2 National Gambling Amendment Bill, 2018 There s good news, and then there s bad news Three years in the making, the recently published National Gambling Amendment Bill seemingly has done nothing to remove any uncertainties facing the horse racing industry. On the contrary, Minister of Trade and Industry Dr Rob Davies notice of intention to introduce the Bill into Parliament, has industry role-players scampering to make heads or tails of the intentions and myriad of possible outcomes of the proposed amendments. While the proposed amendments, as they currently stand, will have far-reaching implications for the gambling industry as a whole, there are two important aspects which has the horse racing fraternity cheering and jeering. Let s start with the good news. The Amendment Bill aims to make it compulsory for bookmakers to contribute a reasonable amount towards the development of the horse racing industry. This can only be good for the racing industry. Fact is that the Totalisator and the racing authorities are contributing in the region of 80% of the funds needed to keep the sport of horse racing alive, returning more than 50% of their gross gaming revenue to the sport. Punters placing bets with bookmakers also contribute financially to the sport of horse racing, but only marginally. This is thanks to the 6% betting tax levied by six of the provincial gambling boards on winnings paid to punters. Half of this tax is paid over to the horse racing authorities to help fund the sport. Bookmakers, on the other hand, do not contribute any percentage of their gross gaming revenue to the funding of the sport of horseracing that while enjoying all the benefits afforded them by accepting bets on the outcome of races. Every rand wagered on a race at a bookmaker, thus increases the financial strain on the sport of racing. While the planned amendments to the Gambling Act aim to change this, it s premature for the industry sheriffs to fire a celebratory salvo from their six-shooters. It is envisaged that there will be many a gunfight before the reasonable amount specified in the Amendment Bill translates to a final reward written into law - for the horse racing industry. GOOD NEWS Let s move on to the bad news. The Amendment Bill provides for a self-regulatory body that operates within the horseracing industry which is recognised, accredited and monitored by the National Gambling Regulator. Further to this, the yet to be established National Gambling Regulator must design the criteria which must operate as the minimum standards to guide a self-regulating body within the horseracing industry. Translated from legalese to English, it basically means the National Gambling Regulator writes the rules for, approves, and then monitors the self-regulatory body. Talk about reinventing the wheel. Isn t that exactly the function of the National Horseracing Authority? The NHA was, after all, established to regulate, govern, serve and promote the sport of horseracing in Southern Africa. The objectives of the National Horseracing Authority are to regulate the sport of horseracing, to govern the sport with integrity, to serve the industry, to promote and/or encourage the promotion of the sport of horseracing and to promote and foster co-operation and goodwill with recognised authorities, governments and other relevant stakeholders. The problem with reinventing the wheel is simply this: The new version might be square. And a square wheel turns even the smoothest of roads into a bumpy ride. Further to this, it remains a mystery why the body regulating the sport of horse racing should be monitored by the National Gambling Regulator. Does the Gambling Regulator monitor the South African Football Association? Does the Gambling Regulator monitor Tennis South Africa? Does the Gambling Regulator monitor the Professional Golfers Association? Golf, soccer and tennis are sports on which punters place bets, but their governing bodies are not scrutinised by the Gambling Regulator. At best, the lawmakers are confusing the sport of horse racing with bett ing on horses. At worst, the Amendment Bill is a blueprint for the capture of the racing industry. After all, the Minister of Trade and Industry appoints the CEO of the National Gambling Regulator who then has to approve and monitor the self-regulating body. And as the Bill stands, it is the National Gambling Regulator s sole discretion as to which self-regulating body will be approved. Unfortunately, with the web of state capture only now being slowly disentangled and the scope thereof still not completely clear, any sign of any kind of capture must be fl agged. Let s hope in time, In The Know will say we were wrong, not we told you so.

3 Team SA to rely on grit, determination Lyle Hewitson, Muzi Yeni and Aldo Domeyer the three young guns who will represent South Africa at the inaugural Premier Gateway International Jockeys Challenge might not be the most experienced. But what they lack in experience, they will make up for in grit, determination and guile far beyond their tender years. The South African threesome, who will go up against teams from the UK, Australia and Asia in four races, is the youngest team by far. Hewitson will only turn 21 later this year while Yeni and Domeyer are 31 years old. That is an average age of Team Asia consisting of Joao Moreira, Vlad Duric and Troy See - have an average age of 35.3 while the Australian team has an average age of 36.6 and is loaded with experience in Hugh Bowman, Kerrin McEvoy and Mark Zahra. Team UK s Hayley Turner, Rab Havlin and Fran Berry are - at an average age of 38.6 the old-timers. While the fledgling South African unit might appear to be lacking in experience, they continue to raise the bar in local racing. Hewitson has been quite a sensation, this year becoming the first apprentice to win the SA Jockeys title since Muis Roberts in He has broken the record for the number of winners ridden by an apprentice while still having nine months to go before becoming a jockey. Both he and Domeyer have fathers who were jockeys and have been brought up around horseracing. With 137 winners last season and a win strike rate of close on 20%, Domeyer is expected to excel at his second Jockeys Challenge. He was part of the SA team which participated in the Air Mauritius International Jockeys Challenge in Yeni has ridden a number of Grade 1 winners and impressed pundits when he rode in Greece last year. He rode 1448 times last season, earning over R18-million in stakes, and is showing absolutely no signs of slowing down this season. He has been riding almost daily since the new season has started, and this dedication has landed him atop the National Jockeys log. The PGI Jockeys Challenge, presented by Phumelela Gaming & Leisure and Tabcorp, will be hosted by the Singapore Turf Club on September 25.

4 Jockey Profiles Aldo Domeyer Aldo Domeyer burst into the limelight in February 2013 when winning the then J&B Met on Martial Eagle. It was a world class ride on an 80/1 shot drawn 14 in a 15-horse field. It was also the first time the seven-year-old had ever run beyond a mile and that victory highlighted Domeyer s incredible talent. For Domeyer, it must have been extra sweet, because ten years earlier, in 2003, he was released from the SA Jockey Academy after being considered not good enough. Fortunately, he is a man of perseverance, and ended up being crowned the South African Apprentice Champion in the 2009/2010 season. In his second stint at the Academy, beginning in 2007, he rode 203 winners. Riding mostly in Cape Town and Port Elizabeth, Domeyer was crowned Cape Champion Jockey in the 2017/2018 season. Among his many achievements, winning the Gr 2 Choice Çarriers and the Gr 1 WSB Cape Fillies Guineas with Silver Mountain stands out. He also steered her to second place in the richest race ever run in South Africa, the CTS Million Dollar. With 137 winners last season and a win strike rate of close on 20%, Domeyer is expected to excel at his second Jockeys Challenge. He was part of the SA team which participated in the Air Mauritius International Jockeys Challenge in Lyle Hewitson Lyle Hewitson is just 21 years old but he has already rewritten the history books of South African racing. On 31 July he became the first apprentice since Michael Roberts in 1973 to be named Champion Jockey. Lyle s passion for horses started when he was very young as his mother owned and rode horses and he would visit the stables as a child. Even while he was stellar student at a leading school in Durban, Lyle was already participating in his first love. He joined the work riders programme run by James Maree and would come up to Johannesburg on weekends to ride in those races. He dominated against riders who were older, stronger and more experienced and he finally joined the Jockeys Academy in January Within three months he had achieved the unthinkable lost his complete apprentice allowance. On 6 March 2018, Hewitson broke another record. Riding a horse called Shenanigans at the Vaal Racecourse, his 285th victory in two years and two months, the 21-year-old surpassed Gavin Lerena s record of 284 wins by an apprentice. It took Lerena 3326 rides and five years to reach 284 winners. Hewitson took 2792 rides to achieve his 285 victories. Muzi Yeni When it comes to hard work and consistency, there aren t many jockeys that compare to the charismatic Muzi Yeni. The 31-year-old achieved a career high during the 2017/18 season, finishing second in the National Jockeys log with 149 winners 36 winners less than history making apprentice Lyle Hewitson. Yeni earned more than R18-million in stakes. He was crowned Champion Jockey at the Highveld Feature Awards and clinched the Northern Cape Champion Jockey title for an eighth time last season. His other successes last season include two Grade 1 victories - aboard Lobo s Legend in the R2million Gr1 SA Classic and Coral Fever in the R4million Premier s Champions Challenge. His first ever Grade 1 triumph was aboard Happy Landing in the Champions Challenge in 2011 talk about going full circle. Yeni s first winner was aboard Storm King for Mike de Kock over 2400m at Clairwood and it was the 12th ride of his career. He only rode 75 winners as an apprentice and in his first season out of the academy registered 36 winners.

5 Fewer runners, more millionaires While prophets of doom have been writing SA horse-racing s eulogy for decades, the sport of kings has survived, and survived pretty well. Although the number of horses raced over the last decade has declined slightly, the number of horses who have won more than R1-million in stakes in a single season has increased dramatically. Number of runners in a season 2008/ / / / / / / / / / The above table with statistics drawn from the NHRA s database, shows that the number of horses raced in South Africa declined by 7,77% in ten years. Considering that 2008 was the year of the global financial crisis - regarded by many economists to have been the worst financial crisis since the Great Depression of the 1930s - it is quite surprising that the impact on the racing industry was so small. In fact, from the 2008/09 season until the 2010/11 season, the number of horses raced actually increased. Only thereafter did the decline start. But interestingly the number of horses winning more than R1-million in stakes increased, as shown by the table below, with statistics again drawn from the NHRA s database. Number of horses earning + R1-million in a season 2008/ / / / / / / / / /18 26 Remarkably the increase in the number of equine millionaires over the same decade is 160%. But horse racing is not the only sport which is not immune against the prevailing economic conditions. A good example is the Super Rugby series, which started out with 10 teams in 1993 and later expanded to 18 teams, but has now also retracted back to 15 teams. Judging by the lack of spectators at most matches, a further retraction cannot be ruled out. Fortunately for horse racing, the first custodians of the sport, namely the owners of thoroughbreds, are constantly working to ensure that the sport is not placed on the endangered list. Yes, escalating costs have seen a decline in the number of horse owners while the remaining owners have also trimmed down on the size of their strings. But thankfully there are still enough people who are passionate about the sport, who are mesmerised by the splendour and power of a thoroughbred, who see value in beauty, and are determined to keep the sport alive.

6 Jockey Profiles Vlad Duric Reigning Singapore champion jockey Vlad Duric, 40, is in his seventh season at Kranji. Formerly based in Victoria, he first plied his trade at Kranji in 2009, going on to finish second to champion jockey Joao Moreira in 2010 and He then went to Australia before making his Singapore comeback in 2016, picking up where he left off to again finish runner-up on the premiership, this time to another Brazilian, Manoel Nunes. He eventually went on to claim his first champion jockey title in He currently leads this year s log on 47 winners with his overall career tally standing at around 2,100 winners. Duric has been a major force in the feature races at Kranji, landing the 2011 Singapore Three-Year-Old Challenge clean sweep with Gingerbread Man, including the Group 1 Singapore Guineas, and the Group 1 Raffles Cup with Always Certain the same year. His feather cap bulged further at his second stint with eight more Black Type wins, including the Group 1 Lion City Cup with Zac Spirit in 2016, Group 1 Queen Elizabeth II Cup with Quechua in 2016 and Group 1 Giovanni Racing Charity Bowl with Elite Invincible this year. Besides Australia and Singapore, Duric has also ridden in New Zealand, Dubai, Macau and Mauritius. João Moreira At 34, João Magic Man Moreira is giving up the celebrity status he achieved in Hong Kong in order to further his racing career in Japan. Born in Brazil, he started his career as an apprentice in 2005/06 season in his home country. After establishing himself in Singapore as one of the best in the world, winning four champion jockey titles, he moved to Sha Tin in October Moreira was an immediate hit, capturing nearly every major race and winning three jockeys championships. Remarkably, Moreira rode eight winners from eight rides on a nine-event card in September 2013 at Kranji race course in Singapore, the same course that hosts the Premier Gateway International Jockeys Challenge on 25 September this year. Interestingly, the PGI Jockeys Challenge will be held a day before Moreira s 35th birthday. Although Moreira s move to Japan came as somewhat of a shock, the Magic Man has formed a formidable partnership with Japanese master trainer Noriyuki Hori after winning the World All-Star Jockeys series in Sapporo, Japan, in He has also won Group Ones in Hong Kong and Dubai aboard Japanese horses. Troy See After learning his trade as a jockey for seven years, Troy See, 29, is as close as he has ever been to his first Singapore champion apprentice jockey title, even if his current three-win lead (as of August 18, 2018) is by no means a safe cushion from defending champion and three-peat bidder Wong Chin Chuen. See was caught in a stirring two-way battle with Wong in 2016, but eventually settled for the runner-up spot, coming up short by five winners from his Penang-born arch-rival. His haul of 26 winners that year remains to this day his best record in one season. Currently on 20 winners, he is well placed to better that record with three months left in the season. See was always considered a gifted rider during his first three years spent at the Singapore Training Academy for Racing (STAR). After making his riding debut in 2012, he did not take long to ride his first winner, Seize The Day, at his fifth time of asking on July 22, 2012, dedicating the win to the memory of his late father Dexter, a former horse owner who had always pushed him to become a jockey. See has since added another 108 winners to his name, but has yet to win a Group race.

8 Jockey Profiles Kerrin McEvoy Kerrin McEvoy took up riding in 1997 before becoming the second youngest jockey to win the Melbourne Cup when partnering Brew in 2000 at the age of 20. A third placing on the Godolphin owned Beekeeper in the 2002 Melbourne Cup catapulted McEvoy on the international stage with Godolphin contracting him as the stable s number two European rider to Frankie Dettori. After riding 120 winners for Godolphin in Europe six at Group One level McEvoy returned to Australia and based himself in Sydney to ride for Darley, Sheikh Mohammad s Australian racing operation, where he amassed more than 20 Group One successes. Announcing the end of his association with Godolphin in September 2014, McEvoy has since established himself as a leading freelance jockey and claimed his second Melbourne Cup success aboard the Lloyd Williams-owned Almandin in Racing and Sports Mark Zahra Beginning his career in 1998, Mark Zahra is well established in the senior Victorian jockey ranks. It was in 2006 that Mark Zahra won his first Group 1 aboard Above Deck in the Doomben Cup for Jim Conlan and his first $1 million Group 1 win coming on Albert The Fat in the 2011 Emirates Stakes. Not linked to any one trainer, Zahra has good relationships with plenty of stables including Robert Smerdon, Peter Snowden, Darren Weir and Tony McEvoy. Zahra first rode over 100 winners in a season in 2015/16 notching up an impressive 110 which included a Group 1 on Palentino in the Australian Guineas. Racing and Sports Hugh Bowman Hailing from the small town of Dunedoo in central western New South Wales, Hugh Bowman has been around horses all his life and began his apprenticeship with Leanne Aspros, wife of champion country jockey Bill Aspros, at Bathurst in Winning the NSW country apprentice title in his first year of riding, Bowman then moved to Sydney the following year under the stewardship of legendary jockey Ron Quinton and despite breaking his arm early in the season still managed to ride 65 winners. Bowman rode his first Group 1 winner aboard the Guy Walter-trained Defier in the 2004 Doomben Cup. Finishing runner up to Darren Beadman in the 2004/05 Sydney jockeys premiership, Bowman has been among the top echelon of riders since, finally claiming his first title in 2008/09 with 60 winners. Whilst having partnered many great horses all around the world, Hugh Bowman won acclaim in 2015 when he rode superstar mare Winx to victory in the WS Cox Plate at Moonee Valley and has since built an incredible record with the Chris Waller-trained mare. 10 Jockey Profiles Hayley Turner Considered to be the first woman to achieve a sustained, successful career as a professional jockey in the UK, Hayley Turner needs no introduction. Born just two miles from Nottingham Racecourse, her first ride in public was on Markellis at Southwell in Turner never finished that race; the horse broke a leg. Seven rides later she turned up in the winner s circle on Generate. Turner rode her first Group winner on Lady Deauville in the Lando-Trophy in Germany in 2008, the same year she became the first woman to ride 100 UK flat race winners during a calendar year. In 2008 Turner rode in over 900 races in the UK - one of only five riders to achieve the milestone that year. In January 2011, Turner had her first race-rides at the Meydan racecourse in Dubai, as part of the annual Dubai Racing Carnival. The following year she became the first female jockey in history to ride on the Dubai World Cup night, taking the reins on Margot Did in the Al Quoz Sprint. Turner s success has contributed to the enormous increase in the number of female apprentice jockeys riding in the UK in the last decade. Robert Havlin Scottish born Havlin learnt to ride at the stables of John Wilson in the shadow of Ayr Racecourse, but also learnt about horses from spending time breaking in non-thoroughbred ponies while still at school. His break as a jockey came when an apprentice for Peter Chapple-Hyam at the prestigious Manton estate in Wiltshire. He rode 32 winners in 1996 but spent the following years as a work rider. He moved to Newmarket in 2008 to team up with John Gosden, who he had first worked under at Manton. Havlin has since become a vital cog in the engine for Gosden, acting as a leading work rider for that powerful team and increasingly making the most of the chances given to him in the saddle. A slow-burner by his own admission, the 44-year-old is on course to ride a notable century of winners for the first time in Although Havlin has yet to ride a Group One winner on the track, he has partnered plenty on the gallops and played a vital role in the racecourse preparations of champions such as Kingman, Cracksman and Enable. Fran Berry Irishman Fran Berry, who replaces the injured PJ McDonald in Team UK, is having a magnificent season, winning both the 188Bet Chester Cup and the Matchbook VIP Henry II Stakes on Magic Circle. Berry began his career as a National Hunt jockey, winning the Coral Cup at Cheltenham in 1999 but went on to concentrate on Flat racing. He was employed as second jockey at John Oxx s stable from 2002 to 2009 and took over as leading jockey for Oxx in He also rode major winners for Jessica Harrington and John Kiely. In 2016, he became stable jockey for Ralph Beckett, an association which lasted about a year until Berry decided to ride freelance. He rode 35 winners from 235 rides in Britain for Beckett at a respectable strike-rate of 15%. The Group 1-winning jockey also has a Cheltenham Festival triumph on his CV. Despite being 5 foot 8 inches tall, he is able to ride off 54.4kg.

12 Grand Heritage The World Sports Betting Grand Heritage is the most unique horse race on the South African calendar for a number of reasons. Firstly, along with the Grand Heritage Consolation, which is for horses who do not make the final field for the main race, they are the only two races in the country where more than 20 runners participate. Secondly they are over 1475m, which is a distance exclusively used for these two races. Thirdly, it is open to the lower level of horse which gives smaller trainers and owners the opportunity to get their horses into a race carrying prize money of R750,000. Prize money for the Consolation race is R250,000. On Saturday 29 September the rail that divides the Vaal straight is removed and some 28 runners are expected to line up for these races. A total of 58 horses have been entered for this year s Grand Heritage. The Grand Heritage is open to all horses and the final field is by way of invitation from racing operator Phumelela. However, there are certain conditions that apply. Every horse nominated must have had at least one run from the time of first entry up to the time the final entries close. That is to ensure the horse is racing fit. There is no sex allowance for fillies and mares and no apprentice allowance. Stakes are payable up to 15th position, provided 28 runners + 2 reserve runners are declared, with the first prize being R406,250. in a league of its own

13 Phumelela & The Public Protector The Pretoria High on Monday 3 August ordered Public Protector Busisiwe Mkhwebane to postpone her planned hearings into horse racing which were scheduled to start on Tuesday 4 August. This followed after Phumelela urgently applied for the hearings to be postponed to ensure the company s right to a fair process. In an earlier statement, Phumelela reiterated that it had not applied for the hearings to be interdicted or cancelled, contrary to an erroneous news report in this regard, notably by Sporting Post. Phumelela does not wish to impede or obstruct the hearings. It merely seeks to ensure that its right to a fair process is protected, and that it is afforded an opportunity ty to participate in the hearings in the interest of a conclusive outcome, read the earlier statement by Phumelela. Should the hearings be properly convened, with adequate notice and a fair opportunity for all affected parties to participate therein, Phumelela is certain that the Public Protector will be in a position to make a well informed final decision in respect of her investigation. Although the Public Protector alluded to the planned public hearings in April this year, no further information n was forthcoming until a media statement was issued on Wednesday last week announcing that the hearings would start today with Mkhwebane hearing evidence from the complainants. This was, however, never communicated to Phumele-ela. Phumelela only became aware of the planned hearings through the press. Phumelela welcomes the investigation and wishes to participate in any public hearing stemming from the investigation. Phumelela is determined to cooperate fully to ensure that the investigation is concluded as swiftly as possible. The Pubic Protector s investigation into the corporatisation of the racing industry in the late 1990s stems from complaints lodged by Ms. P Kema, Mr C Simoto and Mr H Manjoo in 2012 and In reaction to the court interdict, the office of the Public Protector said in a statement that Mkhwebane is disappointed that the public hearings would not go ahead as planned. We have noted the court order. What is important is that the investigation itself has not been interdicted. Therefore normal investigative processes will continue. This means we will still hear from witness but not out in the open as it would have been the case with the public hearings, Adv. Mkhwebane said. The hearings would h a v e formed a critical part of her investigation into allegations of maladministration and improper conduct relating to a Memorandum of Understanding (MOU) concluded between the Gauteng Provincial Government (GPG) and the Gauteng Horse Racing Industry 21 years ago.
