1 ACE Cheer of Dothan LLC. Athlete & Parent Handbook ACE Cheer Company, LLC strives to help each team member reach or exceed their potential as a competitive cheerleader and as a person. Our program is intended to teach teamwork, goal-setting, personal commitment and leadership qualities that will last a lifetime. ACE Cheer Dothan Team Philosophy ACE Cheer of Dothan LLC. Philosophy is program first, team second, and athlete third. Members of ACE Cheer Dothan LLC. agree to put their program ahead of the individual athlete. If it is in the best interest of the program, an athlete may be moved from one team to another team in age appropriate divisions and or levels based on one or more of the following; (1) routine role (i.e., side base, back base or top girl), (2) skill level (3) attitude (4) need for a competition (5) loss of athlete from another team. Athletes may request to be moved to a lower team if he/she feels that he/she is not sufficiently utilized in or overwhelmed by the routine. Although maintaining the mental and physical well being of the athlete is recognized as a paramount concern, any move down to a lower team will depend on whether the team has an opening, and the decision will also consider the overall impact on the ACE Cheer of Dothan LLC. program. Athletes must be willing to fulfill any position needed by the team. Each ACE Cheer of Dothan LLC. team will prepare a set of goals for their upcoming competition season; with our ultimate goal being to create champions both on and off the mat. Competitions are an opportunity to showcase the athletes hard work throughout the year. ACE Cheer of Dothan LLC. family and friends are encouraged to attend and cheer on all the athletes at the competitions. Our regional competitions serve as a platform to prepare us for the national competitions. You can expect the following of the ACE Cheer of Dothan LLC. coaching staff: Continue Cheerleading-industry Education and Certification Always be approachable and friendly Remain safe and realistic with athlete progression while also challenging the athlete to reach his or her potential Maintain open and professional relationships with each athlete and parent/guardian. Consistently enforce all disciplinary actions as stated in the disciplinary procedures section below Strive to provide a fun, safe and overall positive experience for your athlete USASF Credentialed Staff and Certified Gym The mission of the United States All Star Federation (USASF) is to maximize the number of participants benefiting from the positive life experiences of all star cheerleading and dance by developing competition rules and all star gym training guidelines consistent with the most up-to-date safety, educational, and ethical practices. The ACE Cheer of Dothan LLC. staff certified and credentialed through USASF and competes only at sanctioned events. More information is at Communication with Staff At competitions coaches are there to coach. Any issues that may arise during a competition will be addressed promptly during the week following the competition. Parents should never approach a coach with an issue at competitions. Please contact site director to schedule a time after competition to discuss concerns. Coaches will make themselves available for appointments to discuss these matters in person. Any verbal communications at the gym should be held in private and coaches will only discuss concerns regarding your athlete. If a concern is emotional or heated, it is suggested that parents wait 24 hours, as a "cooling period" before contacting the coach. Safety Measures Athlete health and safety is of utmost concern within the ACE Cheer Dothan Inc. program. We are committed to maintaining a safe environment at all times. Proper nutrition and hydration are encouraged for optimal performance and injury prevention. To ensure a safe environment at ACE Cheer of Dothan, all coaches will be: o CPR-certified o Credential coaches and athletes within the USASF o Trained and educated in effective spotting of stunts and tumbling Role of Athlete We expect the following from ALL athletes as members and alternates of both full and limited- travel teams. These expectations will be strictly be enforced at ACE Cheer of Dothan LLC., during practices, clinics, competitions and all ACE Cheer of Dothan LLC. events. Athletes are expected to: Treat fellow teammates, coaches, staff, and parent with respect at all times. Not Participate in Gossip. This includes internal gossip about other ACE Cheer of Dothan LLC. athletes and external gossip about other ACE Brand programs, other cheer program, and their athletes. Problems shall be addressed and resolved directly, and parents should not listen, participate or instigate any idle, worthless gossip. Show good sportsmanship and class at ALL times. Not Bully. This includes all forms such as electronic, verbal, physical, mental, social media based, monetary, etc. Not use profanity and/or abusive language. Not consume alcoholic beverages and/or illegal behavior Use social networking and electronic media as a means of publicizing and spreading the word of ACE Cheer of Dothan LLC. in a positive and appropriate manner. Refrain from using any social networking, messaging services or electronic media to distribute negative or inappropriate information that could be detrimental to yourself, your family, and the ACE Brand or reputation in any way. This is grounds for immediate dismissal from the program. Remain mindful that your decisions, whether you are actually wearing anything displaying the ACE brand or logo at the time or not, affect and can be a negative reflection of yourself, your parents, fellow teammates, coaches, staff, and the entire ACE Brand program. 3 Accept both constructive criticism along with praise for a job well done. Role of Parent Parents are expected to: Encourage their athlete to always treat fellow teammates, coaches, and ACE Cheer of Dothan LLC. staff with respect. Ensure that their child understands what we expect of them as an athlete, as explained in the Role of Athlete section above. Not express their opinions during practice or coach their athlete from the sideline, i.e., from the parent-viewing area or the lobby. Defer to the coaches discretion regarding team decisions. Inevitably, we will lose or gain team members through the course of a season. Any dismissal or addition of a team member is solely at the discretion of the coach, site director, or owner. Withholding a child from practice or competition should never be used as a form of punishment. This punishes not only your child but every other team member and parent. Refrain from threatening to quit or pull their child from a team. This is unacceptable parent behavior that will not be tolerated. Any such threats will subject parents to disciplinary actions, including removal from the team. o Parents should not listen, participate or instigate idle, worthless gossip. o Parents should not manipulate other parents and ACE of Dothan members while present at ACE Cheer of Dothan LLC. practices and competitions. Any perceived issues and concerns must be resolved directly, in accordance with the Issue and Conflict Resolution" section below. Role of Team Representatives This is a very important job responsibility and is a very important role for the team. If you are interested in this responsibility and would like to be considered for this position, please let your owner know. Team representatives receive a discount on their monthly tuition fees and may receive a coach s pass when the competition event allows. This coaches pass may be used by the team rep to enter the event without paying the spectator entry fee. If you choose to be a team representative, you will be responsible, but not limited to, the following duties: Sending out team s, texts, or calls Be the go-to person with concerns/suggestions for the coach Organizing and preparing team outings Taking roll at practice Team management from arrival to release time at all competitions JUDGING THE JOB OF YOUR TEAM REP IS UNACCEPTABLE, IF THERE ARE REASONABLE PROBLEMS THEN YOU MAY DISCUSS WITH OWNER 1. Practice Attendance Policy A. Summer Practice Attendance Policies and Procedures Attendance at practice is critical to your athlete s progress and integral to the success of the team and athletes should be at practices during the summer season. However, we recognize that some athletes may need a break, therefore summer practices are designed to accommodate family vacations, softball, swimming and other summer sports, church camps, summer camps, beach trips, for example. We allow more flexibility with attendance, so long as the absence has been scheduled on the vacation and planning calendar, noting the vacation, camp, game or any other scheduled activity preventing the athlete from attending practice. 4 Re-evaluation can happen at any time if individual and team goals are not being met or skills have declined this could result in a change of team or alternate status. B. Competition Season Practices The "Competition Season" begins August 2016 and ends April 2017 Practice attendance is absolutely mandatory and compliance with the attendance policy below will be strictly enforced. An athlete s team position will be jeopardized for noncompliance with all the following terms of the attendance policy. Athletes are expected to be at every practice. If an athlete is absent from practice for any reason, whether excused or unexcused, he or she is responsible for learning ALL routine changes made in their absence, before to the next practice. It is unfair to the team to waste valuable practice time re-teaching one athlete the material that he or she missed, while the other athletes must then wait for the one athlete to get caught up to speed and learn their part before moving on. Not taking the initiative to learn anything that was missed, so that he or she will be prepared at the next practice, is selfish behavior, and not the attitude of a team player. Practices may be changed or added at any time during the year. Parents must check the website and s on a daily basis to stay on top of the practice schedule for updates on day and times. Although there is not a competition scheduled in April, the athletes will be scheduled for their weekly tumbling class along with a once a week team practice. i. Excused Absences An excused absence must be scheduled on the planning calendar and must be either: a. School Functions that result in a grade, or b. Anything pertaining to school sponsored cheerleading event. o Your Site Director has ultimate discretionary authority to excuse absences on a case-bycase basis. ii. Unexcused Absences "Unexcused absences" are simple; ALL other absences that are not a school function that results in a grade or involve school cheerleading are unexcused. o The following are examples of unexcused absences: part-time jobs, dances, concerts, banquets, long distance driving, family reunions, weddings, recitals, any other sport except cheerleading, and school/church socials. o Academics: School is a high priority and ACE Cheer of Dothan LLC. stresses the importance of education. However; schoolwork, including homework, projects, and studying for tests, are unexcused absences. Athletes are expected to maintain proper time management so this does not become an issue. o Extra Curricular Activities and Jobs: Extracurricular activities and jobs need to be scheduled around the commitment to ACE Cheer of Dothan LLC. this includes any additional community or sports activities your athlete is involved in. o Athletes are only allowed three (3) unexcused absences during competition season, beginning in August before any disciplinary action may be taken for noncompliance; including but not limited to, being put on probationary status, placed as an alternate, or removed from various elements of choreography. o You must notify your coach and team rep at least 24 hours in advance so that the coach may plan practice accordingly. There is no exception to this rule. o In the case of an unexpected emergency, you must contact your coach and team rep as soon as possible to inform them of your situation. o Unexcused absences are NEVER allowed the weekend and week before a competition or performance under any circumstance. Noncompliance will result in the athlete being moved to an alternate position or removed from an upcoming competition, at the discretion of the coach. o Missing a competition may result in immediate dismissal or suspended activity from the program. 5 2. Competition Attendance iii. Absence due to Illness: Injury or Family Emergency Illness: You must attend practice when you are sick, if you are not contagious. You are not required to participate; however, you must be physically present. In addition, when absences due to illness perpetually occur on an ongoing basis, you may be required to provide a doctor s note with detailed information regarding the illness, treatment and length of recovery. This includes dental, medical and any other health related issue that may prohibit a student from participating. Injury: In the event that an athlete is injured you should notify your coach of the happening of such injury immediately. Thereafter, you should continuously update coaches as soon as possible with all information concerning doctor s prognosis, estimated length of recovery, potential for surgery, and any change in circumstance affecting their ability to perform the physical skills required to fulfill their role on the team. We will re-choreograph routines based on the athlete s injury and length of recovery. Once the individual has fully recovered, he or she may or may NOT be choreographed back into the routine. All injured athletes must continue to pay fees in full. Family Emergency: This term is not to be taken lightly. Contact Owner in the event of a major emergency. Roll will be taken at the beginning and end of each competition day. Prior to each competition, Athletes will be given the following set of team-specific times for each competition: Arrival time- when you must be present in the competition venue Meet time- when your team is required to meet with coach and congregate at a specific place designated by the team rep. Team Reps will take roll as the athletes prepare to walk to warm ups. Athletes must leave all backpacks, purses, make-up, warm up jackets and pants etc., with parents at this time. Warm up time- the time the event-hosting company has scheduled the team to warm up Performance time- the time when the team is scheduled to perform Award time- the time of the awards ceremony that your team has been scheduled to receive its award Release time - when you are officially dismissed and allowed to leave the competition venue o o 1. Practice Dress Code In certain circumstances your release time may be scheduled before your awards time. In this case you may opt to leave at an earlier release time, however, doing so will result in forfeiting any awards and prizes you may win. Athletes may not leave the competition before their respective assigned release time without prior approval from your Site Director. Leaving early or not supporting a team without permission may result in disciplinary action. Dress Code Athletes must wear the correct color of practice clothes and cheer shoes must be worn at every practice. If an athlete does not have on the correct practice clothes he or she is required to purchase the correct practice clothes and it will be charged to your ACE Cheer of Dothan LLC. bill. Practice clothes may sometimes shrink and athletes will likely grow throughout a season. ACE Cheer of Dothan LLC. staff may require an athlete to purchase larger sized practice shorts or tops, should the fit become extremely unflattering or inappropriate. Athletes may purchase larger sizes or additional sets of practice clothes at anytime throughout the season. Hair must be pulled up, out of your face in a high ponytail with a gold bow at every practice. Short chin-length hair may be worn pulled back with an ACE headband or half up/half down with a bow. 6 If a female does not have her gold bow or headband, she is required to purchase a new bow or headband and it will be charged to your ACE Cheer of Dothan LLC. bill. Boy s hair must cut out of the face and off of the neck and must be cleanly shaved. Tattoos must be covered. Top Girls must wear bloomers under her practice attire. Young women are encouraged to wear sports bras, rather than regular bras under their practice tops to provide adequate support. Sports bras can even be layered by wearing multiple sports bras at once for additional support. NO jewelry of any kind allowed in the gym. Neither ACE Cheer of Dothan LLC. nor ACE Cheer of Dothan LLC. employees are responsible for jewelry if it is worn into the gym, removed for practice, lost or stolen. 2. Competition Dress Code Athletes have only 3 Dress Code options that may be worn at competitions. Athletes may wear their: 1) Full uniform (proper shoes, hair, bows, etc.) 2) ACE warm up. This is the official ACE, varsity brand warm-up 3) ACE-inspired athletic attire. 4) All hair and make-up must be COMPLETE before entering the competition venue. DO NOT LEAVE the hotel room without your hair being competition ready. That means hair in a high ponytail, gold bow; hair sprayed back, NO curls, NO whispies, NO bumps and NO glitter. Upon arrival to a competition, you may wear your uniform top with a jacket or t-shirt over it. o You may either wear your skirt under your pants (under no circumstances ever may your skirt be worn over your pants) or you may bring your skirt on a hanger or in a bag until it is time to put it on. o All dressing and changing clothes must be done in a restroom, not the ACE Brand room, hallway or any other public place because ACE Brand cheerleaders are always to be 100% ready-to-go, being completely put together when in uniform and looking like classic clean cut athletes that our program boasts. This allows athletes to equate putting on the ACE uniform to mean that it is game time and also provides confidence through the look good, feel good principle. You must wear athletic shoes at the competition at all times. (Absolutely NO Uggs or flip flops etc.) You are NOT allowed to wear any jewelry at any time during competition days. No Hats of any type Only apparel may be worn from the event company that we are competing to and during the competition. (Example - IF it is a Cheersport competition only Cheersport shirts and jackets are allowed NO WCA, UCA etc.) Travel Obligations Parents are responsible for their athlete s activities and behavior at out-of-town events. Parents must understand that competitions are not vacations and that athletes' time and focus should be fully committed to the team and ACE Cheer of Dothan LLC. throughout the time of the event. Please note that from time to time, you may be required to attend an event on a Friday and leave the event on a Monday, due to scheduling by the event company and/or ACE. If a parent/guardian cannot attend an out of town event, you will arrange for another ACE of Dothan parent or responsible adult to travel with your athlete to and from the event, and to be responsible for the athlete during the entire event. If a parent/guardian cannot accompany your athlete to an out of town ACE Cheer of Dothan LLC. event, you must notify the ACE Cheer of Dothan LLC. staff no less than 30 days prior to the scheduled departure date for the event and inform the ACE Cheer of Dothan LLC. Staff of any alternative arrangements made for my athlete s supervision on that particular trip. Healthy & Productive Communication The Owner or Manager is your point of contact regarding coach s decisions. He/She will take the questions to the coach and provide you with an acceptable answer in a timely manner. Coaches will not entertain questions regarding decisions. "Coaching decisions" include, among other things, specific and strategic decisions (placements made in formations, decision of why an athlete was moved, added, removed, or replaced in stunts and tumbling sections). Routine choreography is the result of a time-intensive, comprehensive, and complex process that necessarily takes many factors into consideration. To name a few; the athlete s ability, the athlete s potential, the athlete s attitude, the athlete s position, the team s needs at the moment, and the team s needs in the future. ACE Cheer Company choreographers and coaches are of the highest caliber in the world. Page 6 of 12

7 You must allow coaches to do their job, and exercise their craft, skill and creative genius; after all, this is a part of the services you are paying ACE Cheer of Dothan LLC. to provide your athlete. Like Art, choreography is a work in progress and you must trust that the end result of all coaching decisions will be an artistic masterpiece, although at times it may look like an infant's finger-painting. The coach will not be required to defend his /her thought process or conclusions in these determinations, and it is improper for a parent to request or demand the same. It is inappropriate for an athlete or a parent to approach other ACE Cheer of Dothan LLC. members about a problem they have with a coach or teammate, regarding personal objections to coaching decisions, or disagreements with an administrative decision. In addition, we instruct coaches not to discuss with parents: 1) Any other athlete with parents, aside from their own child. 2) Actions of other coaches who do not coach their athlete 3) Issues that necessarily involve any type of comparison of their athlete to another athlete, or their Coach to another Coach. Issue and Conflict Resolution It is imperative that you understand that discretionary Coaches' decisions are made based on the good of the team, even though you may, personally disagree with the same. These decisions are made after considering all relevant information and consultation with those involved. Coach s decision will be objective and always based on their best evaluation of the facts. Please be mindful of the fact that routine positions are always fluid and never absolutely "set in stone." Athletes will naturally progress over time, some more rapidly than others. ACE Cheer of Dothan LLC. recognizes and rewards hard work and dedication. Therefore it is NOT safe to assume that, because your athlete is doing a certain role in the routine during summer months and even at the time of choreography that he or she will be doing (or not doing) this same thing at the end of the season. Specifically, if you have an issue, concern or conflict, you must follow the following protocol, in the order listed below. This method has been proven to be the most effective and fair way to address these issues and concerns in furtherance of positive conflict resolution achieved through the fairness, transparency, and being open-minded in both listening and communicating. 1. The athlete should speak to the coach about the matter. In cases where the athlete is too young to adequately articulate the issue, then the parent may communicate the concern to the coach. 2. If the matter remains unresolved, or if the athlete has clearly legitimate concerns that speaking to the coach will not or cannot possibly resolve the matter. 3. The parent should then the coach and the Site Director. 4. If the process does not resolve the matter, an in-person meeting will be called with the coach, parent, and your owner. Protocol for Athlete Discipline Athletes are expected to behave themselves in a manner consistent with the expectations and policies stated herein. When an athlete's behavior does not meet these requisite standards, (for example, where an athlete continuously defies coaches' directions at practice, repeatedly talks to coaches or teammates in an inappropriate, rude or disrespectful manner, or displays an overall lack of team-commitment that creates an environment that is not conducive to learning and unproductive for others, amongst other things) we will address such issue by resorting the disciplinary actions, in the order listed below. 1. The Coach will first discuss the problem directly and privately with the athlete, with the assumption the problem will be corrected immediately. 2. If the problem persists, the Coach will remove the athlete from his/her team practice in response to this unacceptable behavior. 3. If the problem remains to be an issue, the Coach will communicate with the athlete's parents to discuss the problem and lack of response on the part of the athlete. Parents will have the opportunity to be involved with correction of the problem at this time. Page 7 of 12

8 Team Placement- 4. If the problem continues, Owner and your coach may temporarily suspend the athlete from participating in team practices. (i.e. benching for a period of time) The Athlete must attend and watch all practices, dressed in practice clothes, but will not be allowed to step on the mat with the team, tumble or stunt. The purpose is to remove the athlete from the practice so that he or she must then sit quietly, watching his or her team so that they gain a renewed perspective on the importance of respect for the coach and the team. It is the goal that viewing the practice from the outside looking in will be an appropriate punishment to reinforce a central tenet of the ACE Brand philosophy, requiring tribe members to be committed to his or her teammates, as part of the tribe family. 5. If the situation warrants, further disciplinary actions may be taken, including team-removal, for example. Our desire is to work in a positive way with all Athletes. Should a problem arise, rest assured that we will make every effort to find an acceptable and creative solution, while also enforcing all policies and procedures set forth herein, in a fair and consistent manner. Financial Policies and Procedures Uniform, Warm-up, Backpack, and Bow payment of $550 shall be paid in two increments. The 1st half ($275) must be paid on or before June 20, 2016 and the remaining balance ($275) must be paid on or before July 15, 2016 in order to be eligible to participate in team placement. The ACE Cheer of Dothan LLC. must be signed accepting the terms of your athletes contract responsibility. ACE Cheer of Dothan LLC. will no longer allow athletes who have not met their previous season financial commitment to participate in Team Selection. We provide monthly installments as a courtesy for parents. During registration week, you will be required to authorize monthly draft using your debit or credit card. There is also the option to pay in full for the whole year with a 10% discount off your monthly gym fee. The below fees are only an estimate, whereas any additional ACE t-shirts, hotels and transportation costs are not included! This financial commitment is for a full 12 months. If you commit to becoming a member of a team you are responsible for all cost and fees associated with having a spot on a team list for the entire 12 months. Understand that our expenses must be paid on time and we expect the courtesy of payment from parents on time. If you quit, injured, or are released from the team, you will pay a $500 cancellation fee. You will not be allowed to attend the gym in another capacity until this fee is paid in full. All Star Fees Cover the Following: - 2 sets of practice gear - 1 pair of varsity cheer shoes - USASF membership certification - Registration fee - Competition Registration Fees Minus the Summit or World Championships o Competition Registration is subject to change. The registration amount is a projection and may not reflect the final amount charged by the competition company. - Skills Camp - Meet the Tribe - Music - Meet the Tribe - Choreography - Coaches Fee s Dates to Remember: - Choreography Camps: (At ACE of Dothan) o ACE of Dothan choreography for teams TBA July or August - Summer Skills Camp: (June BJCC) Page 8 of 12

9 o We will be holding the summer skills camp in Birmingham, Alabama. Athletes will report on June 25. Camp will conclude on June 26. All-Star Program Payment Plan *This payment plan is for full year teams starting May Signature Initial Fee Due May 4th - $150 2nd Fee- Due May 15th- $135 Monthly Fees - Starting June 1st, 2016 through April 15th, 2017 a total of $285 is Due each month - On the 1st of every month, the tuition fee of $150 is due. - On the 15th of every month, the all star fee of $135 is due. *Monthly Tuition Fee must be paid by the 1st of each month or a $50 late fee is applied. *Monthly All- Star Fee must be paid by the 15th of each month or a $50 late fee is applied. 10 *The fee schedule includes the monthly fee along with, coaches, competition, practice clothing, choreography, and music expenses. *The only thing you will be responsible for other than monthly fee: is the before mentioned fee for uniform, warmup, backpack, and bow. -The 1st half ($275) must be paid on or before June 20, 2016 and the remaining balance ($275) must be paid on or before July 15, 2016 in order to be eligible to participate in team placement. This contract sets forth the terms and conditions under which the athlete may participate in the competitive cheerleading season as ACE Cheer of Dothan LLC. team member. Responsibilities of ACE Cheer of Dothan LLC. ACE of Dothan hereby agrees to provide competitive cheerleading coaches and instruction for the purpose of teaching cheerleading, tumbling, dance skills and techniques to athletes in preparation for local, regional and national cheerleading competitions and exhibitions. ACE Cheer of Dothan LLC. cannot guarantee that an athlete will acquire any particular skill level or that an athlete will remain on the same team throughout the entire season. All ACE Cheer of Dothan LLC. cheerleading teams are fluid, so athletes can be moved from one team to another during a season, at the discretion of the ACE Cheer of Dothan LLC. staff, as indicated in the ACE Cheer of Dothan LLC. Athlete & Parent Handbook, hereinafter referred to as the ACE Cheer of Dothan LLC. Handbook and incorporated by reference herein. Responsibilities of Athlete and Parent/Guardian I understand that accepting a place on an ACE Cheer of Dothan LLC. Competitive Team is both an honor and a privilege, and that it entails a significant commitment to ACE Cheer of Dothan LLC. and to fellow team members. Athlete hereby agrees to attend all practices and competitions, and understands the disciplinary actions that may be taken if the athlete does not comply with the attendance requirements set forth in the Practice Attendance and Competition Attendance Sections of the ACE Cheer of Dothan LLC. Handbook. Parent/Guardian s Indemnification of ACE Cheer of Dothan LLC. I hereby give my permission to ACE Cheer of Dothan LLC. staff to seek and give appropriate medical attention for the athlete during the period of practice or competition (or to/from) in the event of accident, injury or illness. I will be responsible for any and all cost of medical attention and treatment. I represent that the athlete is covered by medical insurance. I understand that, as with any sport, injuries can occur and the athlete is physically fit and mentally capable of participating in cheerleading, gymnastic, and dance activities. I represent that I have sought the opinion of athlete s pediatrician/physician. I hereby waive, release and forever discharge ACE Cheer of Dothan LLC., and its staff and representatives from all rights and claims for damages, injury, or loss to person or property which may be sustained or occur during athlete s participation in ACE Cheer of Dothan LLC. activities, whether on the ACE Cheer of Dothan LLC. training facility premises or at any other venue where an ACE Cheer of Dothan LLC. activity takes place, or in travel thereto or there from. I acknowledge that competitive cheerleading is an inherently dangerous sport in which I/my child, participate at my/ my child s own risk. In consideration of ACE Cheer of Dothan LLC. allowing me/my child a position on a competitive cheerleading team, I, on behalf of myself, my heirs, assignees and personal representatives, do release and forever discharge ACE Cheer of Dothan LLC. its employees, agents, officers, members, sponsors, promoters and affiliates from any and all liability, claim, loss, cost or expense, and waive and promise not to sue on any such claims against any such person or organization, arising directly or indirectly from or attributable in any legal way to any negligence, action or omission to act of any such person or organization or execution of any ACE Cheer of Dothan LLC. related cheerleading event, including travel to and from such event, in which I/my child will participate as a team member or spectator. 11 I expressly agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Alabama, and that if any portion of the agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Parent/Guardian s Travel Responsibilities I understand that: ACE Cheer of Dothan LLC. assumes no responsibility to supervise or monitor athlete s activities or behavior during out of town events, except during the time I am required to be at the competition venue. I am responsible for my athlete s activities and behavior during out of town events, including travel to and from. ACE Cheer of Dothan LLC. Staff is solely responsible for, and retains full creative control of, the placement of the athlete on a particular team and all competitive routines, including, but not limited to, the placement of individual athletes in formations, the positions of individual athletes in stunts (e.g., base, back spots, front spot, top girl etc.), cheer and dance sequences. Financial Obligations I have read and signed the ACE Cheer of Dothan LLC. Handbook. I understand that certain violations of team rules may subject the athlete to appropriate disciplinary actions as set forth in the ACE Cheer of Dothan LLC. Handbook. In the event the athlete s status on a team changes in any way, whether suspended or dismissed from the ACE Cheer of Dothan LLC. program for disciplinary reasons, or moved to another team or placed as an alternate, I remain obligated to pay all cost and fees associated with having a spot on a team list for the entire 12 months and will receive no refunds of monies previously paid. The ACE Cheer of Dothan LLC All-Star Payment Plan provided in the ACE Cheer of Dothan LLC. Handbook dictates the exact payment amounts and provides a schedule when all payments are due. All Financial Obligations are considered a part of this agreement and incorporates by this reference thereto. I understand that: The 1st half of the uniform, bow, backpack, and warm-up balance must be paid on or before June 20 th, 2016 and the 2nd half must be paid on or before July 15th, 2016 in order to be eligible to participate in team placement. This is non-refundable. Monthly tuition fee ($150) must be paid on the 1st of each month for the following months from May 2016 through April Monthly All-Star fees ($135) must be paid on the 15th of each month for the following months from May 2016 through April I will be assessed a $50 late fee if any monthly fee is not received by the 1st and 15th day of the current month. I am solely responsible for all travel costs associated with out-of-town competitions including transportation, lodging and food. ACE Cheer of Dothan LLC. is hereby authorized to initiate all payments owed through automatic credit card billing, as indicated on the authorization form attached hereto. I understand that ACE Cheer of Dothan LLC. will initiate payment from my account or credit card on the 1st and 15th day of each month. I will be assessed $30 fee per occurrence of a check or authorized bank draft returned to ACE Cheer of Dothan LLC. due to insufficient funds If I decide to forfeit my contract that there is a $500 contract cancellation fee. The athlete will be ineligible for any classes until cancellation fee is paid. This contract, together with the ACE Cheer of Dothan LLC.
