DURHAM County Attorney Thank you for your recent inquiry concerning property in unincorporated Martin County. You requested zoning and/or development standards associated with the zoning district designation for the identified property. The following information is based upon the questions you asked. The property has the following future land use designation(s) as found on the Martin County Future Land Use Map: Mobile Home. TELEPHONE WEB ADDRESS The property has the following zoning district designation(s) as found on the Martin County Zoning Atlas: RT. The RT zoning District requires a twenty (20) foot front setback (on Rattlesnake Run) and a 6 foot setback for the rear and side property lines. The property is subject to a Preserve Area Management Plan (PAMP) implemented in August of 2004 (enclosed). An environmental Waiver (enclosed) was approved along with the PAMP and has specific requirements regarding construction of a house, driveway and sidewalks and a septic system. As stated in the waiver letter any deviation to the approved waiver would require further review and approval. The following information is based on the specific questions in your request. 1. Modular homes are permitted on the property. Please see the attached definitions for Mobile and Modular homes and the skirting requirements for dwellings with a crawl space. The attached waiver shows a home in a specific location. Any other location must be farther away from the wetland buffer. A larger house must extend away from (to the west) the wetland buffer. A larger house must not further encroach into the wetland buffer. 2. The RT Zoning District only permits structures to be one story or 20 feet in height. 1 of 33 gmd2016l346.docx

2 Jason McNamara April 25, 2016 Page 2 3. Garages whether enclosed or not are permitted on the property; however, agricultural uses are not permitted in the RT Zoning District. All structures must meet the setback and height requirements of the RT zoning district, the environmental waiver and the PAMP. 4. In-ground pools are permitted on the property providing they meet the setback requirements of the PAMP, environmental waiver and RT zoning district. 5. The installation of utility lines for supplying electricity to the site is permitted. 6. The approved waiver for the property calls for stem wall or piling construction wherever possible. The elevation of a dwelling on the site is dependent on Building Code, septic tank permit requirements and Flood Insurance Rate Map requirements. Please see the attached excerpt from Section 3.14, Land Development Regulations, Martin County Code for a description of how the height is measured. Please see an excerpt from a Building Dept. Newsletter discussing finished floor elevations. 7. The Martin County Health Department can provide information regarding the size, elevation and location of septic systems and wells for the property. All construction, including septic systems and wells are required to adhere to the PAMP, environmental waiver, and RT zoning district setbacks. 8. Accessory structures, such as wood decks, pools, porches and garages must comply with the height and setback requirements of the RT zoning district and be consistent with the PAMP, and the environmental waiver.
