1 Statement of Proposal Draft Gambling Venues Policy 2016 Draft Gambling Venues Policy Under the Gambling Act 2003 and the Racing Act 2003, Tauranga City Council (TCC) is required to review its Gambling Venues Policy every three years. As part of this review, TCC is expected to take into account the social impacts of gambling in the city. A Social Impact Assessment (SIA) has been prepared and is attached (Appendix A). Council is proposing some changes to the policy, namely: to reduce the cap for the number of machines that are able to operate in Tauranga; and to clarify that all relocations are to be considered new applications under the policy (unless for reasons beyond the venue s control). Some minor wording changes have also been made to the policy to cater for the changes that have occurred since the last major review in The draft policy with tracked changes is attached (Appendix B). Reason for Proposal Reducing Total Number of Class 4 Machines There are four classes of gambling which are authorised types of gambling under the Gambling Act. Gambling on gaming machines (commonly referred to as pokies) hosted in pubs, hotels and clubs is referred to as Class 4 gambling. This does not include casinos. It should be noted that pokies or class 4 gambling is the most harmful type of gambling. In a 2012 study, nearly 70% of problem gamblers cited class 4 machines as their primary mode of gambling 1. Tauranga s current number of venues and pokie machines now makes up a higher proportion of the national average than in previous years. There has been a national decrease in the number of machines and venues, with other councils choosing to implement sinking lid policies. A sinking lid policy means no new licenses for class 4 machines can be issued and they cannot be transferred to a new pub or owner if the venue closes. 2 Problem Gambling Foundation New Zealand and other addiction agencies tend to view this as the best way to gradually reduce harm caused by this type of gambling. Based on the 2015 population (120,819), TCC s current policy allows up to 821 machines. There are currently 529 machines in 37 venues operating in the city. We are only at 64% of capacity within the policy, meaning there is significant scope for growth in the number of machines. The current density level is considered to be low risk of gambling harm. Although according to the SIA, Tauranga is at medium risk of harm when taking all of the gambling risk indicators into account. Growth in the number of machines has been reasonably stagnant in recent years. This may be partly attributable to the rise of internet gambling. The New Zealand Racing Board noted in their Annual Report that there has been huge growth in this area (see paragraph 13 of the SIA). The accessibility of internet gambling poses the question as to whether the current cap on physical gambling venues is necessary and will be necessary moving forward. In light of the above reasons, Council is proposing through this draft policy to further restrict the number of machines in the city, with the flexibility to increase with population growth. This means: the total number of machines will not exceed the ratio of 1 machine per 228 people at any time; and instead of 821 machines, the number of class 4 machines in the city will be restricted to 529 machines (or the current number of machines) until the population grows. This will limit growth in the number of machines without having an immediate impact on gaming venues and trust organisations which rely on funding from class 4 machines. The other options considered in development of this policy were: Description Pros Cons Status quo (i.e. 1 machine per 147 people, or 821 machines with the current population) Sinking Lid policy (i.e. no further licences approved from this point forward) Consistent with current policy, provides certainty for those involved in the gaming industry The current density provision is considered low risk of harm by KMPG and MOH Will be the most effective way to reduce harm related to class 4 gambling in the city Council is not reducing gambling harm There is significant capacity in the current policy and risk that as the city grows the number of machines could grow significantly Will impact on community funding that comes from gaming trusts May impact on the venues and employment within the industry Relocation A relocation policy sets the parameters for territorial authorities to grant consent in respect of a venue within its district where the venue is intended to replace an existing venue (within the district) to which a class 4 venue licence applies.

3 Under TCC s policy and the Gambling Act, venues who applied for consent prior to 17 October 2001 the maximum number of machines that a venue could have is 18, whereas those who have applied after this date can only have nine machines. TCC s policy is currently silent on the matter of relocation. Relocation is a rare occurrence, however when it does happen, venues usually wish to retain their current number of machines. Currently 22 out of the 37 venues have 18 machines (59%). With the proposal to reduce the cap as outlined above, this will likely pose future uncertainties in relation to relocation. This is why it needs to be clarified within the policy. In clause 5.8 in the draft policy, Council is proposing to consider all relocations as new applications (i.e. relocation not allowed), with provision to allow relocation if for reasons outside of venues control, such as a natural disaster. This approach: provides clarification for staff and the community; is consistent with the approach currently taken; provides flexibility where venues have to relocate for reasons outside of their control; and ensures that all new licences are adhering to the new regulations and Council is applying this consistently (i.e. maximum of 9 machines). Minor Changes to the Policy These are also some minor changes required in order to ensure the policy aligns with the current legislative and regulatory framework. These are as follows: clause 4 reflects that Council has chosen to combine the Class 4 and TAB policies; and that the requirements for these policies come from different Acts; clause 5.4 reflects the Sale and Supply of Alcohol Act 2012; and clause 5.4 reflects the Operative City Plan. 5 1. Executive Summary 1. This report was undertaken to inform the 2015 review of Tauranga City Council s (TCC s) Gambling Venues Policy, which covers both class 4 venues and Totaliser Board Agency (TAB) board venues. 2. The Gambling Act 2003 and the Racing Act 2003 require territorial authorities to conduct an assessment of the social impacts of gambling on their communities prior to adopting policies. In a Council briefing in July 2015, Council indicated that they wanted staff to undertake a desktop analysis to meet this requirement. This report has been prepared on that basis. 3. In 2013, KPMG in conjunction with the Ministry of Health (MOH) released guidance for local government in establishing their risk profile when it comes to gambling. That guidance has been used in preparing this report. 4. The assessment shows that Tauranga is at medium risk of harm when it comes to gambling. This report explores this in further detail. It also explores the social impacts of gambling, both negative and positive. 2. Background 5. The Gambling Act 2003 requires Council to have a policy on Class 4 Gambling Venues (section 101), and the Racing Act 2003 requires Council to have a Board Venue policy (section 65D). 6. These policies must be reviewed every three years. As part of that review, Councils need to take into account the social impacts of gambling in the city or district. This assessment provides an overview of gambling activity in Tauranga, with a focus on class 4 and TAB venues. 7. There are four classes of gambling along with casino gambling, sport and race betting, private gambling and Lotto which are authorised types of gambling under the Gambling Act In the Gambling Act 2003, Class 4 gambling means: a) the net proceeds from the gambling are applied to, or distributed for, authorised purposes; and b) no commission is paid to, or received by, a person for conducting the gambling; and c) there are game rules for the gambling; and d) the gambling, and the conduct of the gambling, satisfies relevant game rules. 9. On 30 September 2015 there were 529 licensed class 4 gaming machines located in 37 approved venues across Tauranga (see Appendix A for a full list of venues). Based on the 2015 population (120,819), TCC s current Gambling Venues Policy would allow up to 821 machines. 10. The New Zealand Racing Board (NZRB) has approximately 80 stand-alone TAB board venues in New Zealand. Council only has jurisdiction over TAB stand-alone board venues, it cannot regulate where the TAB is part of another business. 11. There are currently 5 TAB standalone board venues located within Tauranga, based in the Tauranga CBD, Mount Maunganui, Greerton, Papamoa and Bethlehem 2. 2 Personal , Niall Miller, Head of Gaming (Acting), NZRB. 5

According to figures released in June 2015 by the Department of Internal Affairs 3, in New Zealand Spending on gaming machines in pubs and clubs has decreased in the last ten years, from $1,035 million in 2004 (when it was at its peak) to $806 million in During the same period, TAB racing and sports betting increased from $199 million to $311 million. This increase was driven in large part by the TAB s biggest ever betting event, the Football World Cup 2014, as well as the introduction of TAB online services (e.g. Watch & Bet ). Digital and internet growth remains exceptionally high for the NZRB Gambling in Tauranga Risk Profile 14. In 2013, KPMG in conjunction with the Ministry of Health released guidance for local government in establishing their risk profile when it comes to gambling. 15. The matters that were considered in undertaking this risk assessment were: Prevalence Rate; Gambling Density; Ethnicity; Community Deprivation; and Service Availability. 16. The guidance recommends that where a district is at high risk Council should implement a sinking lid policy (meaning no new licenses should be issued from this point forward). Medium risk means Council should restrict locations and number of machines (which is what TCC s current policy does). For those with low risk, they may not need any restrictions at all. 17. The risk rating is the sum of the risk for all risk factors and is ranked as follows: 8-13 points = low risk points = medium risk points = high risk 18. Tauranga has risk profile of 14, meaning it is at medium risk of harm. The individual sections are discussed in more detail below. Prevalence Rate 19. The prevalence rate refers to the number of people within the city that have sought help with problem gambling compared to the national average. 20. The total number of clients in New Zealand seeking help in the 2013/14 year was 12,627. This is the highest figure for the past 6 years. 21. The latest information from the MOH shows that 236 intervention clients were assisted in Tauranga in the 2013/14 year 5. This makes up 1.9% of the total number of clients assisted. These statistics mean that Tauranga has a low risk rating in relation to the prevalence rate. 3 Statistics 4 The New Zealand Racing Board, 2014: Annual Report New Zealand Racing Board

7 Gambling Density 22. According to the KMPG guidance, the density of gaming machines is important because research shows that the more opportunities there are to gamble, the more at risk the community is at experiencing gambling related harm. Gambling density comprises of two components: Number of gaming machines per person; and Expenditure per person. 23. Having less than 75 machines per 10,000 people is considered to be low risk. Tauranga currently has 43 machines per 10,000 people. Council meet the full capacity as allowed for in the policy, this would still only be 68 machines per 10,000 people, or low risk of harm when it comes to density. 24. The DIA monitors every gaming machine electronically; therefore expenditure data on gaming machines is available in New Zealand down to suburb level. Tauranga has the fourth highest expenditure on gaming machines in the country, despite having the 6th highest population (as at 2013 census). Total expenditure for New Zealand in the 2014/15 year was $818 million 6. This has a medium risk rating. Ethnicity 26. According to the KPMG guidance, certain parts of the population can be at more risk of gambling harm than others (in particular Māori and Pacific Islanders). The table below shows that Tauranga has a lower proportion Pacific Islanders compared to New Zealand as a whole, however a higher proportion of Maori. Based on these statistics, the risk for Maori is considered medium, and risk for Pacific Islanders is low. 6 Numbers-and-Expenditure-by-Territorial-AuthorityDistrict 7

According to the KPMG guidance, highly deprived communities are more likely to experience gambling harm, and as a result they are ranked highest in terms of a risk rating. 28. TCC s policy currently restricts gambling venues to commercial areas. It should be note that commercial areas, particularly central business districts (CBDs) usually score highly on the deprivation index due to variables such as people being more likely to rent and less likely to own a car. 29. Tauranga has 13 venues based in deciles 8 to 10 or most deprived areas 7. The areas with highest deprivation levels are Arataki, Gate Pa, Greerton, Judea, Sulphur Point, Tauranga Hospital and Tauranga South. 23 venues are based in areas with medium levels of deprivation (deciles 4-7). A new venue in Bethlehem is the only venue to rank as low level deprivation. Please refer to Appendix A for a full breakdown of venues and where they are located in regards to the deprivation index. 30. The spread of venues across deprivation areas in Tauranga has a medium risk rating. Service Availability 31. To address the potential harms of gambling there is a range of problem gambling service providers across New Zealand, some of which specifically target ethnic groups most at risk from harm (Māori, Pacific Island and Asian). 32. The development and implementation of problem gambling intervention services in New Zealand are funded from the problem gambling levy, which is collected from gambling proceeds by the Inland Revenue Department. The Ministry of Health is charged with funding and coordinating intervention services, which are then delivered by a range of service providers by contractual agreement. 33. The MOH currently contracts two providers to deliver free face to face gambling harm minimisation services in Tauranga: The Salvation Army Addiction - Oasis Services: and The Problem Gambling Foundation:

9 34. In addition, the Gambling Helpline is available 24 hours a day, 7 days a week. According to the KPMG guidance, where a city has 2 or less local services that deal with gambling harm, this has a high risk rating. 35. The NZRB offers self-exclusion and betting limit programmes to support customers who may wish to restrict their betting activity, and provide information online and instore for customers on where they can seek problem gambling help. 36. During the 2013/14 year the NZRB s investment in responsible gambling measures was $2.3 million ($2.0 million in 2012/13). Of this, approximately $2.1 million ($1.9 million in 2012/13) was paid to the Crown to recover the costs of the MoH s problem gambling management services Social Impacts of Gambling Problem Gambling 37. Gambling can be a harmless entertainment activity from which people derive personal enjoyment and that can provide other positive social effects. However, gambling can also have adverse effects on many individuals, their families and their communities. 38. Class 4 gambling differs from many other forms of gambling as it is available most of the time and offers the possibility of instant gratification. In 2012 nearly 70% of problem gamblers in New Zealand clients cited these machines as their primary mode of gambling The Gambling Act recognises and defines problem gamblers as those whose gambling causes harm or may cause harm, and much of the adverse social impact of gambling generally. Class 4 gambling in particular is associated with the activities of that group of people. 40. Most people do not experience problems resulting from their gambling. However, for the minority that do develop a problem, the impacts can be far reaching and are not exclusive to the problem gamblers themselves. Every person with a gambling problem affects between five and ten other people 10. Employment 41. A survey undertaken in 2009 estimated that there were 300 full-time equivalents (FTEs) directly employed by Class 4 non-club corporate societies and 215 employees of external service providers and contractors also working for the societies 11. 10 Community Funding 43. The New Zealand system is unique in providing a community dividend from the proceeds of gambling. This is the main benefit of class 4 gambling to the community. 44. The gaming industry puts money back into the community by way of grants administered through various trusts that operate gaming machines at the gaming venues. These grants provide financial support to many clubs and organisations that find it increasingly difficult to obtain sponsorship and other revenue streams All societies licensed to operate Class 4 gambling must apply or distribute their net proceeds to authorised purposes. Under the Gambling Act 2003, authorised purposes mean: Charitable purposes; Non-commercial purposes beneficial to the whole or a section of the community; and Promoting, controlling, and conducting race meetings under the Racing Act 2003, including the payment of stakes. 46. From 4 September 2014, corporate societies have to increase the rate of return of gross proceeds from Class 4 gaming to community grants from per cent to 42 per cent over five years. 47. In New Zealand, money returned to authorised purposes through grants varies each year, but totals more than $200 million annually. Pub Charity Limited is the biggest contributor in Tauranga, paying out $1.6 million in grants in the 2014/15 financial year. The most substantial grants given during that time were: Waipuna Hospice ($80k) ARRC Wildlife Trust ($50k) Breat Cancer Support Service Tauranga ($30k) CCS Disability Action Bay of Plenty Incorporated ($30k) Otumoetai College ($25k) Bay of Plenty Cricket ($25k) Christmas in the Park ($22k) Alzheimers Society Tauranga Incorporated ($21k) Tauranga Living Without Violence Trust ($20k) 49. There are a number of other trusts, such as New Zealand Community Trust and the Lion Foundation which also provide community grant funding in Tauranga. Attitudes towards gambling 50. A comparison of surveys undertaken by the Ministry of Health show that decision makers are more likely to take the view that gambling does more good for the community than harm. Whereas the community members view that gambling does more harm than good. 11

12 51. Decision makers are also more likely to identify internet gambling and gambling on mobile phones as the most undesirable form of gambling Conclusion 52. Gambling is a leisure activity, it provides for business opportunities and employment, and provides significant allocation of funding to community activities. However, problem gambling has significant negative impacts, relating to those affected as well as their family and friends. 53. Tauranga has some high deprivation areas, a higher than average Maori population, and a low number of services provided by MOH to deal with problem gambling, all which increase the risk when it comes to gambling harm. However, Tauranga also has a low number of people seeking help with problem gambling, a lower than average Pacific population and low density of class 4 machines. 54. Overall, the gambling risk assessment showed that Tauranga is at medium risk of gambling harm, ranking 14 on the risk assessment scale out of a total of 24. This would indicate that the policy should restrict locations and number of machines in the city; however it may not need to go so far as to implement a sinking lid policy. 55.
