1 City Clerk s Department Bureau du Greffier September 25, 2017 Re: Request for access to information under Part 2 of The Freedom of Information and Protection of Privacy Act: Application Number On July 24, 2017, we provided you with an estimate of costs for the search and preparation of the following: Copies of all itemized receipts / bills from restaurants, Manitoba Liquor Control Commission stores, Kenaston Wine Market, Banville and Jones Wine Co., and De Luca Fine Wines from Nov 1, 2014 to June 26th, We received your payment of fees by on August 24, 2017 and the 21 business day hold on your personal cheque cleared today. The actual time to search and prepare the records exceeded the estimate provided to you; therefore, no refund will be issued. The search for the records returned 71 textual pages, to which access is granted in part, with severing under s.17(1)(2)(g), and 17(1)(3)(i). Disclosure harmful to a third party's privacy 17(1) The head of a public body shall refuse to disclose personal information to an applicant if the disclosure would be an unreasonable invasion of a third party's privacy. Disclosures deemed to be an unreasonable invasion of privacy 17(2) A disclosure of personal information about a third party is deemed to be an unreasonable invasion of the third party's privacy if (g) the personal information describes the third party's source of income or financial circumstances, activities or history. Determining unreasonable invasion of privacy 17(3) In determining under subsection (1) whether a disclosure of personal information not described in subsection (2) would unreasonably invade a third party's privacy, the head of a public body shall consider all the relevant circumstances including, but not limited to, whether (i) the disclosure would be inconsistent with the purpose for which the personal information was obtained. Section 17(1) is a general mandatory exception to disclosure that protects the personal information of third parties. It has been used in conjunction with section 17(2)(g), which prohibits the disclosure of information about a third party s financial activities or history, and with section 17(3)(i), which prohibits the disclosure of information where inconsistent with why it was collected. Personal purchases which were either not charged to the City or were reimbursed have been severed under 17(2)(g), as they are considered the personal information of the user. In regards to portions marked 17(3)(i), the information consists of personal addresses of third parties which were obtained for the purposes of booking tickets or reimbursing costs to the third party. 2 Where the records contain information that was not requested (i.e. receipts for parking), this information has been severed and marked as non-responsive. Section 59(1) of the Act provides that you may make a complaint about this decision to the Manitoba Ombudsman.
