5 Page 5 f 27 1 GENERAL 1.1 INTRODUCTION HIAPL have develped this (DAMP), cvering emplyees wh perfrm, r are available t perfrm, a safety-sensitive aviatin activity (SSAA), t ensure the safety f Hbart airprt and its users. The aim f a DAMP is t minimise the risk f accident, incident r injury in the wrkplace due t the cnsumptin f alchl and ther drugs (AOD). This dcument sets ut hw HIAPL implements its DAMP. It is an imprtant dcument that all emplyees shuld be familiar with. Nte: SSAA is defined in sectin 33 (1) f the Civil Aviatin Act 1988 as activities that impact directly r indirectly n the safety f civil air peratins in Australian territry; r the peratin f Australian aircraft utside Australian territry. The specific categries f HIAPL emplyees t which this DAMP applies are set ut in sectin 1.5 Applicatin belw. 1.2 HIAPL DRUG AND ALCOHOL POLICY Pty Ltd is cmmitted t ensuring staff are prvided with a safe, prductive and supprtive wrk envirnment. Excessive use f Drugs and Alchl in the wrkplace may increase the likelihd f incident and have a negative effect n health, safety and prductivity. HIAPL will wrk t reduce the risk f accident, incident and injury at Hbart Airprt arising frm the cnsumptin f drugs and alchl by: Prhibiting the use f illicit drugs Prhibiting the cnsumptin f alchl whilst n the jb Prviding wrkers with drug and alchl educatin Prviding supprt t wrkers with issues relating t drugs and alchl

6 Page 6 f DISCIPLINARY ACTION HIAPL will investigate each individual DAMP infringement and determine the apprpriate curse f actin based n the facts prvided fr each case. 1.4 KEY CONTACTS DAMP cntact fficer HIAPL has appinted the fllwing DAMP cntact fficer. 7 Page 7 f 27 The purpse f this DAMP is t detail HIAPLs prcesses fr managing drugs and alchl in the wrkplace The plan utlines the prcess fr drug and alchl testing, dealing with psitive test results, supprt and rehabilitatin and drug and alchl awareness training. 1.6 WHO IS COVERED BY THIS DAMP? This DAMP applies t all HIAPL emplyees wh perfrm, r are available t perfrm, a SSAA. These emplyees include: Individuals emplyed directly by HIAPL Cntractrs engaged by HIAPL Subcntractrs engaged by cntractrs f HIAPL Individuals emplyed by thse cntractrs and subcntractrs Vlunteers f HIAPL. Visitrs f HIAPL In this DAMP, the individuals listed abve are all referred t as SSAA emplyees even thugh they may nt be directly emplyed by HIAPL. 1.7 DAMP CONTENT This DAMP cmprises three key elements: Drug and alchl educatin prgram (see further sectin 2). Drug and alchl testing prgram (see further sectin 3). Drug and alchl respnse prgram (see further sectin 4). 1.8 RESPONSIBILITIES UNDER THIS DAMP Respnsibilities f HIAPL HIAPL will: make this DAMP available t each SSAA emplyee befre they begin t perfrm, r becme available t perfrm, a SSAA prvide peridic reprts t CASA abut its administratin f this DAMP r its dealings with its SSAA emplyees wh have been subject t AOD testing nt permit a SSAA emplyee t perfrm, r be available t perfrm, a SSAA in any f the fllwing circumstances: 1. If a DAMP supervisr has reasnable grunds t believe that the emplyee may be adversely affected by AOD. 2. If HIAPL determine that a drug and alchl test is required after an accident r serius incident has ccurred which invlved the emplyee, while he r she is perfrming r available t perfrm a SSAA, and either:

8 Page 8 f 27 a. fr the perid that suitable test cnditins exist fr cnducting AOD tests n the emplyee a test has nt been cnducted; r b. if tests have been cnducted HIAPL has nt been ntified f the test results. 3. If a SSAA emplyee has been required t cease perfrming, r being available t perfrm, his r her SSAA duties because f an incident related t AOD t nt permit that SSAA emplyee t again perfrm r be available t perfrm SSAA until all mandatry pre-cnditins have been met Respnsibilities f SSAA emplyees f HIAPL SSAA emplyees f HIAPL: must nt perfrm, r be available t perfrm, a SSAA if adversely affected by AOD are subject t AOD testing under this DAMP while perfrming, r being available t perfrm, a SSAA fr HIAPL will be required t prvide a bdy sample if they are t be tested fr AOD by HIAPL r by CASA fr the purpses f cnducting such tests must immediately cease perfrming, r being available t perfrm, a SSAA if he r she: returns a psitive result fr an AOD test fails t cmply with a request by an apprved tester t prvide a bdy sample fr CASA AOD testing fails t cmply with a request t prvide a bdy sample fr HIAPLAOD testing under this DAMP; r interferes with a bdy sample they prvide fr AOD testing by CASA r HIAPL. if required t cease perfrming, r being available t perfrm, SSAAs because f an incident related t AOD use must nt again perfrm r be available t perfrm SSAA until all mandatry pre-cnditins have been met; and are encuraged t disclse t HIAPL if they have cnsumed a level f alchl, r have taken any drug, that may adversely affect their ability t carry ut a SSAA Respnsibilities f DAMP supervisrs DAMP supervisrs have been trained n hw t frm an pinin as t whether an rganisatin s emplyee may be adversely affected by AOD and are authrised by HIAPL t frm such an pinin in apprpriate cases.

9 Page 9 f 27 2 DRUG AND ALCOHOL EDUCATION PROGRAM 2.1 OVERVIEW HIAPL will ensure that all SSAA emplyees and DAMP supervisrs cmplete HIAPL s drug and alchl educatin prgram when they first jin the rganisatin and befre they perfrm, r are available t perfrm, a SSAA. Where required, HIAPL will prvide refresher drug and alchl educatin t SSAA emplyees at an interval f n lnger than 30 mnths since cmpletin f the previus drug and alchl educatin prgram. 2.2 COMPONENTS OF THE EDUCATION PROGRAM HIAPL s drug and alchl educatin prgram cntains the fllwing cmpnents: Fr SSAA emplyees awareness f: the rganisatin s plicy n AOD use AOD testing in the wrkplace supprt and assistance services fr peple wh engage in prblematic AOD use infrmatin abut the ptential risks t aviatin safety frm prblematic AOD use. Additinally fr DAMP supervisrs educatin and training t identify and manage emplyees wh engage in prblematic AOD use. 2.3 HIAPL DRUG AND ALCOHOL EDUCATION PROGRAM Frms f Educatin This DAMP will cnsist f three frms f educatin. These are: 1. DAMP Awareness Training DAMP Awareness training is prvided as part f the HIAPL Cntractr inductin. Any persn wrking fr HIAPL must cmplete this inductin prir t beginning wrk. 2. Full DAMP Educatin Full DAMP educatin will be prvided t all peple wrking fr HIAPL wh classify as a regular SSAA Emplyee. 3. DAMP Supervisr Educatin DAMP Supervisr educatin will be prvided t all HIAPL staff that perfrm the rle f DAMP Supervisr Wh will be Educated? Any persn wh is classified as a Regular SSAA emplyee will be required t undertake the full DAMP Educatin prvided by CASA Aviatin Wrx. DAMP Awareness will be prvided t all peple wrking fr HIAPL, including: Individuals emplyed directly by HIAPL

10 Page 10 f 27 Cntractrs engaged by HIAPL Subcntractrs engaged by cntractrs f HIAPL Individuals emplyed by thse cntractrs and subcntractrs Vlunteers f HIAPL. Any persn selected by HIAPL t perfrm the rle f DAMP Supervisr will be prvided with specific DAMP Supervisr training available n the CASA Aviatin Wrx website Hw will Educatin be prvided? DAMP Awareness Training The DAMP Awareness training is prvided as part f the HIAPL cntractr inductin. The HIAPL Cntractr Inductin is available t all peple n the internet at Full DAMP Educatin Full DAMP Educatin will be prvided t Regular SSAA Emplyees thrugh the CASA Aviatin Wrx website. Regular SSAA Emplyees will be required t cmplete the AOD Managing the Risk training curse available n the website DAMP Supervisrs DAMP Supervisrs will cmplete the AOD-DAMP Supervisr training prvided by CASA. This training mdule can be fund n the CASA Aviatin Wrx website at Educatin Recrds DAMP Awareness Recrds As the DAMP Awareness is part f the HIAPL Cntractr Inductin, the HIAPL Inductin register will be used t maintain a recrd f thse wh have cmpleted this training. Full DAMP Educatin Thse wh cmplete the DAMP educatin nline will be prvided with a certificate. A cpy f the certificate shall be prvided t HIAPL and will be stred n the HIAPL server. Recrds f thse wh have cmpleted the full DAMP Educatin will be kept n an excel spreadsheet n the HIAPL server. DAMP Supervisrs Recrds f thse wh have cmpleted the AOD-DAMP Supervisr training will be managed via an excel spread sheet saved n the HIAPL server. All persns wh cmplete the AOD-DAMP Supervisr training will be required t prvide HIAPL with a cpy f their certificate f cmpletin which will be filed n the HIAPL server.

11 Page 11 f 27 3 DRUG AND ALCOHOL TESTING PROGRAM 3.1 TESTABLE SUBSTANCES Tests will be cnducted fr the fllwing substances: 1. Alchl 2. Opiates 3. Cannabinids 4. Ccaine 5. Amphetamines 3.2 HOW WILL TESTING BE CONDUCTED? AOD testing under this DAMP will be cnducted as fllws: breath testing fr alchl using a device that meets either f the fllwing standards: Standard AS 3547, breath alchl testing devices fr persnal use Standard NMI R 126, Pattern Apprval Specificatins fr Evidential Breath Analysers fr urine testing fr drugs in accrdance with standard AS/NZS 4308 Prcedures fr specimen cllectin and the detectin and quantitatin f drugs f abuse in urine. All testing will be perfrmed in line with the requirements set ut in CASR Part 99B 3.3 WHEN WILL TESTING BE CONDUCTED? AOD testing f all SSAA emplyees under this DAMP will be cnducted in the fur fllwing circumstances When first jining HIAPL An emplyee will be AOD tested when they first jin HIAPL, if they will be wrking as a regular SSAA emplyee (see Attachment A fr definitin), r when the rle f an existing emplyee is t change t that f a regular SSAA emplyee, unless: the emplyee has been AOD tested less than 90 days befre the emplyee is required t begin perfrming r being available t perfrm a SSAA; and the test results were nt psitive After an accident r serius incident A SSAA emplyee may be tested after an accident r serius incident that ccurs whilst they are perfrming, r available t perfrm, a SSAA, prvided that suitable test cnditins exist and HIAPL determine that there is reasnable cause that a test is required. Suitable test cnditins exist where, after an accident r serius incident, testing can be cnducted: within 32 hurs f the accident r incident fr drug testing

12 Page 12 f 27 within 8 hurs f the accident r incident fr alchl testing; and it is practicable t cnduct a test DAMP supervisr - reasnable grunds A SSAA emplyee will be tested if a DAMP supervisr has reasnable grunds t believe the SSAA emplyee may be adversely affected by AOD while perfrming, r being available t perfrm, a SSAA On return t wrk fllwing a suspensin event A SSAA emplyee will be tested if they are returning t wrk after a perid during which that emplyee was nt permitted t perfrm, r be available t perfrm a SSAA, because: the emplyee has recrded a psitive result fr a cnfirmatry drug test r a cnfirmatry alchl test cnducted under HIAPLs DAMP r as a result f CASA testing and a DAMP MRO has nt determined that the result culd be the result f legitimate therapeutic treatment r sme ther inncuus surce. If the rganisatin is aware that a SSAA emplyee, after having been required t take a drug r alchl test: refused t take the test; r interfered with the integrity f the test. 3.4 PERMITTED LEVELS Alchl The level f alchl is permitted is less than 0.02 grams f alchl in 210 litres f breath Drugs The permitted level fr each testable drug is specified in the fllwing table. Where an SSAA emplyee is required t perfrm a drug and alchl test, HIAPL will suggest the belw cntact fr testing n behalf f HIAPL: Diagnstic Services Pty Ltd (NATA Accreditatin number 2270)

13 Page 13 f 27 2/4 Kirksway Pl, Battery Pint, TAS 7004 Ph REFERRAL FOR TESTING HIAPL will prvide all peple wh require a Drug and Alchl test with a request frm and chain f custdy frm t Diagnstic Services Pty Ltd (Hbart Pathlgy). All peple perfrming a test at Diagnstics Services Pty Ltd under the HIAPL DAMP will need t prvide the tw frms upn arrival. A cpy f the referral frm is prvided at Attachment B and Attachment C. 3.7 DRUG AND ALCOHOL TEST RESULTS HIAPL require a cpy f Drug and Alchl test results fr all Regular SSAA Emplyees. It is the respnsibility f the persn undertaking the Drug and Alchl test r their cmpany t prvide HIAPL with a cpy f the test results Cnsent Frm Upn perfrming a Drug and Alchl Test at Diagnstics Services, the Regular SSAA Emplyee may sign a cnsent frm, t cnsent t Diagnstic Services prviding the Drug and Alchl test results directly t HIAPL Prvisin f Results Directly t HIAPL Drug and Alchl test may be prvided directly t HIAPL by the persn prviding the sample r their cmpany, if they d nt wish t sign the cnsent frm. 3.8 DAMP MEDICAL REVIEW OFFICER REQUIREMENTS HIAPL will cnsult a DAMP MRO in any f the fllwing three circumstances: 1. If a drug test cnducted under the DAMP returns a cnfirmatry drug test result fr a SSAA emplyee f the rganisatin that is a psitive result t determine if the presence and level f a testable drug detected by the test culd be a result f legitimate therapeutic treatment r sme ther inncuus surce (e.g. pain relief medicatin cntaining cdeine). 2. T review medical infrmatin cncerning a persn s failure t give a bdy sample fr drug r alchl testing because f a medical cnditin. 3. T determine if the emplyee is fit t resume perfrming r being able t perfrm a SSAA.

14 Page 14 f 27 4 DRUG AND ALCOHOL RESPONSE PROGRAM 4.1 CIRCUMSTANCES WHEN AN EMPLOYEE MUST CEASE SSAA HIAPL will nt permit a SSAA emplyee t perfrm, r be available t perfrm, a SSAA in any f the fllwing circumstances: 1. Where HIAPL is aware that a psitive result frm an initial AOD test has been recrded and the emplyee has nt, in respect f that test result, recrded a negative test result fr a cnfirmatry drug test. 2. Where HIAPL is aware that: a psitive result fr a cnfirmatry drug test has been recrded fr the emplyee; and a DAMP MRO has nt determined that the result recrded culd be because f legitimate therapeutic treatment r sme ther inncuus surce; and mandatry precnditins fr return t wrk have nt been met. 3. Where HIAPL is aware that: a psitive result fr a cnfirmatry drug test has been recrded fr the emplyee; and a CASA MRO has nt determined that the result recrded culd be as a result f legitimate therapeutic treatment r sme ther inncuus surce; and mandatry precnditins fr return t wrk have nt been met. 4. Where HIAPL is aware that : the SSAA emplyee subject t AOD testing has refused t take the test; r the SSAA emplyee subject t AOD testing has interfered with the integrity f the test. 5. If a DAMP supervisr suspects the SSAA emplyee s faculties may be impaired due t that persn being under the influence f AOD. 6. Where HIAPL determine a drug and alchl test is required after an accident r serius incident has ccurred invlving the SSAA emplyee while he r she is perfrming, r being available t perfrm, a SSAA and either: fr the perid that suitable test cnditins exist fr cnducting AOD tests n the emplyee a test has nt been cnducted; r if tests have been cnducted under suitable test cnditins HIAPL has nt been ntified f the test results. 4.2 RETURNING TO SAFETY SENSITIVE AVIATION ACTIVITIES Where HIAPL has nt permitted a SSAA emplyee t perfrm, r be available t perfrm, an SSAA as a result f an AOD related suspensin event, HIAPL will nly permit the emplyee t again begin perfrming r being available t perfrm a SSAA in the fllwing circumstances:

15 Page 15 f The emplyee has undergne a cmprehensive assessment fr AOD use; and 2. If the cmprehensive assessment recmmended that the emplyee cmmence an AOD interventin prgram the emplyee has begun participating in the nminated prgram; and 3. The emplyee is cnsidered fit t resume perfrming, r being available t perfrm, a SSAA by: a DAMP MRO; and the emplyee s treating clinician (if any). 4. If the suspensin event related t a drug test at the time the emplyee was cnsidered fit t resume perfrming SSAA activities, the emplyee receives a cnfirmatry drug test and recrds, fr the test, a result that: was nt a psitive result; and a DAMP MRO is satisfied the test indicates the absence f testable drug use Time ff t attend a nminated interventin prgram HIAPL may permit a SSAA emplyee time t attend a nminated AOD interventin prgram, if: 1. a DAMP MRO has advised HIAPL that the emplyee shuld attend the prgram; and 2. the emplyee is returning t wrk after a perid during which the emplyee was nt permitted t perfrm r be available t perfrm a SSAA because f a psitive AOD test result.

16 Page 16 f 27 5 PRIVACY The Privacy Act 1988 may apply t infrmatin gathered under this DAMP and infrmatin held in relatin t the utcmes f AOD testing, whether cnducted under the HIAPL r by CASA. The HIAPL s DAMP is cnsistent with the requirements f the Privacy Act 1988 and HIAPL infrmatin cllected under the DAMP. 6 DAMP REVIEW, AUDIT AND COMPLIANCE The HIAPL r their delegate will review this DAMP a minimum f nce every five years. The review shall take int accunt any feedback frm the HIAPL Bard, HIAPL Management Team and CASA as t the effectiveness f this prgram. Reviews f this prgram will als be cnducted at the directin CASA. T ensure the apprpriate develpment, implementatin and enfrcement f HIAPL s DAMP, CASA may audit HIAPL and require it t prvide relevant dcumentatin. 7 DAMP REPORTING AND RECORD KEEPING HIAPL will ensure it recrds and supplies infrmatin in respect f: drug and alchl testing drug and alchl educatin drug and alchl respnse the number f SSAA emplyees engaged details f the current DAMP cntact fficer These recrds will be prvided t CASA twice yearly (within 21 days f 1 March and 1 September each year), r as therwise required by CASA. Additinally, where requested t d s HIAPL will supply infrmatin abut the identity f a SSAA emplyee t a CASA apprved tester if requested. 7.1 RECORD KEEPING HIAPL will keep all recrds pertaining t this DAMP, including recrds that are used t prvide infrmatin t CASA, fr a perid f 5 years. This infrmatin will be kept n the HIAPL server, subject t rutine backup prcedures. 8 VARIATIONS HIAPL may implement variatins r amendments t this DAMP frm time t time and, where relevant, will prvide written ntice t its emplyees setting ut these changes.

18 Page 18 f 27 ATTACHMENT B Definitins Part 99 f the Civil Aviatin Safety Regulatins 1998 sets ut legal definitins fr varius terms used in that Part (see reg ). The definitins f key terms relevant t in this DAMP are reprduced belw. "accident" means an ccurrence that arises ut f a persn perfrming r being available t perfrm an applicable SSAA if either r bth f the fllwing applies: (a) the ccurrence results in the death f, r serius harm t, a persn; (b) the ccurrence results in serius damage t an aircraft r prperty. "aerdrme testing area" means: (a) any surface in a certified aerdrme r a registered aerdrme ver which an aircraft is able t be mved while in cntact with the surface f the aerdrme, including any parking areas; and (b) any part f the surface f a certified aerdrme r registered aerdrme: (i) that is nt cvered by paragraph (a); and (ii) that des nt have a building n it; and and used: (iii) frm which access t a surface mentined in paragraph (a) may be had; (c) a building lcated n a certified aerdrme r registered aerdrme that is (i) fr maintenance f an aircraft r an aernautical prduct; r (ii) fr the manufacture f aircraft r aernautical prducts; r (iii) by an air traffic service prvider t cntrl air traffic; r (iv) by the hlder f an AOC fr flying training; and (d) any part f an aircraft, aerbridge r ther mveable structure in a certified aerdrme r a registered aerdrme. "apprpriately qualified alchl and ther drug prfessinal" means a persn wh: and (a) materially wrks as a prvider f clinical drug and alchl treatment services;

19 Page 19 f 27 fields: (b) hlds a bachelr degree, r pstgraduate degree, in at least 1 f the fllwing (i) health sciences; (ii) medical science; (iii) scial sciences; (iv) behaviural sciences. "apprved breathalyser" means a breathalyser apprved by CASA under paragraph (a) fr alchl testing. "apprved drug testing device" means a device apprved by CASA under paragraph (b) fr testing fr testable drugs. "apprved labratry" means a persn authrised under subregulatin (3) t cnduct cnfirmatry drug tests fr Subpart 99.C. "apprved persn", in relatin t an apprved labratry, means a persn wh is authrised under the labratry's Natinal Assciatin f Testing Authrities accreditatin t declare the results f drug tests cnducted by that labratry. "CASA medical review fficer" means a medical practitiner wh fr drug and alchl testing under Subpart 99.C, and fr Subparts 99.E and 99.H has: (a) been appinted by CASA under subregulatin (1) fr the purpses f Subpart 99.C; and results; and (b) training and cmpetence in the field f interpreting drug and alchl test (c) knwledge f substance use disrders; and

"cmprehensive assessment", in relatin t a persn's drug r alchl use, means an examinatin f the persn's physilgical and psychscial indicatrs carried ut: (a) by a psychiatrist; r (b) by a medical practitiner wh is a Fellw f the Australasian Chapter f Addictin Medicine; r (c) jintly by: (i) a persn entitled t practice as a medical practitiner under a law f a State r Territry; and (ii) an apprpriately qualified drug and alchl prfessinal. "cnfirmatry alchl test" means an alchl test given in respect f an initial alchl test t determine the presence and level f alchl in a bdy sample. Nte: Act. See paragraph (b) f the definitin f drug r alchl test in subsectin 33 (1) f the "cnfirmatry drug test" means a drug test given in respect f an initial drug test t determine the presence and level f a testable drug in a bdy sample. "DAMP cntractr" means a persn, r the emplyee f a persn, wh is: (a) a party t an nging written r nging ral cntract with a DAMP rganisatin; r

"DAMP medical review fficer" means a medical practitiner wh fr drug r alchl testing under a DAMP has: (a) cmpetence in the field f interpreting drug and alchl test results; and (b) knwledge f substance use disrders; and (c) knwledge f the cntents f this Part. "DAMP rganisatin" means a persn that is required t have a DAMP under subregulatin (1). "DAMP reprting perid, " fr a DAMP rganisatin, means the perid f 6 mnths immediately befre each: (a) 1 March; and (b) 1 September. "DAMP subcntractr", means a persn wh is a party t: (a) an nging written r ral cntract with a DAMP cntractr within the meaning f paragraph (a) f the definitin f DAMP cntractr ; r (b) an nging written r ral cntract with anther DAMP subcntractr (under a previus applicatin f this definitin). "DAMP supervisr, in relatin t a DAMP rganisatin, means a persn wh: (a) has had relevant training t frm an pinin as t whether a persn may be adversely affected by a testable drug r under the influence f alchl; and (b) is authrised by the rganisatin t d s fr the purpses f paragraph (2)(c). "dnr" means a persn wh is asked t give, r has given, a bdy sample t an apprved tester.

22 Page 22 f 27 "drug and alchl educatin prgram", fr a DAMP rganisatin, means a prgram that includes the fllwing cmpnents: (a) fr SSAA emplyees--awareness f: (i) the rganisatin's plicy n drug and alchl use; and (ii) drug and alchl testing in the wrkplace; and (iii) supprt and assistance services fr peple wh engage in prblematic use f drugs and alchl; and (iv) infrmatin abut the ptential risks t aviatin safety frm prblematic use f drugs and alchl; (b) fr DAMP supervisrs--educatin and training t manage peple wh engage in prblematic use f drugs r alchl. "drug r alchl interventin prgram", in relatin t a persn wh has a drug r alchl prblem, means a prgram that includes any f the fllwing measures fr that prblem: (a) assessment; (b) treatment, including any f the fllwing: (i) educatin; (ii) cunselling; (iii) cnsultatin with health care prfessinals; (iv) pharmactherapy; (v) residential r nn-residential treatment prgrams; (c) mnitring and fllw-up actin. "emplyee", in relatin t a DAMP rganisatin, includes a DAMP cntractr f the DAMP rganisatin. "freign peratr" means: (a) the hlder f a freign aircraft AOC; r (b) the peratr f an aircraft perating in Australia in accrdance with a permissin granted by CASA under sectin 26 f the Act; r

23 Page 23 f 27 (c) the peratr f an aircraft perating under a permissin granted under sectin 27A f the Act; r (d) the hlder f a New Zealand AOC with ANZA privileges; r (e) the peratr f an aircraft that is perating in Australia in accrdance with sectin 14 f the Air Navigatin Act "initial alchl test" means an alchl test t determine the presence f alchl in a bdy sample. Nte: Act. See paragraph (a) f the definitin f drug r alchl test in subsectin 33 (1) f the "initial drug test" means a drug test t determine the presence f a testable drug in a bdy sample. Nte: Act. "passenger, " in relatin t an aircraft, means a persn: (a) wh: barded; r (i) intends t travel n a particular flight n the aircraft that has nt as yet (ii) is n bard the aircraft fr a flight; r (iii) has disembarked frm the aircraft fllwing a flight; and (b) wh is nt a member f the crew f the aircraft. "passprt" means an Australian passprt within the meaning f the Australian Passprts Act 2005, r a passprt issued by the Gvernment f a cuntry ther than Australia.

24 Page 24 f 27 "permitted level" means: (a) fr a testable drug--a level f the drug specified in subregulatin (2A) fr the purpses f this paragraph; and breath. (b) fr alchl--a level f alchl f less than 0.02 grams f alchl in 210 litres f "psitive result" means the fllwing: (a) fr an initial drug test--a test result within the meaning f paragraph (a) f the definitin f psitive test result in subsectin 33 (1) f the Act; (b) fr a cnfirmatry drug test--a test result within the meaning f paragraph (b) f the definitin f psitive test result in subsectin 33 (1) f the Act; (c) fr an initial alchl test--a test result within the meaning f paragraph (a) f the definitin f psitive test result in subsectin 33 (1) f the Act; (d) fr a cnfirmatry alchl test--a test result within the meaning f paragraph (b) f the definitin f psitive test result in subsectin 33 (1) f the Act. "regular SSAA emplyee" means a SSAA emplyee wh is reasnably likely t perfrm an applicable SSAA at least 2 r mre times every 90 days. "relevant Standard" means: (a) AS 3547, Breath alchl testing devices fr persnal use ; and and (b) NMI R 126, Pattern Apprval Specificatins fr Evidential Breath Analysers ; (c) AS 4760, Prcedures fr specimen cllectin and the detectin and quantitatin f drugs in ral fluid ; and (d) AS/NZS 4308, Prcedures fr specimen cllectin and the detectin and quantitatin f drugs f abuse in urine. "sample identifier" means a number allcated t a bdy sample using the methd specified in a legislative instrument made by CASA under regulatin "screening fficer" has the meaning given in the Aviatin Transprt Security Act 2004

25 Page 25 f 27 "serius incident" means an ccurrence that arises ut f a persn perfrming r being available t perfrm an applicable SSAA if either r bth f the fllwing applies: (a) the ccurrence gives rise t a danger f death r serius harm t a persn; prperty. (b) the ccurrence gives rise t a danger f serius damage t an aircraft r "SSAA" means a safety-sensitive aviatin activity. "SSAA emplyee", in relatin t a DAMP rganisatin, means an emplyee f the DAMP rganisatin wh perfrms r is available t perfrm an applicable SSAA. "substantial cmpliance", in relatin t a drug r alchl test, has the meaning given in subregulatin (2). "suitable test cnditins" has the meaning given by subregulatin (3). (3) Suitable test cnditins means cnditins that exist after an accident r serius incident if: (a) testing can be cnducted within: (i) fr drug testing--32 hurs after the accident r incident ccurred; and (ii) fr alchl testing--8 hurs after the accident r incident ccurred; and (b) it is practicable t cnduct a test.
