1 THE CORPORATION OF THE TOWN OF SAUGEEN SHORES COUNCIL MINUTES The Regular Meeting of the Council of the Corporation of the Town of Saugeen Shores was held on Tuesday, Monday, at 7:30 p.m. immediately following the Committee of Whole Meeting in the Council Chambers at 600 Tomlinson Drive, Port Elgin, Ontario. PRESENT: Mayor Mark Kraemer Deputy Mayor Mike Smith Vice-Deputy Mayor Doug Freiburger Councillors Judy Ashbee Doug Gowanlock Bill Henderson Duncan McCallum Fred Schildroth Thead Seaman 1.0 CALL TO ORDER Mayor Kraemer welcomed the Public, Press & Staff and called the Meeting to order. 2.0 DISCLOSURE OF PECUNIARY INTEREST AND NATURE Deputy Mayor Smith declared a pecuniary interest on Item No. 7.1 Zoning By-law Stanley on Catherine Street as an owner of property within the area. 3.0 ADOPTION OF MINUTES 3.1 Res. No Moved by: D. Gowanlock Seconded by: T. Seaman That Council adopt the minutes of the March 29, 2004 Council Meeting as presented. 3.2 Res. No Moved by: T. Seaman Seconded by: D. Gowanlock That Council note and file the Committee of Whole Minutes of March 29, REPORT OF COMMITTEE OF WHOLE 4.1 Public Notice Report - March 29, 2004 Res. No Moved by: D. Gowanlock Seconded by: T. Seaman That Council adopt the Public Notice Report dated March 29, 2004 recommending that pursuant to the provisions of the Municipal Act 2001, Section 391 (1), Ontario Regulation 244/02, Section 12 and By-law Number that public notice is hereby given that the Council of the Corporation of the Town of Saugeen Shores intends to repeal By-law # and pass a new by-law to set water and sewer rates for all properties within the Town of Saugeen Shores that are connected to the municipal water and/or sewer system, and that a public meeting will be held on April 26 th, 2004 at 7:30 p.m.
2 2 4.2 General Government Report - March 29, 2004 Res. No Moved by: T. Seaman Seconded by: D. Gowanlock That Council adopt the General Government Report dated March 29, 2004 recommending that the Town of Saugeen Shores appoints Mini Jacques to the Accessibility Advisory Committee for the term of Council. 4.3 Protective Services Report - March 29, 2004 Res. No That Council adopt the Protective Services Report dated March 29, 2004 recommending the following individuals be named to the Town of Saugeen Shores Community Emergency Management Program Committee to assist the CEMC in the completion of the Essential Level Requirements of the Emergency Management Act: Harry Dunning Rob Gross Sue St. Pierre Blace Craig Fred Wuerth And further, that in addition to the above named persons, a Council Member and Alternate shall be named. 4.4 Committee of Whole Report - March 29, 2004 Res. No Moved by: M. Smith Seconded by: B. Henderson That Council adopt the Committee of Whole Report dated March 29, 2004 recommending support of the Township of South Stormont's Resolution to recognize the Ontario Recreation Facilities Association as the certifying body for recreational facility professional designations. 5.0 REPORT OF MUNICIPAL OFFICERS / COMMITTEES 5.1 Special Event Application - Huron Shores Gymnastics - Beach Meet 2004 This event has been sanctioned by Gymnastics Ontario and was held for the first time in 2003 and proved to be a huge success. Proceeds raised from the event are used by the Huron Shores Gymnastics and Trampoline Club for equipment improvements. Res. No That permission be granted for a Special Events Application received from the Huron Shores Gymnastics and Trampoline Club to operate a Beach Meet on Saturday, June 19 th and Sunday, June 20 th, 2004 during the hours of 9:00 a.m. to 8:00 p.m. to be operated from North Shore Park in the Port Elgin Harbour Green Area. Setup will commence on Friday, June 18 th, 2004 with cleanup taking place on Monday, June 21 st, 2004; And further, that the Club be allowed to set up barbeques and cook hot dogs and hamburgers to sell which will assist in the raising of funds for new equipment and maintenance. 5.2 Special Event Application - Heart & Stroke Foundation - Big Bike for Stroke
3 3 The Heart and Stroke Foundation of Ontario is requesting permission to host their Big Bike for Stroke event on Thursday, May 6 th, 2004 with the route commencing from Port Elgin Home Hardware on Goderich Street with right turns at James, Waterloo and Gustavus Streets then turning left at Goderich Street back to Home Hardware. Pledges will be collected for the event. The bike accommodates 30 riders and all proceeds will be donated for Stroke research. Res. No Moved by: M. Smith Seconded by: B. Henderson That permission be granted for a Special Events Application received from the Heart and Stroke Foundation of Ontario to operate a Big Bike for Stroke event on Thursday, May 6 th, 2004 during the hours of 4:00 p.m. to 8:00 p.m. 5.3 Special Event Application - Annual Canada Day Celebrations - Southampton Chamber of Commerce This annual event includes a barbeque, live entertainment, games for the children and a fireworks display, weather permitting. The request for municipal assistance will be forwarded to the Bruce County Special Events Resource Centre. Proceeds from this event will be used for this Canada Day event as well as the 2005 event and many more community projects. The Southampton Chamber of Commerce has in place general insurance coverage in the amount of $2,000, commercial general liability through Hills Insurance that covers all events but the fireworks. Michael Hills has indicated that the insurance company (Frank Cowan Company Ltd.) will issue a certificate showing the Corporation of the Town of Saugeen Shores as additional named insured once the Town approves the Special Events Application. The fire works display is covered under the Town s Insurance as well as Victory Fireworks who will provide certificate of insurance closer to the date of the display naming the Town of Saugeen Shores as additional insured. Henderson That the Town of Saugeen Shores grants permission for the Southampton Chamber of Commerce to hold their Annual Canada Day Celebrations on Friday, July 2, 2004 from 6:00 p.m. to 11:00 p.m. And further, that the following roads be closed from 4:00 p.m. to 11:00 p.m.: - Millard Blvd. (Huron Street West to Lake Huron) - Lansdowne Street (Front Street West to Lake Huron) 5.4 Coliseum Chiller Replacement - Award Tender The call for tenders for the Southampton Coliseum Chiller replacement resulted in four bids being received. The following prices were submitted: J.L. Wilson Ltd. $103,860. Cimco Refrigeration $ 89,115. Total Refrigeration $ 74,432. T. & W. Enterprises $ 61,667. The 2004 budgeted amount for this tender has been adjusted from $55,000 to
4 4 $61,667. This additional cost can be related to two items. The tender called for two additional options that in the opinion of the tendering contractors should be carried out in phase one while the plant is dismantled. The first option added to the tender is in the form of replacement of the sump tank and pump. This vessel contains water that is used to cool the condenser. During the tendering process, the contractors recognized that the pump is twenty eight years old, has been rebuilt on several occasions, and is corroded to the point of requiring replacement. (Cost $2,843.00) The second option being recommended to be added includes the addition of auxiliary cooling for the three compressors. At present, our compressors are cooled with fresh water used only once at which time the used water is sent to waste, whereas an auxiliary cooling system will allow for use of the available cooling water on multiple passes. This provides for a reduction in water consumption due to recycling of the available cooling water. This water is stored in the sump tank as outlined in option one above. (cost $2,505.00) The Southampton Curling Club have been requested to contribute towards this capital upgrade. A capital contribution of 30% has been requested with a re-payment plan to be negotiated between the Town of Saugeen Shores and the Club. This will amount to $18,500. Included in 2004 Capital Budget (Chiller/Roof Reserve) With the Curling Club contribution, the transfer from the Chiller/Roof reserve can be reduced to $43, That T. & W Enterprises be awarded the tender for the Chiller replacement at the Southampton Coliseum at a cost of $61, plus GST. Council agreed to bring forward Item Parks & Trails Master Plan - Award Tender The Parks & Trails Master Plan interview team consisting of Councillor s Duncan McCallum and Doug Gowanlock, Waterfront Committee members Jane Kramer and Bob Clarence, along with staff members Joanne Morison and Mike Myatt, conducted three interviews. The consulting firms interviewed were as follows: Larry T. Porter, Landscape Architect Monteith-Brown & Stantec Marshall, Macklin, Monaghan Johnson, Sustronk, Weinstein & Associates $31, plus applicable taxes $36, plus applicable taxes (Includes $ cost for round table discussion) $32, plus applicable taxes $47, plus applicable taxes (This firm was not interviewed due to tender price.) Council reviewed a copy of the rating results prepared by the Technical Review Committee, along with a corporate profile for Monteith-Brown Planning Consultants and Stantec. The rating results are based on the tender documents submitted by each firm. The Interview Committee was unanimous with their selection of Monteith- Brown and Stantec.
5 5 A Budgeted amount of $36, is funded through a planning grant from the Ontario Trillium Foundation. Staff will negotiate with the consulting firm to bring the tender price under the $36, figure to meet budget. Res. No Moved by: D. Freiburger Seconded by: F. Schildroth That Council approves the recommendation from the Parks & Trails Master Plan Interview Committee which includes the hiring of Monteith-Brown Planning Consultants, in association with Stantec, at a cost of $36, plus applicable taxes. 5.5 Goderich Street Reconstruction - Award Tender An invitational tender (PW2003-CP06-B) was prepared by Municipal Staff for street reconstruction and sidewalks on Goderich Street from Concession 10 to Devonshire Road of the former Town of Port Elgin. Three Contractors took out plans, and the following tenders were received: E.C. King Contracting $198, Harold Sutherland Construction $213, The Director of Public Works recommended that the tender be awarded to E.C. King Contracting Res. No That E.C. King Contracting be awarded the tender for Goderich Street reconstruction in the amount of $198, plus applicable taxes, and that the Mayor and Clerk be authorized to sign the necessary contract documents. 5.6 South-West Quadrant of Southampton - Award Tender Municipal Engineers, Gamsby and Mannerow Limited, prepared a tender document (PW22004-CP05, Contract No. M-1521-A) for street reconstruction, sanitary sewers, storm sewers, and watermains on various streets in the south-west corner of the former Town of Southampton. Plans were taken out by ten Contractors and received back from the following: Harold Sutherland Construction $1,329, Welsh Construction $1,412, Moorefield Excavating $1,646, E.C. King Contracting $1,746, Omega Contractors $2,196, Elgin Construction $2,354, Subterra $2,713, The Director of Public Works recommended that the tender be awarded to Harold Sutherland Construction. Freiburger That Harold Sutherland Construction be awarded the tender for the street reconstruction, sanitary sewers, storm sewers and watermains for the southwest segment of the former Town of Southampton in the amount of $1,329, plus applicable taxes and that the Mayor and Clerk be authorized to sign the necessary contract documents. 6.0 MOTIONS AND NOTICE OF MOTIONS
