1 CONTINUATION OF THE "HOUSE RULES" UNDER ARTICLE VIII OF THE BY-LAWS FOLLOWING THE CONDOMINIUM OFFERING PLAN FOR CONDOMINIUM I AND II: AMENDED AND REVISED SEPTEMBER 1, Section 9. Flower pots/decorations/ornaments/american flags a) Homeowners may have the following type of items under the covered overhang at the front door only: flower pots, plants, potted shrubs, ornaments, bench, chair, or other appropriate decoration. These items do not have a maximum size requirement as long as they are contained under and within that overhang and do not in any way clutter or create a hazardous condition for homeowners and/or visitors that enter and exit the home. b) The items mentioned in (a) above may not at any time be hung on the walls, or trim of your unit, which includes hanging flower baskets, silver disks, streamers, etc. c) Planting of fruits, vegetables, or the placement of bird feeders, is absolutely prohibited in or on any common element of the exterior premises of your home. (The birds knock the bird seed to the ground in and around the entire area of the feeder and this seed will attract rodents such as mice, rats, squirrels, etc. Bird seed scattered on the lawn will also promote the growth of crabgrass and a number of other unwanted weeds.) Humming bird feeders are permissible inasmuch as the liquid is contained in a sealed glass bottle with pin hole type openings for the humming birds to place their beak and draw the liquid. d) Flower pots and ornamental items of any kind are not permitted to be placed on or hung along the rear sound wall and/or retaining walls. e) Ornamental items such as gnomes, statuary, flower pots, etc. are not permitted in the planting beds, stone beds, walkways, or driveways. Solar lights equally spaced and in an upright position along the front walkway is the only area where solar lights are permitted. f) American Flags are permitted on the lawn area in accordance with the below specifications in order to maintain uniformity throughout the community regarding size of pole, flag and location. Please note that if a homeowner elects to fly the U.S. flag, it is with the specific understanding that your flag must be flown in accordance with the U.S. Flag Code, which means that at dusk all flags must be taken down. The street light is not considered as a light on your individual flag. Please safeguard your flag on days that the lawns are being mowed, to prevent obstructing the path of the lawn equipment. Specifications: Flag and Pole: The flag size must be 3 ft. X 5 ft.; the pole height must be 9 ft. from the ground up; (standard sleeve in ground can be from 1 to 1 1/2 feet, which means you require a 10, or 10/12 ft. pole length depending upon the depth of the sleeve underground. Location: The pole must be placed 6 ft. from your driveway (toward your front door) and 6 ft. from the sidewalk (toward your front door).

2 Section 10. Clubhouse Usage a) The Activities Committee shall maintain a master calendar of activities and events to oversee the use of the three clubhouse private rooms (card, poker, billiard rooms) off the corridors for "homeowner events", subject to the use of the private room between the indoor pool and fitness room for HOA meetings whenever necessary. The Great Room will remain open to all homeowners, subject to the Social Committee scheduling First Friday's and other community events in the Great Room as it has done in the past. Social Committee events would be on the calendar in order to avoid conflict with non-social committee activities (30 days notice required by both). Homeowners may also schedule the Great Room for events as long as the event can accommodate the capacity permitted by the Town Code, and does not conflict with already scheduled events. The nature of the event and number of participants will determine which room will be utilized. All requests should be made via to the Activities Committee with names and house numbers of all participants. The Activities Committee will make every effort to assist any homeowner select the room needed to meet the requirements for the requested activity. b) A homeowner may invite guests to play cards at the Clubhouse as long as they play with chips and not cash at any time. The homeowner will be responsible to tidy-up, clean and restore the rooms utilized after the events are concluded, including the disposal of any refuse into the outside dumpster. Room usage and all games, cards, etc. should be on a first come basis to be scheduled by the Activities Committee. Requests will be determined by the number of residents participating. (Example: a request by four resident participants will have precedence over a request with two resident participants for the same date and time.) Any group that wishes to have a standing game or sport session, (i.e. weekly, monthly, etc.) be it card, mahjongg, dominoes, etc. must first submit a request and receive approval from the Activities Committee. The exception will be the already existing groups, using the rooms and times as already scheduled. The activities committee will require the names and house numbers of all group participants and the contact information for group liaison. All non resident participants shall register their name and vehicle license plate number with the Activities Committee so that the information may be relayed to security at the gate. c) The Board reserves the right to cancel any scheduled dates when it deems it necessary to use the area to conduct HOA business. d) There shall be no selling or exhibiting of any items whatsoever on HOA property, or in the clubhouse. Garage, estate and/or yard sales are not permitted in the community at anytime. e) Homeowners must accompany all guests if there are children under 16 years of age to use the pool or any of the Clubhouse facilities. Guests must relinquish the use of said facilities to any homeowner wishing to use the gym equipment and/or the pool table. f) Homeowners and guests must observe all posted clubhouse rules. g) Homeowners will be held financially responsible for any property damage caused by the homeowners or their guests. h) Wet swimsuits may not be worn in the clubhouse great room area and are only permitted in the pool areas and locker rooms.

3 i) Shoes or appropriate foot coverings and shirts/cover-ups are to be worn when not in the pool areas or locker room. j) Please shower or rinse off in the locker room before using the indoor/outdoor pools/spa if you return from a day at the beach in order to avoid sand in the pools. (The sand causes malfunctioning pool equipment requiring unnecessary repairs or even replacement which can be avoided.) k) Please do not use any creams, salves or ointments on your body before using the pools at any time. (This clogs the pool equipment causing unnecessary repairs or even replacement which can be expensive.) Suntan lotions are acceptable. l) Homeowners may not host private parties for their families or friends in the Clubhouse or pool areas at any time. m) The Activities Committee will resolve any conflicts regarding the scheduling of clubhouse activities by homeowners. Section 11. Fitness Center a) The fitness center is primarily for the use of the homeowners. b) There is a 30 minute limit on all equipment, if someone is waiting to use the equipment. c) Homeowners are not permitted to bring their own exercise equipment into the fitness center. d) The equipment must be wiped down after use, including the area beneath, if necessary. e) All guests must be accompanied by the homeowner. Any guests under the age of 18 years are not permitted to use the fitness center. f) Personal trainers must ensure that their program is mindful of other residents in the gym. Personal trainers must submit proof of insurance, photo ID and their certification. g) The Association, or representative thereof, reserves the right to restrict the use of the Fitness Center. Homeowners are advised to consult a physician before the use of any exercise equipment. Section 12. Outdoor/Indoor Pools. The use of the swimming pools is at your own risk. The hours of use will be posted at the pool and/or announced by Memo to all homeowners. All homeowners and guests must obey all posted health rules. Horseplay of any kind, including yelling and running is strictly prohibited. No ball playing in or around any of the pools. No diving or jumping into the pool. The umbrellas around the outdoor pool may not be moved by any homeowner, nor the pool attendant, at any time. The stands are extremely heavy, may cause injury and moving will also damage the umbrellas. Please move your chair should you wish to socialize with anyone. Homeowners must sign in with the pool attendant; if any relatives and/or guests have children under the age of 16, the homeowner must remain at the pool at all times. If the homeowner's guests are all over the age of 16, the homeowner may leave after he or she signs the guests in with the pool attendant.

(This clogs the pool equipment causing unnecessary repairs or even replacement which can be expensive.) Suntan lotions are acceptable. Homeowners may not host private parties for their families or friends in the Clubhouse or pool areas at any time. Wet swimsuits are not be worn in the clubhouse great room area and are only permitted in the pool areas and locker rooms. Strollers are permitted to be kept behind the lounge chairs as long as such chairs are at least 5 feet from the pool coping and do not block the walking paths. The brake must be on at all times and an adult must remain with the stroller/carriage, if there is a child in the stroller/carriage. Swim diapers must be worn by bathers who are incontinent, children who lack toilet training or are otherwise lacking voluntary control of excretory functions. The homeowner is responsible for all costs relating to any biological waste from any guest; this includes Board of Health fines, or cost of draining the pool and chemical treatment. Homeowners are responsible for clean-up after the use of the tables/chairs at the outdoor pool area. Please place all refuse in the disposal can. Audio equipment may be played utilizing headphones or earpieces only. Homeowners and their guests are expected to observe all rules including, but not limited to any profanity or loud conversations, and will follow the instructions of the pool attendant at all times. Only drinks in plastic or paper containers are permitted. Absolutely no glass bottles or drinking glasses are permitted. No food or snacks of any kind are permitted within the indoor pool/spa area. Food is permitted on the outside patio area only. In accordance with the Department of Health Regulations, all chaises and chairs must remain at least five (5) feet from the coping of the outdoor pool. As a matter of courtesy, towels may not be left on a chaise lounge for more than 20 minutes, if the homeowner and/or guest has left the pool area. The pool attendant has the authority to remove the towel and keep it at his/her station. The reservation of pool lounge chairs, chairs and tables is not permitted. Once homeowners and guests leave the pool facilities, the pool furniture is to be made available for others to use. Shoes or appropriate foot coverings and shirts/cover-ups are to be worn when leaving the pool areas or locker room should you decide to enter other areas of the clubhouse. Homeowners and their guests are not permitted to use the interior or exterior pool outside of the scheduled pool hours, or when an attendant is not on duty. Residents who are caught

5 climbing over the exterior pool fence or jimmying open the interior pool doors in order to use the facilities will be issued a substantial monetary house rule violation fine. The pool must be closed when it rains, or at the approach of storms, and swimmers must leave the pool area. Children under 6 years old must have a responsible person in the water with them and within arms reach at all times. Children may not play with toys or any games while in the pool; children may not throw balls or squirt water guns in the pool, nor on the pool deck at any time, which shall be strictly enforced. The Westhampton Pines HOA, Inc. is not responsible for loss or theft of personal property. Persons under the influence of alcohol or drugs will not be permitted in the pool areas or on the surrounding areas at anytime. Any person with bandaged or open sores will not be permitted in the pools or spa. Anyone doing laps in the indoor pool must use the side closest to the windows in order to allow others to utilize the opposite side of the pool for swimming at the same time. Section 13. Hot Tub/SPA Guests under the age of 16 years old are not permitted in the hot tub/spa at any time, pursuant to the regulations of the Suffolk County Department of Health. (Note: should there be an inspection by the Suffolk County Department of Health when a child under the age of 16 is in the hot tub, the homeowner shall be responsible for any fine levied against the HOA. This is a serious offense.) Any injury occurring in the pool areas must be recorded by the pool attendant and reported to Einsidler Management, Inc./NYS Pool Company and/or an officer of the Westhampton Pines HOA, Inc. ASAP after the incident. Section 14. Tennis Court Rules and Regulations a) The Tennis Courts are for homeowners and their guests. b) The homeowner must accompany all guests using the tennis courts. Guests under 18 years of age may not use the tennis courts. c) There is a one (1) hour time limit permitted on the courts, if others are waiting. d) Only tennis shoes are permitted on the courts. e) No glass containers are permitted in the tennis court area. f) No bicycles, skateboards, roller-skates, carriages, pets, etc. are permitted on the courts. g) Tennis Courts are for tennis players only. Horseplay of any kind is strictly prohibited. h) Any litter is to be placed in the trash receptacles. i) Homeowners may not place any tape or any markings of any kind on the tennis court surface at any time whatsoever inasmuch as this will damage the tennis court finish. Section 15. Use of Facilities Homeowners will assume all risks of any personal injury and property damage to themselves and

6 their guests from or in any way associated with entry upon the Westhampton Pines clubhouse, use of the gym equipment, pool/spa facilities, or recreational activities provided by the Westhampton Pines Homeowners Association. Section 16. Satellite Dishes Satellite Dishes may be installed with the permission of the Board of Directors only. Please contact The Management Company for the appropriate paperwork, which must be completed prior to the installation to avoid a house rule violation/fine. The location of the dish will be specified by the Board of Directors. Please note, once you install a satellite dish, the warranty of your roof in that area shall be voided. You will also be responsible to remove the dish and repair the roof, if and when your unit is sold. Section 17. Homeowner Handymen & Contractors Handymen and Contractors, working on a homeowner unit, whether it is on the inside, or outside of the home, must be licensed by the Town of Southampton and insured. Both Handymen and Contractors must have a minimum of One Million Dollars in Liability and New York State Compensation and Disability. Appropriate Insurance Certificates must be obtained and filed with Einsidler Management, Inc. You must contact Einsidler to obtain the precise names of the additional insured's to be named on the Insurance Certificate, together with the language required in the Description of Operations and Certificate Holders sections. Section 18. Modifications A Request for a Modification must completed and forwarded to Einsidler Management, Inc. for the following: patio alterations, storm doors, awning and landscaping changes, together with a signed Hold Harmless Agreement and other necessary documents before proceeding with any alteration and/or modification, or a substantial fine will be imposed. (Modification forms may be found on the WHP website: No other exterior modifications are permitted. HOMEOWNERS ARE NOT PERMITTED TO DO ANY INTERIOR ALTERATIONS TO THE HOME AND/OR BASEMENT WITHOUT PROCURING A PERMIT FROM THE TOWN OF SOUTHAMPTON AND NOTIFICATION TO EINSIDLER MANAGEMENT, INC. AND WESTHAMPTON PINES HOA, INC. THE ABOVE WILL BE STRICTLY ENFORCED. Section 19. Smoking Smoking is not permitted at any time inside the clubhouse; the indoor pool/spa area; the pool/patio area immediately outside of the clubhouse; clubhouse grounds; tennis court and bocce ball areas.

7 Cigarette butts are not to be discarded on the community grounds. Please be considerate and place them in the ash urn outside the front clubhouse doors. Section 20. Pets a) Pets are not under any circumstances permitted inside the clubhouse, or on the walk around the pool area, or on the common grounds or grassy areas outside the clubhouse. b) All pets must be leashed and under full control at all times. c) Pets will be allowed on grassy areas within the community, excluding front lawns, those areas between the front of all homeowners houses and the sidewalk, as well as the areas adjacent to and surrounding the pool, clubhouse, tennis court, and bocce court. d) All pet waste is to be picked up and disposed of properly. Please do not dispose waste in the mail house refuse pail. e) Pets are not permitted to run loose in the back of your home, in the preserve, or on any common area within the community. Pets are not to infringe on neighboring property. f) Homeowners are responsible for notifying any and all guests that all pet rules pertain to visiting pets as well. g) Homeowners will be responsible for any damage to the common areas caused by their pets or their guests pets. Section 21. Holiday decorations a) For two weeks prior and for two weeks following the holiday, homeowners are permitted to string holiday lights on shrubbery within their front garden only and will be responsible for any damages to the shrubs. Any decorative lights must be off by midnight. b) Inflatables of any kind are not permitted. c) No decorations are to be hung from the roof, gutters or exterior windows, and no nails, hooks or screw holes are permitted nor spotlights illuminating any exterior portion of your home or landscape areas at any time, with the exception of illuminating your front porch by spotlight which shall be as close to the cement as possible. Section 22. Refuse a) Trash cans may not be placed outside before 6:00 PM the night prior to collection. All trash cans must be stored within your garage as soon as possible after pickup. If you choose not to use a trash can, you must use heavy duty black plastic trash bags. White plastic kitchen bags are not to be used as the sea gulls, crows, etc. can and will destroy them. b) Only if absolutely necessary, trash may be placed within the dumpster adjacent to the clubhouse, but please do not separate the trash as all recyclables should be placed in the dumpster along with the trash. All boxes must flattened before placing them in the dumpster. Please keep the dumpster area neat by not overfilling the dumpster. A fine will be issued to anyone placing trash outside of the dumpster or not complying with the above rules concerning the use of the dumpster.

8 c) Open boxes of trash or recyclables are not permitted at curbside due to the winds prevalent in the area as the trash is then blown all over the immediate and surrounding areas. d) Permission is required to place a dumpster on your driveway and if permitted, the dumpster must be placed on wooden blocks to prevent damage, although any damage to the driveway is the responsibility of the homeowner. Homeowners must procure a Certificate of Insurance from the dumpster supplier to be filed with Einsidler Management, Inc. prior to the dumpster being delivered (details for the named insured s and other information required on the certificate is to be provided by Einsidler Management, Inc. Section 23. Signs Signs are not permitted within the community at any time whatsoever, except as specified in this rule. Homeowners or persons selling homes shall not post or place any signs, posters or advertisements of any kind, including but not limited to for sale, slow, drive carefully, do not speed, etc.: a) in any window of the home; b) anywhere on the exterior of the home; c) within any common areas in and around the home; d) in any area visible from outside of the home; e) on any personal item of furniture, decoration or accessory on the porch, front lawn, garden or other portion of the homeowner s property or the common areas; f) within or mounted on the trunk or other part of a motor vehicle; or g) within any garage with the door open. Signs shall only be permitted as follows: a) In the event the homeowner elects to sell his or her home, and engages a licensed real estate broker, the homeowner s broker may place an Open House sign on the front lawn of the home for the duration of each open house at the premises. No other signs shall be placed for such purpose. The Open House sign shall be no larger than the size of a portable sign customarily used by local brokers for such purpose. b) In the event a homeowner desires to sell his or her home without engaging a real estate broker, the homeowner may place one Open House sign (no larger than the dimensions of portable signs customarily used by local brokers) on the front lawn of the home for the duration of each actual open house event at the premises. The homeowner may hold a maximum of two (2) Open House events per week; the maximum time for each event shall be three (3) hours. All open house signs must be stored immediately after the close of any open house event. The dates and times of Open House events must be communicated to Einsidler Management, Inc. and the Gate House at least 24 hours in advance of each event. c) Signs of reasonable dimensions, not to exceed 8 ½ X 11 inches, may be posted on the designated signboard in the community s Mail House. d) A sign advising that a home security or alarm system is installed at the premises may be placed in the vicinity of the front door of the home under the front covered portion of the stoop, or mounted in the ground as close as possible to the edge of the stoop, so long as it is mounted on a post directly in the ground, or propped on the stoop with an overall height not to exceed 18 from ground level. This rule shall be enforced in accord with the appropriate provisions of the Homeowners' Association and the Condominium By-Laws.

9 Section 24. Renting/Leasing RENTING/LEASING OF ANY HOME IS ABSOLUTELY PROHIBITED PURSUANT TO THE DECLARATION ON FILE WITH THE TOWN OF SOUTHAMPTON. Section 25. Generators A portable generator may be used in the event the community shall lose electric power, due to a storm/hurricane for refrigeration purposes and lighting as long as the generator is quiet and properly ventilated and does not emit an over abundance of fumes. A generator over 5,000 watts is not permitted due to the extreme noise and heavy fumes. Section 26. School buses School buses are not permitted in the community to pick up and drop off children who may be relatives or guests of any homeowner. Any pick-ups shall be on a temporary basis only during the summer months and not at any other time and the pick-ups must be on Old Country Road. Section 27. Vehicles a) Operators of motor vehicles must observe the posted 15 mph speed limit signs within Westhampton Pines as well as observe all other signs throughout the community. Homeowners are responsible for reminding their guests of the posted speed limits when necessary. b) Commercial vehicles may not be parked overnight in the community at any time. c) Homeowners requiring a multiple car carrier to transport their car shall advise the carrier that they are not permitted in the community at any time and must remain on Old Country Road. The homeowner shall drive his or her vehicle to the car carrier on Old Country Road. c) Moving vans that do not have a small wheel base will not be permitted to enter the community and will be stopped at the Gate House. Tractor trailers are not permitted to enter the community. Please alert your moving company of this rule at the time your move is estimated. Moving companies must examine the community's streets and assign the appropriate vans/trucks that will not cause property damage. Any property damage will be the homeowners' responsibility. Anyone selling their home should notify the purchaser of this house rule. d) Since there is limited street parking, homeowners shall use their garage and their driveway which allows 4 vehicles per home. Cutouts are primarily for guests, although homeowners may also use them on an occasional basis. These spaces are not to be used as a parking lot. e) A homeowner leaving the community for the winter season is not permitted to park any vehicles in the cut out spaces since the snow plows will not be able to properly clean these

10 areas. If homeowner vehicles remain in the cut out spaces more than 24 hours, the vehicle will be towed at homeowner's and/or owner's expense. f) Guests of homeowners must obtain a pass from the Gate House for overnight parking, which shall be kept on the dashboard of the vehicle while parked. The pass will contain the name and house number of the homeowner and the number of nights for parking. Section 28. Barbeque Grills Homeowners may not barbeque in the driveways or inside garages. Section 29. Outdoor Fireplaces, Chiminea's, Hot Tubs, etc. Outdoor Fireplaces of any type are absolutely prohibited and not permitted on your patio, nor on the common grounds behind your home, or any other place within the community. This is a danger to the health and welfare of the entire community. Section 30. Common Areas Homeowners may not remove any plantings from the common areas, nor plant or place anything whatsoever on the common areas at anytime. Section 31. Irrigation System Homeowners may not alter the irrigation system at anytime, nor change sprinkler heads or heights at anytime. Section 32. No Food Tossing Please do not toss any food whatsoever to feed the deer, wild turkeys, etc. on any of the common grounds, including the property surrounding your home, inasmuch as this is also common property. Tossing food will attract various rodents which must be avoided, since there are raccons and other animals in the area and most are rabid! VIOLATION OF THE ABOVE HOUSE RULES ARE SUBJECT TO FINES AND HOMEOWNERS WILL ALSO BE RESPONSIBLE FOR THEIR GUESTS' VIOLATIONS AND PAYMENT OF FINES.
