1 Tuck Tales TUCKASEIGEE RIVER CHAPTER # 373 OF TROUT UNLIMITED November 2012! Orvis, TU Begin Project to Open 1,000 Miles of Water Over Next Decade October 4, 2012!! O! rvis and Trout Unlimited this week announced the! first two streams that will be improved to allow better passage for wild and native trout as part of the new Orvis / Trout Unlimited "1,000 Miles Campaign." Murphy Brook in Vermont and Tabor Brook in New Hampshire both tributaries of the Connecticut River system will be the first beneficiaries of funding raised by Orvis and its customers, and TU will oversee construction and reconnection projects on both streams. Migrationhalting culverts will be replaced, and dozens of new miles of habitat will be available to brook trout and brown trout that need intact coldwater habitat to spawn and to escape the worst of summer's heat. Thanks in part to an Orvis grant and matching funds from the company's customers, the two entities hope to open up 1,000 miles of new coldwater habitat to trout and salmon all over America. Many streams with spawning and rearing potential and fishing potential are now blocked by faulty culverts and other man-made barriers. The campaign's goals include not only increasing overall trout habitat from coast to coast, but improving fishing opportunity resulting from stream improvements. "Opening up 1,000 miles of new habitat for trout and salmon over the next 10 years is an ambitious goal, but we think we can do it," said Elizabeth Maclin, TU's vice president for eastern conservation. "We're lucky to have dedicated partners like the people at Orvis they've always been very supportive of the work we do, and their commitment to this project means the world to us." By opening up habitat in Murphy Brook and Tabor Brook to migrating fish, anglers will likely see improved fish numbers in downstream stretches of water, and enjoy more fishable water in the coming years. Two culverts will be replaced on Tabor Brook this fall, and work to remove a culvert that blocks upstream migration on Murphy Brook will begin later in the year. The 1,000 Miles Campaign will help fund culvert removal projects on several other trout streams located all over America. These streams are: Kinne Brook, a tributary to the Westfield River in Massachusetts Coyner Springs, a tributary to the South River near Waynesboro, Va. Crazy Creek, a tributary to the Crooked River in the Upper Deshutes River drainage in Oregon Aldrich Brook, a tributary to Azizchos Lake and the Magalloway River in Maine Yellow Creek, a tributary to the Bear River in southwest Wyoming Big Slough Creek, a Driftless Areas stream in Jackson County, Wisc. "Culverts are significant impediments to fish passage and survival just as significant as a major dam but the solution is dramatically simpler, costs less, and the overall benefits to many watersheds is profound," said Dave Perkins, Vice Chairman of Orvis. "By removing these impediments, we not only add vital habitat for fish, but we also open many miles of fishable waters for anglers. We're proud to partner with TU in this effort to engage the fly-fishing community in support of this often overlooked opportunity to dramatically improve fish habitat across the country."

6 ! T Editor s Cast DUE TO THE ELECTION THE NOVEMBER MEETING DATE HAS BEEN CHANGED TO THURSDAY, NOVEMBER 8 TH!! he October meeting offered a presentation by! Paul Carlson, Executive Director of the Land Trust for the Little Tennessee. Paul provided some background information about LTLT, where itʼs been, and where itʼs going. The organization has had quite an impact on conservation in the southwestern corner of our state and continues to be a catalyst for the creation of conservation easements and resource protection for present and future generations. LTLT recently co-hosted Conservation Options Workshops for Forest and Farmland Owners at the Jackson County Library Complex in Sylva along with the Blue Ridge Conservancy, Foothills Conservancy, and Southern Appalachian Highlands Conservancy. The free, informal workshops provided information to landowners interested in preserving special areas, learning more about keeping forests and farms in production, and how to leave a legacy for future generations. Paul was complimentary of Tuck chapterʼs contribution last year to assist with the option purchase by NCTU State Council of property on the North Mills River by saying it was a great move by TU, including the Tuck chapter. LTLT as an organization is concerned about the protection of our coldwater resources just as Trout Unlimited is. The two organizations share a common interest in this regard and can compliment one anotherʼs efforts. Our thanks go to Paul for coming to Sylva last month and providing such an interesting program for TCTU. Members will be interested to hear that the Jim Mills rod was not won at the October meeting. We are now down to just 14 cards and itʼs looking like the rod wonʼt last long so everyone had better plan to be at the November meeting to get a chance to win. Remember, you have to be present to win. A $5 purchase will get you 6 chances to draw the winning card. Fall Fishing on Deep Creek Forward Cast The November 8 th program will be a treat. A fly tying demonstration will be provided by the chapterʼs resident fly tyer, Willie Cope. Willie will be able to answer almost any question you may have about tying and if he canʼt at the meeting, heʼll research it and get back to you with the answer. See you there! The November 8 th meeting at United Community Bank should see a report from the Nominating Committee. Your editor has heard rumors regarding the possible slate of officers but youʼll have to attend the November meeting to learn the results. 8 Public Access Closed to a Portion of the Delayed Harvest Trout Water on Watauga River BOONE, N.C. (Sept. 28, 2012) A popular section of Delayed Harvest trout water on the Watauga River west of Boone in Watauga County where private landowners have allowed anglers to access the river in the past has closed to public access due to landowner concerns about activities other than fishing. Anglers no longer have access to the upper mile of Delayed Harvest water running from Shulls Mill Road downstream to the parking area near the intersection of N.C. 105 and Old Shulls Mill Road,where the caboose was formerly located. Landowners have posted no trespass signs at all parking areas along the upper end of the Delayed Harvest water, including the roadside pull-offs along Old Shulls Mill Road and the main parking area on N.C. 105 near the Old Shulls Mill Road intersection. Visitors who park in these areas will be towed. Because this section of the river is no longer accessible to the public, the N.C. Wildlife Resources Commission will not stock it with trout this fall. Landowners in this section of the Watauga River have always supported access for trout angling, said Kin Hodges, a district fisheries biologist with the Commission. But activities not related to fishing have recently escalated to the point that the landowners felt they needed to close off all parking access. Hodges said that Commission staff continues to explore options to restore angler access to this highly valued section of the Watauga River; however, until staff can find a suitable solution, Hodges suggests anglers fish the lower part of this stretch of Delayed Harvest water running downstream to the N.C. 105 bridge and an additional section of water in Valle Crucis, which will open on Oct. 1 under Delayed Harvest regulations and will receive its allotted stockings this fall. Other Delayed Harvest trout fishing opportunities in the Watauga County area include two separate sections of water on Elk Creek in western Wilkes County near the Watauga County border. Loss of public access to trout waters on private lands has been an ongoing problem for Commission fisheries biologists. According to Hodges, this latest closure is particularly disappointing because it was a popular trout fishing destination. Unfortunately, this scenario of losing fishing access to trout waters on private lands plays out all too frequently as the access provided by private landowners is used for purposes other than fishing. To help prevent future closures of trout waters, Hodges reminds anglers to: - Respect private property and landowners; - Remove all trash and litter from fishing and parking areas; - Park only in designated areas and leaving driveways open for pass-through traffic; - Close and/or locking gates after use; - Report wildlife violations by calling Find additional fishing opportunities for trout and other species across the state by visiting the Commissionʼs new N.C. 10 Wildlife Commission Unveils New Trout Fishing Information Webpage Photo - Courtesy NCWRC The Wildlife Commission s new trout fishing webpage is a one-stop resource for anglers interested in fishing for trout in western North Carolina. RALEIGH, N.C. (Oct. 26, 2012) Anglers interested in getting comprehensive information on trout fishing in North Carolina now have a one-stop resource at their fingertips. The N.C. Wildlife Resources Commissionʼs new trout fishing webpage (ncwildlife.org/fishing/trout) provides information a trout angler needs when planning a fishing trip in the mountains. Looking for a new stream to try? Click on the Trout Fishing Maps link at the top of the page to find maps of Public Mountain Trout Waters including a new interactive map. Want to know when delayed-harvest regulations go into effect or what the size and creel limits are for hatcherysupported waters? Click on the trout signs gallery icon to view information, including seasons and limits, on the seven classifications for trout streams in North Carolina. Current trout stocking information, as well as materials discussing life history characteristics of the three trout species found in North Carolina, also can be found on the trout fishing page. 13 Ausable Wulff Tied by Craig Forrest T! his pattern was originated by the late Adirondack tyer Fran Betters. Fran died on September 6, The Ausable! Wulff is a fantastic attractor pattern that can be very effective on brown trout in the Fall season. On my very first fishing outing with fellow TCTU member Tom Massie (photo below) back in the early 1980ʼs we used the Ausable Wulff along with Black Girdle Bugs almost exclusively on the upper Whitewater River fishing to the Ax Handle Pool. They were in a word - deadly. Iʼve never enjoyed fishing like that since while on the Whitewater. Those brown trout took Wulffs in every pool and if youʼve ever fished it you know that there are a lot of pools to be fished! There is a video on the web of Fran tying this pattern and he states that it is better to make the tail a little bit longer than the hook shank to make the fly balance better. Fran didnʼt use hackle pliers and tied off with a whip finish by hand - no tool. 14 This month's Website-Of-The-Month is: Fly Fish America is a different kind of magazine in a lot of different ways. We're not a bunch of ivory-tower journalists here at Fly Fish America. We're just a bunch of guys like you who live to fish, and can speak and write fairly good English. When we test and review fly rods, reels, lines and accessories, we present the results in a straightforward, no-nonsense format that provides all the information you need to make a purchase decision including the price. We all live and work in New Hampshire's Mount Washington Valley, surrounded by the White Mountain National Forest. The Saco River flows past our office, with its East and Rocky Branches a stone's throw away, and the fabled Ellis, Sawyer and Androscoggin Rivers just up the road. The Big A (as in "Atlantic") is less than sixty miles to the east, and the entire New England Coast is within easy striking distance. Needless to say, we have no shortage of flyfishing opportunities. The print version of Fly Fish America can be picked up free at any of the more 1,600 fly-fishing retailers nationwide who distribute the magazine. Those retailers include all Cabela's, Gander Mountain, Dick's, Scheel's, Sportsman's Warehouse and other "big box" stores, as well as your local, independently owned fly shop. Subscriptions are not available, and for good reason. We're not looking for the chance to provide free magazines to "couch potatoes" who don't support their local fly shops, and by extension, the fly-fishing industry. Our readers have to get off the couch and visit a fly-fishing retailer to obtain a copy of Fly Fish America, so it's a good bet that they're all active fly-rod, - reel, -line and accessory consumers. Those are the people we want as readers, and the folks who deserve a free copy of Fly Fish America. Many readers are unable to obtain Fly Fish America before their fly shops run out of copies, and for them we also publish a digital version of Fly Fish America called i-ffa. You can download i- FFA free, of course right here on our website. While it looks pretty much like the printed version of Fly Fish America the pages actually turn just like a printed magazine our digital magazine goes way beyond anything that can be done with ink on paper. In addition to containing extra content not appearing in the print-version of Fly Fish America, all i-ffa editorial and advertising pages are hot linked for one-click access to the websites of those manufacturers and advertisers appearing on the respective pages. i-ffa is zoomable and scrollable, making it easy to read on your computer, and it can be printed out in color for a leisurely read in the outhouse. In just a few short years, Fly Fish America has become one of the leading publications in the industry. We're not completely simple, so we'll take some of the credit for that, but it never would have happened without our readers, retail distributors and advertisers, all of whom have our heartfelt thanks for their loyal and continuing support. 15 UPDATE III: Judge Rules Against Fly Fisherman in Virginia River-Access Case Photo by Beau Beasley With the exception of his two attorneys, Dargan Coggeshall stood in the courtroom completely alone as the decision in North/South Development v Crawford was handed down. The avid Virginia fly angler has been embroiled in a lawsuit for the past two years over the use of the Jackson River, and in particular his ability (and that of the public) to wade in a certain section of the Jackson River. Considered one of the best wild trout fisheries in the east, and the only trout stream in the Old Dominion large enough to float a drift boat, the Jackson River draws visiting anglers from multiple states. Friction between landowners and anglers is nothing new along the Jackson River and started almost immediately with the creation of the Gathright Dam. The dam built in the late 1970ʼs turned what was once a warm and shallow water bass stream, into a blue ribbon trout fishery with browns occasionally pushing 20 inches. Kayaks, rafters and float tubers are also frequent visitors to the river and local businesses seem eager to draw tourist to the tiny towns of Clifton Forge and the larger town of Covington. Coggeshallʼs trouble began in June of 2010 when he was charged with criminal trespassing by North South Development, a small family owned company which sells river front lots. According to the owner of the company Coggeshall was warned multiple times not to return to an area which they had posted as private property between two public access points from Smith Bridge to Indian Draft. Coggeshall who had fished the river for years claimed he had every right to be in the river since the Virginia Department of Game and Inland Fisheries (VDGIF) advertised it as public water. Indeed multiple signs still exists at the public put ins along the river, and on state created maps informing anglers they could fish in the same area where the angler was charged with trespassing. Once Coggeshall was served with a criminal charge of trespassing he contacted the VDGIF and was shocked to find out that while they had been happy to sell him a license, they had no authority to represent him in court. The embattled angler eventually had his day in criminal court and was relieved when the case was nol-prossed due to lingering questions as to river bed ownership. Failing a criminal conviction however, North/South Development refilled civil charges and sued the angler for $10,000. During his ordeal the angler eventually contacted the Virginia Attorney Generalʼs Office as well, but was told since the state was not a party to the case they had no reason to be in court much less represent him. 16 Sportsmen around the state were outraged to discover a license holding angler, who was obeying game laws while fishing in waters the state claimed was public, would not be aided in any way by state authorities. Members of several TU chapters, private citizens as well as companies like Patagonia chipped in funds to mount a legal defense, but this effort proved to be inadequate and in the end and the angler stated lack of funding as a major reason he was abandoning his case. Prior to and during the case the riparian landowner claimed to have a chain of title leading back to a pair of 18th century land grants issued by King George II. Virginia law, which asserts state ownership of river bottom, didnʼt occur until 1802, long after numerous crown grants had been issued. These grants have led to some landowners claiming the state has over-stepped its authority by intentionally sending sportsmen on to private property. VDGIF officials recently disclosed in a white paper written in response to concerns about the case, that state officials presume to own the stateʼs riverbeds. Uncertainty remains however as to which riverbeds they specifically own in whole or in part due to the expense of investigating such crown grant claims. Crown grant, or kingʼs grant cases as they are often called, rarely lead to litigation in Virginia. Thus named because the land grants were originally deeded from monarchs in Great Britain, kingʼs grants have become a flash point between landowners and river users across the state. Virginia was one of the original 13 colonies and much of its laws are rooted in English Common Law, especially as it pertains to property. Two previous cases involving anglers on the Jackson River were decided in 1955 and 1996 and in both cases landowners won. Though the state of Virginia claims to have ultimate ownership, these riparian landowners proved primafacia title, a legal term meaning they appear on the face to have superior claim to river bottom than the public. The ultimate decision as to who has actual ownership of the riverbed was left undecided since the state of Virginia refused to enter the case. Some have speculated that since North/South Development v Crawford was a civil case, it doesnʼt apply to others in the general public. This assumption is incorrect and those that return to this section of the river and touch bottom without prior approval of North/South Development are now subject to criminal prosecution. Some in the sporting community have decided not to return to the Jackson River and all and some fly shops have stopped taking clients there stating the ambiguity of the situation. There is however several miles of river below the dam which are not posted by landowners and these owners have no objection to anglers fishing as long as they stay in the river. Sportsmen across the state have grown more concerned as theyʼve discovered the state is unsure as to what its ownership rights are as it pertains to riverbeds. Anglers have also expressed their displeasure at not being certain where they can and canʼt fish if VDGIF signs are unreliable. This coupled with the states reluctance to assist anglers who are sued while following all VDGIF rules and regulations have led some sportsman to discuss burning their fishing licenses in a public protest.* Anglers are hopeful the stateʼs legislative body, the General Assembly, will be willing to provide clarity in this coming session. Thus far however, the only legislator who has shown any leadership on the issue is Delegate Scott Lingamfelter(R) of Fauquier County. Lingamfelter, head of Virginiaʼs Sportsmenʼs Caucus, is running for Lieutenant Governor in Lingamfelter has stated he is very concerned with the ambiguity of the situation where state inaction thus far has pitted landowners and sporting citizens against each other. In regards to crown grants Lingamfelter said Iʼm ready, willing and eager to bring something about this issue to the legislature. Though an avid sportsman himself, Lingamfelter is keen on protecting property rights and is known for his balanced approach to tough issues. Anglers in Virginia are still trying to determine how this case may affect other rivers in the state where crown grants are known to exist. Popular rivers like the James, Shenandoah, Cowpasture, Rappahannock, Hazel and York are all subject to crown grants. While anglers are currently barred from touching bottom on this new section of the Jackson River between Smith Bridge and Indian Draft, they can still fish there from a boat since the act of fishing was not before the court. While Coggeshall agreed he would not touch bottom on that section of the river in the future, he was not required to pay damages. Virginia fly anglers have watched North/South Development v Crawford since the beginning and no doubt some will return to the river while avoiding this section. 17 Regulation Reminders W! ild Trout: Natural Bait trout waters and their tributaries, " except as noted, may be fished with artificial lures or natural bait, except live fish. Lures and natural baits are restricted to one single hook. The minimum length limit is seven inches, and the daily creel limit is four trout. These streams are marked with brown-and-gold signs. D! elayed-harvest Trout Waters trout waters, excluding " tributaries except as noted, may be fished only with artificial lures with one single hook. No natural bait may be possessed, and no trout may be harvested or possessed while fishing these waters between Oct. 1, 2011 and 30 minutes after sunset on June 1, These waters are closed to fishing between 30 minutes after sunset on June 1 and 6 a.m. on June 2. At 6 a.m. on June 2, 2012, these waters open to fishing for youths under 16 years old under Hatchery-Supported regulations no bait restriction, no minimum length limit and seven-trout- per-day creel limit. At 12 p.m. on June 2, 2012, these waters open for all anglers under Hatchery-Supported regulations. These waters are marked with black-and-white signs.
