1 CITY OF PALMDALE REPORT to the Mayor and Members of the City Council from the City Manager DATE: SUBJECT: September 3, 2014 Adoption of Ordinance No. 1461, Adopting Speed Limits ISSUING DEPARTMENT: Public Works SUMMARY Issue: Shall the City Council adopt Ordinance No. 1461, amending the City Code, to designate speed limits on various City Streets? Recommendation: Staff recommends that the City Council adopt Ordinance No Fiscal Impact: $00.00 for sign changes and additions. Funds for the postings are available in the Maintenance Division's account (Traffic Signs & Safety Devices). BACKGROUND The proposed speed limit ordinance has been developed in accordance with the California Vehicle Code (CVC), which requires that speed limits be established based on engineering and traffic surveys. The last major update of speed zones was conducted in Generally, surveys must not be more than 7 years old if radar or other electronic devices are to be used for enforcement. The proposed ordinance will update all the surveys conducted in 2007.

2 Report to Mayor and Council Re: Ordinance No September 3, 2014 Page2 Prima Facie and Maximum Speed Limits The CVC establishes certain prima facie speed limits for streets (e.g., 25 MPH in a residential district). These prima facie speed limits do not need studies or signs posting the limits in order to be enforced. Such requirements would place a significant burden on local jurisdictions for studies, would clutter roadways with signs, and result in little public benefit. There is a maximum speed limit of 65 miles per hour ( miles per hour on undivided, two-lane roads) when prima facie limits do not apply (except on designated freeway segments). In order to vary from such limits, the speed limit must be based on engineering and traffic surveys. Various other CVC sections may also be applicable in certain situations. Fundamentals of Speed Zoning Speed zoning fundamentals are identified in many national, state and other publications. The methods of engineering and traffic investigations to determine realistic speed limits are relatively consistent throughout the United States. A key component of the engineering and traffic surveys is the prevailing speed of traffic. Driving behavior is an extension of social attitude, and the majority of drivers respond in a safe and reasonable manner. Therefore, the speeds at which most people drive may be considered a form of vote regarding the reasonable speed on a street. The engineering and traffic surveys also consider other factors such as unusual roadway features which may not be anticipated by drivers, incident rates, and speed limits on extensions of the roadway segment. Speed Zone Impacts Proper speed zoning accomplishes several purposes, including: Compliance with the laws regarding establishment of speed zones. Provide notice to non-conforming violators. Provide an effective enforcement tool for police by clearly separating violators from the reasonable majority.

Inject logic and reason into what would otherwise be an arbitrary and emotional issue. Some members of the public will ask that speed limits be lowered based on some widely held misconceptions. These include the following. Posting of lower speed limits will slow the speed of traffic. Raising a posted speed limit will cause an increase in the speed of traffic. Speed limit signs will decrease the collision rate and increase safety. Any posted speed limit must be safer than an unposted speed limit, regardless of traffic and roadway conditions prevailing. Speed limit signs have such a small influence on the speed of traffic that the impact is often not measurable. Drivers primarily drive based on their overall perceptions of the roadway and adjacent land uses. Except in cases which are very unusual or not readily perceptible to drivers, speed limit signs have little impact on actual speeds. In such cases (such as curves) warning speed limits are posted in particular relation to the condition and with other warning signs. Setting speed limits lower than reasonable can have several negative impacts, such as: Disrespect for regulations, controls, police, and other officials since they are apparently unreasonable. Irritation of drivers receiving citations which are not reasonable and/or overstate the magnitude of a violation (which can affect fines and insurance). Police or courts may set high tolerance levels for speeding citations in order to make enforcement more reasonable. This may result in complaints that laws are not being properly enforced. The courts may not uphold issued citations if the survey for the roadway segment was not established as required by state law.

6 CITY OF PALMDALE COUNTY OF LOS ANGELES, CALIFORNIA ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALMDALE AMENDING CHAPTER OF TITLE 10 OF THE PALMDALE MUNICIPAL CODE RELATING TO VEHICLES AND TRAFFIC. THE CITY COUNCIL OF THE CITY OF PALMDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Section of Chapter of Title 10 of the Palmdale Municipal Code is hereby amended to read as follows: " Chapter Speed Limits Designated." A. As authorized by the ehicle Code (CVC), it is hereby determined upon the basis of ng and traffic surveys that the maximum speeds (in miles per hour) o the following streets are as identified in subsection C. Speed limits established pursuant to this Chapter shall be effective when appropriate signs giving notice thereof are erected upon said street. 8. Definitions. For the purpose of this chapter, the following words shall have the meaning here-in specified: 1. "Interim" - shall mean a time period from the signing of an engineering and traffic survey and the posting of appropriate signage to the legal statute as determined by the eve or until this section is amended. 2. "New Street Segment" - shall mean any public road opened to the public, accepted for public maintenance, subsequent to adoption of this ordinance. 3. "Substantially Modified" - shall mean any public road that has been modified to provide an additional lane or median, has changed in classification, or has been extended beyond its previous limits.

The Traffic I Transportation Engineer may establish, based on an engineering and traffic survey, interim maximum speed limits for new or substantially modified street segments. SECTION 2. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would

25 Page 20 have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one (1) or more subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional, or invalid, or ineffective. SECTION 3. The City Clerk shall certify to the adoption of this ordinance and shall cause this ordinance to be published or posted as required by law.
