1 EUROPEAN CIVIL AVIATION CONFERENCE CONFÉRENCE EUROPÉENNE DE L AVIATION CIVILE ECAC/34-SD 29/07/2015 THIRTY-FOURTH PLENARY (TRIENNIAL) SESSION OF ECAC (Strasbourg, 30 June - 1 July 2015) SUMMARY OF DISCUSSIONS Agenda item 1 Opening of the Thirty-fourth Plenary (Triennial) Session 1. The 34 th Plenary (Triennial) Session of ECAC was convened by its President, Ms Ingrid Cherfils, at the European Parliament in Strasbourg on 30 June 2015, in the presence of the President of the Council of ICAO, Mr Olumuyiwa Benard Aliu, the Secretary General of ICAO, Mr Raymond Benjamin, the Director of Aviation and International Transport Affairs, DG MOVE of the European Commission, Mr Margus Rahuoja, and the Director General and CEO of IATA, Mr Tony Tyler. 2. Mr Benard Aliu addressed the Opening Session, followed by Mr Rahuoja and Mr Tyler. The speeches of Mr Benard Aliu, Mr Rahuoja and Mr Tyler can be found on the ECAC website Thirty-six ECAC Member States were represented at the Session and the full attendance list is at Attachment The Secretary of the Session was Mr Salvatore Sciacchitano, Executive Secretary of ECAC, assisted by the Deputy Executive Secretaries Ms Patricia Reverdy and Mr John van Lieshout, Ms Marion Leveau, Ms Gillian Caw, Ms Alexandra Alexis and Mr Simon Kedgley. Agenda item 2 Adoption of the agenda 5. The Session adopted without amendment the agenda in WP/1, reproduced at Attachment 2. All items were dealt with in Plenary Session. Agenda item 3 ECAC celebrates 60 years Theme 1: 60 years of European contribution to international civil aviation 6. The President of ECAC explained the intentions of Theme 1, composed of two panels that would review the development of the European air transport industry over the past 60 years and the challenges it faces in the present competitive market. She then introduced the moderator of this theme, Mr Margus Rahuoja, and asked him to lead the first debates of the day. 7. Mr Rahuoja introduced the members of the panel: Ms Patricia Hayes, Director General for the United Kingdom, Mr Bilal Eksi, Director General for Turkey, Ms Mirjana Cizmarov, Director General for Serbia, Mr Gerold Reichle, Director General for Germany, 1 (14 pages)

2 ECAC/34-SD Mr Marc Borel, Deputy Director General for France, replacing Mr Patrick Gandil who was unable to come to Strasbourg, and Mr Maris Gorodcovs, Director General for Latvia, which held the presidency of the European Union from 1 January until 30 June In the ensuing introductory remarks by the panellists a number of issues were highlighted, such as the liberalisation of market access that had resulted in considerably cheaper air travel, the growth of the market in some parts of Europe, and the increase in traffic from and to Asia and Africa. The changes related to the increase in membership of ECAC and the need to connect EU and non-eu Member States were also brought to the attention of the audience. 9. In the discussion that followed, the consequences of these developments were examined. Whereas it was clear that in Europe safety, security and environmental matters were ranked at the top of the list of strategic issues, the economic issue of fair and open competition and liberalisation were also important. Some delegations from non-ecac Member States stressed the importance of resources and the need for technical assistance, in particular in the areas of safety and security. 10. As already debated at the 2014 ECAC/EU Dialogue with the air transport industry, the question of how far Europe saw aviation as a strategic means to boost its economic development as other States did - was raised. This point was stressed with reference, in particular, to the foreseen increase of air traffic double in the next 15 years- and the possible positive implications for the European economy. 11. Discussing the institutional architecture of Europe s aviation-related international organisations, it was generally agreed that this was a complicated issue and sometimes could appear unclear. More proaction was called for, e.g. through smarter regulation regarding SMS and its consequences for operations and oversight. Also it was emphasised that States, international organisations and industry should be more involved in order to understand what was needed from each of these parties. 12. Closing the subject and introducing the next panel, the moderator wondered whether the industry might have answers to the issues that had been raised. 13. The next panel was composed of Mr Tyler, Ms Sylviane Lust, Director General of the International Air Carrier Association (IACA), Mr Athar Husain Khan, Secretary General of the Association of European Airlines (AEA), Mr Simon McNamara, Director General of the European Regions Airline Association (ERA), and Mr Jan Pie, Secretary General of Aerospace and Defence Industries Association of Europe (ASD). 14. Mr Rahuoja reminded the panel of the main question: What would the industry need to be successful?, before opening the floor for discussion. The ensuing interventions covered inter alia the need for more competitiveness, which would involve more efficient ATC, and airport capacity. The institutional situation in Europe would have to be improved which called for better cooperation between existing organisations. It was emphasised that Europe had achieved considerable results in the past, e.g. in developing the (expanding) internal market, better competition and liberalisation worldwide, and the manner in which this had been achieved should be studied in order to learn for the future. The panel also noted that today s circumstances were different from the past as clearly there are developing new markets, in particular in Asia. Given these developments, Europe should look for more global rather than European solutions. 15. The ensuing discussion highlighted the past achievements while emphasising the need to learn from the past in order to move ahead. Smart(er) regulation, simplified and harmonised globally, especially in the field of safety and security, was needed. Global differences in regulations and oversight should be removed.

Several voices from the floor agreed that in order to facilitate and support ECAC Member States, cooperation among each other and with the industry should be improved, acknowledging that the real expertise lies within the States. A more practical approach, less influenced by political discussions, would better support industry. 17. Other comments emphasised that self-regulation would not work everywhere in the world and that smart regulation would therefore need to be proportionate. Industry would also need to self-reflect more on the current situation. 18. Closing the second panel debate, the moderator concluded that both panels had enabled all participants to appreciate the achievements of European air transport in the past 60 years. He stated that Europe must be prepared to face the challenges of the future. The Chair thanked Mr Rahuoja for his energetic management of the discussions, which had offered the opportunity to Directors General, industry representatives and organisations to contribute. Theme 2: ECAC s main achievements since The Chair then invited Mr Salvatore Sciacchitano, Executive Secretary of ECAC, to moderate the afternoon session focussing on ECAC s main achievements since Before introducing the keynote speakers, Mr Sciacchitano recalled some of the highlights in ECAC s history. He mentioned the Multilateral Agreement on Commercial Rights of Non-scheduled Air Services in Europe, signed in 1956 and which is still valid and applied by some of non-eu ECAC Member States; the Multilateral Agreement relating to Certificates of Airworthiness for Imported Aircraft, signed in 1960; the International Agreement on the Procedures for the Establishment of Tariffs for Scheduled Air Services, signed in 1967; the Memorandum of Understanding on North Atlantic Pricing signed with the United States in 1982, and many other achievements in the fields of safety, security and the environment. 21. He then introduced Mr Raymond Benjamin and Mr Michel Wachenheim, inviting them, in their capacities as former Executive Secretary and former President of ECAC respectively, to present their reflections on ECAC s achievements. Having served ECAC between 1994 and 2007, Mr Benjamin had seen ECAC membership grow from 32 to 42 States. He recalled the many programmes launched by ECAC, such as the Safety Assessment of Foreign Aircraft (SAFA) Programme, which was eventually taken over by the EU and the Audit and Capacity Building Programme. In particular he emphasised ECAC s work in the field of security which became the centre of attention globally following the events of 11 September ECAC Doc 30, Part II, had laid the foundation for the first EU regulations the field of aviation security in Beginning with only 19 Member States in 1955 Mr Wachenheim emphasised ECAC s importance to the commercial air transport industry. Firstly focusing on the needs of the air transport sector, in particular developing arrangements for non-scheduled flights, he recalled that ECAC had been faced with a rise in environmental issues in the 70s, deregulation in the 80s and the consequent liberalisation of Transatlantic flights, and the efforts to unify European airspace through projects such as EATCHIP, APATSI and others in the 90s. The 80s also saw an increase of acts of unlawful interference against aviation (e.g., Pan Am 103 in Lockerbie, attacks at Vienna and Rome airports), culminating with the 9/11 events in the United States. 23. The moderator then introduced speakers from the sister regional organisations: Mr Hicham Bennani representing ACAC, Mr Abdulai Alhassan, President of AFCAC, and Mr Norberto Luongo (Alternate Representative of Argentina on the ICAO Council) on behalf of LACAC. The organisations highlighted their good cooperation with

4 ECAC/34-SD ECAC, which they wished to continue in the future. They also emphasised the increasing credibility of the work carried out by all regional organisations in their shared objectives and endeavours to harmonise civil aviation policies and practices. Finally, the principle of the status quo and reciprocal support at the next ICAO Council elections was emphasised. 24. Mr Sciacchitano then invited some ECAC associates and former associates to address the audience each in their specific fields of activity. Mr Frank Durinckx, former Director General for Belgium and former Focal Point for Facilitation and Security, outlining the history of security activities within the framework of ECAC; Mr Mike Ambrose, former Director General of the European Regions Airline Association (ERA) emphasising lessons to be learned from economic history; Mr Urs Ziegler, Head, Environmental Affairs of the Federal Office of Civil Aviation, Switzerland, who gave an overview of the only very recent developments in environmental matters and in particular climate change; and finally Mr Catalin Radu, former Director General of Romania and former President of ECAC, and currently Deputy Director Aviation Safety of the Air Navigation Bureau of ICAO, highlighting the benefits of the Integration Programme until only recently implemented by ECAC and which introduced new Member States into the ECAC system, assisting them in the implementation of the necessary policies and programmes to bring them fully on board. 25. Finally, the moderator invited Mr Patrick Ky, Executive Director of EASA, and Mr Frank Brenner, Director General of EUROCONTROL, to offer their views on the 60 years of ECAC s existence. In their speeches, they emphasised how much ECAC had contributed to the existence and development of their two organisations. The strengthened relationship between the organisations had helped to bring to life new systems and concepts. ECAC s Ministerial meetings on ATS in Europe (MATSE) had led Europe along the road to the unification of airspace, including an institutional strategy that directed EUROCONTROL on a new path to include the European Union as a new player. It was noted that EASA did not start its operations in 2003 from scratch but rather took over the functions of the Joint Aviation Authorities (JAA), an ECAC associated body. 26. The Chair thanked Mr Sciacchitano and the speakers for their interesting contributions, which were perfectly suited to celebrate the 60 th anniversary of ECAC. 27. She then invited the Director General of Civil Aviation, Dato Sri Azharuddin Abdul Rahman, to sign the Cooperation Agreement between ECAC and Malaysia in the presence of the Minister of Transport of Malaysia, Dato Sri Liow Tiong Lai. 28. The discussions under agenda item 3 continued the following morning with addresses by Mr Augustin Tompieu-Zouo, Commissioner for Urban and Community Planning and Transport at the Western African Economic and Monetary Union (WAEMU), Mr Yap Ong Heng, Director General of Civil Aviation for Singapore, Mr Suprasetyo, Director General of Civil Aviation for Indonesia, and Mr Richard Swayze, Assistant Administrator of the US FAA. They all underlined the importance of good cooperation with ECAC and congratulated the organisation on its 60 th anniversary. Agenda item 4 Presentation of the President s Triennial report 29. The Chair presented an overview of ECAC's activities 2 over the last three years, focusing on her role as ECAC President and Focal Point for External Relations. 5 - 5 - ECAC/34-SD a) Ensure ECAC Member States remain in the vanguard of future developments in aviation safety, security and the environment; b) Continue to be the think tank of European civil aviation and to act as an integrator of pan-european aviation activities, working closely with the European Commission, EASA and EUROCONTROL; and c) Strengthen cooperation with ICAO and the sister regional organisations and non- ECAC Member States under existing MOUs, and extend relations with the industry. 30. Having recalled the special relationship with ICAO, the Chair drew attention in particular to ECAC s close working relations with the European Commission, and the fruitful dialogue with sister organisations, ACAC, AFCAC and LACAC. The Session noted the content of the President s presentation. Agenda item 5 Presentation of the Focal Point reports 31. The Chair introduced this agenda item by explaining that each Focal Point would give a short presentation on achievements during the present Triennium in their respective areas of responsibility, and present work priorities proposed in the Work Programme for There followed presentations by Mr Michael Lunter (Chairman of ANCAT) on behalf of Mr Patrick Gandil as Focal Point for Environmental matters, Mr Pekka Henttu as Focal Point for Safety, Ms Patricia Hayes as Focal Point for Facilitation and Security, Mr Alessio Quaranta as Focal Point for Training, and Mr Bilal Eksi as Focal Point for Pan- European matters. Due to the absence of a Focal Point for Economic matters, the President herself gave a presentation on ECAC s economic activities. The slides used in these presentations are available on the meeting website. 33. The President thanked the Focal Points for their reports and their involvement in ECAC activities in the past, wishing them all the best for the implementation of the Work Programme. The Session noted the information provided by the Focal Points. Agenda item 6 - Election of the President, Vice-Presidents and members of the ECAC Co-ordinating Committee Paper presented: WP/2 34. The Executive Secretary presented WP/2, which noted that by letter of 30 April 2015 and in accordance with Article 8 of the ECAC Constitution, nominations had been invited for the positions of ECAC President and Vice-Presidents, and for membership of the ECAC Co-ordinating Committee. 35. Those listed below were nominated by Mr John Fearon, Director General of Civil Aviation, Ireland. Further to Mr A. L. Arias Serrano s departure (notified on 29 May 2015) one vacancy was available within the Committee, and Ms Ingrid Cherfils, by letter dated 1 June 2015, nominated Mr Mario Nemeth, Slovakia. Expressions of support were received from a very large number of States. The following Directors were then elected by acclamation to the positions indicated: As President of ECAC: Ms Ingrid Cherfils (DGCA Sweden); As Vice-Presidents: Mr Patrick Gandil (DGCA France), Mr Bilal Eksi (DGCA Turkey); As members of the Co-ordinating Committee:

The President thanked her colleagues for having re-elected her as ECAC President, a position she was honoured to accept. Agenda item 7 - Consideration and approval of the ECAC Work Programme and associated Budget for Papers presented: WP/3 and WP/4 37. At the President s invitation, the Executive Secretary presented ECAC s draft Work Programme (WP/3) for , highlighting several innovations, such as: a) The deletion of the distinction between tasks of a continuing nature and those of a more project-oriented, time-limited character, which had been used in the Work Programme; b) The inclusion of secondments in the regular Work Programme, recently undertaken under the Special Projects Fund, for both Member States (professional development of their own staff) and the ECAC Secretariat (additional workforce); c) The inclusion of the Towards One Stop Security projects for non-eu ECAC Member States in the regular Work Programme due to their importance for enhancing aviation security and achieving One Stop Security in the ECAC region; and d) The introduction of a qualitative indication of the costs and/or workload implications on the ECAC Secretariat of each expected deliverable in the Work Programme. 38. Following the explicit support expressed by Ms Mirjana Cizmarov (DGCA Serbia) for the inclusion of Towards One Stop Security and of secondments in the regular Work Programme, the Plenary Session approved the ECAC Work Programme for the Triennium. 39. Referring to WP/4, the Executive Secretary emphasised the key elements of the proposed draft budget for , as follows: a) The discontinuation of the Special Projects Fund (SPF); b) The discontinuation of the Zero Nominal Growth (ZNG) principle for the next Triennium, which had been implemented starting from 2001, as this would ensure the sustainability of the budget and prevent ECAC from facing economic difficulties in The proposed budget would still result in a deficit. However, it would require less reserve than required by a ZNG budget; c) The increase of 5% of the overall Member States contribution to cover the transfer of the Towards One Stop Security and Secondment SPF projects to the regular Work Programme and to reduce the aforementioned deficit; d) The maintenance of the floor rate at 1.5% as in the previous Triennium; and e) Some efficiency gains (e.g., on Formal meetings, Printing and Translations ). 40. The Plenary Session approved the ECAC budget for the Triennium.

7 - 7 - ECAC/34-SD Agenda item 8 - Adoption of Recommendations or Resolutions Papers presented: WP/5 and WP/6 41. At the President s invitation, the Executive Secretary presented WP/5, which proposed an amendment to the Annex to the ECAC Constitution (6 th edition/december 2013) with the objective of granting associated body status to the European Aviation Security Training Institute (EASTI), in line with the decision taken at the last DGCA meeting (DGCA/144, 6 May 2015). The draft Resolution amending the Annex to the ECAC Constitution was approved without discussion. 42. The Executive Secretary introduced WP/6 proposing a draft Resolution further specifying the authority of the ECAC Executive Secretary in managing the budget of the organisation. The Plenary Session approved the draft Resolution on the authority of the Executive Secretary in managing the ECAC budget, without discussion. Agenda item 9 - Other business 43. There being no other business, the Chair offered the meeting her concluding remarks. The Chair observed that throughout the Session s very interesting, fruitful and sometimes challenging debates ECAC had been honoured by the presence of the President of the Council of ICAO, the Secretary General of ICAO, the Minister of Transport of Malaysia and the Director General of IATA, and also by the presence of many senior delegations from beyond Europe. She thanked them all warmly for participating in the Session and for celebrating the 60 th anniversary of ECAC. 44. The Chair also thanked ECAC s Member State delegations for their contributions to the discussions and for having adopted the Work Programme and budget of the organisation for next Triennium. 45. Finally, the Chair thanked the European Parliament for once again hosting ECAC s Triennial Session in Strasbourg, the place of its birth sixty years earlier, the French DGAC for hosting a superb gala dinner, and - echoing also the appreciation of many Directors General expressed during the meeting - the ECAC Secretariat for its careful preparation and delivery of the meeting. 46. The Chair then declared ECAC s 34 th Plenary (Triennial) Session closed.

13 Attachment ECAC/34-SD ATTACHMENT 2 PROVISIONAL AGENDA Agenda item 1. Opening of the Thirty-Fourth Plenary (Triennial) Session Note: The Session will be opened by the President of ECAC. The President of the Council of ICAO, the Secretary General of ICAO and the Director General for Mobility and Transport of the European Commission will be invited to address the Session. 2. Adoption of the agenda 3. ECAC celebrates 60 years Theme 1: 60 years of European contribution to international civil aviation Note: Note: Representatives of ECAC Member States and industry partners will be invited to outline the development of European air transport over the past 60 years and the challenges faced in the present competitive global market. All participants will then engage in an open forum discussion. Theme 2: ECAC s main achievements since 1955 Senior representatives from the aviation sector and in ECAC s key areas of expertise will be invited to offer their reflexions on ECAC s achievements. Representatives of ECAC s sister regional organisations will be invited to offer thoughts on their cooperation with ECAC, highlighting the evolution of their partnership, their major achievements, and their vision for future cooperation. 4. Presentation of the President s Triennial report Note: The President will present an overview of ECAC s activities over the past three years. 5. Presentation of the Focal Point reports Note: The Session will be addressed by ECAC s Focal Points in the fields of the environment, safety, facilitation and security, economic matters, training and pan-european matters. 6. Election of the President, Vice-Presidents and members of the ECAC Coordinating Committee Note: Article 8 of the Constitution refers. 7.
