reports relating to the Windsor Bike Share Program and the Seminole Street Bicycle Lanes will be presented to Council on May 7, D. Dawson indicates a representative from BT Engineering will be present for the discussion at a future Council meeting relating to bicycle road safety audits. In terms of the Seminole Street bicycle lanes, K. Dohring states at the Environment, Transportation & Public Safety Standing Committee meeting held April 18, 2018, he suggested the use of physical separations, i.e. larger buffers be utilized due to safety concerns. The Chair adds there is no physical separation in the east/west connection. D. Dawson responds there are specific roadway conditions that influence when physical separations for bike lanes are appropriate. A concern relating to the removal of on-street parking on Seminole Street has been received but it is unclear at this time if they will be registering to be a delegate at the upcoming meeting of Council. As it relates to the City Wide Bike Share Program, the Environment, Transportation and Public Safety Standing Committee at its meeting held April 18, 2018 supported undertaking a peer review of the Student Report to potentially lower the estimated $70,000 for a consultant study. J. Eugeni refers to Decision Number ETPS 595 of the Standing Committee and quotes #3 of the motion which states: That the original study undertaken by the Engineering students and updated statistics provided by the University of Windsor Student Alliance BE INCORPORATED into the functional analysis. Constable Roorda states he visited New York City and free amenities were offered at his hotel which included free internet and a one hour use of a bicycle to tour the city. He suggests this be offered in the City of Windsor. J. Eugeni reports she attended the Ontario Bike Summit held April 17-18, 2018 in Toronto and indicates she participated in interesting workshops and there was a great opportunity to network with subject matter experts and municipal peers. 22 Windsor Bicycling Committee April 24, 2018 Meeting Minutes J. Eugeni states attendees at the recent Earth Day celebration were given bike lights and were apprised of Walk Wheel Windsor and the on-line survey. J.. Eugeni and D. Dawson provide the following highlights of current cycling related activities and projects: A public meeting is being hosted for cycling facilities on Totten Notice to be provided to the Committee Coordinator for distribution The City was successful in obtaining $7,500 in Safe Cycling Education Funds from the Ministry of Tourism Culture and Sport. Funds were used to promote the 1m rule video at Cineplex during March Break and on Tim s TV during the month of March, to purchase sets of bike lights, and to purchase signage to advertise the correct direction of travel in a bike lane on solid waste collection vehicles. The following cycling facilities are being finalized or are under construction: o Pillette Road o Rivard o North Service Road Phase 2 o South Cameron o Malden Road o Ojibway Parkway o Matchette Road o Cabana Road Phase 2 o Riverside Drive extending west to Lauzon Road o Walker Business Park Trail 5. New Business 5.1 Bike to Work Day L. Newton, Bike Windsor Essex advises three sponsors have been confirmed for the event to be held May 28, 2018 that includes the Walkerville area (leave from Anchor Coffee House), the University of Windsor and Infinity Cycle located on Eugenie Street. She adds the Town of LaSalle may also be a sponsor. Additional logistics of the event includes the following: The Bike to Work Day ride will culminate at The Bistro At the River located at 78 Riverside Drive West for a free breakfast. Free t-shirts will be given to the first 100 participants. Bike Windsor Essex is looking for sponsors to assist in the purchase of the t- shirts, i.e. Chryslers, Enwin, Caesars Windsor. Developing materials to encourage commuter cycling and, Bike Windsor Essex offers to provide lunch and learn sessions for local businesses. The Chair asks for volunteers for the Bike to Work event and asks how much the WBC would like to contribute for this endeavour. The Chair questions if members wish Page 4 of 5 Page 22 of 51

29 Background: On February 28, 2018 Council services received a letter dated February 20, 2018 from UNIFOR local 195 President, John Toth and Marwan Abou-Zeeni, Chairperson Vets Taxi Unit (Appendix A). In the body of this letter the union for the drivers of Veterans Cab Ltd. are asking for an exemption to the City of Windsor s parking bylaw #9023, which would allow them to contravene Sec. 31 of this bylaw, Park or Stop in a Fire Route as well as section 2.5 of the Fire Code, Fire Department Access to Buildings. In most cases, Fire routes are located directly in the front of and around the perimeters immediately abutting structures, allowing emergency vehicles and personnel quick access to a specified location and situation. These lanes are also designed for access to emergency equipment such as hydrants and stand pipes. UNIFOR local 195 would like this exemption to be allowed in shopping centres throughout the City of Windsor to allow their fares to be dropped off closer to the front doors of these locations. This has been a parking enforcement issue for a number of years both with City forces, and the present enforcement contractor. This letter was presented as a communication item to Mayor Dilkens and the members of Council at the Monday March 26, 2018 meeting. As a result of entering this communication Council asked administration to formulate a response to this request, either in favour or in opposition Discussion: In a written response to this request (Appendix B), Chief Fire Prevention Officer John Lee states that Windsor Fire and rescue are definitely in opposition to this request as it would violate the Fire Code (Appendix B). In addition to being in contravention of the the Fire code, should the request be granted, it could create unnecessary obstacles for pedestrians to traverse safely through who are trying to enter these establishments. If a cab was stopped inside a designated Fire Route zone and the operator of the cab had their attention on the exiting fare process, they might not be aware of any pedestrian that has entered into the path of the vehicle. This could also create a situation where the view of pedestrians using a crosswalk, could be obscured by vehicles stopped in the fire route. Another factor to consider in this request, is that of the general public s perception. If we were to allow one entity to be exempt for courtesy purposes, other members of the public would likely feel they should be allowed to do the same when they feel they need to be dropped as close as possible to the closest entrance due to either weather, or physical constraints. One of the centres that highlight these issues is seen in the pictures listed below. Page 29 of 51 Page 2 of 5

30 A solution to this request may be as simple as UNIFOR local 195 approaching management of these individual stores and shopping centres to create and allow a pick up and loading zone. Taxi s and similar livery agents as well as general public patrons can use these spots for a timed period which would be located in a more conducive and safe location. The management of these locations should be contacted and included in these discussions as they are ultimately responsible legally for keeping the Fire Route lanes free and clear of obstructions or they themselves may face actions and fines. 31 Risk Analysis: If Council so grants this request it may call into question all past tickets for this type as well as any other locations that may not fall under the parameters of this request. The request of UNIFOR local 195 runs counter to the reason that fire routes exist. Fire routes or lanes, ensure that Windsor Fire and Rescue can prevent the spread of fire, reduce property and environmental damage, and reduce injuries and or death. Often Fire routes are determined after a site plan and or building permit process has taken place. A signed fire route Site Plan Control for a property located at 3120 Dougall Ave is shown in Appendix C. Given the extreme importance of fire routes and the potential for significant danger to life and property, if the fire department had its access impeded by a vehicle under this request it would expose the City to a heightened legal risk. Executive Summary: N/A Background: At the October 16, 2017 Council Meeting, the following Council Question (CQ ) was raised by Councillor Borrelli: Asks "whether the much smaller water flow culvert design, compared to California and Rankin Streets for the Grand Marais Drain, has contributed to the excessive flooding in South Windsor due to the 100 year storm, and if so, what can be done to mitigate damage from future events? Discussion: In response to the Council Question, City Administration sent a notice to the Parkway Infrastructure Contractors (PIC), the Windsor Essex Mobility Group (WEMG) and the Ministry of Transportation (MTO) requesting a response to this question. 37 A response from the Windsor Essex Mobility Group (WEMG) was received on April 19 th 2018 as shown below: During the Initial Work period, Dillon on behalf of PIC conducted detailed analysis/design of the Grand Marais Drain and prepared the Grand Marais Drain Stormwater Management Report which was issued in The Report in brief can be summarized as follows: Updated and recalibrated hydrologic and hydraulic models demonstrate that the proposed crossing has sufficient capacity to safely convey the 100 year return period design flow with a freeboard in excess of 1.0 m. Minor and major systems of Highway 3 have been designed to convey the 100-year return period event flow to the Grand Marais Drain without allowing flooding to occur in the travelled lanes. The SWM plan ensures that there are no adverse impacts to downstream properties in terms of water quality, peak flows and velocities. The hydraulic modeling has determined that there are no adverse impacts to upstream properties in terms of water surface elevations. An OGS (oil grit separator) will provide enhanced water quality treatment to The Parkway storm sewer discharges to the Drain. The proposed crossing has been designed to accommodate fish passage by maintaining the existing low flow channel geometry through the centre barrel and by maintaining culvert velocities to pre-development rates. On August 28 and 29, 2017, the City of Windsor experienced severe rainstorm events that resulted in widespread flooding across the City. Rainfall quantity recorded by the City at the hardest hit area exceeded a total of 219mm during the storm events, exceeding a 1:100 year frequency event and representing 300% of the normal amount of precipitation received for the month of August (72.6mm), as recorded by Environment Canada over a 30-year period between 1981 and As noted above, WEMG confirmed that the new Grand Marais Drain culverts under the Herb Gray Parkway were modelled and sized to convey the 1:100 year storm design flow. There is currently no evidence to indicate that the new Grand Marais Drain culverts capacity under the Herb Gray Parkway had an impact on the recent flooding in the South Windsor area. However, the City will be undertaking a Hydraulics and Hydrology Study for the entire stretch of the Grand Marais Drain within the City limits in 2018 (CR541/2017), with recently approved funding from the National Disaster Mitigation Program (NDMP). This study will provide better information on the functioning of the Grand Marais Drain including the culverts at the Herb Gray Parkway. Easement The University of Windsor agrees to gratuitously convey to the Corporation, an easement sufficient in magnitude to allow for the use, maintenance and the eventual replacement of the municipal sewers constructed under the terms of this agreement. The University of Windsor agrees to cover costs for the preparation of a reference plan for the noted easement to the satisfaction of the City Engineer, and the easement shall be prepared to the satisfaction of the City Solicitor. Executive Summary: N/A Background: The Lancers Sport and Recreation Centre [LSRC] is a planned 130,000 ft 2 addition to the St Denis Centre located at 2555 College Avenue and is proposed to include a new 2,500 seat field house, 8-lane, 25 metre pool, and other amenity spaces. Construction for the project is scheduled to start in early 2019 and will also include a new, artificial turf soccer field and three additional practice fields. There is existing municipal infrastructure located on the University s property which prevents the construction of the proposed LSRC and therefore requires relocation in order to accommodate new construction. More specifically, existing sanitary and storm sewers run north/south through the property, parallel to California Avenue from Tecumseh Road to College Avenue. The sewers were installed in 1930 and are reaching the end of their useful service life. Based on this, the University s Project Team and City Administration have agreed that it is mutually beneficial to replace both sewers at this time as part of the LSRC project, and an agreement has been reached in principle to cost share the work required. The purpose of this report is to bring cost sharing terms before Council for consideration and approval. Page 40 of 51 Page 2 of 5

41 Discussion: As discussed, a portion of the existing sanitary and storm sewers obstruct the proposed building addition, and will need to be relocated in order for the work to proceed. The portion of the sewers south of the new building are not in conflict with the addition, but the sewers are almost 90 years old and are considered to be in fair condition. The sewers south of the building are also located under existing University sports fields which are being replaced as part of the LSRC project. Based on this, City Administration believes it makes sense to partner with the University to replace all of the sewers closer to the property at this time. Under the terms of the proposed cost sharing, the University will be responsible for contributing costs associated with flows entering both sewers from the University s property and the City is responsible for contributing costs associated with all other flows. Under these criteria, the construction costs for the new sewers would be split 60/40 City/University. The University would also be responsible for 100% of the surface restoration costs, and will be required to grant the City an easement over the new sewers located on University property after completion of construction. The City has requested for the University to cover costs associated with the preparation of the reference plan needed for the easement. Administration understands the University continues to work on the final design for the LSRC facility, and that construction is scheduled to begin in early In order to accommodate the overall project schedule, the University s design team is proposing to complete the sewer relocation project this summer (2018) during intermission, as an early works project. Risk Analysis: Associated risks to the Corporation relating to the completion of this project are considered to be minimal. The University of Windsor is responsible for the design, procurement and construction of the project. The Corporation s involvement will be limited to review for compliance with City and Industry Construction Standards, as well as providing payment for the City s share of associated costs. The project will be publically tendered and awarded to the lowest qualified bidder in accordance with the City s purchasing by-law. Financial Matters: The total value of the overall sewer relocation project is estimated to be $1,700,000, with the City s share being $1,040,000. Traditionally the City also contributes an additional 15% on eligible cost sharing amounts, for Engineering Design and Construction Administration Costs. Based on this, estimated Costs for the City s Share require the following funding: City s Share of Construction Costs $1,040,000 15% Engineering Design and CA 156,000 SUB TOTAL $1,196,000 HST (13%) 155,480 TOTAL $1,351,480 Page 41 of 51 Page 3 of 5
