4 1.0 Statement f Intent 1.1 As a respnsible emplyer, Discvery Schls Academies Trust, further referred t as the Trust will hnur their legal bligatins, in particular the requirements f the Health and Safety at Wrk Act 1974 and assciated regulatins and cdes f practice. 1.2 The Trust recgnises and accepts its respnsibilities and duties as the emplyer t cnduct its peratins in a manner which prtects the health, safety and welfare f emplyees, students and visitrs s far as is reasnably practicable and versees the management f Health and Safety at the lcal level i.e. schls and partners f the trust. 1.3 In cmpliance with the Management f Health and Safety at Wrk Regulatins, risk assessments will be undertaken and arrangements made. Where significant risks are identified, the necessary preventative and prtective measures will be put int place s far as is reasnably practicable using a sensible risk management apprach. 1.4 The Trust and its schls are cmmitted t the preventin f accidents and ill health. 1.5 The Trust and its schls will wrk twards cntinual health and safety imprvement. 1.6 T achieve these bjectives, we will: Cnduct all ur activities safely and in cmpliance with legislatin and where pssible, best practice Prvide safe wrking cnditins and safe equipment Ensure a systematic apprach t identify risks is develped and implemented and sufficient resurces are allcated t cntrl them Prvide suitable infrmatin, instructin, training and supervisin Prmte a psitive health and safety culture that is demnstrated by pen cmmunicatin and a shared cmmitment t the imprtance f health, safety and welfare Prmte the principles f sensible risk management Mnitr, review and mdify this plicy and any arrangements as required. 1.7 All emplyees have a respnsibility t take reasnable care f themselves and thers and t cperate with their emplyer t ensure statutry duties and bligatins are fulfilled. 1

5 2.0 Lcal Organisatin Rles and Respnsibilities Discvery Schls Academies Trust 2.1 (Name f Schl) is a schl whereby the trust has verall respnsibility as the emplyer t ensure cmpliance with health and safety legislatin and t ensure the health, safety and welfare emplyees, pupils, visitrs and cntractrs and the self-emplyed. 2.2 The Trust is respnsible fr: Gvernance determining the schl's health and safety plicy and its implementatin establishing clear lines f accuntability fr health and safety peridically assessing the effectiveness f the plicy and ensure that any necessary changes are made identifying and evaluating risks relating t pssible accidents and incidents cnnected with the schl. prviding access t cmpetent health and safety advice 2.3 Withut limiting the respnsibility f the trust, gvernance will ensure that health and safety issues are discussed at grup meetings and plicy is adpted at lcal level. Plicy adptin t reflect lcal arrangements Head Teacher 2.4 Withut limiting the respnsibility f the trust, the Head Teacher will versee the day-t-day management f safety and implementatin f this plicy within the schl. 2.5 The Head Teacher will cmply with the health and safety plicy and in particular will: make themselves familiar with any dcumentatin and/r instructin referring t the health and safety arrangements fr staff, building maintenance r peratin f the Schl and maintain an up t date system f plicies, prcedures and risk assessments wrk with the executive team, trade unins and emplyee health and safety representatives and ensure that all emplyees are aware f and accuntable fr their specific health and safety respnsibilities and duties allcate sufficient funds fr health and safety 2

6 in the event f any hazard r risk t health and safety f any persns under their cntrl, take apprpriate actin t cntrl the hazard/risk and infrm the executive team f such hazards r risks in a timely manner ensure the health and safety plicy, prcedures, actin plan and risk management prgramme is implemented as an integral part f business, peratinal planning and service delivery liaise with the executive team t undertake mnitring and ensure the prvisin f adequate resurces t achieve cmpliance ensure that trust prcedures fr the selectin and mnitring f cntractrs are in place with supprt f the executive team, take apprpriate actin under the trust s disciplinary prcedures against anyne under their cntrl fund nt cmplying with health and safety plicies and/r prcedures liaise with the executive team t access cmpetent health and safety advice 2.6 In additin t their statutry duties, Head Teachers and teachers have a cmmn law duty f care fr pupils which stems frm their psitin in law in lc parentis. Senir Leadership Team 2.7 The leadership team at the schl will undertake general respnsibility t ensure that all necessary health and safety activities, requirements and standards are undertaken and met within their respective areas f cntrl. This will be dne under the directin f the Head Teacher and executive team. Any member f staff with supervisry respnsibilities will:- make themselves familiar with and cnfrm t this plicy, including any instructins and requirements fr safe methds f wrk identify new and existing hazards, initiate risk assessments, recrd the significant findings, implement any necessary cntrl measures and review these t ensure that they remain relevant in cnsultatin with the executive team check and dcument that the wrking envirnment is safe; equipment, prducts and materials are used safely; that health and safety prcedures are effective and cmplied with and that any necessary remedial actin is taken infrm, instruct, train, supervise and cmmunicate with emplyees and prvide them with equipment, materials and clthing as is necessary t enable them t wrk safely; wrk with the executive team t cmplete a health and safety inductin checklist fr all new emplyees at the cmmencement f their emplyment reprt all accidents, incidents and near miss events, undertake an investigatin int the cause and take apprpriate remedial actin t prevent recurrence be respnsible fr aspects f health and safety included in their jb descriptin rganise risk assessments where significant risks are identified and ensure as far as is reasnably practicable the implementatin f any cntrl measures ensure that all statutry registers and recrds are adequately kept ensure the reprting and investigatin f all accidents ensure all persns under their cntrl are aware f the reprting prcedure Office Managers and Premises Officers wrking with the Executive Team In additin t the respnsibilities abve Office Managers and Premises Officers have specific duties: t maintain an understanding f the Health and Safety Plicy arrangements and their respnsibilities detailed within them. 3

All staff are required t: take reasnable care fr their wn health and safety at wrk and f thse wh may be affected by their actins r by their missins cperate with their line manager and senir management t wrk safely cmply with health and safety instructins and infrmatin and undertake apprpriate health and safety training as required nt intentinally r recklessly interfere with r misuse anything prvided in the interests f health, safety and welfare reprt t their manager any health and safety cncerns, hazardus cnditin r defect in the health and safety arrangements supprt the Schl in embedding a psitive safety culture that extends t pupils and any visitrs t the site 4

8 carry ut Flick training as required Pupils 2.9 All pupils are expected t behave in a manner that reflects the schl s behaviur plicy and in particular are expected t:- Lettings take reasnable care fr their wn health and safety and f their peers, teachers, supprt staff and any ther persn that may be at the schl cperate with teaching and supprt staff and fllw all health and safety instructins given nt intentinally r recklessly interfere with r misuse anything prvided in the interests f health, safety and welfare reprt t a teacher r ther member f the schl staff any health and safety cncerns that they may have 2.10 The Trust has a lettings plicy which the schl adpts. The plicy cvers prcedures fr fire evacuatin and security arrangements and the requirements relating t accident, assault and near miss reprting requirements and the prvisin f first aid. Persns/rganisatins letting the site must agree t: c-perate and c-rdinate with the schl n health and safety matters agree t the terms f the lettings plicy in relatin t health and safety arrangements prvide infrmatin relating t any additinal risks r prcedures which will be new r unusual t thse f the schl that may arise frm their activities The schl will ensure that: the premises are in a safe cnditin fr the purpse f use the health and safety arrangements detailed in the lettings plicy are fully explained and cmmunicated t all individuals r grups letting a space/area f the schl premises adequate arrangements fr emergency evacuatin are in place and cmmunicated 5

9 3.0 Organisatinal Arrangements fr Health And Safety 3.1 The fllwing arrangements will be adpted t ensure the Trust and the Head Teacher fulfil their respnsibilities and prvide the fundatin fr securing the health and safety f emplyees and all users f the site Setting health and safety bjectives 3.2 The Executive Team and persnnel designated respnsibility by the Head Teacher will specifically review prgress f health and safety bjectives n a termly arrangement. Where necessary health and safety imprvements will be identified and included within the schl actin plan. Prvisin f effective health and safety training 3.3 The Trust and the Head teacher will cnsider health and safety training n an annual basis in line with the schl s health and safety training matrix, fcussing n mandatry training as a pririty. Prvisin f an effective jint cnsultative prcess 3.4 The executive team and the schl will meet at least nce per term t review health and safety prcesses and prcedures t create a clear actin plan, with identified respnsibilities and target dates. Establishing adequate health and safety cmmunicatin channels 3.5 Cmmunicatin channels will be established fr the exchange f health and safety knwledge and infrmatin. Where necessary, these cmmunicatins will be recrded and include: senir leadership team meetings and staff meetings site health and safety cmmittee prvisin f infrmatin relating t safe systems f wrk and risk assessments training prvided cmmunicatins with relevant specialist advisrs and bdies 3.6 Where health and safety issues cannt be reslved at lcal level, they will be escalated thrugh the management structure as apprpriate. Financial resurces 3.7 The Head teacher will review the schl budget with the grup finance fficer t determine, in the light f past perfrmance, if adequate resurces are being deplyed t ensure adequate health and safety management and cntrl. Specialist advice/supprt 3.8 The Trust will ensure that access t cmpetent technical advice n health and safety matters is prcured t supprt cmpliance with statutry duties and meeting health and safety bjectives; the trust will d this by; Accessing the services f a cmpetent Health and Safety Advisr thrugh Leicestershire Cunty Cuncil Health, Safety and Wellbeing Service 6

10 4.0 Organisatin - Other Arrangements Accident and assaults 4.1 All accidents, assaults and near miss incidents will be reprted in the accident bk r agreed reprting frm within 24 hurs f ccurrence; RIDDOR reprtable incidents, as per the HSE's Infrmatin Sheet (EDIS1), will be reprted t the HSE within the required timescales. 4.2 All incidents will be investigated in an attempt t identify the rt cause: relevant lcal plicies, prcedures and risk assessments will be reviewed and revised as required. All premises related issues will be addressed in a timely manner. Any relevant learning frm investigatins will be cmmunicated t relevant staff, pupils etc. 4.3 Accident, assaults and near miss incidents will be mnitred at least termly as part f the site health and safety cmmittee; identificatin f significant trends r majr incidents will be reviewed by the senir leadership team as required with infrmatin cmmunicated t the gverning bdy. 4.4 Accident recrds will be retained fr the fllwing perids; Pupil s recrds will be retained fr a perid f Date f Birth + 25 years, emplyee recrds will be retained frm the date f incident + 7 years and frms relating t wrk related ill health is current year + 10 years r lnger (40 years where there has been ptential expsure t asbests; where radiatin is the cause retentin is last actin + 50 years). Audit 4.5 The schl health and safety management will be audited annually by the executive team and by a cmpetent Health and Safety Advisr thrugh Leicestershire Cunty Cuncil Health, Safety and Wellbeing Service every tw years. The trust reviews this prcess as a psitive assessment f ur health and safety management system and takes apprpriate actin t cntinually imprve health and safety acrss the wider trust rganisatin. Cntractr management 4.6 The trust cmplies with the HSE's apprved cde f practice Cnstructin (Design and Management) Regulatins 2015' (L153) relating t the management and cntrl f cntractrs. The executive team wrking with the schl will ensure that: rles f client, principal designer, designer, principal cntractr, cntractr are understd and frmally allcated cmpetent cntractrs are used clear specificatins f wrks are drawn up by a cmpetent persn t include phases f the wrk, duratin, separatin f building and schl site, delivery times and lcatins, tapping int utilities, site security, fire and emergency crdinatin, fire escape rutes, accident reprting etc. pre start meetings take place t discuss hw wrks will be managed, respnsibilities, cdes f cnduct and t assess new hazards that may be intrduced t the site; including child safeguarding and inductin key cntacts are identified regular update meetings take place thrughut any wrks/prjects wrks are visually mnitred and any cncerns immediately reprted wrks are signed ff and any assciated certificatin and dcumentatin is btained 7

11 all staff/ pupils and ther users f site remain in a safe envirnment fr the duratin f the wrks. all cntractrs are given access t the asbests register all cntractrs t cmplete a cntractr site inductin sheet befre wrk can prceed Cntrl f hazardus substances 4.7 The trust cmplies with the HSE's apprved cde f practice Cntrl f Substances Hazardus t Health (L5) relating t the management and cntrl f hazardus substances n site. The executive team wrking with the schl will ensure: an inventry f all hazardus substances n site is kept and updated regularly wherever pssible nn-hazardus substances are used and if this is nt pssible the least harmful substance is used a COSHH risk assessment will be cmpleted fr all hazardus substances used and shared with relevant staff wherever pssible expsure t hazardus substances is prevented, where expsure cannt be prevented, a risk assessment will be carried ut and cntrls measures implemented where identified as part f the risk assessment, apprpriate PPE will be prvided t staff any requirement fr expsure mnitring r health surveillance will be carried ut sufficient infrmatin, instructin and training is given t staff t ensure full understanding f the hazards t health psed by substances in the wrkplace and the imprtance f cntrl measures prvided training recrds are maintained fr thse wh receive training infrmatin will als be given t thers wh may be affected, such as cntractrs, temprary staff and visitrs nly substances purchased thrugh the schls prcurement systems can be used n site substances are stred crrectly and thse that are n lnger used are dispsed f as per the substances safety data sheet COSHH risk assessments are mnitred quarterly and reviewed annually Dealing with health and safety emergencies - prcedures and cntacts 4.8 As per legal requirements all dangerus ccurrences and near miss incidents that are RIDDOR reprtable incidents, will be reprted t the HSE within the required timescale. 4.9 All incidents will be investigated in an attempt t identify the rt cause: relevant lcal plicies, prcedures and risk assessments will be reviewed and revised as required. All premises related issues will be addressed in a timely manner. Any relevant learning frm investigatins will be cmmunicated t relevant staff, pupils etc. Captain s Clse has a full Business Cntinuity plan t address emergency situatins. This is held by all key persnnel. Defect reprting 4.10 The schl has a defect reprting prcedure whereby any damage r defect t the premises, equipment r furnishings is reprted. Defective equipment is islated and labelled as defective t prevent use until replaced r repaired. Where premises defects are identified a dynamic assessment is carried ut t decide whether an area shuld be islated r crdned ff whilst awaiting repair. 8

12 Display screen equipment (DSE) 4.11 The schl acknwledges that staff wh use DSE shuld have suitable equipment t undertake the tasks that they are required t carry ut, knws hw t safely use the equipment and have a DSE assessment which is reviewed at suitable intervals. At that end the schl ensures that: Driving all static wrkstatins used by staff meet the minimum standards required equipment is maintained in gd wrking cnditin staff are aware f best practice in using DSE and issued with relevant infrmatin the the Flick nline training prvisin. staff whse rles require significant use f DSE are priritised fr individual assessment assessments are reviewed at least bi-annually, earlier if there are significant changes t equipment/layut individual health. a trained DSE assessr can be accessed thrugh the Leicestershire Traded Service (LTD) All staff that drive their wn cars fr wrk purpses must have a full UK driving licence, business insurance and maintain their vehicle in a rad wrthy cnditin. Annual licence and insurance checks are undertaken and dcumented. Electrical systems and equipment 4.13 The trust ensure that schls maintain and service electrical systems and equipment in line with statutry guidance and best practice. Electrical systems (hard wiring) is peridically inspected every 5 years by a cmpetent cntractr and recrds maintained; any remedial wrks recmmended are acted upn in a timely manner Prtable electric appliances have a prtable appliance test (PAT) carried ut, in line with HSE guidance 'Maintaining prtable electrical equipment in lw-risk envirnments' (INDG236), by a cmpetent cntractr with recrds maintained Frmal termly wrkplace inspectins are undertaken whereby all equipment is visually inspected. Staff are instructed t undertake a visual inspectin f equipment prir t use and nt t use any equipment that appears damaged r defective. The schl s defect reprting prcedure is fllwed as required. Fire safety 4.16 The trust is cmmitted t prviding a safe envirnment fr bth staff and pupils and by wrking with the executive team, the schl manages the risk f fire by ensuring: a cmprehensive fire risk assessment is in place, reviewed annually and any actins/imprvements identified are prgressed given cnsideratin t risk and cst a detailed fire and emergency evacuatin plan has been develped that clearly details actins t be taken when a fire is identified r suspected, individual respnsibilities and arrangements fr safe evacuatin, this will include the develpment f a Persnal Emergency Evacuatin Plan (PEEP) fr any persn requiring assistance in an evacuatin. statutry inspectins are carried ut n all fire related systems and equipment either by cmpetent cntractrs r in huse by trained staff all staff receive fire awareness training via the Flick nline training prtal that is regularly updated and fire marshals receive rle specific instructins 9

13 a fire drill is undertaken at least termly t practice evacuatin arrangements and t ensure that the evacuatin prcedure is carried ut successfully and as expected. A fire lg bk is kept and maintained First-aid and supprting pupils' medical cnditins 4.17 Adequate first aid arrangements are assessed, maintained and mnitred at the schl and fr all activities that the schl leads. The schl ensures that: Glass & Glazing the number f first aiders and appinted persns meets recmmendatins and adequate cver is available t cver fr annual leave and unexpected absences all first aiders and appinted persns hld a valid certificate f cmpetence, the schl maintains a register f all qualified staff and will arrange re-training as necessary first aid ntices are clearly displayed sufficient numbers f suitably stcked first aid bxes are available and checked peridically t ensure they are adequately stcked a suitable area is available fr the prvisin f first aid staff are regularly infrmed f first aid arrangements, thrugh inductin, teacher training days and the staff handbk which is issued annually where first aid has been administered this is recrded in the first aid treatment bk crrect reprting prcedures are fllwed including thse required under RIDDOR regulatins individual risk assessments have been carried ut which cnsider first aid prvisin fr lne wrkers and emplyees wh travel in wrks vehicles that carry passengers. infrmatin, instructin and training will be prvided t staff n any specific medical cnditins f pupils and the prcedures t fllw in case f an emergency children with medical cnditins will be cared fr in line with plicy medicatin shall be kept securely in line with the plicy 4.18 The schl will cmply with the Wrkplace (Health, Safety and Welfare) Regulatins 1992 and the Apprved Cde f Practice L24 as it relates t glass and glazing 4.19 The schl will survey its glass surfaces in drs, windws and dr side panels fr the presence f safety glass and where apprpriate will make remedial actins t install safety glass r film and have it suitably marked t that effect Grunds - Safety/Security Safety 4.20 The schl will ensure that there is safe access and egress frm the buildings and grunds including balancing the need fr security with the need fr emergency escape and ensure that there is a regime fr maintaining the grunds, perimeter demarcatin (where wned) and equipment e.g. utdr play equipment Security At Captain s Clse ur playgrund gates are lcked at 9am and 3:30pm Schl main gates will be lcked frm 9am t 3 pm and all visitrs must use the pass gate. 10

14 Staff shuld secure all external classrm drs are shut befre and after hurs when n-ne is present. All visitrs t schl site shuld sign in at the Office and be allcated a visitr badge. Staff in the playgrund classrm shuld be alert t entrance pints befre and after schl and use schl agreed emergency prcedures if required. Any staff r children wh require special access arrangements will be assessed and relevant risk assessments and arrangements in place. Husekeeping strage, cleaning & waste dispsal 4.21 The schl will ensure that there is suitable and sufficient strage including systems fr ensuring that items are included n an inventry and checked peridically where necessary fr safety The schl will ensure that there are systems in place fr cleanliness, t minimise the accumulatin f rubbish, fr the remval and dispsal f cntrlled waste and fr the cleaning f spills/ wet flrs t minimise the risk f slips. The schl will ensure that there are suitable and sufficient external waste bins secured frm the risks f arsn and tampering Where applicable and t accmmdate the requirements f envirnmental legislatin the schl will arrange fr suitable dispsal/recycling f relevant items e.g. flurescent lighting and waste electrical appliances Suitable arrangements will be made fr the clearing f snw as part f winter preparedness. Jewellery Pupils shuld nt wear any jewellery in schl except fr earring studs. These must be taped up by the child/parent fr PE. Lne wrking 4.25 The schl will ensure thrugh risk assessment that all staff wh wrk alne are given suitable instructin n lne wrking prcedures including cmmunicatins, emergency prcedures and any restrictins during lne wrking e.g. wrk at height. Management f asbests 4.26 The schl cmplies with the HSE's apprved cde f practice 'Managing and wrking with asbests, Cntrl f Asbests Regulatins 2012, Apprved Cde f Practice & Guidance (L143) and is cmmitted t preventing expsure t asbests fibres t all persns that enter nt its premises. T this end the schl has a whle site asbests management survey (previusly knwn as Type 2 survey) frm which a lcal asbests management plan (Lamp) has been develped.
