Flood, Assistant Commissioner Minnesota Pollution Control Agency 520 Lafayette Road North St. Paul, Mimiesota REPLY TO THE ATTENTION OF: WW-16J Dear Ms. Flood: The U.S. Environmental Protection Agency has conducted a complete review of the revisions to Appendix A and Appendix B ofthe Minnesota Statewide Mercury Total Maximum Daily Load (TMDL) received by EPA on April 15, Appendix A was revised to include 48 new lake and river assessment unit mercury impairments, and changes or corrections to 3 river and 6 lake assessment units. Amendments to Appendix B include an updated list of point sources which contribute mercury loads to the waterbodies identified in Appendix A. Based on this review, EPA has determined that no changes are being made to the original elements of the TMD L as approved on March 27, 2007, and subsequently revised on April 3, 2008, September 28, 2010 and May 31, This decision addresses amendments to waters included in Appendix A and facilities included in Appendix B of the 2014 Revision to the Minnesota Statewide Mercury TMDL. EPA has determined that the revisions to Appendix A and Appendix B meet the requirement of Section 303(d) ofthe Clean Water Act, 33 U.S.C. Section 1313(D), and EPA's implementing regulations of 40 CFR Part 130. This approval addresses the revisions to Appendix A and Appendix B. The statutory and regulatory requirements, and the TMDL's compliance with these requirements, are described in the enclosed decision document. 3 TMD L Decision Document TMDL: 2014 Revisions to the Minnesota Statewide Mercury Total Maximum Daily Load Approval Date: September 24, 2014 Background On March 27, 2007, the United States Environmental Protection Agency approved the northeast (NE) and southwest (SW) regional mercury Total Maximum Daily Loads (TMDLs) submitted by the State of Minnesota. 1 For purposes ofthis Decision Document, the northeast and southwest regional TMDLs approved by EPA on March 27, 2007, will be referred to as the 'original TMDL'. The original TMDL addresses waterbodies not meeting the aquatic consumption designated use due to exceedances of the numeric mercury water column water quality standard (WQS) or elevated mercury concentrations in fish tissue. The original TMDL established a load allocation (LA) for the primary nonpoint source, atmospheric deposition. Additionally, a wasteload allocation (WLA) was calculated for point sources, including electricity generators, wastewater treatment facilities, and industrial discharges (e.g., pulp & paper mills and refineries). An explicit margin of safety (MOS) was established for the southwest region's TMDL while an implicit margin of safety was used for the northeast region's TMDL. The mercury target for both the northeast and southwest regional TMDLs is a mercury concentration of 0.2 milligram per kilogram (mg/kg) measured as mercury concentration in fish tissue. This target is a surrogate measure for the numeric water column water quality standard of 1.3 nanograms per liter (ng/l) for the Lake Superior Basin, and 6.9 ng/l for the rest of the State. 2 The original TMD L calculated reduction factors necessary to achieve the target fish tissue mercury concentration for a standard size top predator fish. Reduction factors were determined by using the target fish tissue mercury concentration of 0.2 mg/kg and the 90 t h percentile fish tissue mercury concentrations in the standard size top predator fish. The highest fish tissue mercury concentration, estimated from the 90 t h percentile fish tissue calculations, was mg/kg. Therefore, only waterbodies that have fish tissue mercury concentrations greater than 0.2 mg/kg or equal to or less than mg/kg are addressed by the original TMDL. Appendix A of the original TMD L identifies lake and river assessment units that are addressed. The Minnesota Pollution Control Agency (MPCA) is continually monitoring and assessing surface waterbodies to protect the integrity of Minnesota's surface water resources. Through its water quality monitoring strategy, MPC A collects and assesses new fish tissue mercury concentration data. This new data is considered during the State's two year integrated reporting cycle pursuant to Sections 305(b) and 303(d) ofthe Clean Water Act (CWA). There are three possible outcomes ofthe State's assessment of new fish tissue data. 4 TMp L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24, A lake or river assessment unit is determined to be addressed by the original TMDL, ifthe fish tissue mercury concentration is greater than 0.2 mg/kg or equal to or less than mg/kg. The lake or river assessment unit is then added to Appendix A of the Statewide Mercury TMDL. 2. A lake or river assessment unit is placed in Category 5 of Minnesota's Integrated Report if the fish tissue mercury concentration is greater than mg/kg and the water quality data meets all criteria described in MPCA' s 2014 'Guidance Manual for Assessing the Quality of Minnesota Surface Waters for the Determination of Impairment, 305(b) Report and 303(d) List" for an impaired waterbody. 3. A lake or river assessment unit is placed in Category 2 of Minnesota's Integrated Report, or Category 3 due to insufficient data. MPC A analyzes and assesses new fish tissue mercury concentration data every 2 years and revises the waterbodies included within Appendix A of the Minnesota Statewide Mercury TMDL. Waterbodies included within Appendix A of the original TMDL have been revised three times. EPA approved the first revision to the original TMDL's Appendix A on April 3, 2008 (addressing the updates to Appendix A of the original TMDL from the 2008 integrated reporting cycle) and referred to as the '2008 Revision'. EPA approved the 2010 revision to Appendix A on September 28, 2010 (the '2010 Revision') and the 2012 revision to Appendix A on May 31, 2013 (the '2012 Revision'). A copy of the most recent approval, for the 2012 Revision, is attached to this Decision Document as Attachment Revisions to the Minnesota Statewide Mercury Total Maximum Daily Load On April 15, 2014, EPA received amendments to Appendix A ofthe original TMDL for review and approval. These revisions will be referred to as the '2014 Revision'. EPA is approving revisions to Appendix A from the original TMDL based on information submitted by the State of Minnesota in April The 2014 Revision was completed using water quality data collected and analyzed for the 2014 integrated reporting cycle. As was the case for the 2008, 2010 and 2012 Revisions, the State did not make any revisions to the TMD L targets, reduction factors, loading capacities, allocations, reduction goals or any other element of a TMD L loading capacity established in the original TMD L for the 2014 Revision. Identification of Waterbodies for the 2014 Revision The 2014 Revision includes additions to Appendix A of lake and river assessment units with fish tissue mercury concentrations greater than 0.2 mg/kg or equal to or less than mg/kg. Lake and river assessment units which have measured fish tissue mercury concentrations greater than 0.2 mg/kg or equal to or less than mg/kg, are addressed by the original TMDL and listed in Appendix A. MPC A collected and analyzed mercury fish tissue concentration data during the 2014 assessment cycle and submitted a list of waterbodies with mercury fish tissue concentration data greater than 0.2 mg/kg or equal to or less than mg/kg. In its April 15, 2014 Letter, MPCA asked EPA to approve these revisions to the Statewide Mercury TMDL. EP A considered all readily available data and information shared by MPC A during its review of lake and river water quality data for the 2014 Revision. 2

5 TMD L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24, 2014 The State has identified 48 new lake and river assessment units (Table 1 of this Decision Document) for inclusion in Appendix A. 3 EP A reviewed submitted mercury fish tissue concentration data from MPC A and determined that the waterbodies submitted by MPC A are acceptable to be added to the 2014 Revision of the Statewide Mercury TMDL. The 2014 Revision was reviewed using the same EP A internal review protocols which were completed for the 2008 Revision, 2010 Revision and the 2012 Revision. The 2008, 2010, 2012 and 2014 revisions were based upon mercury fish tissue data submitted by MPCA within their integrated report submittal package to EPA. EPA Assessment: EP A finds the State's decision to include 48 new lake and river assessment units to Appendix A is reasonable and appropriate. Waterbodies added to Appendix A were identified by the State as having fish tissue mercury concentrations greater than 0.2 mg/kg and equal to or less than mg/kg. As discussed in the Background section of this Decision Document, waterbodies having fish tissue mercury concentrations within this range are consistent with the reduction factors used to develop the original TMDL. Table 1 ofthis Decision Document identifies the 48 lake and river assessment units which are being added to Appendix A of the original TMDL, as revised in 2008, 2010 and Other Changes to Appendix A for the 2014 Revision EP A encourages States to review previously assessed waterbodies during each integrated reporting cycle. During this review, the State may determine a more appropriate way to segment a waterbody to reflect tributary impacts and morphological features. MPC A defines the boundaries of a river assessment unit as those which typically extend, from one significant tributary to another or from the headwaters to the first significant tributary and is typically less than 20 miles in length. The river may be further divided into two or more assessment units when there is a change in the use classification (as defined in Minn. R. ch. 7050) or when there is a significant morphological feature such as a dam, or a lake within the river. 4 In addition to identifying new lake and river assessment unit impairments for inclusion in the revised 2014 Appendix A, the State also identified the following changes and corrections (Table 2 of this Decision Document) to existing lake and river assessment units already included in Appendix A. Corrections to assessment units: Removed lake assessment unit (AUID) for Clear Lake from Appendix A. Changed the lake AUID to Clear Lake for the 2014 Revision to Appendix A. Splitting of assessment units: Removed lake AUID for Long Lake from Appendix A and split the lake into two new lake AUIDs, (North Lons Lake) and (South Lons Lake). Both of these lake AUIDs were added to the 2014 Revision to Appendix A. Corrections to descriptions in Appendix A: The description for North Center Lake ( ) was updated in the 2014 Revision of Appendix A to include a Mercury TMD L Region for this lake segment. The Mercury TMD L Region was set to Southwest (SW). The description for North Center Pond ( ) was updated in the 2014 Revision of Appendix A to include a Mercury TMD L Region for this lake segment. The Mercury TMD L Region was set to Southwest (SW). The description for South Whaletail Lake ( ) was updated in the 2014 Revision of Appendix A to include a Mercury TMD L Region for this lake segment. The Mercury TMD L Region was set to Southwest (SW). The description for the Pomme de Terre River segment ( ) was changed from Pomme de Terre River (Pomme de Terre Lake to North Pomme de Terre Lake) to Pomme de Terre River (Barrett Lake to North Pomme de Terre Lake) for the 2014 Revision to the Appendix A. EPA Assessment: EP A finds these corrections and changes to assessment units acceptable. MPCA' s review of previously assessed waterbodies during the 2014 integrated reporting cycle resulted in corrections to existing assessment units, splitting lake and river assessment units and combining existing assessment units. MPC A staff communicated all corrections and changes to EP A within integrated reporting documentation. EP A recognizes that the splitting of the original assessment unit is actually a resegmentation, or a revision to the start and end points, of the assessment unit. For the purposes of tracking individual lake or river assessment units, EP A refers to the original assessment unit as being removed. Table 2 of this Decision Document identifies the changes and corrections being made through the 2014 Revision. Public Participation for the 2014 Revision MPCA includes information related to the revision of its Statewide Mercury TMDL as part of the Minnesota Integrated Report (IR) to EPA. Minnesota submits an IR to EPA every two years in order to fulfill the reporting requirements of Sections 305(b) and 303(d) of the Clean Water Act. As part of this submission process, MPC A must provide the public with the opportunity to review and comment on assessment decisions made for the IR, including the opportunity to provide input on waterbodies included or not included within the 2014 Revision. MPC A posted draft 2014 Revision information on its website in December 2013 and invited public comment on the 2014 Revision during a 47-day formal comment period from January 2, 2014 to February 18, 2014, which is longer than its usual 30-day public comment period. Notice of these informational meetings and the public comment period were communicated to the general public 4

7 TMD L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24,2014 through news releases, MPCA' s gov.delivery ing database, MPCA' s website, and via a publication in the State Register. 5 MPCA received twenty-seven (27) public comments during the public comment period for the 2014 IR. Two of the twenty-seven commenters requested that MCP A assess water quality information and consider the inclusion of additional waterbodies to the (d) impaired waters list as impaired due to mercury concentrations. The commenters did not specifically request that MPCA include these waters on the 2014 Revision to the Statewide Mercury TMDL. The commenters referenced specific waters including the Partridge River ( ), the Embarrass River ( ), Lake Sabin ( ), Wynne Lake ( ) and Colby Lake ( ). MPCA reviewed the water quality data cited by the commenters as well as water quality data within MPCA' s databases and other documentation to re-assess the five waterbodies referenced. MPC A determined that existing water quality data indicated that Lake Sabin ( ) and Wynne Lake ( ) were impaired due to mercury concentrations. These 2 lakes were added to the final (d) list as Category 5 waters. These waters were added to the final (d) list instead of the Statewide TMD L based on level of mercury concentration measured in both lakes. The mercury data indicated that concentrations were above the mercury concentration values which would have classified these waters as Category 4A waters and subject to the Statewide Mercury TMDL. Colby Lake, the Partridge River and Embarrass River segments were not assessed by MPC A due to deficiencies identified by MPCA with the water quality data cited and supplied by the commenters, and deficiencies in water quality information from MPCA' s internal water quality databases. MPC A explained that it will not make assessment decisions on waterbodies without appropriate water quality information. The water quality data requirements for mercury impaired waters can be found within Section VI.A.2 of MPCA's 2014 Assessment Methodology (pages 24-25). MPCA provided its response to all comments received during the public comment period in its Response to Public Comments Summary document (http :// state.mn.us/index.php/water/water-types-andprograms/minnesotas-impaired-waters-and-tmdls/impaired-waters-list.html#public-participation, beneath the Public Participation tab). EPA Assessment: EPA reviewed the public participation information submitted by the State and concluded that the MPCA adequately addressed the public comments regarding mercury impairments. EPA also reviewed information made available by MPC A to the public for review and comment, and MPCA' s announcement of the public comment period. EP A finds that the State of Minnesota's public participation process for the 2014 Revision to the Statewide Mercury TMDL provided the public with a reasonable opportunity to review and provide comments on the 2014 Revision. 8 TMD L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24, 2014 Tribal Consultation Under its tribal consultation process, EPA consults with federally-recognized tribal partners, on a goverrrnient-to-government basis in instances when EPA decisions may impact tribal interests. EPA contacted federally-recognized tribal partners within the State of Minnesota to provide tribes the opportunity to consult with EP A on the 2014 Revision to the Minnesota Statewide Mercury TMD L (the 2014 Revision) in early May Representatives from the Fond du Lac Band of Lake Superior Chippewa, the Mille Lacs Band of Ojibwe and the Red Lake Band of Chippewa requested a tribal consultation with EPA. EPA hosted a tribal consultation conference call for the 2014 Revision on June 23, Tribal representatives communicated their concern that MPC A was not considering mercury water quality data collected within the St. Louis River watershed. 6 Specifically, that MPCA was not assessing all available water quality data for segments of the Embarrass and Partridge Rivers. Prior to the consultation discussion on June 23, 2014, tribal representatives shared fish tissue data and water column concentration data with EPA. Both of these data sets were collected by the Minnesota Department of Natural Resources (MN-DNR) at various stream locations within the St. Louis River watershed in the summer of After the conclusion of the call, EP A shared both of these stream water quality data sets with MPC A during a follow-up discussion related to tribal concerns. EP A requested that MPC A review the MN-DN R stream fish tissue data and stream water column data. MPCA reviews available water quality data to assess waters. For assessments, MPCA uses water quality data it collects via MPCA' s annual watershed monitoring schedule and water quality data collected by other federal and state agencies, local government partners and volunteers. MPC A solicited these groups, and the general public, to share water quality data with MPC A in the fall of 2011 and Data submitted to MPC A during this 'Call for Water Quality Monitoring Data'' solicitation was used, along with MPCA collected water quality data, in MPCA's assessment of water quality data for the (d) list. MPCA's Call for Water Quality Monitoring Data outlines submittal deadlines and data formatting instructions for data submittals from outside partners and agencies. This information is communicated by MPC A via its 'GovDelivery' electronic mail distribution system. MPC A expects that partners submitting data will follow the requested submittal deadlines and formatting guidelines to ensure that their water quality data will be assessed in a timely manner. There are instances where water quality information is not submitted in time to meet MPCA's requested submittal deadlines. In those cases MPCA will accept the water quality data submission and consider it for the following assessment cycle. For data submissions received outside of the 2014 Call for Water Quality Monitoring Data deadlines, MPCA will consider the water quality data for the (d) assessment cycle. MPCA reviewed the MN-DNR stream fish tissue data collected at various locations within the St. Louis River watershed and communicated that it had received this same data set from the MN-DNR in April 6 On the June 23, 2014 consultation call, a representative from the Red Lake Band of Chippewa expressed concern that MPCA had included waters within tribal boundaries on the (d) list. This issue will be addressed during the tribal consultation process for the final (d) list. 6

9 TMD L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24, MPC A explained that it did not consider this data during its 2014 assessment for the 303(d) list because it was shared too late in MPCA' s assessment process to be considered for the 2014 assessment cycle. MPC A communicated that it will consider this information during its assessment cycle for the (d) list. MPC A reviewed the MN-DN R stream water column data collected at various locations within the St. Louis River watershed and explained that the data provided by the tribes included stream water quality information which MPCA had yet to receive from the MN-DNR. MPCA explained that it typically receives lake water quality data from MN-DNR, but not stream water quality data. MPCA indicated that it will consider the MN-DNR stream water column data from the St. Louis River watershed during its assessment cycle for the (d) list. EPA considered the tribal input during its deliberations related to the approval ofthe 2014 Revision to the Minnesota Statewide Mercury TMDL. EPA provided each ofthe participating tribes with a written response which explained how EPA considered their input in EPA's final decision on the 2014 Revision. This response was sent to the most senior tribal official involved in the consultation from the Fond du Lac Band of Lake Superior Chippewa, the Mille Lacs Band of Ojibwe and the Red Lake Band of Chippewa. Conclusion EPA has completed a full review of the information shared by MPCA on April 15, 2014, and other appropriate supporting documentation. EPA finds that pursuant to Section 303(d) ofthe Clean Water Act, 33 U.S.C. Section 1313(D), and EPA's implementing regulations at 40 CFR Part 130, the 2014 Revision satisfies the elements of an approvable TMDL. This approval addresses changes to Appendix A of the Minnesota Statewide Mercury TMD L as approved on March 27, 2007 and subsequently revised on April 3, 2008 (the 2008 Revision), September 28, 2010 (the 2010 Revision) and May 31, 2013 (the 2012 Revision). No other elements or documentation supporting the original TMDL, 2008 Revision, the 2010 Revision or the 2012 Revision are being revised. This approval addresses 48 new lake and river assessment units (Table 1 of this Decision Document) not addressed in the original TMDL, the 2008 revision, the 2010 revision or the 2012 revision. This approval also recognizes corrections to one lake assessment unit (Clear Lake), the splitting of one lake unit (Long Lake) and one river assessment unit (Rum River), the corrections to three lake assessment units (North Center Lake, North Center Pond and South Whaletail Lake) and the correction to one river assessment unit (Pomme de Terre River) (Table 2 of this Decision Document). Table 3 ofthis Decision Document is the complete Appendix A, as revised by this approval. EPA's approval of the 2014 Revision extends to the lake and river assessment unit impairments identified in Tables 1 through 3 of this Decision Document, with the exception of any portions ofthe waterbodies that are within Indian Country, as defined in 18 U.S.C. Section EP A is taking no action to approve or disapprove the State's Mercury TMD L with respect to those portions ofthe waters at this time. EPA, or eligible Indian Tribes, as appropriate, will retain responsibilities under Section 303(d) for those waters. 7

10 TMD L Decision Document 2014 Revision to the Minnesota Statewide Mercury TMD L Approval Date: September 24,2014 EPA's approval of the 2014 Revision does not extend to any element ofthe original TMDL or the 2008 Revision, the 2010 Revision or the 2012 Revision unless it is specifically discussed in this Decision Document. EPA's approval of the 2014 Revision does not approve any additions of impaired waters or removal of impaired waters from Minnesota's Integrated Report. EPA will issue a separate decision specific to Minnesota's 2014 Integrated Report. 8
