Staff THAT Council receive the Balment Park User Impact Review, for information. BACKGROUND INFORMATION: At the June 25, 2018 CLOSED meeting of Council, a resolution was passed to support the use of lands at Moir Centennial Athletic Park (Moir Park) for the purpose of building an indoor sports facility. Since that time, there have been a number of concerns brought forward by KEYSA, resulting in a re-examination of the decision. At the February 4, 2019 REGULAR meeting of Council, Councillor Blissett made a Notice of Motion that the City provide KEYSA land at Balment Park for the Cranbrook Indoor Sports Facility. Council requested additional information from staff, including an impact assessment on four locations at Balment, to release the results from the Open House, held on June 20, 2018, and to provide information with regards to the s that came to Mayor and Council following the June 25, 2018 decision. A summary of the Open House, held on June 20, 2018 is as follows: 92 Adults and 17 minors attended 81/92 adults preferred a Balment Park location Of the 81 preferring Balment, 26 preferred a site parallel to 17th Avenue South, 41 preferred a location where the existing BMX track is located, 9 preferred a location between 17th and the BMX park, and the remainders did not cite a preference. Of the 41 preferring the BMX Park location, 5 added comments that they wanted the BMX to be preserved in some way. Of the youth, 14/17 preferred Balment, with 12 preferring the BMX Park location. 10 respondents chose Moir Park Staff were unable to collect the s that had been sent to Mayor and Council. The attached Balment Park User Impact Review highlights feedback from KEYSA and the Cranbrook Bike Skills Park Society. It also includes comments regarding the impacts to Sam Steele Society (and by extension other potential events), and City staff. If Council chooses to stay with their decision to have the facility located at Moir Park, staff will follow up with KEYSA to have them sign the previously circulated Letter of Intent, dated June 28, 2018, and will follow the next steps which had been outlined in the previously passed resolution of June 25, Page 1 of 14

2 COUNCIL REPORT BALMENT PARK USER IMPACT REVIEW If Council chooses to move forward with one of the Balment Park locations that displaces the BMX Park, staff would notify the Cranbrook Bike Skills Park Society with a termination of the existing license of occupation. Staff would consult with the Cranbrook Bike Skills Park Society to identify preferred locations and report back to Council. Staff would develop a new conditional letter of intent with KEYSA, outlining the location, the development of a License of Occupation, and term period. This would allow KEYSA to refine their plan and firm up costs, then proceed to finalizing details of a License of Occupation (LOO) for final Council approval. Staff will develop a draft License of Occupation to present to Council for final approval. This LOO will outline items such as insurance/indemnification requirements, expectations of KEYSA, City responsibilities, license term and renewal, proof of permits and engineered building structure, city retains ownership of top soil, and termination/cancellation clauses if KEYSA does not fulfill their obligations. The LOO will provide details as to the timeline, location and cost obligations for KEYSA to relocate/realign the BMX track. In the event KEYSA is unable to fulfill their operational obligations, the City would include an option in the LOO, to take on the operations or close the facility. In the event the facility is closed, the City would retain the right to sell the structure to recover reclamation costs of the site. 3 Balment Park User Impact Review 1. Introduction At the February 4, 2019 REGULAR Meeting of Council, staff were directed to provide additional information on four different options for the location of the KEYSA Indoor Sports Facility (the dome). The information would include updated diagrams and the impact on the primary user groups. Staff met with representatives from KEYSA and the Cranbrook Bike Skills Park Society (Cranbrook BMX) to discuss options. During this meeting, staff discussed next steps which included identification of the potential locations, updating maps, and requesting feedback from them. Due to time constraints, KEYSA was able to have New Dawn Construction provide updated maps, which are included in this report. Five options will be presented in this report the fourth and fifth options provide two different alignments if the BMX Track is relocated. The report serves to provide Council with feedback to assist in determining if Balment Park will be considered for the dome. Staff have attempted to keep the information specific to the impact on the primary users. The primary users include KEYSA, Cranbrook BMX, the City of Cranbrook, and other uses (predominantly the Sam Steele Society). 2. Previous Information Staff have limited this report to a general impact assessment. There are items that Council has previously discussed that are relevant to this discussion, as well as other assumptions that help put items in the report in context. These include: i. In previous reports (May 28, 2018), staff provided additional comparisons of Moir, Balment and other locations. Balment was highlighted as a strong location for things like ease of access to services, existing parking lot, minimal residential concerns, and ease of operation if the City were to take the facility over. However, it was noted that the biggest concern was what value we placed on the loss of strategic greenspace, in particular if both the BMX and the dome were placed at Balment Park, and how that could affect future opportunities. ii. KEYSA has commented on the ability to have space for a Phase 2 expansion which would include permanent washrooms. This was highlighted in their presentation to Council on February 4, KEYSA has noted that there are some options which do not allow for a phase 2 expansion however this has not been included as a requirement as previous selection criteria. iii. If an option is chosen which would see the BMX track realigned or relocated to a new location, KEYSA has indicated in all past discussions that they would incur this cost. In previous reports (May 28, 2018), staff reported that it was likely to be in the $50, $60, range based on the information available. Representatives from Cranbrook BMX are suggesting it could be upwards of $90, Page 3 of 14

4 iv. The options for relocating the BMX Track are limited. The BMX track (previously the Bike Jump Park), was located at Balment Park primarily because it was an activity complimentary to the age group that uses the skate board park, and the location was accessible to kids cycling to it. Moir Park would not be a suitable location due to the distance for kids on bikes. The current site of the BMX Park is currently ideally located for their needs. Options that could be considered would include Mountain View Field and Pop Price Park. v. In the attached spreadsheets, Sam Steele Society has been included as one of the primary users. The Society has provided two letters, dated June 25, 208 and February 6, The first letter supports the dome at Balment Park, with the BMX Park being relocated to preserve maximum space for the festival. The most recent letter highlights their desire to have as much greenspace as possible, as the event continues to grow. Page 4 of 14
