2 Intrductin This guidance nte relates t SEPA s sealed surce registratin applicatin frm, which will allw yu t apply fr a new registratin, a variatin t an existing registratin r t cancel yur registratin. SEPA wuld expect that the amunt and detail f the infrmatin submitted wuld be prprtinal t the cmplexity f the prpsed applicatin. Please nte that this applicatin frm des NOT cver registratins relating t the keeping r use f unsealed radiactive material r authrisatins relating t the accumulatin r dispsal f radiactive waste. Fr applicatins f this nature, please cmplete SEPA s Radiactive Substances mdular applicatin frm available n SEPA s website. Applicatin Fees Mst types f applicatin will be required t be accmpanied by the apprpriate applicatin fee. Fr mre infrmatin n the relevant applicatin fees and accepted payment methds, please refer t the Radiactive Substances Fees and Charges Scheme fr the current year which is published n SEPA s website. Please nte SEPA cannt prgress an applicatin until the relevant fee has been paid. Payment can als be submitted nline via the Applicatins page n the SEPA website using web payment facility. Submissin f applicatin and Duly Made checks If yu are printing ut the frm t fill in by hand, please use black ink and ensure that all infrmatin prvided is legible. Further infrmatin may be submitted n additinal sheets and/r reprts. These must be clearly marked with the name and address f the applicant. Applicatins that are incrrect r incmplete may be deemed nt t be Duly Made. If an applicatin has been deemed t nt be Duly Made, the applicatin frm and fee will be returned t yu alng with an explanatin f why it is nt Duly Made. Fr an applicatin t be Duly Made, it must be: 2

3 1. Submitted n the crrect applicatin frm. 2. Accmpanied by the apprpriate fee. 3. Signed by a relevant persn authrised t sign n behalf f the applicant s rganisatin. 4. All relevant sectins/questins have been cmpleted. 5. All supprting dcumentatin has been included. Applicants shuld nrmally allw up t 4 mnths frm the date an applicatin is deemed Duly Made fr the applicatin t be determined. Please nte that by making an applicatin yu are nt guaranteed t be granted a permit. SEPA reserves the right t determine the applicatin which may result in the applicatin being refused. If refused, SEPA will write t yu t explain the reasns fr the refusal and prvide details f hw t appeal SEPA s decisin. Furthermre, yu have the right t withdraw yur applicatin at any time. Shuld yu wish t withdraw yur applicatin, yu must write t SEPA t request it. SEPA will acknwledge yur request in writing. Cnsultatin In accrdance with the High-activity Sealed Radiactive Surces and Orphan Surces Regulatins 2005, SEPA is required t cnsult with the plice n site security fr all surces nt falling int Surce Categry/Security Grup 5D. This prcess may take up t 6 weeks t cmplete. The plice may visit the site, r in the case f mbile radiactive apparatus, the place where it is usually kept as part f the cnsultatin. This visit may r may nt invlve SEPA. 3

4 Frnt Page and Sectin 1 This sectin is applicable t all applicatins made n this frm. Which ne f the fllwing applicatins are yu making? Please indicate which type f applicatin is being made by ticking the apprpriate bx. Please use ne frm fr each type f applicatin. List all relevant certificates under the Radiactive Substances Act 1993 (RSA93) which are currently held by the applicant. Give a brief explanatin f why yu are seeking t apply (e.g. variatin t increase number f nuclear density gauges held). In additin, list all ther SEPA permits that apply t the site, r in the case f mbile radiactive apparatus, the place where it will usually be kept. Other SEPA permits include thse made under the Pllutin Preventin and Cntrl Regulatins (PPC), the Water Envirnment (Cntrlled Activities) Regulatins (CAR) and the Waste Management Licensing Regulatins (WML). Sectin 1 General Infrmatin Name f Site 1a Please prvide details f the premises t which this applicatin refers Please prvide the address f the site where the radiactive material will be kept r used, including its pst cde and the main telephne f the site (e.g. receptin). Fr mbile radiactive apparatus registratin applicatins, this address wuld be the ne where the registered sealed surces are usually kept, including thse usually kept in ther parts f the UK r elsewhere. Fr ffshre applicatins, please state the installatin name, blck number(s), field name and any satellite platfrms and sub-sea maniflds assciated with the site. Include blck numbers and field names f the satellite platfrms and sub-sea maniflds where these are different frm the main installatin. The permit must be sent t the registered/principal address in accrdance with Sectin 41 f RSA93, hwever if yu require an additinal cpy t be sent t an alternate address please specify the details in writing. 4

This shuld cnsist f 2 letters fllwed by 8 numbers, fr example, SJ Legal Status f Applicant 1d Please describe the applicant s undertaking Please prvide a descriptin f the applicant s undertaking. Undertaking is defined in Sectin 47 f RSA93 as fllws: includes any trade, business r prfessin, and, in relatin t a public r lcal authrity, includes any f the pwers r duties f that authrity, and, in relatin t any ther bdy f persns, whether crprate r unincrprated includes any f the activities f that bdy. The undertaking is nt the same as the purpse fr which the applicant has registered sealed surces. Fr example, a firm may have its undertaking described as light engineering wrks whilst the reasn fr the registered sealed surces being n site may be liquid level detectin as part f a gauge. SEPA wuld prefer t use the applicant s Standard Industrial Classificatin (SIC) descriptin as the descriptin f its undertaking. Fr cmpanies registered in the UK this infrmatin can be btained frm Cmpanies Huse f the Office f Natinal Statistics ( 1e Please indicate what the legal status f the applicant is by selecting ne ptin frm the drp dwn menu Any Registratin, Ntice f Variatin r Ntice f Cancellatin issued by SEPA is a legally binding dcument. Therefre, it is imperative that yu are crrectly described in legal terms n the frnt sheet t the permit r ntice. 5

6 Depending n exactly what yur legal status is will determine what infrmatin SEPA needs. There are 4 categries f legal status, and yu will fall int nly ne f these categries. The required infrmatin t describe the applicant s legal status has been brken dwn int fur ptins: Individual/sle trader Organisatin f individuals/partnership Public bdy Cmpany r crprate bdy Please select ne ptin. If in dubt, please cntact SEPA befre making the applicatin. Organisatin f individuals may be a club r similar rganisatin. In thse circumstances where there are mre than 1 individual invlved, please use separate sheets t cmplete the same infrmatin and nte these sheets under sectin 3a. Applicant Cntact Details 1f. Please prvide details abut the persn that we may cntact abut the applicatin This sectin refers t the persn authrised by the applicant t be the primary cntact fr queries abut the applicatin. This culd include a persn within the applicant s rganisatin r thse utside f the rganisatin such as cnsultants r Radiatin Prtectin Advisers (RPA s). Queries are likely t be f a technical nature. 1g. Please prvide details abut the site cntact r respnsible persn if different frm the persn abve This is the persn wh has the direct management f the registered sealed surces n the site (e.g. Radiatin Prtectin Officer r Radiatin Prtectin Supervisr), usually n a dayt-day basis. This is usually the persn with whm SEPA wuld ask fr if undertaking an inspectin. It may be the same persn as listed under 1f abve. 1h. Please prvide details f the cntact and billing address fr invices t be sent t The granting f a registratin will attract an annual subsistence fee as set ut in the Radiactive Substances Fees and Charges Scheme fr the current year, available frm SEPA s website. This sectin identifies where any invices frm SEPA shuld be sent. 6

7 Sectin 2 Applicatin Details Details f the registered sealed surces t be kept and used Radiactive material has the same meaning as the Radiactive Substances Act 1993 Amendment (Sctland) Regulatins Sealed surces mean a radiactive surce cntaining radiactive material where the structure is designed t prevent, under nrmal use, any dispersin f radiactive substances, excluding such a surce where it is an electrdepsited surce r a tritium fil surce. Mbile radiactive apparatus means any apparatus, equipment, appliance r ther thing which is radiactive material and is cnstructed r adapted fr being transprted frm place t place. 2a. Please state fr what justified practice yu will be using the registered sealed surces All uses f radiactive material, including registered sealed surces, require t be justified in accrdance with the Justificatin f Practices Invlving Inising Radiatin Regulatins 2004, as amended. Scttish Ministers are the cmpetent authrity fr this legislatin; hwever, SEPA cannt issue a registratin unless a practice is justified. A list f justified practices can be btained frm: atin-guidance.pdf Annex 3 f The Justificatin f Practices Invlving Inising Radiatin Regulatins 2004, lists the justified practices. Als, the Justificatin Register cntains further updates: catin_applicatin_centre_-_register_-_2014_-_07.pdf 2b. Please prvide details in the table belw f the registered sealed surces t be kept r used Please cmplete the table with the sealed surces yu intend t keep and use: Radinuclide - state the full name f the element fllwed by the mass number f the istpe (e.g. Caesium-137 ); Maximum Number state the maximum number f registered sealed surces cntaining that radinuclide yu intend t keep r use. It is recmmended that if the registered sealed surces require t be replaced frequently and the replacement is unlikely t ccur n the same day that the replacement surce arrives n yur site that cnsideratin is given t increasing the maximum number f surces t be kept. Additinally, if there is a likelihd that the number f sealed surces required will 7

8 increase in the near future (within mnths) then it may be best t apply fr the ttal number required rather than immediate/current usage; Maximum Activity (Individual) - State the single maximum r highest activity f the surce fr each radinuclide that will be n the premises at any ne time in Becquerels r multiples theref (e.g. kbq, MBq, GBq). Each radinuclide shuld nly be listed nce; Maximum Activity (ttal per radinuclide) State the maximum ttal amunt f activity fr each radinuclide in Becquerels r multiples theref (kbq, MBq, GBq). This is the activity aggregate f all registered sealed surces cntaining that particular radinuclide; and Purpse fr which the registered sealed surces will be used - List all the purpses fr the specified radinuclide. Please use generic categries where pssible (e.g. level gauge, density measurement, radigraphy). SEPA is likely t ask fr mre detailed infrmatin during the determinatin prcess. The purpse will usually be mre descriptive f hw yu are using the surce than the justified practice. Fr variatins, it is nly necessary t cmplete the table where yu intend t hld new radinuclides r where there is a prpsed change in the number/activity/purpse f an existing radinuclide. All registered sealed surces must be listed, including thse already appearing n an existing registratin in rder t avid cnfusin n what is t be registered. In such cases it may be necessary t prvide additinal infrmatin n a separate sheet and list it under 3a. 2c. Please prvide details in the table belw f the lcatin where the registered sealed surces will be kept r used SEPA needs t knw exactly where each registered sealed surce will be kept r used n yur premises. In the case f mbile radiactive apparatus, the lcatin will be where the surces are nrmally kept. This infrmatin will be shared with the lcal Plice Cunter Terrrist Security Adviser in rder t allw them t determine the apprpriate level f security fr the registered sealed surce(s). Building r lcatin name r number State the name r number f the lcatin where the sealed surce(s) will be kept r used (e.g. bttling plant area, Rm 223, etc.). Radinuclide - State the full name f the element fllwed by the mass number f the istpe (e.g. Caesium-137 ). If registered sealed surces cntaining the same radinuclide are used in separate lcatins, please ensure that all lcatins where thse surces are used are listed; and 8

9 Ttal Activity [Bq] State the ttal activity f all sealed surces cntaining that particular radinuclide in that particular lcatin in Becquerels r multiples theref (e.g. kbq, MBq, GBq). If there are multiple lcatins where registered sealed surces are kept r used, please ensure that all lcatins have been listed. Fr variatins, it is nly necessary t cmplete the table where yu intend t hld new radinuclides r where there is a prpsed changed in where existing radinuclides will be kept. All registered sealed surces must be listed, including thse already appearing n an existing registratin in rder t avid cnfusin n what is t be registered. In such cases it may be necessary t prvide additinal infrmatin n a separate sheet and list it under 3a. 2d. Please prvide details in the table belw f any depleted uranium being kept r used in assciatin with the registered sealed surces If there are any items incrprating depleted uranium assciated with the keeping r use f the registered sealed surces, SEPA requires t knw the fllwing infrmatin: Type f item incrprating depleted uranium State the type f item. Fr example, transprt cntainer, shielding, cllimatr, etc.; Ttal number f items incrprating depleted uranium State the number f items f that particular type that will be kept. Fr example, transprt cntainers - 3, cllimatr - 1; Ttal mass f items incrprating depleted uranium State the ttal mass in kilgrammes (kg) fr each different type f item. Fr example, transprt cntainers kg, cllimatr - 5 kg; and Lcatin f items incrprating depleted uranium As fr 2c abve, state the lcatin f the items incrprating depleted uranium. Fr example, transprt cntainers and cllimatr - equipment strage lcker. Fr variatins, it is nly necessary t cmplete the table where yu intend t hld a different type f item incrprating depleted uranium, mre items, increase the mass held r where there is a prpsed change in where the items will be kept. All items incrprating depleted uranium must be listed, including thse already appearing n an existing registratin in rder t avid cnfusin n what is t be registered. In such cases it may be necessary t prvide additinal infrmatin n a separate sheet and list it under 3a. Mvement f registered sealed surces The purpse f this sectin is t establish whether registratin under sectin 7 r sectin 10 f RSA93 is mre apprpriate. Mbile radiactive apparatus means any apparatus, 9

10 equipment, appliance r ther thing which is radiactive material and is cnstructed r adapted fr being transprted frm place t place. 2e. D yu intend t mve the registered sealed surces frm the premises? If it is yur intentin that the registered sealed surces (r the device in which they are cntained - the mbile radiactive apparatus) will g ff the site where they are usually kept in rder t be used, yu shuld tick the yes bx and prvide further details f these mvements in the space given. The type f infrmatin t be prvided includes, but is nt limited t: The frequency and duratin that the mbile radiactive apparatus will be away frm the place where is nrmally kept; The manner in which the mbile radiactive apparatus will be transprted; and Cntrl measures, including registered sealed surce security, when the mbile radiactive apparatus is away frm the place where it is nrmally kept. Please nte that a registratin fr mbile radiactive apparatus issued by SEPA is nly valid in Sctland. If yu wish t keep r use the mbile radiactive apparatus elsewhere in the UK, yu will be required t have an apprpriate permit frm the EA (fr England and Wales) r an apprpriate registratin frm the NIEA (fr Nrthern Ireland). 2f. D yu intend t lend r hire the registered sealed surces? If it is yur intentin t lend r let n hire the registered sealed surces (r the device in which they are cntained - the mbile radiactive apparatus), yu shuld tick the yes bx and prvide further details f this activity in the space given. The type f infrmatin t be prvided includes, but is nt limited t: The management arrangements fr ensuring that the persn t whm the mbile radiactive apparatus is being lent r let n hire is apprpriately registered/permitted; The manner in which the mbile radiactive apparatus will be transprted; and The manner in which the mbile radiactive apparatus will be stred when nt in use. Please nte that the persn t whm yu lend r let n hire yur mbile radiactive apparatus must als have his wn registratin t keep and use sealed surces f the type he has been given as well as having enugh registered number f surces n his registratin t accmmdate his wn mbile radiactive apparatus as well as any he may be lent r let n hire. In additin, if that persn intends t transprt the mbile radiactive apparatus utside f Sctland fr wrk in ther parts f the UK, he will als be required t hld an apprpriate 10

11 permit frm the EA (fr England and Wales) r an apprpriate registratin frm the NIEA (fr Nrthern Ireland). End f Life 2g. Please state what yu intend t d with the registered sealed surces at the end f life It is imprtant that yu cnsider hw the registered sealed surce(s) will be dealt with when they reach the end f their useful lives r yu n lnger have any use fr them. SEPA recgnises that circumstances may changes during the curse f keeping and using the surce(s), and this will be part f the rutine inspectins that SEPA undertakes t ensure that these plans change accrdingly. The mst cmmn apprach is t plan t dispse f the surce(s) in accrdance with the Radiactive Substances Exemptin (Sctland) Order 2011, as amended. Safe management f high activity surce(s) (HASS) 2h. Please prvide details f the arrangements fr the safe management f any registered sealed surces that are als High-activity surces (HASS) Details f the prvisin f a financial security r any ther equivalent means apprpriate t the registered sealed surce in questins, fr the safe management f surces when they becme disused surces must be prvided befre a registratin cntaining HASS can be issued by SEPA. If suitable financial prvisin is nt yet in place, yu must prvide the date n which it is expected t be in place. Examples f suitable arrangements include: A dcumented agreement with the manufacturer r supplier t take back the surce; r A dcumented agreement by a public bdy that the dispsal will be underwritten by that public bdy (e.g. Department f Health). Other frms f financial prvisin may be acceptable t SEPA. Yu shuld discuss these requirements at the earliest pprtunity with SEPA in rder t facilitate the applicatin. 11

12 Sectin 3 Additinal Infrmatin Supprting Dcuments and Attachments 3a Please list any and all supprting dcuments r additinal pages supplied In this sectin, SEPA expects the fllwing infrmatin t be included with the cmpleted applicatin frm: In mst cases, ne site plan shwing the lcatin f the site in relatin t its surrundings. The site plan must als delineate the site bundary by marking this clearly in red. It wuld be preferred if n ther markings n the plan were in red ther than the site bundary. The site plan scale must be sufficient t allw the lcatin t be identified and a clear distinctin t be made between the site and surrunding premises. Fr sites which cntain multiple buildings where registered sealed surces are kept (e.g. university campus), the site bundary must encmpass nly thse buildings where the surces are kept r used and exclude areas such as car parks and ther public areas; Nte: a site plan will NOT be required fr the fllwing applicatins: mbile radiactive apparatus registratins; cancellatins; variatin where this is n change t the site bundary; r fr ffshre installatins. Fr cancellatins SEPA expects t receive cpies f all transfer r dispsal recrds relating t the Registered Surces. Please refer t the Guidance n Decmmissining f Nn-Nuclear Facilities dcument n SEPA s website fr further infrmatin. If applicable, a list f the additinal sheets and/r ther supprting infrmatin that has been attached t the applicatin. All separate sheets must be clearly marked with the name and address f the applicant. Natinal Security and Trade Secrets 3b Please infrm us abut any Natinal Security r Cmmercial in Cnfidence Claim Natinal Security - under the Radiactive Substances (Natinal Security) (Sctland) Certificate and Directin 2009, SEPA must nt include infrmatin relating t applicatins r registratins under sectin 7 r 10 f RSA93 in registers f infrmatin made accessible t the public. In keeping with this Directin, SEPA cnsiders all cmpleted sealed surce 12

13 registratin applicatin frms t fall within the scpe f the Directin and will deal with such infrmatin accrdingly. SEPA wuld urge all applicants and their agents t be aware f the sensitivity f the infrmatin cntained within the applicatin and t take suitable precautins t prevent the lss r theft f that infrmatin. Infrmatin security will be a requirement f the registratin. If yu have any queries n hw this infrmatin shuld be handled, the applicant is urged t cntact SEPA at the earliest pprtunity. Althugh SEPA cnsiders a cmpleted applicatin t fall within the scpe f the Directin and will nt place it n the public register, there is a pssibility that knwledge f the applicatin r its cntents may have ther Natinal Security implicatins. If yu believe this t be the case, tick the yes bx, but d nt write anything else n the applicatin frm. Yu shuld cntact SEPA befre submitting the applicatin t discuss the requirements fr determining such a claim. Trade Secrets - yu may claim that yur applicatin includes infrmatin that needs t be prtected n the grunds f it being a trade secret r cmmercially cnfidential. If yu believe there is any infrmatin in yur applicatin that shuld be kept frm the public register fr reasns f it being a trade secret (in additin t it being excluded frm the public register by dint f the Natinal Security Directin), please tick the yes bx, but d nt write anything n the applicatin frm that reveals this infrmatin. Yu shuld cntact SEPA befre submitting the applicatin t discuss the requirements fr determining such a claim. Remittance Infrmatin 3c Please prvide payment details fr applicatin fee Mst applicatins will attract an applicatin fee, althugh sme applicatins will nt. Fr mre infrmatin n the fee (r the reasn why n fee is required) and the acceptable means f paying, please refer t the Radiactive Substances Fees and Charges Scheme fr the current year which is available frm SEPA s website. If yu have any dubt, please cntact SEPA befre submitting the applicatin. On the applicatin, please indicate whether yur applicatin requires a fee (if nt, why), the amunt paid and the methd f payment used. Declaratin This sectin must be signed by a persn that is authrised t sign n the applicant s behalf. 13

14 If the declaratin is being signed by smene utside f the applicant s rganisatin, he/she will als need t prvide written evidence that they have been authrised t sign in that capacity. Any persn named n the applicatin frm, such as under 1e, 1f, 1g r 1h shuld be infrmed that they have been s named and the cntents f SEPA s Data Prtectin Ntice made knwn t them. 14
