1 Bourne Youth Baseball By-Laws (Amended October 23, 2007) All rules and regulations for all leagues are subject to Babe Ruth or Cal Ripken Rules, as listed herein and in each leagues and regulations. Article 1 The purpose of Bourne Youth Baseball is to provide all participants with the enjoyable recreational activity that foster good sportsmanship and the spirit of team play as well as the development of sound fundamental skills in baseball. Article 2 The membership of Bourne Youth Baseball and Babe Ruth Leagues, herein referred to as the League, consists of the players, the players parents, coaches and all members of the Board of Directors. The league membership is invited and encouraged to attend all meetings. However, all decisions will be voted on by the Board of Directors in accordance with Article 8. Article 3 The Board of Directors shall be elected annually by a simply majority vote of the adult membership present. The annual meeting at which the Board of Directors is elected shall be held in October of each year. The monthly meeting in September shall in part consist of nominations for all positions being voted for in the October elections meeting. All persons wishing to be nominated must do so during this September meeting. Beginning in October 2005, the positions of President and Secretary will be two (2) year terms. Beginning in 2006, the positions of Vice President and Treasurer will be two (2) years. Notice of this meeting shall be advertised in a newspaper in the town of Bourne at least seven (7) days in advance of the meeting. Executive meetings of the Board of Directors may be called by a majority of the Board. Article 4 The Board of Directors shall consist of the President, Vice-President, Treasurer, Clerk, Field Maintenance Director BYB, Field Maintenance Director BBR, Umpire-in-Chief BYB, Umpire in Chief BBR, Player Agent BBR, Coordinators of the Babe Ruth League, American League, National League, Minor East League, Minor West League, T-Ball North League, Tee Ball South League, Snack Bar Manager BYB, Snack Bar Manager BBR, Equipment Manager BYB, Equipment Manager BYB, Senior Babe Ruth Coordinator, Fundraising Coordinator, Tournament Director, BYB and Tournament Director, BBR. All positions, except for Umpire-In-Chief are voting positions. Article 5 The duties of the Board of Directors shall be as follows: President: Is responsible for the overall operation of the league. Runs monthly meetings. Oversees coordinators and the board members. Is the representative of the league. Vice-President: Assists in the operation of the league. Presides in the absence of the President. Meets with coordinators monthly. Oversees financial support by sponsors. Treasurer: Supervises incoming and outgoing funds and manages checkbooks. Authorizes any league expenditures. Provides monthly expenditure report.
2 Clerk: Records minutes of every meeting. Prepares agendas with the president for every meeting. Maintains updated by-laws and rules and regulations of the entire league and of each individual league. Publicizes league meetings and events through the media and mailings. Coordinators: Manages and supervises his/her league. Submits to the Board of Directors for approval, a lists of coaches for his/her division. Schedules fields for practice and with the field maintenance personnel, (coaches and volunteer parents), maintain fields, before and after games and practices, including raking and lining fields before scheduled games, picking up and cleaning out dugouts after games, including stands areas. Tournament Director/Tournament Committee: Arranges, manages and supervises all league tournaments including: the in-town, Jamboree and Bourne tournaments. Notifies and confirms tournaments in other towns. Schedules tournaments in Bourne and confirms the attendance of other towns. Umpire-In-Chief: Recruits, supervises and schedules umpires. Acts as League representative of the umpires. Field Maintenance: Is responsible for the operational maintenance of all fields in conjunction with the League Coordinators. Informs the Board of major expenditure. Snack Bar Manager: Maintains the snack bar and purchases food and supplies. Supervises snack bar volunteers for all scheduled and tournament games. Equipment Manager: Procures and distributes all playing equipment and uniforms for the season. Collects the equipment at the end of the season and maintains it in the off season. Player Agent, BR: Junior and Senior Babe Ruth Player Agent responsibilities are Player, Coach, and Parent Liaison Acts as mediator when called upon. The decisions made are generally final, (in accordance to National Babe Ruth rules and regulations), unless local leagues modify. The purpose is to give both the coach and parents a person to talk to before going to the league President or Board of Directors. Based on National Babe Ruth rules and regulations and local league rules, maintain a list for the next team available for new players should a new player sign up to play in the league. Coordinates the local draft unless the local league chooses otherwise. Maintains the player pool of available players should a surplus exist where no roster space is available for the number of players that have signed up to play. Article 5A There shall be a minimum of 5 board members present at each meeting, including the president as part of the 5 members needed to satisfy a quorum. In all cases, the president may vote only in the event of a tie Article 6 Article 6 was voted to be taken out by a unanimous decision (public relations position) will be left blank
3 BOURNE YOUTH BASEBALL CORI POLICY Where Criminal Offender Record Information (CORI) checks are part of a general background check for employment, volunteer work or licensing purposes, the following practices and procedures will generally be followed. I. CORI checks will only be conducted as authorized by CHSB. All applicants will be notified that a CORI check will be conducted. If requested, the applicant will be provided with a copy of the CORI policy. All disqualifying offenses shall be made by the guidelines set forth by The Bourne Recreation Committee. If an applicant would like to appeal, follow appeals process set by Bourne Recreation Director. II. An informed review of a criminal record requires adequate training. Accordingly, all personnel authorized to review CORI in the decision- making process will be thoroughly familiar with the educational materials made available by CHSB. III. Unless otherwise provided by law, a criminal record will not automatically disqualify an applicant. Rather, determinations of suitability based on CORI checks will be made consistent with this policy and any applicable law or regulations. IV. If a criminal record is received from CHSB, the authorized individual will closely compare the record provided by CHSB with the information on the CORI request form and any other identifying information provided by the applicant, to ensure the record relates to the applicant. V. If Bourne Youth Baseball is inclined to make an adverse decision based on the results of the CORI check, the applicant will be notified immediately. The applicant shall be provided with a copy of the criminal record and the organization's CORI policy, advised of the part(s) of the record that make the individual unsuitable for the position or license, and given an opportunity to dispute the accuracy and relevance of the CORI record. VI. Applicants challenging the accuracy of the policy shall be provided a copy of CHSB s Information Concerning the Process in Correcting a Criminal Record. If the CORI record provided does not exactly match the identification information provided by the applicant, Bourne Youth Baseball will make a determination based on a comparison of the CORI record and documents provided by the applicant. Bourne Youth Baseball may contact CHSB and request a detailed search consistent with CHSB policy. VII. If Bourne Youth Baseball reasonably believes the record belongs to the applicant and is accurate, based on the information as provided in section IV on this policy, then the determination of suitability for the position or license will be made. Unless otherwise provided by law, factors considered in determining suitability may include, but not limited to the following: Relevance of the crime to the position sought; The nature of the work to be performed; Time since the conviction; Age of the candidate at the time of the offense; Seriousness and specific circumstances of the offense; The number of offenses; Whether the applicant has pending charges;
4 Any relevant evidence of rehabilitation or lack thereof; Any other relevant information, including information submitted by the candidate or requested by the hiring authority VIII. Bourne Youth Baseball will notify the applicant of the decision and the basis of the decision in a timely manner. Article 8 The Board of Directors shall be empowered to: 1)Establish and amend the League by-laws and rules 2)Discipline coaches, players, parents of players in such situations as judged necessary by the coordinator with the President. 3) Establish the registration fee annually as requested by the Treasurer with the President. 4) In compliance with the Town of Bourne requirements regarding requests for price quotations, approve major financial expenditures as requested by the Treasurer with the President. 5)Any voting by the Board of Directors shall require a majority of the Directors. 6)Establishment and amendment of the League by-laws and Rules as well as the expulsion of a member from the League shall require a two-thirds vote of the Board of Directors present and voting. 7) The Board of Directors may determine a Board member is ineligible to vote on an article due to a conflict of interest. If so that member may not vote on that article. All other matters shall be decided by a simple vote of the voting Board of Directors Article 9 Within a reasonable amount of time after each Presidency change within Bourne Youth Baseball the Leagues financial books shall be audited. The audit will be performed by a licensed CPA or at the leagues discretion shall be performed by a group of volunteers designated by the Board. Article 10 Bottle Redemption for Fund Raising. The Board of Directors will select a volunteer friend of the league to perform the activities required to redeem the deposits on the bottles collected at the Bourne landfill. The activities include, on a timely basis, The sorting and segregation of the bottles, as required by the redemption centers. The transportation of the sorted bottles to the redemption center. The collection of money from the redemption center. Delivering the leagues portion of the proceeds to the league treasurer. The League will accept in good faith whatever the volunteer submits to the treasurer as an accurate disposition of the money collected. Article 11 Bourne Youth Baseball League and Babe Ruth Baseball League will pay the appropriate meals tax on every sale which it transacts.
5 Article 12 Bourne Youth Baseball and Babe Ruth Baseball Leagues will present all scholarship candidates to a sub-committee of the Board consisting of the President, Vice-President, and the Secretary. This sub-committee will determine the eligibility and status of each candidate and render it's decision. Article 13 Any returned checks will be subject to the original fee plus nominal bank charge and league will consider registration incomplete. Fees owed to the league shall be paid with cash or money order before that player re-registers. No refunds will be given without Boards majority vote. Article 14 Bourne Youth Baseball and Babe Ruth Baseball Leagues will institute a Parental Code of Conduct. (Herein known as the PCC). This PCC will be separate of and distributed with the registration form. PCC form will be signed by the parent or legal guardian, must accompany registration form and will be kept on file. Bourne Youth Baseball and Babe Ruth Baseball Leagues will instruct its umpires and coaches to give offender one warning. After one warning if the offense continues that person will be asked to leave the ball field altogether, including any parking area. If the offender refuses, then the police are to be summoned, the offender removed and suspended from attending future games, the number to be decided on by the Board of Directors. The league clerk will notify offender by mail immediately of the board s decision. Amended 10/23/07
