1 THE CORPORATION OF THE TOWN OF SAUGEEN SHORES REGULAR COUNCIL MINUTES The Regular Meeting of the Council of the Corporation of the Town of Saugeen Shores was held on Monday, at 7:30 p.m. immediately following the Committee of Whole Meeting in the Council Chambers at 600 Tomlinson Drive, Port Elgin, Ontario. PRESENT: Deputy Mayor Mike Smith Vice-Deputy Mayor Doug Freiburger Councillors Judy Ashbee Doug Gowanlock Bill Henderson Fred Schildroth Thead Seaman ABSENT: Mayor Mark Kraemer and Councillor Duncan McCallum 1.0 CALL TO ORDER Deputy Mayor Smith welcomed the Public, Press & Staff and called the Meeting to order. 2.0 DISCLOSURE OF PECUNIARY INTEREST AND NATURE None Declared. 3.0 ADOPTION OF MINUTES 1. Res. No Moved by: B. Henderson That Council adopt the Minutes of the Regular Council Meeting of March 27, 2006 as presented. 2. Res. No Moved by: J. Ashbee Seconded by: F. Schildroth That Council note and file the Committee of Whole Minutes of March 27, REPORT OF COMMITTEE OF WHOLE 1. General Government Report - March 27, 2006 Res. No Seconded by: B. Henderson That Council adopt the General Government Report dated March 27 th, 2006 recommending the following: 1. That Council authorize Staff to proceed with processing a Business Licence application for Jodi Burton-Schiefley to operate a Hair Braiding service on the Port Elgin Beach. 2. That Council authorize the Clerk to issue a Taxi Licence to Dan and Mary Dawe to operate Wolfy s Taxi, upon the applicants fulfilling all of the terms and conditions of the Taxi License Application.
2 2 2. Community Services, Parks & Recreation Report - March 27, 2006 Res. No That Council adopt the Community Services, Parks & Recreation Report dated March 27, 2006 recommending the following: 1. That rental rate increases for the Southampton Yacht Club, Southampton Harbour, Chesley Street Docking Committee and Centennial Pool be approved as presented. 3. Protective Services Report - March 27, 2006 Res. No Seconded by: D. Freiburger That Council of the Town of Saugeen Shores adopt the Protective Services Report dated March 27, 2006 recommending the following: 1. That the tender submitted by Metz Fire in the amount of $376, be accepted for the supply of a new KME Custom fire apparatus. 5.0 REPORT OF MUNICIPAL OFFICERS / COMMITTEES 5.1 Municipal Vehicle Purchase Council has approved the purchase of the new and replacement vehicles in the 2006 Capital Budget. Tenders were received from five area dealers for the units. The dealers were Fox Chrysler, Gardhouse Motors, Peninsula Ford, Rosner's and Fenton's Garage. Tenders were requested for: 2-4x4 Pickups 2 - Regular Pickups lb GVW 1 - Cab and Chassis including dump box Pricing for the 4x4 Pickups was: Fox Chrysler $55, Gardhouse $56, Peninsula Ford $58, Fenton's $60, Rosner's $61, The tender document for the two pickup trucks contained an error which required cancelling the tender and issuing a re-tender. Only one tender was received for the cab and chassis c/w dump box. Peninsula Ford's tender was $45, which is slightly higher that the identical unit purchased in Res. No That Council of the Town of Saugeen Shores approve the purchase of two (2) x 4 pickup trucks from Fox Chrysler for a total cost of $55, and one (1) Ford Cab and Chassis including dump box from Peninsula Ford at a cost of $45, P.S.T. is included in price.
3 3 5.2 Southampton Sewage Treatment Plant - OCWA Report The Ministry of the Environment has previously informed municipalities and septage hauling contractors that land spreading of septage (septic tank waste) would be banned a the end of 2006 with all septage then requiring treatment by municipal sewage treatment facilities. The deadline has been extended until further studies and planning can be completed but the province has banned land spreading from December 1 to March 31 in any year which now creates problems for disposal of septage from emergencies and holding tanks during this period. A Septage Study was completed previously for Saugeen Shores which has identified the number of installations of septic systems, locations and potential treatment methods. The Southampton Sewage Treatment Plant was identified as the plant with the most organic treatment capacity but assessment of the plant's capacity to accept septage without modification was not completed. The Town has not been accepting any septage waste but instances have occurred where emergencies have required acceptance of waste including emptying of holding tanks prior to overflow into the environment. A study of the Southampton plant will serve a number of purposes. An assessment of the capacity of each component will identify where potential increased capacities may exist, if there is potential increased capacity in the aeration cells, potential aerator rotor upgrades as these units are now 34 years old and potential electrical power savings as was identified in OCWA's recent report to Council OCWA will be utilizing Hydromantis Inc. GPS- modelling software which is a widely used wastewater treatment program and OCWA is an authorized agent of the engineering firm. Res. No Moved by: J. Ashbee Seconded by: F. Schildroth That Council of the Town of Saugeen Shores recommends that OCWA, Project Development and Technical Services Group, be authorized to proceed with an investigation of the Southampton sewage treatment plant to determine the volume of septage that can be treated by the plant in its current configuration. In addition, a study of the power consumption and recommendations to reduce consumption to be completed concurrently. Costs not to exceed $30,000 including any applicable taxes and disbursements. 5.3 Special Events Application Huron Shores Run The Port Elgin and Southampton Rotary Club is holding the 2006 Rotary Huron Shores Run on June 4 3rd, The proceeds from this annual event will go to the Saugeen Memorial Hospital Foundation and local Rotary projects. The run will start at the Walker House and travel west on High Street to the Lake and return east on Huron Street S. and proceed south to Huron Street S. and Miramichi Bay Road to Concession 10 and turn and return to Walker House. The Committee will be responsible for the manning and barricading of the route. The Director of Public Works will notify the various agencies affected by the road closures. A copy of their insurance policy with Marketplace Insurance and Financial Services shows $5,000,000. coverage with the Town of Saugeen Shores being listed as an additional insured. Res. Schildroth That Council of the Town of Saugeen Shores recommend that permission be granted to the Rotary Huron Shore Run Committee to hold the 2006 Huron Shore Run on June 3, 2006, from 8:00 a.m. to 12:00 noon starting and ending at the Walker House in Southampton; And further that High Street be closed from the west side of the intersection at
4 4 Grosvenor to the east side of intersection of Huron Street. 5.4 Cruiser's Cruise Night Saugeen Shores Chamber of Commerce has made application for a Special Events Cruiser s Cruise Nite to be held in Southampton on Thursday nights, from the May 18 th to September 14 th at the Dominion Lookout. This is the twelfth year of the weekly summer event with proceeds being donated for Saugeen Memorial Hospital equipment purchases. The organization have sufficient staff to erect the barricades and provide assistance to affected residents to access to and from their properties, being one residence on the south side of High Street and one residence on the north side of High Street and one residence on the northwest corner of High and Huron Streets. A copy of Certificate of Insurance has been received showing that the Town of Saugeen Shores is listed as an additional insured. The Director of Public Works will notify the various agencies affected by this closure. Res. No That permission be granted to Saugeen Shores Chamber of Commerce for Cruiser s Cruise Nites at Dominion Lookout each Thursday evening commencing May 18 th, 2006, until September 14 th, 2006, from 5:00 p.m. until 9:30 p.m. and further that High Street be closed west of Huron Street to Lake Huron. 6.0 MOTIONS AND NOTICE OF MOTIONS 7.0 BY-LAWS Linda White, Clerk, presented a Staff report outlining that the Town of Saugeen Shores Planning Advisory Committee held a public meeting on Thursday, April 6, 2006 in the Rotary Hall for the purpose of hearing a Zoning By-law Amendment and Official Plan Amendment application which would allow for a large retail department store, proposed to be a Walmart, and a maximum of five smaller buildings at the front of the property. The Planning Act requires that before passing a by-law under Section 34 of the Planning Act, the Council shall ensure that sufficient information is made available to enable the public to understand generally the zoning proposal that is being considered by the Council and, for this purpose, shall hold at least one public meeting, notice of which shall be given in the manner and to the persons and public bodies prescribed. The prescribed public notice is required to be given to every owner land within 120 metres of the area to which the proposed by-law applies, or, by giving notice by publication in a newspaper that, in the opinion of the clerk of the municipality or the secretary-treasurer of the planning board, is of sufficiently general circulation in the area to which the proposed by-law would apply to give the public notice of the public meeting. Notice of the Public Meeting must be given twenty days prior to holding the public meeting. The Planning Act further requires that the public meeting be open to the public and that any person who attends the meeting shall be afforded an opportunity to make representations in respect of the zoning proposal. Each person who wished to speak at the public meeting was asked to register prior to speaking and was added to the list of speakers. Each person who requested to be registered as a speaker
5 5 was afforded the opportunity to speak at the public meeting. The Town of Saugeen Shores has complied with the provisions of the Planning Act by giving public notice, holding a Public Meeting and affording each person an opportunity to speak on the planning applications. Mr. Dennis Woods, Solicitor for the Shoreline Shopping Centres Ltd. requested Council s consideration to allow personal service shops less than 2000 square feet. Mr. Wood offered that if Council was not is support of allowing personal service shops less than 2000 square in the Zoning By-law, that Council could allow such a use in the Official Plan. This approach would eliminate the need for the Developer to apply for an Official Plan Amendment and Zoning Amendment in the future. Deputy Mayor Smith and Councillor Gowanlock, both representatives of the Town of Saugeen Shores Planning Advisory Committee, stated that the Planning Advisory Committee gave consideration to the request, however, the Committee believed that retail stores, less than 2000 square feet should be located in the Downtown Core. The importance of protecting the Downtown Core was supported by Council and the Official Plan and Zoning Amendment by-laws were adopted as presented. Councillor Thead Seaman requested a recorded vote for Agenda Items 7.7 and By-law # Official Plan Amendment No Shoreline Shopping Centres Res. No Moved by: B.
