1 EN Offiial Journal of the European Union C 382/1 IV (Noties) NOTICES FROM EUROPEAN UNION INSTITUTIONS, BODIES, OFFICES AND AGENCIES COUNCIL THIRTEENTH ANNUAL REPORT ACCORDING TO ARTICLE 8(2) OF COUNCIL COMMON POSITION 2008/944/CFSP DEFINING COMMON RULES GOVERNING CONTROL OF EXPORTS OF MILITARY TECHNOLOGY AND EQUIPMENT (2011/C 382/01) INTRODUCTION The present report overs ativities undertaken y the EU and its Memer States in the framework of the implementation of Counil Common Position 2008/944/CFSP ( 1 ) throughout 2010 and As far as onventional arms exports are onerned, the report overs the 2010 alendar year. The EU and its Memer States ontinued to play a leading role in the Arms Trade Treaty proess, thoroughly preparing for, and atively partiipating in all the sessions of the Preparatory Committee that took plae in 2010 and EU efforts also foused on outreah to third ountries, oth through ilateral onsultations and the organisation of regional outreah events in the framework of relevant Counil Deisions 2009/42/CFSP ( 3 ) and 2010/336/CFSP ( 4 ). During 2010 and 2011 the EU and its Memer States ontinued to implement Counil Common Position 2008/944/CFSP defining ommon rules governing ontrol of exports of military tehnology and equipment, whih replaed the EU Code of Condut on arms exports in fore sine June The following third ountries have offiially aligned themselves with the riteria and priniples of Common Position 2008/944/CFSP: Bosnia and Herzegovina, Canada, Croatia, the former Yugoslav Repuli of Maedonia, Ieland, Montenegro and Norway. During 2011, the EU Counil Working Party on Conventional Arms Exports (COARM) also started the development of a speifi exhange information system etween the EU and third ountries aligning themselves with the Common Position. The promotion of effetive national arms export ontrol regimes was arried out in 2010 and 2011 in the framework of Counil Deision 2009/1012/CFSP of 22 Deemer 2009 on support for EU ativities in order to promote the ontrol of arms exports and the priniples and riteria of Common Position 2008/944/CFSP among third ountries ( 2 ). I. IMPLEMENTATION OF COUNCIL COMMON POSITION 2008/944/CFSP 1. Implementation of Common Position 2008/944/CFSP in national legislation or administrative rules Memer States shall apply the provisions of the Common Position, whih is an updated and upgraded instrument ompared to the EU Code of Condut on arms exports, whih it replaed in Deemer The Common Position goes far eyond the Code of Condut, inluding an extension of ontrols to rokering, transit transations and intangile transfers of tehnologies, as well as strengthened proedures to harmonise Memer States export poliies. Memer States are required to ensure full implementation of the Common Position in their national legislation or administrative rules. Outreah The User s Guide is an essential instrument summarising agreed guidane for the implementation of the operative provisions of the Common Position 2008/944/CFSP, and the interpretation of its riteria. Referred to in Artile 13 of the Common Position, it has een developed y the Counil Working Party on Conventional Arms Exports (COARM) and is updated as appropriate. It is intended for use primarily y export liensing offiials, thus sustantially ontriuting, in a pragmati way, to the onvergene of Memer States arms export ontrol poliies and proedures. The Guide is a puli doument availale on the wesite of the European External Ation Servie. The User s Guide ontains setions, inter alia, on the following issues: (a) Denial notifiations and onsultations Denial notifiations and ilateral onsultations ontinue to take plae via the EU s eletroni oreu system on a daily asis. Information is irulated in a timely manner, ensuring transpareny on the arms export poliies of Memer States vis-à-vis speifi ountries of final and end-users. The denials notified, as well as the results of ilateral onsultations, are inluded in a entral eletroni EU dataase of denials. The dataase, whih is managed y the European External Ation Servie, is a dynami system refleting Memer States arms export ontrol poliies. The numer of denials notified in 2010 are indiated in row (d) of the tales in Tale A.I (annexed to this report) per and per military list ategory; the numer of onsultations issued and reeived y eah Memer State, and the numer of onsultations per an e found in Tales B.I and B.II respetively. () Best pratie for interpretation of riteria Artile 11 of the Common Position alls on Memer States to use their est endeavours to enourage other States, whih export military tehnology or equipment to apply the riteria of the Common Position. Coordinated outreah ativities y Memer States and the EU ontinued throughout 2010 and 2011 to date (see Tale D, annexed hereto). Events in the ontext of Counil Deision 2009/1012/CFSP of 22 Deemer 2009 on support for EU ativities in order to promote the ontrol of arms exports and the priniples and riteria of Common Position 2008/944/CFSP among third ountries Counil Deision 2009/1012/CFSP alloated funds for five regional outreah seminars and four staff exhanges with third ountries losely assoiated to the EU. Its tehnial implementation has een entrusted to the German Federal Offie of Eonomis and Export Control (BAFA). During 2010, three outreah seminars were organised in the ontext of Counil Deision 2009/1012/CFSP. The first took plae in Algiers in Marh 2010 for the North Afrian ountries (Algeria, Egypt, Liya, Moroo and Tunisia). The seond seminar was held in Sarajevo, Bosnia and Herzegovina, in June 2010 for the Western Balkan ountries (Alania, Bosnia and Herzegovina, Croatia, former Yugoslav Repuli of Maedonia, Montenegro and Seria). The third seminar was held in Kiev, Ukraine, in Novemer 2010 for the Eastern European and Cauasian partners of the European Neighourhood Poliy (Armenia; Azeraijan; Belarus; Georgia; Moldova and Ukraine). In 2011, the fourth and fifth outreah seminars foreseen y Counil Deision 2009/1012/CFSP took plae respetively in Podgoria, Montenegro, in May 2011 for the Western Balkan ountries (Alania; Bosnia and Herzegovina, Croatia; the former Yugoslav Repuli of Maedonia; Montenegro, and Seria), and in Kiev, Ukraine, in Novemer 2011, for the Eastern European and Cauasian partners of the European Neighourhood Poliy (Armenia, Azeraijan, Belarus, Georgia, Moldova, and Ukraine). The est praties for interpretation of the riteria of Common Position 2008/944/CFSP have een developed y the COARM working party, uilding on national est praties and taking into aount input from other relevant stakeholders. Their purpose is to ahieve greater onsisteny among Memer States in the appliation of the riteria of the Common Position. This is ahieved y identifying fators that need to e onsidered when assessing export liene appliations. The est praties are for the use y export liensing offiials and other offiials in government departments and agenies whose expertise inter alia in regional, legal (e.g. human rights law, puli international law), tehnial, development as well as seurity and military related issues should inform the deision-making proess. As far as the staff exhanges foreseen y the Counil Deision are onerned, Hungary hosted Croatian arms export ontrol offiers in June 2011, Portugal hosted relevant offiers from the former Yugoslav Repuli of Maedonia and from Montenegro in Otoer 2011, and arms export ontrol personnel from the three EU andidate ountries (Croatia, the former Yugoslav Repuli of Maedonia, and Montenegro) was hosted y Poland in Novemer These staff exhanges enaled offiials from EU andidate ountries to enefit from Memer States experiene regarding the implementation in day-to-day pratie of, inter alia, arms exportsrelated ustoms issues, rokering and transit ontrols, reporting and transpareny, exporters internal ompliane programmes, and the national implementation of international and EU santions. An additional and final staff exhange under the Counil Deision will take plae in the first quarter of 2012.

Politial dialogue meetings Politial dialogue meetings on arms export ontrol issues were held in 2010 with Norway, Canada, Ukraine, the United States and the Russian Federation. Generally held on a iannual asis with eah of the aovementioned ountries, those politial dialogues enaled fruitful disussions on matters of mutual interest suh as speifi s of onern, ompliane and ontrol issues and the Arms Trade Treaty proess. In the ourse of the meetings, the EU side, represented y the European External Ation Servie sine the entry into fore of the Lison Treaty, also informed interloutors on COARM priorities and ativities sine the previous meeting. During 2011, the EU has also initiated a proess to develop an information exhange mehanism that would allow EU Memer States, the EEAS, and third ountries aligning with the Common Position, to exhange relevant information onerning national arms export ontrols poliies. 5. Update of the Common Military List of the European Union The Common Military List of the European Union has the status of a ommitment in the framework of the Common Foreign and Seurity Poliy. It is reprodued as the list of defene-related produts annexed to Diretive 2009/43/EC of the European Parliament and of the Counil of 6 May 2009 simplifying terms and onditions of transfers of defene-related produts within the Community ( 1 ). On 21 Feruary 2011, the Counil adopted an updated version of the list whih takes into aount hanges in the Wassenaar Arrangement s Munitions List agreed at the 2010 Plenary meeting of the Wassenaar Arrangement. The updated version of the Common Military List of the European Union was pulished in the Offiial Journal of the European Union C 86 of 18 Marh exhange of relevant information on registered rokers. Information on rokering lienes granted and denied y EU Memer States an e found in the annexed Tale A.III. Detailed information on national implementation of the Common Position on rokering or, for those Memer States whih have not yet fully implemented the Common Position, information on the state of play of their implementation, is provided in the annexed Tale C. 7. Intra-EU arms transfers The European Parliament and the Counil adopted on 6 May 2009 Diretive 2009/43/EC simplifying terms and onditions of transfers of defene-related produts within the Community. The Diretive provides that Memer States shall adopt and pulish, no later than 30 June 2011, the laws, regulations and administrative provisions neessary to omply with it. Memer States are ound to apply the adopted measures as from 30 June Sine the adoption of the diretive, Memer States have held disussions in the ontext of a Commission-haired ommittee on how est to address issues raised y the transposition of the Diretive into their national legislation. Based on the input of this ommittee, the Commission adopted on 11 January 2011 Reommendation 2011/24/EU ( 3 ) on the ertifiation of defene undertakings under Artile 9 of Diretive 2009/43/EC. 8. Dialogue with the European Parliament and NGOs COARM meetings with the Su-Committee on Seurity and Defene have een suspended in 2010, pending the estalishment of the European External Ation Servie. In the future, a new format may e deided for suh meetings. It is expeted that meetings will resume y the end of As has een the pratie for several years, COARM delegates from most EU Memer States have attended informal meetings organised y non-governmental organisations (in partiular Saferworld), at six-monthly intervals. 6. Arms rokering II. ARMS TRADE TREATY (ATT) COARM agreed that the information sharing ommitments set out in Counil Common Position 2003/468/CFSP of 23 June 2003 on the ontrol of arms rokering ( 2 ) should e implemented via the mehanism laid down in Common Position 2008/944/CFSP. In aordane with Artile 5 of Common Position 2003/468/CFSP, Memer States have put in plae separate arrangements for the exhange of information on rokering lienes granted and denied. Furthermore, in aordane with Artiles 4 and 5 of Common Position 2003/468/CFSP, those Memer States who have required rokers to otain a written authorisation to at as rokers and/or have estalished a register of arms rokers, have put in plae separate arrangements for the ( 1 ) OJ L 146, , p. 1. ( 2 ) OJ L 156, , p Engagement in the sessions of the Preparatory Committee Ahieving a legally inding and roust Arms Trade Treaty (ATT) is among the top foreign poliy priorities for the EU and its Memer States. An ATT an make a sustantial ontriution to the regulation of the international trade in arms at the international level, making it more transparent and more responsile, through the estalishment of ommon, high international standards. The relevant UN General Assemly Resolutions sine 2006 were supported y all EU Memer States. ( 3 ) OJ L 11, , p. 62.

4 C 382/4 EN Offiial Journal of the European Union Throughout 2010 and 2011 to date, the European Union and its Memer States ontinued to losely support and partiipate in the ongoing UN-led Arms Trade Treaty proess. In preparation to the sessions of the ATT Preparatory Committee (PrepCom), whih have taken plae to date (July 2010, Feruary and July 2011), a dediated su-group of the COARM working group has met regularly to share views and oordinate positions, therey allowing the EU and its Memer States to ontinue to e very ative and visile players in the ATT proess. On the asis of EU oordinated positions, the EU and its Memer States also held extensive onsultations with third ountries, and in partiular major armsmanufaturing ountries, and with the Chairman of the Preparatory Committee, Amassador Garia Moritàn. III. PRIORITY GUIDELINES FOR COARM FOR THE NEAR FUTURE With the adoption of the legally-inding Common Position 2008/944/CFSP, the fundamental elements of a ommon approah to the ontrol of onventional arms exports y Memer States have een identified. In spite of the progress represented y the adoption of the Common Position, there is still work to e done, espeially in the areas whih have not een addressed in the past, or where further work is neessary to onsolidate and uild on the results ahieved. The following are priority guidelines for the near future: 2. Outreah efforts in the ontext of Counil Deision 2009/42/CFSP of 19 January 2009 and Counil Deision 2010/336/CFSP of 14 June 2010 on EU ativities in support of the Arms Trade Treaty 1. to ensure that those Memer States, whih have not yet done so, adopt the appropriate national regulations or administrative rules to fully implement: Sine 2009, the EU has een partiularly ative in promoting the ATT proess vis-à-vis third ountries, and with the aim of inreasing partiipation in the UN onsultations and improving understanding y all UN Memer States of the different elements of a future treaty. To this end, the EU adopted in 2009 and 2010 two Counil Deisions that allowed for the organisation of several regional outreah events, in ooperation with the UN Institute for Disarmament Researh (UNIDIR). The implementation of Counil Deision 2009/42/CFSP started in 2009 and was ompleted in Feruary 2010 with the organisation of an outreah event for OSCE ountries and of a final seminar for all UN Memer States. Both events were held in Vienna and losed the series of six outreah seminars funded y Counil Deision 2009/42/CFSP. Common Position 2003/468/CFSP on the ontrol of arms rokering, Common Position 2008/944/CFSP defining ommon rules governing ontrol of exports of military tehnology and equipment; 2. to ontinue oordination at EU level and input into the negotiating proess on the Arms Trade Treaty, providing expert ontriution for the preparation of the Feruary 2012 session of the Preparatory Committee and the July 2012 diplomati onferene mandated to negotiate the treaty; 3. to ontinue to exhange among EU Memer States relevant information on arms export poliies towards partiular s; On the asis of the results ahieved through the first series of outreah events, the EU deided to inrease efforts to enhane partiipation in and etter understanding of the ATT proess. A new Counil Deision was adopted to this end in June 2010, providing for the organisation of seven regional workshops fousing oth on the politial aspets of the Arms Trade Treaty and on the tehnial aspets of national arms export ontrols. In 2010 and 2011, outreah seminars were held in Kathmandu, Nepal (Deemer 2010) for South and Central Asia ountries, in Casalana, Moroo (Feruary 2011) for Northern, Western and Central Afria ountries, in Montevideo, Uruguay (April 2011) for Amerian and Cariean ountries, in Bali, Indonesia (June 2011) for East Asia and Paifi ountries. Side events were also organised in the margins of the ATT Preparatory Committee sessions, held in New York in July 2010 and in Feruary and July 2011, and in the margins of the 66th session of the UN General Assemly First Committee in Otoer to omplete the implementation of Counil Deision 2009/1012/CFSP, through the organisation of a staff exhange in 2012, and to undertake an assessment of the results ahieved; 5. to omplete the implementation of Counil Deision 2010/336/CFSP on EU ativities in support of the Arms Trade Treaty, and to ensure the partiipation of COARM experts in outreah regional seminars; 6. to ontinue to develop information and est praties exhanges with third ountries aligned with Common Position 2008/944/CFSP, in onsultations with relevant stakeholders; 7. to renew the dialogue with the European Parliament and to further develop relations with ivil soiety and industry;

5 EN Offiial Journal of the European Union C 382/5 8. to start the preparatory proess towards to the review of Common Position 2008/944/CFSP, to e undertaken three years after its adoption, as foreseen in its Artile 15; 9. to start preparation for further COARM outreah ativities to promote the priniples and riteria of the Common Position 2008/944/CFSP, taking aount the results of the assessment of the implementation of Counil Deision 2009/1012/CFSP; 10. to update as appropriate the User s Guide and EU Common Military List, inluding in the framework of the review proess of the Common Position 2008/944/CFSP; 11. to ensure the early finalisation and pulishing of the 14th EU annual report on arms exports.

It is important to note that row () of Tale A.I is the total of the atual exports y those ountries whih sumitted these data. Belgium, Denmark, Germany, Poland, Greee, Ireland and the United Kingdom ould not supply these data; therefore row() of the EU total does not reflet total EU atual exports. Sweden has reported total values only for rows () and (). Frane and Italy have reported total values only for row (). It is important to ear in mind that exports to s sujet to EU arms emargoes omply with the terms, onditions and possile exeptions set out in the deisions imposing suh emargoes. The full list and details of emargoes is availale at: ( 1 ) To make the tale more readale, nil values and/or the mention not availale are omitted, and empty rows deleted. ( 2 ) Conerning refusals (row (d)), totals do not always orrespond to the sum of the refusals shown per military list item; this is eause in some instanes one refusal onerns more than one military list item, and in some instanes refusals whih have een issued in aordane with the Common Position for items whih do not appear on the military list (for example dual use items for military end-use) are inluded in the total. ( 3 ) (i) Conerning Austria: With regard to items overed y the EU Common Military List, the Austrian law distinguishes etween war material (as stipulated in the Austrian War Material At and Regulation) and equipment on the Common Military List not listed as war material overed y the Austrian Foreign Trade At. As to ategory ) value of atual exports y Military List Category figures may e inaurate in partiular as suh data regarding equipment of the Common Military List not listed as war material is availale to the ompetent authorities only after expiration or full utilization of the individual export liense. (ii) Conerning Germany: some lienses issued over goods of more than one ML Category (e.g. one liense for the export of rifles and their ammunition). In reporting in Tale A.I, eah time a liense onerns a ML ategory, it is ounted as one single liense, so the sums in rows a) and olumn Total per do not always reflet the atual numers of lienses granted, ut a slightly higher figure (i.e. the numer of times a ML ategory has een affeted y a liense for that ). (iii) Conerning Greee: the reported export lienes inlude temporary exports for overhaul, repair, exhiitions, demonstrations and field trials. (iv) Conerning Frane: exports to Hong Kong are inluded in the figures for China (Mainland). Exports to Greenland, the Faeroe Islands, Arua, the Netherlands Antilles and the islands assoiated to the United Kingdom are onsidered without ojet; exports to New Caledonia are not inluded (ut an e found in the national report). (v) Conerning the Netherlands: As values of gloal lienes annot always e attriuted to individual military list ategories or individual ountries, quoted total values may e higher than the sum of the values per ML ategory or per. The figures on atual exports reported y the Netherlands are ased on information provided y exporters in 2010, and may reflet exports ased on a liene issued in a previous year. Although muh are has een given to the olletion of the data on atual exports, the atual export figures for 2010 may e higher than the values quoted in this report.
