Estuarine Striped Bass Fishery Management Plan, the proposed amendments shift the existing Joint/Coastal boundary line between the Roanoke River Management Area (RRMA) and the Albemarle Sound Management Area (ASMA) to facilitate easier public identification and adherence to striped bass regulations. These rule changes are consistent with the principles of Executive Order 70. Summary: The proposed amendments (see Appendix 1) modify the boundary line between Joint and Coastal Waters of the Cashie River to make it easier to identify and adhere to the different striped bass regulations present in the two neighboring management areas. There may be minimal quantifiable economic impacts related to the change in striped bass regulations over the approximate 20.8 acres of water that change from the RRMA to the ASMA. These impacts will likely be negligible due to the relatively small area and because any costs would simply shift between two state agencies, resulting in no net change. Both the general public as well as law enforcement will benefit by being able to better distinguish the boundary lines of the RRMA and the ASMA due to the presence of easily identified landmarks. The rule changes also include minor changes to rule language that do not have substantive impacts. The proposed effective date of these rule changes is May 1, Purpose of Rules: The Descriptive Boundaries for Coastal-Joint-Inland Waters Rule (15A NCAC 03Q.0202), in the format of coordinates, has been in the North Carolina Administrative Code since 2004; jurisdictional boundaries have been in existence since the 1960s. A request from a member of the public, on behalf of a group of local anglers, was made to the Wildlife Resources Commission (WRC) in December 2009 to shift the boundary line between Joint and Coastal Waters of Cashie River (see Map 1). The WRC forwarded the request to Division of Marine Fisheries (DMF) staff for consideration as part of the N.C. Estuarine Striped Bass Fishery Management Plan review. 1

2 Joint waters of the Cashie River represent the RRMA and are under the jurisdiction of the WRC and DMF for fishing regulations. Coastal waters represent the ASMA and are under the jurisdiction of the DMF for fishing regulations. Each management area has separate rules for striped bass retention limits. But, the current coordinates create a boundary line between the two areas without a clear landmark on the northern shoreline of the Cashie River, making it difficult for striped bass anglers to determine which management area they are in and which coinciding set of regulations to follow. By moving the northern boundary point approximately 645 yards southwest to the mouth of Cashoke Creek, a clear boundary landmark is established, making it easier for the general public as well as law enforcement to distinguish the boundaries of the two management areas. This would reduce confusion about the coordinates and make it easier for the public and law enforcement to determine the applicable regulations for the corresponding fishing area. The proposed rule changes would lead to a slight decrease in the size of the RRMA (Joint waters) and a slight increase in the size of the ASMA (Coastal waters). The total change in size would be approximately 20.8 acres. The current regulations governing the recreational harvest of striped bass in Joint waters include an 18-inch TL minimum size limit, two fish per person per day creel limit, a no-harvest provision of fish between 22 and 27 inches, and only one fish of the two-fish creel can be greater than 27 inches. Commercial striped bass harvest is prohibited in the Joint waters of the RRMA. The current regulations governing the recreational harvest of striped bass in Coastal waters include an 18-inch total length (TL) minimum size limit and three fish per person daily creel limit. Commercial striped bass harvest is allowed in Coastal waters. Both WRC and DMF staff agree that there will be no noticeable negative impacts from the boundary line shift. Basic Economic Impact: There may be minimal economic impacts related to the change in striped bass regulations in the approximate 20.8 acres of water that change from the RRMA to the ASMA. These impacts will be minimal due to the relatively small area affected. The WRC law enforcement will see a slight decrease in area to enforce fishing regulations; however, they will continue to patrol the area in question to enforce boating regulations. The DMF Marine Patrol will not see a change in area to patrol, as these waters are currently under Marine Patrol jurisdiction and will remain so under the rule change. Enforcement costs for both agencies will be unchanged, as this is simply a minor shift of jurisdiction between state agencies and no new enforcement staff will be required. Benefits: Both the general public as well as law enforcement will benefit by being able to better distinguish the boundary lines of the RRMA and the ASMA due to the presence of easily identified landmarks. The increased area may also slightly increase the commercial and recreational catch of striped bass. The commercial catch of other species will not be affected as this is already allowed in the area in question. The ASMA is currently approximately 318,475 acres. The additional 20.8 acres of increased area represents a percent increase in total fishable area. Applying this increase in area to an equal increase in commercial striped bass landings will yield an approximate increase in catch of nine pounds, worth approximately $25 per year, based on 2011 commercial landings and price per pound of striped bass. Using the same methodology, the increase in recreational catch in the ASMA based on 2011 recreational landings will be three pounds per year. Costs: There are very few costs associated with the proposed rule changes. There may be a slight increase in catch near the mouth of the Cashie River where fish are removed from the resource 2

3 as well as not available for anglers to catch upstream, however this is expected to be very minimal. Based on the change in area, landings are only expected to increase approximately 12 pounds per year, which is extremely small when compared to the overall 2011 striped bass harvest in the ASMA of 177,074 pounds. There will be minor opportunity costs to state government employees related to notifying interested parties of the boundary change once it is implemented. The DMF Marine Patrol will need to move the existing sign that is posted to indicate the demarcation between Joint and Coastal waters to the new location once the rule becomes effective. The DMF also issues a news release via distribution lists to notify the public of all rule changes in a given package of proposed rules. These things are done in the normal course of staff s duties and are not significant enough to quantify. Substantial Impact Declaration: The proposed rule amendments do not have a substantial economic impact. 3
