2 Page 2 f 8 RATIONALE It is the plicy f Fairhlme Cllege t cnduct its activities in such a manner that will prvide a wrk envirnment, which s far as is practicable: Places the safety f the staff and the public ahead f the prtectin f the Cllege equipment and services; and Actively encurages safe wrking practice bth at the Cllege and at hme. DEFINITIONS Definitins relevant t this plicy include: Persn Cnducting a Business r Undertaking (PCBU): a business r an undertaking that is either cnducted alne r with thers, whether r nt fr prfit r gain. A PCBU can be: a sle trader (fr example a self-emplyed persn) a partnership a cmpany an unincrprated assciatin a gvernment department a public authrity (including a municipal cuncil). An elected member f a municipal cuncil acting in that capacity is nt a PCBU. Wrker: emplyees, cntractrs, subcntractrs, utwrkers, apprentices and trainees, wrk experience students, vlunteers and PCBUs wh are individuals if they perfrm wrk fr the business. Officer: fr a crpratin, partnership r unincrprated assciatin is as defined in sectin 9 f the Crpratins Act 2001 (Cth), and includes a persn: wh makes, r participates in making decisins that affect the whle r a substantial part f the business has the capacity t significantly affect the crpratin's financial standing n whse instructins the directrs f the crpratin are accustmed t act. Due Diligence: emphasises the crprate gvernance respnsibilities f fficers. Officers f crpratins and unincrprated bdies will need t shw that they have taken reasnable steps t: acquire and update their knwledge f health and safety matters understand the peratins being carried ut by the persn cnducting the business r undertaking in which they are emplyed, and the hazards and risks assciated with the peratins ensure that the persn cnducting the business r undertaking has, and uses, apprpriate resurces and prcesses t eliminate r minimise health and safety risks arising frm wrk carried ut ensure that the persn cnducting the business r undertaking has apprpriate prcesses in place t receive and respnd prmptly t infrmatin regarding incidents, hazards and risks ensure that the persn cnducting the business r undertaking has, and uses, prcesses fr cmplying with duties r bligatins under the Wrk Health and Safety Act 2011 (Qld) (the WHS Act ) and fr verifying cmpliance with thse duties.
3 Page 3 f 8 Health and Safety Representative (HSR): a wrker wh has been elected by a wrk grup t represent them n health and safety issues. Reasnably practicable: means that which is, r was at a particular time, reasnably able t be dne t ensure health and safety, taking int accunt and weighing up all relevant matters including: the likelihd f the hazard r the risk cncerned ccurring the degree f harm that might result frm the hazard r the risk what the persn cncerned knws, r ught reasnably t knw, abut the hazard r risk, and ways f eliminating r minimising the risk the availability and suitability f ways t eliminate r minimise the risk after assessing the extent f the risk and the available ways f eliminating r minimising the risk, the cst assciated with available ways f eliminating r minimising the risk, including whether the cst is grssly disprprtinate t the risk. Dangerus Incident: A dangerus incident is an incident in relatin t a wrkplace that expses a wrker r any ther persn t a serius risk t a persn's health r safety emanating frm an immediate r imminent expsure t: an uncntrlled escape, spillage r leakage f a substance an uncntrlled implsin, explsin r fire an uncntrlled escape f gas r steam an uncntrlled escape f a pressurised substance electric shck the fall r release frm a height f any plant, substance r thing the cllapse, verturning, failure r malfunctin f, r damage t, any plant that is required t be authrised fr use in accrdance with the regulatins the cllapse r partial cllapse f a structure the cllapse r failure f an excavatin r f any shring supprting an excavatin the inrush f water, mud r gas in wrkings, in an undergrund excavatin r tunnel the interruptin f the main system f ventilatin in an undergrund excavatin r tunnel any ther event prescribed under a regulatin; but des nt include an incident f a prescribed kind.
4 Page 4 f 8 Serius Injury r Illness: The Wrk Health and Safety Act 2011 (Qld) and the Safety in Recreatinal Water Activities Act 2011 (Qld) set ut that a serius injury r illness f a persn is: an injury r illness requiring the persn t have immediate treatment as an in-patient in a hspital immediate treatment fr the amputatin f any part f his r her bdy a serius head injury a serius eye injury a serius burn the separatin f his r her skin frm an underlying tissue (such as deglving r scalping) a spinal injury the lss f a bdily functin serius laceratins medical treatment (treatment by a dctr) within 48 hurs f expsure t a substance any infectin t which the carrying ut f wrk is a significant cntributing factr, including any infectin that is reliably attributable t carrying ut wrk with micr-rganisms that invlves prviding treatment r care t a persn that invlves cntact with human bld r bdy substances that invlves handling r cntact with animals, animal hides, skins, wl r hair, animal carcasses r animal waste prducts RESPONSIBILITIES Fairhlme acknwledges that a duty under the legislatin cannt be transferred r delegated t anther persn. Fairhlme Cllege als acknwledges that in accrdance with the legislatin: Mre than ne persn can cncurrently have the same duty Each duty hlder must cmply with that duty t the standard required by the legislatin even if anther duty hlder has the same duty If mre than ne persn has a duty fr the same matter, each persn retains respnsibility fr their duty in relatin t the matter; and must discharge their duty t the extent t which they have the capacity t influence and cntrl the matter r wuld have had that capacity but fr an agreement r arrangement purprting t limit r remve that capacity; and must, s far as is reasnably practicable, cnsult, cperate and crdinate activities with all ther persns wh have a duty in relatin t the same matter The specific rles and respnsibly f a Persn Cnducting a Business r Undertaking, Officers, Wrkers and Other Persns are utlined belw.
5 Page 5 f 8 Persn Cnducting a Business r Undertaking In its legal rle as a Persn Cnducting a Business r Undertaking, Fairhlme Cllege must undertake its rle and respnsibilities under the legislatin as fllws: Fairhlme Cllege will ensure, s far as is reasnably practicable, the health and safety f: Wrkers engaged, r caused t be engaged by the Cllege; and Wrkers whse activities in carrying ut wrk are influenced r directed by the Cllege; while they are at wrk in the Cllege. Fairhlme Cllege will ensure, s far as is reasnably practicable, that the health and safety f ther persns is nt put at risk frm wrk carried ut as part f the cnduct f the Cllege. Fairhlme Cllege will als ensure, s far as is reasnably practicable the prvisin and maintenance f a wrk envirnment withut risks t health and safety; and the prvisin and maintenance f safe plant and structures; and the prvisin and maintenance f safe systems f wrk; and the safe use, handling and strage f plant, structures and substances; and the prvisin f adequate facilities fr the welfare at wrk f wrkers in carrying ut wrk fr the Cllege, including ensuring access t thse facilities; and the prvisin f any infrmatin, training, instructin r supervisin that is necessary t prtect all persns frm risks t their health and safety arising frm wrk carried ut as part f the cnduct f the Cllege; and that the health f wrkers and the cnditins at the Cllege are mnitred fr the purpse f preventing illness r injury f wrkers arising frm the cnduct f the Cllege. If a wrker ccupies accmmdatin that is wned by r under the management r cntrl f Fairhlme and the ccupancy is necessary fr the purpses f the Wrker s engagement because ther accmmdatin is nt reasnably available; Fairhlme Cllege will, s far as is reasnably practicable, maintain the premises s that the wrker ccupying the premises is nt expsed t risks t health and safety. Fairhlme Cllege will ensure, s far as is reasnably practicable, that the Cllege, the means f entering and exiting the Cllege and anything arising frm the Cllege are withut risks t the health and safety f any persn. Fairhlme Cllege will ensure, s far as is reasnably practicable, that the fixtures, fittings and plant are withut risks t the health and safety f any persn. Fairhlme Cllege will ensure the prvisin f cnsultatin, cperatin and issue reslutin in relatin t wrk health and safety as required under the relevant prvisins f the legislatin Fairhlme Cllege will wrk twards ensuring cmpliance when reprting ntifiable incidents under the relevant prvisins f the legislatin
6 Page 6 f 8 Officers In their legal rle as Officers, Fairhlme Cllege Bard Members, Principal and Leadership Team must undertake their rle and respnsibilities under the legislatin as fllws: If Fairhlme Cllege has a duty r bligatin under the legislatin, an Officer will exercise due diligence t ensure that the Cllege cmplies with that duty r bligatin. Due diligence includes taking reasnable steps t acquire and keep up-t-date knwledge f wrk health and safety matters; and t gain an understanding f the nature f the peratins f Fairhlme Cllege and generally f the hazards and risks assciated with thse peratins; and t ensure that Fairhlme Cllege has available fr use, and uses, apprpriate resurces and prcesses t eliminate r minimise risks t health and safety frm wrk carried ut as part f the cnduct f the Cllege; and t ensure that Fairhlme Cllege has apprpriate prcesses fr receiving and cnsidering infrmatin regarding incidents, hazards and risks and respnding in a timely way t that infrmatin; and t ensure that Fairhlme Cllege has, and implements, prcesses fr cmplying with any duty r bligatin f the Cllege under the legislatin; and t verify the prvisin and use f the resurces and prcesses mentined abve. Wrkers In their legal rle as Wrkers, emplyees f Fairhlme Cllege, cntractrs and subcntractrs and their emplyees, emplyees f a labur hire cmpany wh has been assigned t wrk in the Cllege, utwrkers, apprentices, trainees, students gaining wrk experience and vlunteers, must undertake their rle and respnsibilities under the legislatin as fllws: take reasnable care fr his r her wn health and safety; and take reasnable care that his r her acts r missins d nt adversely affect the health and safety f thers; and cmply, s far as the Wrker is reasnably able, with any reasnable instructin that is given by Fairhlme Cllege t allw cmpliance with the legislatin; and c-perate with any reasnable plicy r prcedure f Fairhlme Cllege relating t health r safety at the Cllege, that has been ntified t Wrkers. Respnsibilities f Others at the Cllege In their legal rle as Other Persns at the Cllege, Bard Members, students, parents and visitrs, must undertake their rle and respnsibilities under the legislatin as fllws: take reasnable care fr his r her wn health and safety; and take reasnable care that his r her acts r missins d nt adversely affect the health and safety f thers; and cmply, s far as the persn is reasnably able, with any reasnable instructin that is given by Fairhlme Cllege.
7 Page 7 f 8 IMPLEMENTATION In practice, Fairhlme Cllege s cmmitment t prtecting Wrkers and Other Persns against harm t their health and safety means that it will implement the fllwing measures: A risk management prcess Prvide infrmatin, training, instructin and supervisin Prvide a prcess fr cnsultatin, cperatin and issue reslutin Risk Management Prcess Fairhlme Cllege Risk Management Plicy prvides further guidance n the prcess and apprach t managing risks at the Cllege. Prvide Infrmatin, Training, Instructin and Supervisin In accrdance with the legislatin, Fairhlme Cllege will ensure that apprpriate infrmatin, training, instructin and supervisin is prvided t Wrkers t enable them t perfrm their wrk withut risk t their health r safety, as far as is reasnably practicable. This infrmatin, training, instructin and supervisin will be suitable and adequate, having regard t: The nature f the wrk carried ut by the Wrker; and The nature f the risks assciated with the wrk at the time the infrmatin, training, instructin r supervisin is prvided; and The cntrl measures implemented. Fairhlme Cllege will ensure, s far as is reasnably practicable, that the infrmatin, training and instructin is prvided in a way that is readily understandable by any persn t whm it is prvided. Fairhlme Cllege s Risk Management Plicy prvides further guidance n the infrmatin, training, instructin and supervisin prvided t Wrkers at the Cllege. Structures t further supprt these aims are cntained in the wrk undertaken by the cmmittees acknwledged in the Cmpliance and Mnitring sectin verleaf. Prvide fr Cnsultatin, C-peratin and Issue Reslutin Fairhlme Cllege acknwledges its duty t cnsult, s far as is reasnably practicable, with wrkers wh carry ut wrk fr the business r undertaking, wh are r are likely t be, directly affected by a matter relating t wrk health r safety. Where mre than ne persn has a duty fr the same matter, each persn, must, s far as is reasnably practicable, cnsult, cperate and crdinate activities with all ther persns wh have a duty in relatin t the same matter Fairhlme Cllege will cnsult with Wrkers in relatin t the fllwing health and safety matters in accrdance with the legislatin: when identifying hazards and assessing risks t health and safety arising frm the wrk carried ut r t be carried ut by the Cllege; when making decisins abut ways t eliminate r minimise thse risks; when making decisins abut the adequacy f facilities fr the welfare f Wrkers; when prpsing changes that may affect the health r safety f Wrkers; when making decisins abut the prcedures fr cnsulting with Wrkers; r
8 Page 8 f 8 reslving wrk health r safety issues at the wrkplace; r mnitring the health f Wrkers; r mnitring the cnditins at any wrkplace under the management r cntrl f Fairhlme Cllege; r prviding infrmatin and training fr Wrkers; r when carrying ut any ther activity prescribed under the relevant legislatin. When cnsulting with Wrkers, Fairhlme Cllege will ensure that: that relevant infrmatin abut the matter is shared with Wrkers; and that Wrkers be given a reasnable pprtunity t express their views and t raise wrk health r safety issues in relatin t the matter; and t cntribute t the decisin-making prcess relating t the matter; and that the views f Wrkers are taken int accunt by Fairhlme Cllege; that the Wrkers cnsulted are advised f the utcme f the cnsultatin in a timely way; and that recrds f the cnsultatin prcess and utcme are kept Fairhlme Cllege Dispute Reslutin Plicy and Prcedures prvide further guidance n reslving wrk health and safety issues. COMPLIANCE AND MONITORING In line with the legislatin and its duties, Fairhlme Cllege is cmmitted t mnitring the health f wrkers and the cnditins at the Cllege. Fairhlme Cllege has implemented an nline Incident Reprting Frm which requires Wrkers and Other Persns t reprt any hazards r incidents resulting in ptential r actual harm t health and safety. Fairhlme Cllege will regularly mnitr, cllate and reprt n hazards and incidents in accrdance with the legislatin. Grups in the Cllege wh are key in mnitring fr cmpliance include the Wrk Health and Safety Cmmittee, Internal Risk Cmmittee and the fllwing Bard Cmmittees Cmpliance and Risk Management Cmmittee and the Prject and Finance Cmmittee. Fairhlme Cllege is cmmitted t reprting ntifiable incidents t Wrkplace Health and Safety Queensland in accrdance with the legislatin. Ntifiable incidents include the death, serius injury r illness f a persn r a dangerus incident, arising ut f the cnduct f the Cllege.
